The Appeal Court will on Thursday decide who will represent the PDP in the November 26 election.
Eyitayo Jegede seeks to displace Jimoh Ibrahim as the PDP candidate.
Mr. Jegede's lawyer said the motion was an attempt to delay proceedings.
Mr. Ibrahim is currently recognised as a candidate of the PDP by INEC.
An APC governor also took a jibe at Governor Olusegun Mimiko.
Mr. Jegede was earlier replaced by Mr. Ibrahim.
"It can cause conflagration in the state," Mr. Mimiko said of INEC's action.
Streets have been blocked and bonfires set up in major highways of Akure.
Justice Okon Abang had on October 14 declared Mr. Ibrahim the true candidate of the PDP.
Two different courts had given contradictory rulings on the authentic candidate of PDP.
"Cloned cards will not work, the card readers will detect the cloned cards," the INEC chief said.

The party asks its members to disregard the judgement.
Mr. Ibrahim recommended that Nigeria adopts the economic model of Iran in order to record meaningful development.
Mr. Ibrahim is the candidate for the Modu Sheriff faction of PDP.
The Ahmed Makarfi already produced Eyitayo Jegede, as candidate of the party in the state.
In a short ruling, Justice Anka discharged the interim order, and adjourned the matter till Aug.1 for report.
