Nnamdi Kanu: ECOWAS court dismisses Nigerian govt’s objection

The ECOWAS Community Court of Justice dismissed a preliminary objection filed by the Federal Government of Nigeria challenging the jurisdiction of the court to hear a case of breach of fundamental human rights filed by Nnamdi Kanu..

In a ruling on Tuesday in Abuja, presiding judge, Micah Wright, held that the court had jurisdiction to entertain the application.

Mr. Wright ruled that the case was admissible.

The judge then adjourned till April 27 for continuation of hearing.

Mr. Kanu, the Director of Radio Biafra and Leader of Indigenous People of Biafra (IPOB),is suing the Federal Government for his prolonged detention.

Joined in the suit are the Attorney-General of the Federation and Minister of Justice and the Director-General of State Security Services (DSS).

Mr. Kanu, in the suit, is seeking $800 million compensation for violation of his human rights and an order directing his unconditional release and that of his personal belongings.

He is also praying the court to direct the defendants to respect, protect and promote his rights to life, liberty and freedom of movement, assembly and expression.

Mr. Kanu is also praying the court to declare that his arrest and detention since Oct. 14, 2015 by the defendants, is in flagrant disobedience to several orders of courts of competent jurisdiction.

He is also praying the court to declare that his continued detention is a violation of the African Charter on Human and Peoples’ Rights, the Universal Declaration of Human Rights, the United Nations Charter of 1970.

Mr. Kanu was arrested on October 18, 2015 and subsequently detained by the SSS in Abuja.

He was , however, granted bail on October 19, 2015 but was not released and has been in detention since.

On November 18, 2015 ,the Magistrate Court I , sitting in Abuja, ordered the SSS to produce Mr. Kanu, at the court on Nov. 23, 2015.

Mr. Kanu was finally arraigned on November 23, 2015 in the court for the first time on charges of “criminal conspiracy, intimidation and membership of an illegal organisation” by the SSS. (NAN)

    The dude just doesn’t get it…importing arms is illegal…bearing arms without permission is also illegal…smuggling transmission equipment into any country and using it to run an illegal radio station is also against the law…then tying all this together with a threat to violently overthrow the government of the day that was validly elected is not only illegal but treasonable…and treason my fellow Nigerians is not a balilable offense in nigeria.

    All because your candidate lost re- election…now that’s sour grapes, bad belle, and an example of losers onions….in life you win some and lose some..but always be ready to compete another day instead of crying over split milk.

      I agree with your submission I also think the FG should ‘ve been more strategic in handling this case by first obeying the court order and using the same court to send him to where he belongs.

        Being in the FG’s position is a difficult thing…esp when you have a corrupt judiciary – once the charge is treason there is no bail so if a Nigerian court granted him bail that was wrong cos it is written in black and white in the criminal code and is not up to judge’s discretion…the ECOWAS court judgment is of persuasive nature and not binding so it was always going to be ignored and will continue to be ignored.


          …..And when the Judge finds deems the charge untenable or inappropriate ?


      The truth is that Kanu has not committed any of the offences you stated as regards arms, the issue of the radio which was mostly operated from outside Nigeria is for the courts to decide. This government is a lawless regime and many right thinking Nigerians are realising it. You cannot make laws then flout the same laws while hanging on to legitimacy, you must let one go.

        If this government is a lawless regime, why is Kanu still breathing?He better thank his lucky star that Nigeria is not Turkey or China. I was personally present at the event here in the States where Kanu was soliciting for arms to wage a war against the Nigerian government. If in doubt, the clip is still on YouTube. We have to learn to call a spade a spade.


          Well this is Nigeria and Nigeria happens to be a democracy which is run by laws and a constitution. You were not there, you are an agent of the state, the World Igbo Congress are ready to put you to shame in court when they take the witness stand . Your Youtube video is no grounds for treason, it may have been doctored and also the mere declaration of intent does not imply that any action was taken.

          Treason is an action, an example of classic treason is when Muhammadu Buhari led a treasonable coup and removed a duly elected and legitimate democratic government, he committed treason, he took the action which he is yet to pay for because he is a northerner.

            Nigeria should leave Biafra alone. After our independence there is nothing to show as a progressive country i.e No Light, No good road, No good health, Education is zero, unemployment, no food, etc.

        believe what you want…but meanwhile the rigger who installed the transmitter on MTN masts was also arrested by the sss and fired by MTN…the arms found in his possession too is evidence…the videos he was propagating all over the internet about violently overthrowing the FG and soliciting arms procurement is there for all to see ( he actually did make moves to procure and smuggle in arms in order to overthrow a democratically elected government)…his customs declarations form for the illegally imported transmission equipment too is available…so yes one can demonstrate and protest but when it goes into what I mentioned above no government in the world will turn a blind eye…

          There is no tangible evidence for the arms allegations, your masked witnesses are fake, the two dane guns you found at Ihiala has no connection with Kanu. You have to prove that Kanu personally imported the Transmitters and you cannot….you have no case.

    As far as the international community of democratic nations are concerned the quasi dictatorship operated by Buhari and his relatives at Abuja has no legitimacy because they disobey court orders with impunity. In a democracy you cannot pick and choose .
