Falana fires back at Okonjo-Iweala, says she left “appalling record”

A senior lawyer, Femi Falana, has lashed back at former finance minister, Ngozi Okonjo-Iweala,‎ saying Mrs. Okonjo-Iweala has a habit of attacking critics of her “appalling records”.

In a statement on Wednesday, Mr. Falana said the ex-minister resorted to “scurrilous attacks” on him for requesting the International Criminal Court to investigate crimes against humanity committed by past public officers.

Mr. Falana had petitioned the ICC, last week, urging the court to investigate serving and retired military officers and their civilian accomplices involved in arms procurement for the war against insurgency.‎

“Her baseless attack is not unusual as she is always quick to deflect criticisms by accusing anyone seeking to hold her to account for her appalling records in government of ulterior political motives,” said Mr. Falana, a Senior Advocate of Nigeria.

“When Professor Chukwuma Soludo alleged that about N30 trillion could not be accounted for under her watch he was described as ‘an embittered loser in the Nigerian political space’”.

“When Comrade Adams Oshiomhole questioned the illegal withdrawal of $2 billion from the Excess Crude Account, he was accused of having animus towards her because she had blocked Edo State from obtaining a loan.

“Therefore, instead of exchanging vulgar abuse with the former minister, I shall respond to the diversionary allegations which lacerated her response and the attempt to extricate herself from the mass looting of the commonwealth under her watch,” he said.

FEMI FALANA’S REJOINDER TO DR. NGOZI OKONJO-IWEALA’S REPONSE TO ICC PETITION

In my application to the Special Prosecutor of the International Criminal Court (ICC) last week, I requested for investigation into the allegations of crimes against humanity committed by serving and retired military officers and their civilian accomplices. Having diverted over $8 billion earmarked for the procurement of arms and armament for counter insurgency operations I argued that the suspects who aided and abetted the dreaded Boko Haram sect in the barbaric killing of over 25 soldiers and civilians including children and the displacement of 2 million people ought to be prosecuted at the ICC. However, for having the temerity to request the ICC to investigate the crimes against humanity committed by some former public officers who bear full responsibility for the atrocities perpetrated by the terrorist group Dr. Okonjo-Iweala resorted to the scurrilous attack of my person.

Her baseless attack is not unusual as she is always quick to deflect criticisms by accusing anyone seeking to hold her to account for her appalling records in government of ulterior political motives. The claim that I am unfamiliar with the mandate of the ICC shows that Mrs. Okonjo-Iweala has not been following the practice of the court and its active and robust approach to its mandates, in particular with regard to the investigation of crimes in Darfur, the warrant of arrest for Joseph Kony (Uganda), and the warrant of arrest for Ahmad Harun, (Sudan). In many decided cases, the ICC has expanded its mandate to humanitarian issues, aimed at forestalling and impeding the perpetration of crimes which cause gross human rights abuse. There is absolutely nothing in the Rome Statute of the ICC to suggest that the court cannot address impunity for enormous financial crimes (and its crippling impact) which took place while Mrs. Okonjo-Iweala was the Finance Minister and the Coordinating Minister of the economy.

Dr. Okonjo-Iweala’s claim that I own the Socio-Economic Rights and Accountability Project (SERAP) is far-fetched and laughable. A simple google search would have shown her that while I am one of the legal advisers of the organization, there are other very distinguished lawyers and academics of international repute on SERAP’s board. Her claim that SERAP is ‘discredit’ is the exact opposite of reckless characterization because it is an organization that has won national and international recognitions – including nomination for the UN civil society award; the Ford Foundation Jubilee Transparency Award; and the Wole Soyinka Anti-Corruption Defender Award.

Dr. Okonjo-Iweala also claimed that my petition against her to the Economic and Financial Crimes Commission (EFCC) “were lacking in credibility”, without any substantiation of what this means or specific rebuttal of the allegations contained in that petition. She has however not denied the accuracy of the claims in my petition. Whereas the former Finance Minister had insisted that only $500 million was recovered from the Abacha loot my petition detailed the recovery of $4 billion. As she could not challenge my claim Dr. Okonjo-Iweala now says that the $500 million was the amount recovered while she was the Minister of Finance under President Obasanjo. In making that claim she did not take cognizance of her recent statement that while she gave out $322 million to Col. Dasuki the sum of $700 million had been set aside for development. From her own account, over $1 billion was recovered from the loot under the Jonathan regime when she was coordinating the economy.

Dr. Okonjo-Iweala should have also provided further explanations as to why a substantial part of the Abacha loot was criminally diverted under her watch, especially in light of her confessional statement that she transferred $322m from the Abacha loot to former National Security Adviser, Sambo Dasuki, to prosecute the war on terror. Apart from the said $322m, Dr. Okonjo-Iweala also released £5.5m to Dasuki. Even on this ground alone, Mrs. Okonjo-Iweala cannot plausibly claim not to have anything to do with the arms procurement scandal. Dr. Okonjo-Iweala’s excuse that the said $322m was released due to the urgency of the crisis in the North-East region is untenable having regard to the fact that former President Jonathan had sought the approval of the National Assembly to take a loan of $1bn to equip the armed forces to fight insurgency. Therefore, her self-induced urgency is not a justification for spending public funds without appropriation.

In the course of my defending several military officers and soldiers who were charged before court-martial for demanding weapons to fight the terrorists I confirmed that the $1 billion loan for arms procurement. I was compelled to request Dr. Okonjo-Iweala for an inventory of the military equipment purchased with the $1 billion loan. The requested inventory was made available to me as the weapons were not purchased.

Dr. Okonjo-Iweala has continued to give the erroneous impression that she rendered selfless service to the nation. But while her colleagues who served as ministers under President Olusegun Obasanjo were paid their salaries and allowances in the local currency she received hers in dollars despite a judgment of the Court of Appeal which had declared the payment illegal and unconstitutional in the case of Fawehinmi v The President (2007) 14 NWLR (Pt 1054) 275. In order to weep up sentiments Dr. Okonjo-Iweala referred to the unfortunate kidnap of her 84-year mother, two years ago. But it is public knowledge that the lumpen elements involved in the kidnap were arrested by the Lagos State Police Command. From the report of police investigation the kidnappers were palace guards who were inspired by sheer avarice. In fact, they were arrested by the Police following the disagreement over the sharing of the N12 million ransom paid to them for the criminal enterprise.

The most ludicrous of Mrs. Okonjo-Iweala sweeping and jejune allegation is that some “corrupt elements” are using me as a tool. Although the allegation is without factual support it is illogical, to say the least. My request that the disbursement of the Abacha loot be investigated is further buttressed by the fact that the $500m Dr. Okonjo-Iweala claimed was spent on development projects was also not appropriated by the National Assembly, contrary to constitutional provisions. However, I have asked the EFCC to discountenance the 700-page report of the World Bank which has listed some phantom projects executed with the $500 million.

In the Appropriation Act of 2011, the sum of N245 billion was budgeted for fuel subsidy. But at the end of the year, Dr. Okonjo-Iweala had authorized the illegal payment of about N2.5 trillion to a cabal of fuel importers. As usual, she washed off her hands like Pontius Pilate. In order to unearth the monumental fraud I petitioned the EFCC and gave oral testimony before the House of Representatives Committee which separately investigated it. In the same vein, I have just asked the Group Managing Director of Nigerian National Petroleum Corporation under the Freedom of Information Act to provide information on the failure of the NNPC to pay into the Federation Account the sum of $9.7 billion out of the $11.8 billion dividends paid by NLNG from 2004-2014. I have equally demanded information from the NEITI over its claim that the NNPC and some oil companies are indebted to the Federal Government to the tune of $19.1 billion.

Finally, let me make it abundantly clear that my petitions to the anti-graft agencies and the Special Prosecutor of the ICC were anchored on law and facts as there is nothing personal in the ongoing battle to end impunity and retrieve the looted wealth of the nation from corrupt elements and institutions. It is my belief that the recovered loot should be channelled towards job creation and infrastructural development. Therefore, all hands should be on deck to ensure that the recovered loot is not criminally diverted by another set of looters.

        Rotimi, please can you then answer this: Is it a crime to seek clarification of any issue when the whole country says that their is media trial and a neutral arbiter will help reinforce her cherished integrity?

            This is an accusation not is it a verdict…its a call for affirmation that does it fit into the legal framework for the ICC.
            The reason they are in court in the first is that the ICC is a neutral arbiter and they are away from the so called media trial.
            In the same case, are you aware more generals are involved than madam?
            What Falana is sayin is that there are several tangents that tilts in the direction of crime against humanity. People have used religion, they have used war and now he is seeking that could office have been used to make soldiers die needlessly? Could it be responsible for the over 17k people killed by BH.             Are you aware OBJ did the investigations of the past and its why the Abacha loot even was proven, he probed Buhari and also found nothing, the Siemens and Haliburton scam all happened under OBJ and was investigated but prosecution not done on the Nigeria end and PMB just said that would be continued. Point here is that the only case GEJ touched was the Malabu scam and its been proved that even his AG did that to be settled and the block is about to be canceled. If OBJ did pre 1999 to his 2007, GEJ did nothing, are you asking PMB to now not check again or should do pre historic work because GEJ refused to do his?

          Biafra may be serial loser, but they still have the highest literacy rate in Nigeria, they still have the highest human development index in Nigeria, they are still the least dependent on government handouts. Go to the Min. of Education and look at the charts. The first three states on top of that chart are from the Biafran region (Anambra (139/200), Imo (138/200), Enugu (134/200), Lagos (133/200) –mainly because of Biafrans in Lagos). So you can claim victory all you want but fact on the ground show that you are falling behind everywhere the government is not able to decide winners and losers. The SW have to enter the Federal Unitary Schools with much lower cutoff marks than the Biafrans.

      4 you again got Nigeria its first ever global rating from the most reputable International rating agencies- Fitch, Standards and Poor, JPMorgan etc
      5 In your second term as Minister of Finance you set up the Nigerian Mortgage Refinancing Company

      7 You brought the world economic forum to Nigeria despite the negative publicity Boko Haram had generated.
      8 To foster a culture of transparency you kept publishing the accounts of government. But the liars want to rewrite history
      9 During your time as minister of finance under GEJ our economy grew at over 6 percent annually – unprecedented
      10 You undertook a complete analysis of the depth of our economy which resulted in the rebasing of our economy. What it reveled was that Nigeria under your watch became the largest economy in Africa. A 500 Billion Dollar economy- bigger than even The South African economy.

    Falana’s anger seeps through the letter, hence the numerous typos.
    Who would not be angry at a charlatan’s ill-advised resort to deflection tactics?
    NOI’s sole interest in government was to build her personal profile and brand. Explains why she will never own up to any mistake and will blame every other person. I’m sure if any of her children has a bad habit, she will quickly blame the housegirl or the school teacher. She does not seem to have the ability to introspect.
    Let’s ask about her legacy…. SEEDs, NEEDs, SURE-P etc. All buzz words that dissolved into thin air like snow meeting sunshine.
    And whilst we are at it, she should consider responding by herself or keeping quiet. There seems to be something rude in this habit of using a hired pen to respond to allegations.

      Good observations about both parties.
      Falana indeed has not even called for her head, of his case thus go through at the ICC, several people will be called and not her alone.
      The angle here is that ICC seem to be a neutral ground wherein the so called media trial will not happen and all will state their side of the story.
      The useless guess at the NASS are doing us a great disservice as they should be the ones asking why so many leakages while madam “coordinated”.
      Developed countries call the heads to give accounts to committees for the benefit of the citizens. A call for clarity is not an indictment so madam should tone down her anger.
      Personally I suspect that its her media aide that did the write up and she out of anger, endorsed it.

      When Chief Awolowo was jailed for stealing from the Nigerian state he was accorded due process and allowed to access the legal system.
      Chief Awolowo even went to the extent of trying to stop the initial inquiry set up to investigate his culpability by the Federal Government using a star studded legal team.
      Of course it failed.
      He was eventually convicted and jailed for stealing
      However in the case of Okonjo Iweala we have the direct opposite happening. The woman has openly said that she is prepared for a probe and has advised the Federal Government to do so.
      What does that tell you about the woman?
      There is a popular saying that tells us that the guilty are afraid.
      If this woman is openly saying to Nigerians that she is prepared for a probe it only points to one thing- that she is clean as a whistle.
      These same allegations also came up after she left office as minister the first time under Obasanjo. The Yoruba media went to town circulating false hoods that this women made billions from her negotiations of Nigeria’s debt . They pushed Obasanjo who is known for his pettiness to conduct a full blown investigation on this woman. The said investigation involved various international security agencies. In the end Ngozi was given a clean bill by these international agencies and Obasanjo who had a vendetta against Okonjo for resigning from his government was forced to eat the humble pie. Shortly
      After that Okonjo Iweala was appointed the Managing Director of the world bank.
      What does that tell you?
      Do you think the world bank would rehire an individual who is corrupt?
      This lady has continued to maintain her position on issues and has demonstrated strength against criminals and corrupt government officials.
      We all know t hat Nigeria is in trouble today because we failed to listen to this brilliant economist.
      From the issue of removing the petroleum subsidy which she championed in 2012 to insisting that there be greater savings by government this woman has been at the forefront of creating solutions for Nigeria’s troubled economy.
      It is on record that she set up the debt management office which today has become the institution responsible for managing Nigerias debt. Before Okonjo Iweala came this institution never existed
      2 she is largely responsible for helping Nigeria secure debt relief- even Obasanjo despite his pride came openly on television and called Ngozi a Nigerian Hero. It took Nigeria 30 or so years to secure debt relief and it was Ngozi and the economic team that did it.
      3 Ngozi Okonjo Iweala was the first Nigerian Minister of Finance to openly publish our statutory allocations and this brought accountability into the management of our finances. Today everyone knows what each arm of government receives
      4 it was to her credit that the Excess Crude Account was set up. No person had ever thought of such an innovation to help deal with issues of price volatility in crude oil sale
      That excess crude account has metamorphosed into what is now the sovereign wealth fund. In trying to fund that Institution Ngozi experienced so much trouble from the APC Governors like Amachi and Fashola who made sure that the frustrated efforts on the part to the federal government to save for the rainy day. Now that GEJ is no longer the president these enemies of the Nigerian masses have been forced to eat their own vomit and start to save money with the Sovereign wealth fund
      5 Ngozi was the one who got Nigeria its first global rating. Which allowed Nigerian businesses to access foreign capital
      6 Ngozi is responsible for setting up the Nigerian mortgage refinancing company. An institution which if handled properly could transform Nigeria
      7 Ngozi set up the Nigerian development bank. This institution was set up to provide longer term financing for Nigerian businesses and refinance the commercial banks.
      8 Ngozi as finance minister over saw an economy that grew at an average of 6 percent. No other finance minister in Nigeria has had such long sustained peace time growth
      9 it was Ngozi who rebased our economy and showed the true position of the Nigerian economy relative to others. This singular move has given Nigeria prominence as an emerging economy
      10 it was Ngozi who took on the fraudulent oil marketers and conducted the first ever investigation into the payment structure of subsidy – the Imokwede panel discovered the fraud in the payment arrangement and recommended that over 20 marketers be sanctioned. Remember that most of these fraudulent marketers are Yoruba- wale Tinubu , Otedola , Jide Omokare, Dapo Abiodun to name a few.
      So you can not over night change recent history. We would never allow you to do so.

        Some 30 Boko Haram leaders were declared wanted a few months ago. A few of them were later said to nave been killed. This means they are known. Or was it all a joke. Do you really have to arrest someone before petitioning ICC. When was Mrs Iweala arrested? I agree that it is easier to go for Iweala (soft target) than for Boko Haram (tough target). But I also believe that the present govt is tough enough, at least more than her predecessor. If Boko Haram is allowed to fizzle out, then its mystery will remain, and probably recur whenever opportune. The difficulty getting to the root of such things justifies the provision for international collaboration at the level of ICC. I believe that Nigeria’s justice system can handle Iweala. The recourse to ICC as a first instance measure is daft on the part of Falana. You don’t need a sledgehammer to kill an an. You don’t deploy a bulldozer to grass-cutting duties, in the presence of competing needs. That is why Falana’s move can be seen as a mere publicity stunt, especially when it is not out of character.

    Breeze don’t blow to expose the hen you-know-what. This is a lesson for Nigerian government not to judge the book by its cover. By this, I mean that the government should not hire people based on their ivy league degree, pedigree, but on what they have done at the company or country they work. It seems madam finance minister was not satisfied with what she realized ‘loot’ during the Paris Club debt release or forgiveness.
