EFCC slams 7-count charge of corruption on PDP spokesman, Metuh

The Economic and Financial Crimes Commission has filed a seven-count charge of corruption against the spokesperson of the opposition Peoples Democratic Party, Olisa Metuh.

The EFCC also listed a former Board of Trustees chairman of the PDP, Tony Anenih, as one of the recipients of payments from N400 million it says Mr. Metuh received from former National Security Adviser, Sambo Dasuki.

The first four counts, filed Thursday, accuse Mr. Metuh of receiving N400 million from Mr. Dasuki.

Here are the details of the charge:

“That you Olisa Metuh and Destra Investment Limited, on or about 24th November 2014 in Abuja, within the Jurisdiction of this Honourable court, took possession of the sum of N400, 000 000:00 (Four hundred Million Naira) only, paid into the account of DESTRA INVESTMENTS limited with Diamond Bank Plc, with account number: 0040437573, from the account of the office of the National Security Adviser with the Central Bank of Nigeria without contract award when you reasonably ought to have known that the said fund formed part of the proceeds of an unlawful activity of Col. Mohammed Sambo Dasuki (Rtd.); the then National Security Adviser (To wit: criminal breach of trust and corruption) and thereby committed an offence contrary to section 15 (2) (d) of the Money Laundering (Prohibition) Act 2011 as amended in 2012 and punishable under section 15(3) of the same Act.

“That you Olisa Metuh and Destra Investment Limited, on or about 24th November, 2014 in Abuja, within the Jurisdiction of this Honourable court converted the sum of N400, 000 00: 00 (Four Hundred Million Naira only) which sum was received from the office of the National Security Adviser with the Central Bank of Nigeria without contract award, which you claimed to have received for political activities of the People Democratic Party when you reasonably ought to have known that the said funds form part of the proceeds of an illegal activity of Col. Mohammed Sambo Dasuki (Rtd.) the then National Security Adviser, (To wit: criminal breach of trust and corruption) and you thereby committed an offence contrary to section 15(2) of the Money Laundering (Prohibition) Act 2011, as amended in 2012 and punishable under section 15(3) of the same Act.

“That you Olisa Metuh and Destra Investment Limited on, or about the 24th November, 2014 in Abuja, within the jurisdiction of this Honourable court, did retain the sum of N400, 000 000: 00 (Four Hundred Million naira only), on behalf of the Peoples Democratic Party for its campaign by concealing the said sum in your account, with Diamond Bank Plc, when you reasonably ought to have known that the said funds form part of the proceeds of an illegal activity of Col. Mohammed Sambo Dasuki (Rtd.) the then National security adviser, (To wit: criminal breach of trust and corruption) and you thereby committed an offence contrary to section 17(a) of the Money Laundering (Prohibition) Act 2011, as amended in 2012 and punishable under section 17(b) of the same act.

“That you Olisa Metuh and Destra Investments Limited, sometime between November 2014 and March 2015, in Abuja, within the Jurisdiction of this Honourable court, having reason to know that an aggregate sum of N400 000 000:00 (Four Hundred Million Naira only) directly represented the proceeds of an unlawful activity of Col. Sambo Dasuki (Rtd), the then National Security Adviser, (to: with criminal breach of trust and corruption) in respect to the same amount, used the said fund for the campaign activities of the Peoples Democratic Party and other personal purposes and thereby committed an offence contrary to section 15 (2) (d) of the Money Laundering (Prohibition) Act 2011, as amended in 2012 and punishable under section 15(3) and (4) of the same act”.

Counts five to seven accuse Mr. Anenih and others of being part of the alleged fraud.

“That you Olisa Metuh and Destra Investments Limited, on or before the 22nd of December 2014 in Abuja, within the jurisdiction of this honourable court did make a cash payment through your agent, one Nneka Nicole Ararume to one Kabiru Ibrahim; a none Financial institution to the tune of $1, 000 000:00 USD, (One million United States Dollars) only, and thereby committed an offence contrary to section 1 of the Money Laundering (Prohibition) Act 2011, as amended in 2012 and punishable under section 16(2)(b) of the same Act”.

“That you Olisa Metuh and Destra Investments Limited, on or before the 22nd of December 2014 in Abuja, within the Jurisdiction of this honourable court did make a cash payment through your agent, one Nneka Nicole Ararume to one Sie Iyenome of Capital Field Investment, to the tune of $1, 000 000:00 USD, (One million United States Dollars) only, and thereby committed an offence contrary to section 1 of the Money Laundering (Prohibition) Act 2011, as amended in 2012 and punishable under section 16(2)b of the same Act.

“That you Olisa Metuh and Destra Investments Limited on or about the 4th of December 2014, in Abuja, within the Jurisdiction of this Honourable court did transfer the sum of N21, 776, 000:00 (Twenty-One Million, Seven Hundred and Seventy-Six Thousand Naira) being part of the N400, 000 000:00 (Four Hundred million Naira) which directly represented the proceeds of an unlawful activity of Col. Mohammed Sambo Dasuki (Rtd.) the then National Security Adviser, (to: with criminal breach of trust and corruption) to Chief Anthony Anenih and thereby committed an offence, contrary to section 15(2) of the Money Laundering Prohibition Act, 2011 as amended in 2012 and punishable under section 15(3) of the same Act.”

Mr. Metuh on Wednesday filed an application before the court demanding the commencement of his trial or his immediate release from the custody of the EFCC.

He also requested a speedy hearing of the case, an application turned down by the judge.

        Buhari set up a panel to investigate purchase of arms and defence spending from 2007 to 2014. Dasuki was appointed NSA on June 22, 2012. He held that position till July 2015 when Buhari removed him and immediately launched a witch hunt using the DSS. They first began with laying a siege on Dasuki’s house. In the end, the DSS came out with a press statement that they found seven rifles, amoured SUVs, and $50,000 in Dasuki’s house and threatened to charge him for treasonable felony suggesting that Dasuki was planning to topple the Buhari government with the seven rifles.

        The matter ended in court where Dasuki was charged for possessing firearms without a license. The judge granted Dasuki bail on his personal recognition. That surely didn’t go down well with Buhari. So the government requested a secret trial for Dasuki. The Sokoto Prince kicked against a secret trial and requested permission from the court to travel abroad for treatment of cancer.

        Buhari felt that if the court order was obeyed, his image as an emperor fighting corruption would be tarnished. The tyrant in him came to life. He sent the DSS to lay a siege on Dasuki’s house. The siege was on for three weeks. He then used that time to manufacture the $2.1 billion arms fraud or scam to cover up his lawlessness, given that there was a human rights abuse outcry against his government.

        So, where did the figure come from?

        Buhari’s panel submitted a report saying it found that the NSA’s office had been allocated $2.1 billion for the period under review. What is the period under review? 2007 – 2014. Whereas, Dasuki was NSA for 18 months for the period under review. So there you have it. That is where the media has been saying that $2.1 billion arms money was diverted.

        Note that neither Buhari, the DSS, the EFCC have officially declared the existence of a $2.1 billion arms money diverted. Buhari went on TV growling over “How can a president ask [Dasuki] to withdraw N40 billion and you do it?” The EFCC has not mentioned any arms money or diversion of it in their charges against Dasuki, Dokpesi or anyone else.

        So, where did the monies being mentioned come from? They are talking about money allocated to the SECURITY VOTE for the NSA’s office and for the President. The security vote money is not for arms purchases. That is why the EFCC has not charged Dasuki for diversion of arms funds. Because they would lose woefully.

        Another interesting fact. Of the $2.1 billion, $300 million was specifically allocated for the purchase of arms. And Dasuki has issued a statement explaining what arms were bought and how the Nigerian arms forces took delivery of the equipment, arms, and ammunition. Ironically the $300 million is from the Abacha loot recovered by the Jonathan administration.

            The NSA has funds usually allocated to his office to cover very very broad functions of varied and wide scope … he has the latitude to make decisions as he deems fit provided he limits himself to the funds allocated to his Office. It is very difficult to define the boundaries of the NSA’s activities.

            Metuh has no reason to investigate the NSA before receiving funds from him.

            Can Any body who have been paid by FG proof that credit to his or her account without payment advice always disclose the originating government agency, moreso when the payment is made from presidency. EFCC is just wasting their time. Since when does cash payment becomes a money laundry offence. What CBN said that individual or corporate organisation can withdraw or make a payment within a certain limit on daily basis and any amount above, that will attract a charge.

Stop fooling yourself, PDP may decide to disburse their campaign funds through that office .ask your self how did APC disburse their own campaign funds. Security votes can be used for anything that can guarantee peace,security and well being of a nation or state and that’s why in Nigeria, it is shielded from scrutiny.

      What further evidence does EFCC need to draw that simple, commonsense conclusion of theft, if there is no single functioning school to show for these oodles of money?

      Here was a state governor, RAJI FASHOLA, who could not run the Lagos city BRT transport – which collapsed in just three years under his incompetent watch – and who also failed to run schools to pass WAEC examination. Is that not the meaning of INCOMPETENCE, to start with, besides roguery? Or, what else is a state governor to do, majorly, other than run sensible school system and a state bus system in an orderly environment?

    I admire the guts of Olisa Metuh, the PDP National Spokesperson.

    He’s got balls. I have been reading reports, some of which are obviously doctored by the opposition press, that he has a case of 1.4 billion naira to answer by the EFCC over the arms budget. Before he was arrested, he raised an alarm that he was being framed by the present government and that he would be arrested soon because he was a thorn in the flesh of the government. A few days later, he boldly responded to an invitation by the EFCC and thereon he was detained.

    To prove the allegations that he is being framed and perhaps deliberately detained to teach him a lesson, EFCC quickly got a curious court order to detain him indefinitely because ‘he is being investigated’. What kind of federal court gives that kind of order when the suspect is not even charged for anything? In a democracy? There are things this government have been doing since May 29 which alarms the civil sensibilities of the law keepers and no one seems to be talking.

    Anyway, they say EFCC having interrogated Metuh and seeing nothing so far about the 1.4 billion which they had deliberately leaked to the press through their Sadist Reporters, tried to make him sign a statement which he refused and tore to shreds because Metuh saw that it was a doctored statement. That’s what some papers have been reporting.

    They say Metuh told the EFCC bluntly that he would only reveal anything they wish to ask him in an open court of law and that if they have a case against him, they should charge him to court according to his constitutional rights. Just charge him to court to prove his case.

    That’s what is now getting the authorities alarmed. Olisa Metuh is showing an astute stubbornness which they underrated.

    It’s really a simple thing. You guys say I’m a thief. You guys went to the press to malign my name and put me on media trial and to embarass me and my party. You guys have tried to link me with the Arms Scandal which has no direct link with the monies I am being accused of. Ok. No problem. Do all you want. I don’t care.

    But take me to court and charge me. When we get to court, in an open court, with the media and world watching, I will make my statement and maje known everything in front of a judge.

    And that boldness is rattling the authorities.

    That’s gutsy.

    Even the PDP has waded in and have given the EFCC 48 hours to charge Metuh to court or the next steps will be taken.

    I’m beginning to feel a wake up by the party to the alarming subtle tyranny and disregard for constitutional order by agents of the government. They pick suspects and quickly leak stories to the press to gain media advantage. Everyone abuses the latest scapegoat and the public opinion is already biased. Then they hold the person for weeks against the law under the pretence of ‘investigating’. There is a law in place which forbids the authorities to detain anyone unless the authorities have a substantial case against the suspect for prosecution.

    They even tried a bit of media bullying on Femi Fani-Kayode by ‘leaking’ a story that he received 1.7 billion from the Arms Budget. Of course, FFK responded immediately through a statement denying that and laughing at the Gestapo tactics of the government. I’m ready for you, he said.

    The same is the attitude of Metuh.

    They see his spirit is not broken. In his book ‘ My Watch’, President Obasanjo speaks glowingly about Olisa Metuh who was one of the foremost youth vanguard members of the PDP from inception. I was able to psychoanalyse Metuh a bit from that book. And he’s no pushover.

    You see this Dasuki and the so-called Arms scandal, I have been researching on it from open reports and I will do a post on it soon. It’s getting to be a charade.

    Olisa Metuh is innocent until proven guilty. And he wants his day in court to prove that. The least the authorities can do is to give him that.
