Why I refused to honour EFCC’s invitation – Tompolo

A former Niger Delta militant leader, Government Ekpemupolo, also known as Tompolo, has reacted to the Economic and Financial Crimes Commission, EFCC’s plan to declare him wanted in connection with an alleged fraudulent multi-billion naira contract.

Mr. Ekpemupolo said in a statement Saturday that the EFCC merely resorted to “self-help” after failing to appear before a court in an earlier case he filed against the anti-graft agency.

Mr. Ekpemupolo said he went to court after the commission froze his company’s accounts since August 2015.

He said if there were questions regarding the contracts awarded to him, they should be directed to the federal government bodies that approved and awarded them.

EFCC’s ACCUSATIONS AGAINST ME AND THEIR RESORT TO SELF HELP

I, High Chief Government Ekpemupolo wish to state that my attention has been drawn to a news story on Channels Television of 10th December 2015.

The impression being conveyed is that I was invited by the Economic and Financial Crimes Commission (EFCC) and I failed to honour the invitation or even respond by letter to the invitation.

On the contrary, nothing could be further from the truth. On the 24th of November 2015, I was informed at about 4pm that a letter of invitation had been dropped at my home in Warri, inviting me to EFCC’s office in Lagos by 10am on the 25th of November 2015.

I responded by a letter from my Solicitors, Messrs Jakpa, Edoge & Co. The letter dated 25th of November 2015 was received by one Uduak Ouot, a staff of EFCC on the 3rd of December 2015, after several attempts to deliver. I have proof of delivery from the courier company.

I was therefore not a little surprised that the EFCC – an otherwise reputable institution – would stoop so low as to lie to Nigerians.

As my Solicitor’s letter indicated I am already in court with the EFCC in Suit No: FHC/W/CS/152/2015. EFCC had been served with the court processes since 20th of October 2015 but they refused to attend court on several occasions, or to file any court papers, only to appear for the first time on 30th November 2015 without filing any court papers. They even asked for the matter to be adjourned to 17th December 2015, the date they are now inviting me to appear before them.

In fact, EFCC only invited me two months AFTER I sued them. In my Solicitor’s letter I informed them that as soon as the court decides one way or another, I would honour their invitation.

So the attempt to harass me by their reminder of 9th December 2015, which was leaked to the media on the 10th of December 2015 , the same day as it was delivered to my house in Warri is an unnecessary and face saving effort at brinksmanship.

As a full blooded Ijaw man and citizen of Nigeria, I have done everything in my power to follow the laws of Nigeria. Since the amnesty declared in 2009 by late President Yar’ Adua I have strained myself to ensure that we all live in peace in this country. Those who think they can push us to war must rethink the necessity of such a war.

How can a law-abiding Government declare a man wanted who is in the law courts with them?

They froze our business accounts since August 4th 2015, but we have not quarrelled with anybody. We sued them to court, they refused to come to court. Now they are threatening to declare me wanted.

I know why they are after me. It is not the alleged multi-billion naira property transaction. Afterall, it went through due process and was approved by the Federal Executive Council (FEC). And as such if there are any questions to answer, it is the people at the FEC, Bureau of Public Procurement (BPP), Federal Ministry of Lands and Survey, Federal Ministry of Transport, NIMASA, etc who approved the transaction that should be answering such questions.

The real reason this All Progressive Congress (APC)-led Government is after me is that I bluntly refused to join APC and to support their Governorship candidate in Bayelsa State. We cannot all be in APC. Our people have always believed in the Nigerian project and had always hoped to join hands with this administration to move this project forward, but the conditions being attached are not acceptable. I insist on believing in the Nigerian project unconditionally!

We will continue to pursue our court case. The threat to declare me wanted is an unnecessary attempt to heat up the polity. I will go about my daily business, usual.

Finally, let me say this: if people can come from Sokoto, Katsina or Lagos to campaign in Bayelsa, why can’t I, a full blooded Ijaw man, go to my Bayelsa to campaign?

I will only add this: let the will of the people of Bayelsa prevail. Nobody should attempt to force the outcome of the election. We have kept faith with our promise to Nigeria, we expect no less from this country. So if anyone tells you that Tompolo is on the run, tell him Tompolo is not going anywhere.

Why should he condescend to responding to an EFCC’s call when the EFCC refused to obey the court and the law? Is EFCC above the law. Mind you, Sir Tompolo is a Niger Deltan and so you shouldn’t expect him to buckle under the watery threat of one Hausa man in EFCC, neither should you expect him to kneel down like Oladipo Diya and begin to cry and beg for hand kerchief to clean tears. From this response, even though I’m no fan of his, you have to give it to the man and blame the EFCC. If EFCC want to meet him let them attend the court sessions and arrest him in front of the judge.     Nigeria has become a banana republic where the EFCC has become an instrument to hunt and haunt perceived opponents and present a cosmetic posture of fighting corruption. But the inevitable boomerang of this otherwise satanic tactic is already evident in Biafra and the unwavering demand for a separate state of that land of the rising sun.

    From the calculated response of Sir Government Ekpemupolo, it is clear that Buhari is dealing with a man who not only passed his WAEC secondary school exams but has a certificate and testimonial as evidence. The Nigerian Govt should wake up to reality and begin a process of a referendum to determine if the nationalities within Nigeria still want to live together and if so, determine the basis for such coexistence. It is utterly stupied for EFCC to refuse to appear in court in a case brought forward by Tompolo but at the same time expect General Tompolo to honour its own invitation. This is gross stupiedity on the part of the EFCC.

    The EFCC should not be so stupied to underestimate the effect of its rats biting the tail of a sleeping Cat. The effect from the reaction of the Cat, might be felt all around Nigeria..and it would make the reaction of IPOB & MASSOB reaction to Kanu’s illegal detention a child’s play. A word is enough even for the brainless.

    We, the people of the West African Delta (South South States) commend our noble comrade (Sir Tompolo) for his matured and intelligent response. We support his bravery and display of self awareness. We are behind him 100%. If EFCC obeys the law ;and appears in court in the case against them, then Tompolo may reciprocate. Pure & Simple. I perceive that the ediorts who have run this continent (Nigeria) aground for about 5 decades have not learned from history. I will advise such people to go through Gideon Orkar’s coup speech again. Control of our resources and self rule is nor singular objective.

One thing that is remarkable in this Dasukigate is that, all those indicted have accepted that, they collected the blood money.       But the same ‘law abiding EFCC’ failed to appear in a juridistic court of law when invited. They blatantly disobeyed a court order summoning them. They thus lost he moral right to summon any one .

        If EFCC fails to attend court, Tompolo can still get judgement from the court which cannot wait forever for EFCC. But if he fails to honour EFCC’s invitation, he can be arrested. Mind you that freezing an account under suspicion is one effective tools that law enforcement agencies can deploy.

            tompolo should say, because the efcc has frozen his account, that he cannot raise funds to buy the fare for the proposed meeting in abuja. the efcc should advance/ wire him the funds to make such journey…. and pay his costs…

        Taking EFCC to court, say, for one issue such as contesting the freezing of an individual’s accounts or seizure of property does not in anyway prevent EFCC from arresting that same individual for a related offence or for even the same offence for a different charge so long as there is no court injunction to that effect.
        I think a lot of Nigerians tend to confuse being in court to being above the same law the courts are supposed to enforce. For instance, Saraki is in court, yet he assumes that the fact he has gone to the supreme court, then the government has no right to investigate him where evidence makes such investigation or inquiry necessary. It is also clear from the behaviour of many Nigerians with means (people with money) that they assume that they are above the law. I see nothing wrong from Tompolo honouring the invitation by the EFCC. In fact it gives him a better opportunity to satisfactorily show to the whole world that the EFCC is after him for reasons other than a genuine case of financial crime. If I were in Tompolo’s shoes, I’d hire a team of legal experts from Nigeria, seek their informed opinion on the issue, so long as there is no skeleton’s in the cupboard, I’d honour the EFCC’s invitation. Even if they decide to arrest me, my lawyers will fight all the way until the EFCC surrenders to the might of the law. But in this case, Tompolo’s refusal to honour the EFCC’s invite shows that he has something to hide. As much as I dislike Akpabio, former governor of Akwa Ibom and a PDP chieftain who was a staunch Jonathan supporter, and if we are to believe all these rumours of witch-hunt of political opponents by this government, then Akpabio ought to be one of this government’s most hated enemies yet EFCC invited him, Akpabio duly honoured the invitation, twice, and still he was allowed to go home. So, it is simply obvious that the logic about a witch-hunt is simply used by individuals who without a doubt have a lot of nasty skeletons in their cupboard.
        Tompolo, biko, go to EFCC before it is too late. Jonathan, or all the SS government officials of the last administration are simply powerless now, they cant save you neither would the empty threats of war save you. The current president is not like Jonathan who has never tasted a real battle. Buhari has seen more than enough battles to the point he commanded a unit of soldiers in 1983 who within days of being given orders to hunt down Chadian backed rebels who killed Nigerian soldiers were just a few miles outside Ndjamena the Chadian capital and Buhari was simply hell bent on pursuing those rebels to every foxhole in Chad. The point is, Buhari is not someone who will back down or be cowered by threats from a common oil thief.     Tampolo has finally realised his power of banditry could only have survived as long as his sponsors were in power. The sooner he realises that the game is over the better for him. He can quote all court processes as much as he like but the fact remains that EFCC was in court before him. So there was no point for him to file another suit in a different court. Besides, he has no court injunction restraining EFCC from investigating him.

    I think he needs to change his lawyer as he is not been properly advised.

We are very lucky as a country that we still have a person alive today and in active politics, who is patriotic and courageous enough to volunteer to tackle these problems head-on. I am confident our country will become great. I have always said that, with so many creative and industrious minds and with the right and honest leadership, Nigeria will go places.     Dear Tompolo, my 1 kobo advice ‘honor the EFCC invitation’. They might at the moment need you to answer some questions to help them in their investigations. I don’t see them putting you in detention and even if they are, you certainly have no choice. Your thinking that the selling of your land had gone through a proper channel might be wrong. You were dealing with criminals (in government) too, you know.

    If I may ask, are you Olu of Warri or Olu of your town to be able to own massive plots of land that worth billions? It seems a case of money laundering to me or a case of ‘stealing is not corruption.

    Mind you, you cannot be bigger than the state where there is a president. I mean a president, not the likes of Jonathan.
    I will also advise that you keep to yourself the APC/PDP issue. It is not tenable in the law court.

      Read his comments again. He responded in writing but want EFCC to respond to court order if they believe in the rule of law. If I may suggest, EFCC should treat this matter carefully. Let no one aggravate another fighting in Niger delta.

    This is a reaction of a semi-literate person. Doesn’t he know that refusing to honor invitation of a federal institution like the EFCC is an offense which is liable of sentence? Also reasons provided by Tompolo is more like of narrow thinker and who is all caught up by guiltiness. Let him honor their invitation, the worst that could happen is for them to take him to court, and then if he’s innocent, the court will clear his name. So what is the big trouble in it? After all Fani Kayobe was also cleared by court in this APC regime.

    There is something Tompolo as well as “true” Ijaw people can see very clearly, which other people can not see, even from the roof top of a skyscraper. How does a case of alleged “trespass” or encroachment on land become EFCC case? this may explain a part of why Tompolo may be skeptical about this “booby trap” called EFCC’s invitation.
    Tompolo, as a free Nigerian and a High Chief of the Ezons has unassailable right of aligning with a political party of his choice and canvassing votes for a candidate in an election anywhere in Nigeria including the Ijaw state of Bayelsa. Should the political influence of the chief constitutes an impregnable obstacle to the planned rigging of the governorship election in the Southern Ijaw Local Government of Bayelsa state on the 5th and 6th, and the only way to break the obstacle is to have the Chief quarantined before the ‘RE-RE-SCHEDULED” election, then such an invitation must be viewed as mischievous and snubbed.
    It must however emphasized that while the EFCC under the control the APC led Fed. government has unlimited powers to treat Tompolo at it pleases, but it is not without far-reaching consequences.

    “How can a law-abiding Government declare… another Government wanted ….?” If Government APC declares Government Tompolo wanted, this will be an act of war. If the High Chief has restrained himself even after the provocative act of freezing of his account, Government PMB should not push his luck through ‘lawyer-less” EFCC. Settle through the courts and don’t declare war, because when two Governments fight, it is the common man that suffers.
