SERAP asks Okonjo-Iweala to apologise for illegally transferring $322milion Abacha loot to NSA, Sambo Dasuki

The Socio-Economic Rights and Accountability Project (SERAP) has asked a former Minister of Finance, Ngozi Okonjo-Iweala, to “apologise to Nigerians for claiming recently that recovered Abacha loot was transparently spent while she knew that $322m (about N63billion) recovered Abacha funds were inappropriately released to finance the fight against Boko Haram.”

SERAP’s statement Thursday followed Mrs Okonjo-Iweala’s confession that she released about $322m to the former National Security Adviser Sambo Dasuki for military operations.

In a statement by its Executive Director, Adetokunbo Mumuni, SERAP said, “The truth about the spending of Abacha loot is now coming out, and it is clear that Mrs Okonjo-Iweala was wrong to accuse SERAP of bias while she knew that we are simply seeking truth, justice and accountability on the spending of recovered Abacha loot.”

“Mrs Okonjo-Iweala’s approach of ‘no answers, no apology’ on how Abacha loot was spent is doing her reputation more harm than good. We hope that she will take cue from the World Bank (her former employer) when it defined ‘accountability and probity’ as knowing what task has been set, accepting to do it, and going about it with a sense of probity.

“Probity implying the willingness to self-disclose such information to which a specific stakeholder group has a right as well as tolerance of the scrutiny of such a stakeholder group on information to which they have a right,” the organisation said.

“We therefore urge her to now come out for the sake of millions of Nigerians living in extreme poverty but also of generations as yet unborn and tell Nigerians the whole story about what exactly happened to recovered Abacha loot, as well as publicly apologise for claiming that Abacha loot was transparently spent. She should be willing to be held to account,” the organisation added.

The letter, dated January 20, 2015, which was addressed to former President Goodluck Jonathan, revealed that $322m of Abacha loot was transferred following a January 12, 2015 request by the office of the former National Security Advise Sambo Dasuki for funds for the procurement of arms and ammunition as well as intelligence equipment.

The letter reads: “Please find a request by the National Security Adviser (NSA) for the transfer of $300 million and £5.5 million of the recovered Abacha funds to an ONSA [Office of the National Security Adviser] operations account. The NSA has explained that this is to enable the purchase of ammunition, security, and other intelligence equipment for the security agencies in order to enable them fully confront the ongoing Boko Haram threat. His request is sequel to the meeting you chaired with the committee on the use of recovered funds where the decision was made that recovered Abacha funds would be split 50-50 between urgent security needs to confront Boko Haram and development need (including a portion for the Future Generations window of the Sovereign Wealth Fund)”.

It would be recalled that SERAP had raised some questions for Mrs Okonjo-Iweala to answer regarding how Abacha loot was spent.

The questions read in part: “First, the World Bank confirmed that of the 51 projects reviewed, 23 were described as “completed”, 26 were at various stages of completion, and 2 were described as “abandoned”. Nigerians would like Mrs Okonjo-Iweala to show us evidence of the 23 projects allegedly completed, and whether the 26 projects where actually completed; and what became of the 2 abandoned projects.”

“Second, the World Bank confirmed that 6 out of 8 health centers reviewed pertained to physical infrastructure but were not completed. Nigerians would like Mrs Okonjo-Iweala to explain why these projects were not completed on time, and whether in fact they were completed at all; as well as location of completed projects.”

“Nigerians would also like Mrs Okonjo-Iweala to explain the letter she wrote to the Ambassador of Switzerland to Nigeria January 9, 2005 that of the 174 health centers built with Abacha funds, 138 were fully functional and that remaining 36 were expected to be commissioned in January 2005. Nigerians would appreciate it if Mrs Okonjo-Iweala could identify and name all the health centers mentioned her letter.”

“Third, as regards power projects, the World Bank confirmed that payments by government to contractors could not be verified “because in most cases contact information for contractors was not available,” and that 10 of the 18 power projects pertained to physical electrical installations. Nigerians would like Mrs Okonjo-Iweala to identify and name the 10 installations, and to provide contact details of the contractors that executed the projects.”

“Fourth, the World Bank confirmed that most of the recovered funds were used to repay domestic borrowing. Nigerians would like Mrs Okonjo-Iweala to explain how much exactly was involved as a part of 2004 annual budget execution in anticipation of the repatriation of the looted funds in 2004, as well as repayment terms of the funds and from which banks.”

“Fifth, the World Bank confirmed that the government opened a special US dollar account for recovered funds with the Bank for International Settlements in Basel, to which various transfers of Abacha loot were made. The World Bank also confirmed that some $50 mn was received before 2005 which was kept in the special account. Nigerians would like Mrs Okonjo-Iweala to explain how much was left in the account by the time she left office in May.”

“Sixth, the World Bank confirmed that the data on inflows of recovered funds are broadly identical but that there was one material discrepancy, which was unexplained. The Bank also said the information it received from the government ‘does not contain a reference to the transfer of $5.2 mn in August of 2006.’ Nigerians would like Mrs Okonjo-Iweala to explain the material discrepancy, and why the transfer of $5.2 mn was not disclosed to the Bank.”

“Seventh, the World Bank confirmed that Abacha returned loot was used as source of 2005 budget deficit financing, and that the funds were directed to co-financing of capital expenditure and balancing the 2005 budget. Nigerians would like Mrs Okonjo-Iweala to explain exactly the capital expenditure involved.”

“Eighth, the World Bank confirmed that the Abacha funds were used to provide additional financing for the Universal Basic Education (UBE) program in the amount of NGN24.25 bn to support basic education throughout the country. This amount was fully disbursed and fully utilized. Nigerians would like Mrs Okonjo-Iweala to identify the number and location of schools which benefited from these funds at the time.”

“Ninth, the World Bank confirmed that there were problems with collecting project-related information because of under-developed reporting and accounting standards, and absence of properly set-up databases for sectoral project portfolios; and weak administrative capacity in the ministry of finance. Nigerians would like Mrs Okonjo-Iweala to explain why this was the case under her watch.”

“Tenth, the World Bank confirmed that 13 road projects were completed including 3 of the largest road and bridge projects in each geo-political zone. Also, the Bank regretted that it was not possible to interview many contractors in order to obtain independent confirmation of amounts spent on individual projects, and record their comments on project status. Nigerians would like Mrs Okonjo-Iweala to explain exactly happened, and to identify unconfirmed individual projects, including the largest roads and bridges completed.”

“Eleventh, the World Bank confirmed that no special arrangements were made for project selection and monitoring. According to the Bank, ‘Given the weakness of general budget reporting systems at the moment, this decision greatly undermined the opportunity for tracking the returned Abacha funds and analysis of their utilization.’ Nigerians would like Mrs Okonjo-Iweala to explain why this was the case under her watch.”

    I wish to disagree with SERAP’s idea of apology to be tendered by Dr Ngozi. Such a bow and go approach is only tenable in the Senate. I find it difficult to believe that anyone that helps someone to steal will also not steal herself. As a Coordinating Minister of the Economy Dr Okonjo’s financial rascality can only be properly scrutinized and dealt with before a court of competent jurisdiction.

    The same woman that helped pay the nation’s debt unprecedentedly under OBJ also helped accumulate debt unprecedentedly under GEJ. With her wanton granting of import waivers under GEJ I know that she has derailed. She is never remorseful, ever attacking those who are not fooled by her voodoo economics. Today, Amaechi and Oshiomole are vindicated. So far the can of worms for arms and the federation account has been opened, we await many other cans to be opened such as the import waivers, the sovereign wealth fund etc.

    Dr Ngozi is not a sacred cow, hiding under presidential directives is no excuse. This is the same woman that resigned in annoyance under OBJ so why did she stayed on knowing that GEJ is very generous at spending outside the budget. We do need scape goat. Even if there is no case of self enrichment against Dr Ngozi her mismanagement of the economy, providing leveled playing ground for looting of the economy is also contribution to the nation’s economic adversity. All her contemporaries including those who have crossed carpet to the APC must not be spared. Unless this is done the anti corruption war will remain a ruse!

          3 That was the same time the APC propaganda machine led by the thief el Rufia was referring to the Nigerian army as GEJs army. A military he described as being incapable of winning any battle because the GEJ administration had deliberately refused to purchase weapons for.
          Recall also that the certificate forger had openly told Nigerians that Boko Haram fighters are in his words ” our brothers only who are misguided ”
          The president under immense pressure to do something in order to stop the killing and rape of defenseless Nigerians constituted a committee of the Attorney General of the Federation and Minister of Justice, The National Security Adviser, The Coordinating Minister of the Economy and Minister For Finance and the President. The said committee was chaired by Mr President to find a way to fund the military operations in the North East. Specifically the used of part of the returned loot from Switzerland to fund the military.
          The committee reached key decisions on the returned loot from Switzerland.
          Nigeria had received a first trench of 322 million USD with an additional 700 million U
          SD expected.
          The Decisions reached
          I That given the urgency of the request by the National security adviser, a part of the returned loot from Abacha- ( The certificate forgers boss ) would be used for the purchase of weapons , ammunition and vital communication equipment to be used in the fight against the terrorists who the certificate forger had said were his misguided brothers. Indeed the committee decided that the returned loot was to be split 50- 50 for both security needs and development needs.
          The overwhelming argument put forward by the national security adviser was that no development could occur when territory is being taken and the country is at war- good argument in my opinion.
          The committee therefore decided that 322 million USD constituting the first trench of the loot be deployed to meet the urgent security needs of the country as canvassed by the national security adviser.
          The committee further decided that 700 million USD that was to be returned to Nigeria by Switzerland constituting the second trench was to be used for development projects .
          Dr Ngozi Iweala in her capacity as a member of that committee and on the the strength of the decisions reached by the committee wrote Mr President on the 20th day of January 2015 seeking approval to disburse funds to the office of the national security adviser in line with the decisions reached by the committee . A mere formality and accordance with due process documentation.
          Mr President accented and approved that disbursement on the 29th day of January 2015 in line with the request made.
          The issues that one has to consider therefore areas follows
          I Does the president have the right under emergency situations involving issues of national security where Nigerian citizens are being killed to appropriate funds without recourse to the National Assembly?
          2. Was any law broken by Ngozi Okonjo Iweala as coordinating Minister of the economy and minister for finance in the disbursement of funds to the office of the national security adviser as reached by the committee.
          3. Is Okonjo – Iweala who was not a part of the security infrastructure of the government Responsible for ensuring effective utilization of the disbursed funds. Those saying that she was ultimately responsible should show under what section of our constitution that makes her responsible when acting under her statutory role as the minister of finance
          4. Does Okonjo Iweala and the ministry of finance have the capacity to monitor issues of national security which involve the purchase of weapons and ammunition for the prosecution of an on going war.
          5. Why did the midget el Rufia deliberately withhold the letter written by Okonjo Iweala to the President seeking approval to disburse the funds to the office of the national security adviser.
          6. Is it because the said letter contained exculpatory evidence?
          7 . Why are the other members of the committee that was constituted not being held responsible? People like the attorney general of the federation and minister for justice.
          8 If your position is that The president does not have the power to make such an appropriation under emergency situations can you tell me under what authority president Buhari disbursed bailout funds to the states?
          Did Buhari seek the approval of the National Assembly before making such a disbursement?
          9. What do you think would have happened to Ngozi Okonjo Iweala given Nigeria’s tribal inclinations had refused to disburse the money for the prosecution of the war in the North East? A place where innocent Nigerians of a different ethnic nationality then herself were being and are still being killed on a daily basis?
          10. Did Okonjo Iweala as the coordinating minister have the right to flout the instruction of the president given that due process had actually been followed in arriving at a framework for the disbursement- note that this was done under emergency conditions.
          11. Has the government provided any evidence of fraud on the part of the national security adviser. If so why has the government not tended that evidence in court?
          12 What ammunition and weapons has the military been using to prosecute the war given the fact that the certificate forger is yet to purchase a single bullet since taking office as our selected president?
          I would expect a comprehensive response to the issues raised.
          I would also expect you to address issues of coop ability .
          I expect an intellectual debate not your regular response relating to changing diapers
