Buhari, APC fail to stop suit challenging Buhari’s eligibility for presidential poll

The All Progressive Congress and its Presidential flag-bearer, Muhammadu Buhari, on Tuesday failed to stop the Federal High Court in Abuja from examining the merit of the consolidated suit challenging the eligibility of Mr. Buhari for the March 28 presidential election.

Justice Adeniyi Ademola also reserved ruling till Wednesday on applications filed by two persons seeking to be joined as defendants in the suit. One of the applicants is a pro-democracy activist, Ebun-Olu Adegboruwa.

When the suit came up for hearing, Mike Ozekhome, a Senior Advocate of Nigeria, and counsel to one of the plaintiffs, Chukwunweike Okafor, asked the court to reject the applications because it does not need them as parties in the suit to determine the merit of the case.

One of the suits was instituted by Mr. Okafor challenging Mr. Buhari’s eligibility to contest the presidential election.

He claimed that the APC presidential candidate perjured by allegedly claiming to have attached his academic qualifications to the INEC form he filled even though he did not do so.

The APC and INEC were joined as defendants in the suit.

The party and its candidate protested with separate preliminary objections to the hearing of the suit, arguing that they were not served the court process as required by the principle of natural justice and the rule of the court.

Although, the court granted Mr. Okafor the order to serve the process through substituted means, the APC flag-bearer, through his counsel, Wole Olanipekun, brought an application to set the order aside, contending that as far as he was concerned, no suit exists before the court for determination.

The APC and INEC also argued that even if they assumed that the court papers were properly served on them, the matter before the court was that of perjury, which according to them, was a criminal offence.

They contended that a criminal case could not be commenced by way of originating summons.

In his ruling, Mr. Ademola said the court would hear both the objections and the substantive suit together.

      It looks clear to me that both Buhari and APC are legally out of 2015 presidential race.
      This court case may not be finalized before Saturday’s election – which should be ideal,
      since the object is to decide the qualification of Muhammadu Buhari to run for president.

      But the pace Justice Ademola is going is un-helpful, as he’s again adjourned till tomorrow so as
      to decide ‘joinder’ of new parties to this lawsuit – a wholly inconsequential step in the proceeding.
      Nigeria must live with this type of creaky judiciary it has, which is bound to collapse very shortly.

    Best case scenario is that the judge will dismiss the lawsuits tomorrow, ruling that the court has no jurisdiction since the alleged offense is perjury which happens to be a criminal matter. worst case scenario is that after ruling “negatively” on both objections, the court would commence(adjourning to a later date) the substantive case which can never be resolved by saturday, meaning that Jonathan may use the matter for appeal of the monumental “beating” that his fellow Nigerians are going to apply to his thievin’ behind on saturday.       The Plaintiffs here are actually asking for a precise civil remedy –
      despite that the same facts can later be used in court to jail Buhari.
      The Plaintiffs at this time are only asking for DIS-QUALIFICATION.
      In another court, afterwards, a criminal prosecution will start for jailing.

            ex mero motu in a civil case if a criminal case is on-going on the same facts,

Just to get some clarification from you, are you stating that it is the norm in common law for a civil proceeding to run concurrently with, or precede a criminal proceeding in the same matter?     I am deeply disappointed by our judges. Our judicial system is killing us. How can they fix hearing of Buhari’s case, three days to election. They better postpone this case till after the election for the sake of the common people. Many of the prominent politicians in Nigeria have shipped their families abroad. Since over three months Nigerians have been crying for Buhari to present his certificate to no avail. He went to UK, came back without certificate. Buhari is above the law in Nigeria. He can circumvent the law of the land and nothing will happen.He is looking for the blood of the dog and the baboon to soak now. They should leave him alone. He will not win.

      His knowledge of law is laughable, in my opinion, and quite disgraceful too, fr sure.
      Unlike his ignorant contention so confidently asserted, the law actually is that where
      a person has cumulative remedies – some redressible by criminal proceedings,
      the person may pursue both criminal and civil proceedings but in separate forums;
      or waive any whatever remedy but solely at his own discretion. It is nonsense talk
