Court bars use of soldiers in election

A Federal High Court in Lagos has ruled that the Nigerian Armed Forces have no role in the conduct of elections in the country.

The court relied on a recent Court of Appeal ruling that barred the use of soldiers in the conduct of elections, stating that it was a violation of Section 217(2)(c) of the Constitution and Section 1 of the Armed Forces Act.

The appellate court had also relied on a judgment by a Federal High Court in Sokoto last January also barring the use of armed forces in the conduct of elections.

The latest ruling says the Nigerian government should not deploy soldiers at polling units, a plan that had generated controversy between the ruling Peoples Democratic Party, PDP, and the opposition All Progressives Congress, APC.

    These Judges don’t seem to know what they’re doing. The Nigerian Police alone can’t guarantee security at the Polls venue. Some civilians know how to disarm our policemen. I have seen it happen many times at many places. Lets be truthful to ourselves, we need Soldiers at the election venues, even if just to hang around the venues to guard against possible violence. We have greater regards for our soldiers than for our Police men and women.

Obama asked Nigerians to observe, and also all loving Nigerians pray for, the soldiers should remain in the barrack because it is not Military Regime.     The same court cannot rule on Buhari certificate.
    Nigeria is too divided and can only prospers with autonomous regions.
    Disregard the judge. The Salami in them are plenty.

    Nothing but anther nail in the coffin of Dumbo and his PDP cabal, soldiers have no role to play in a civil duty as simple as casting a vote, Nigerians are not going to war on Saturday. Good judgment, but I expect the ruling Party to ignore it as has been the case on previous occasions. $Dumbo and his evil cabal want to hijack our democracy by stationing soldiers only 300m away from polling unit such that an argument would be enough reason for them to close down that unit and cancel elections there. PDP are not going for the win that has since eluded them, they want to create “Enabling Environment” for a military coup that will effectively truncate democracy in Nigeria and install a military who will oversee another elections at a future day. PDP is gone with this decision… Hahaha chei!

    the pronouncement is clear. soldiers should not get involved in things like sorting cards, queues, movements and all direct activities to the process; however if there is a breach to the extent that the police are overwhelmed, the ruling does not stop the commander in chief from ordering an intervention. only mischievous persons will allow the breakdown of law and order no matter from where it emanates.

    What are they afraid of? A military coup? Such a thing can only bring an armyman in power, and GEJ is not an armyman. Pushing the soldiers away from voting units will only make tehm more vulnerable to BH attacks.
