Disqualification suit: Judge orders service of court documents on Buhari, INEC through newspapers

A Federal High Court, Abuja, on Monday fixed February 9 for mention and hearing of a suit seeking the disqualification of the presidential candidate of the All Progressives Congress, Muhammadu Buhari, from contesting the February 14 election.

The court also ordered that Mr. Buhari be served the court documents ahead of the hearing.

Justice Adeniyi Ademola gave the order on Monday in a suit FHC/ABJ/CS/14/2015 filed by way of originating summon by an Abuja-based legal practitioner, Max Ozoaka, against Mr. Buhari and the Independent National Electoral Commission, INEC.

Mr Ozoaka sought and secured an exparte order for the defendants to be served by substituted means, including notices in three national dailies.

Mr. Ademola also granted the applicant’s prayers for an abridge time within which the defendants would enter appearance in the matter.

In the substantive suit, Ade Okeaya-Inneh, SAN, counsel to the Mr. Ozoaka, is seeking among other relief:

-“A declaration that by the combined provisions of Sections 31(1)(2) and (3) of the 2010 Electoral Act as amended and INEC Form CF 001, the 1st defendant is mandatorily obliged by the law to comply strictly with the provisions laid down under the Electoral Act as amended and INEC Form CF 001 as it relates to attaching evidence of the 1st defendants birth certificate and evidence of his educational qualifications as required under INEC Form CF 001;

-A declaration that by the combined reading of Sections 31(1)(2) (3) and 31 (8) of the Electoral Act, the 1st and 2nd defendants are mandatorily obliged by law to comply strictly with the provisions laid down under the Electoral Act vis-a-vis the filing and submission of INEC Form CF 001, by the 1st defendant attaching evidence of educational qualifications as required under the said INEC Form CF 001 and that non compliance with this condition inherent amounts to an offence under Section 31(8) of the Electoral Act;

-A declaration that the curriculum vitae and voters registration card attached by the 1st defendant in his INEC Form CF 001 and submitted to the 2nd defendant as a presidential candidate in 2015 general election is not in conformity with the form prescribed by the Electoral Act/INEC Form CF 001 and is manifestly in contravention of the said Act/INEC Form CF 001 and therefore null and void;

-An other declaring as invalid the INEC Form CF 001 as filled by the 1st defendant as being inchoate and manifestly in contravention of the provisions of the Electoral Act/INEC Form 001 as the 1st defendant did not comply with a condition inherent/precedent in the INEC Form CF 001 submitted to the 2nd defendant, by failing and/or refusing to attach evidence of his birth certificate and educational qualifications which are conditions inherent/precedent as prescribed in the form;

-A declaration that the 1st defendant is not eligible to participate in the 2015 Presidential election for failure to comply with the terms for submission of list of candidate and affidavit of personal particulars of persons seeking election to the office of the president;

-A declaration that the sworn affidavit by the 1st defendant stating that his original certificates are presently with the Secretary Military Board cannot replace and/or satisfy the provision under INEC Form CF 001 requiring him to attach evidence of his educational qualification as such requirement is a condition inherent and a condition precedent to his eligibility to contest/participate in the 2015 presidential election;

-An order disqualifying the 1st defendant from contesting and/or participating in the presidential election fixed for the 14th February, 2015 or any other date that the 2nd defendant may fix; and

-An order restraining the 2nd defendant from permitting the 1st defendant from participating in the presidential election fixed for 14th February, 2015 or any other date that the 2nd defendant may fix.

Mr. Ozoaka also raised eight questions for the court’s determination. Among the questions are:

-Having regards to the clear, unequivocal and sacrosanct provisions of Section 31(1), (2), (3) and (5) of the Electoral Act, Cap 15 Laws of the Federation of Nigeria, 2010 and INEC Form CF 001 which stipulates the conditions to be complied with in the submission of list of candidates and their affidavits to INEC, whether the 1st defendant herein has complied with the said law and INEC Form CF 001, when he failed to attach evidence of his educational qualifications to the INEC Form CF 001 submitted to the 2nd defendant for the purpose of the 2015 presidential election.

-Whether the curriculum vitae of the 1st defendant as attached by the 1st defendant alongside the affidavit sworn by the 1st defendant and attached in the INEC Form CF 001 to the 2nd defendant suffices and/or replaces evidence of the 1st defendant’s educational qualifications as required by INEC Form CF 001 and is in accordance with the prescribed form as stipulated by Sections 31 (1) of the Electoral Act, Cap 15 LFN, 2010.

      No abuse at all. The court allows a person to take a case to the high court if he reasonably believes any information contained in an affidavit of a candidate is false. If a court finds it to be false then such candidate can be disqualified.

        D.A., could you please tell me how a Court, or persons, can determine how a person lied under Oath or in an affidavit, if such person stated what he reasonably believed to be true at the time such an oath or affidavit was sworn?

        All GMB needs to do is prove such information was indeed lodged with such body and that the body re-posited with such authority has not claimed that there is/was no such process.

        As it is, the case (applicant) would still need to prove his locus standi in the matter and how this would be injurious to his interests.

        Just remember that he who alleges, must prove.

          The issue as stated in the statute makes reference to the affidavit being “false” and not that a “lie” had been told. A person’s reasonable belief is therefore immaterial! The Act simply states that the person taking the case to court has to reasonably believe that the facts stated is false for it to be considered by the court. Once considered by the court and if such affidavit is found by the court to be false then the candidate can be disqualified by the court!

      I feel very sad for APC and Buhari in particular because how on earth could a party full of intellectuals have made such an error of submitting a sworn affidavit. Was it arrogance, naivety, oversight or stupidity? Every other documents submitted mistakenly can be treated with levity in the court but falsely submitting a sworn affidavit, that is serious perjury. We all know that Buhari is qualified to contest for the office of the president of Nigeria however, there is due process to be adhered to. The law says the minimum educational qualification required by INEC is WASC and from my investigation, the Diploma he obtained from American war College is equivalent to a National Diploma obtain from any Nigerian Polythecnic. The pertinent question therefore is, why did APC and Buhari submit a sworn affidavit instead of the War College Diploma? There are ethics and rules to be followed and we should not allow our party affiliation to cloud our sense of reason change must be done in accordance with the law.

    If Bokohari and APC could not get the filing of a presidential nomination form right, how could they even imagine solving Nigeria’s problems. Bokohari and APC have themselves to blame not anyone else. The guideline was simple: attach evidence of qualification and birth and be truthful in every information you give to INEC. Bokohari was unable to meet any of those simple (?) requirements. His nomination form was incomplete and, therefore, invalid.

    I wonder who gave the prestigious SAN to this brainless lawyer. My self not being a lawyer knew long ago that affidavit serves the same purpose as the document on which the affidavit is filled. My first experience on that is long ago when I lost my bank documents, the bank manager ask me to produce an affidavit, and that serves it all. Thereafter, when I found my lost documents and take it back to the bank, the same manager told me that, he doesn’t need it any more as my affidavit is with him. Therefore, any sensible lawyer may only ask for the how genuine the affidavit is but not to contest presentation of the affidavit.

      You don’t swear to an Affidavit when the said document can be obtained, in the case from WAEC or Cambridge. The reason you needed one for your bank Acc was that the Acc data files were also located within the bank. The only place Buhari needed Affidavit was at WAEC if they were in doubt that he is Mohamed or Mohamadu (Whatever) Buhari.

      You dont need to be a lawyer to understand this simple fact.

      So, what if you were a fraudster with an affidavit claiming to be someone with lots of money in his account? Clearly, the details attested to are wrong and the fact that they are contained in an affidavit does not make them right in any way. What I am saying to you is that a falsehood is a falsehood and you can swear till the cows come home, it would not make it right. Clearly your Bank Mahager did his home work to verify your sworn facts, otherwise he would not last a week as a manager.

      1) In your example, you said you lost your bank documents. The keyword here is ‘lost’. You didn’t go to the bank manager with an affidavit that your father or somebody is with your bank document.
      2) Buhari didn’t say he lost his documents. Buhari swore to an affidavit that his documents are with somebody. If you sent someone an invitation to a job interview 2 – 3 months before hand and then the person appears with an affidavit that his qualifications are with his previous employer, would you take the person seriously? Wouldn’t you ask the person why he didn’t retrieve the documents within the past 3 months?

      If for any reason Buhari gets disqualified, I will place the blame squarely on APC and Buhari. Both parties have seemed to take Nigerians for granted and just want to have their way. This whole issue could have been settled long ago by simply presenting Buhari’s certificate, if nothing else to at least shut the PDP folks up. But no, APC and Buhari carry on as if they are above the law.

        Affidavit serves to affirm what the the affiant believes to be true at the time he or she filed such affidavit. GMB sworn to an affidavit that his certificates were with the military because he believed that to be true at the time that affidavit was sworn to. if any one later claimed that the certificates were no more with the military, such would not change the fact that GMB’s belief was that his certificates were with the military as at the time he sworn to affidavit. Unless it is proved beyond reasonable doubt that: GMB never submitted his certificates to the military; and or that GMB knowingly perjured that his certificates were with the military, if affidavit were for any reason whatsoever acceptable in lieu of the other form of documentation of educational qualification, the affidavit submitted by GMB would remain admissible and acceptable to serve the same purpose. If anyone however is capable of proving that the affidavit sworn to by GMB was nothing but perjury, then GMB might have a question to answer. If GMB dod not perjure or could not be proved to haver perjured, the worst that could happen would be to declare that he should provide a copy of the certificate that was already confirmed to be valid by his alma mater. If anyone believes that his alma mater might have forged the circulated certificate or testimonial, the burden of proof lies in the court of such element, not in the court of the school that provided the allegedly forged document or that of GMB. In other words, the burden of proof is more of the plaintiff than anyone else.

          1) This is Buhari’s fourth time of contesting. The law for minimum qualification has not changed. Have you ever wondered why all these times Buhari has been contesting, he has never bothered to actually retrieve the physical copy of his certificate?
          2) INEC laws were amended to say candidates should attach proof of their educational qualification. Since Buhari said the certificates were with the military, why didn’t he try to get them instead of going to swear an affidavit. Suppose you were in his shoes, which would you do – ask the military for your certificate? Or go and swear to an affidavit? Please be honest as you think about your answer

    Affidavit serves to affirm what the affiant believes to be true at the time he or she files such affidavit.

    GMB allegedly sworn to an affidavit that his certificates were with the military presumably because he believed that information to be true as at the time that affidavit was sworn to. if any one later claimed that his certificates were no more with the military, such would not change the fact that GMB’s belief was that his certificates were with the military as at the time he sworn to such affidavit.

    Unless it is proved beyond reasonable doubt (emphasis on the REASONABLE DOUBT here because we are now discussing criminal allegation) that: GMB never submitted his certificates to the military; and or that GMB knowingly perjured that his certificates were with the military, if affidavit were, for any reason whatsoever, acceptable in lieu of the other form(s) of documentation of educational qualification, the affidavit submitted by GMB would remain admissible and acceptable to serve the same purpose. If anyone however is capable of proving that the affidavit sworn to by GMB was nothing but perjury, then GMB might have a question to answer. If GMB did not perjure or could not be proved to have perjured BEYOND REASONABLE DOUBT, the worst that could happen would be to declare that he should provide a copy of the certificate that was already confirmed to be valid by his alma mater.

    If anyone believes that his alma mater might have forged the circulated certificate or testimonial, the burden of proof lies in the court of such element, not in the court of the school that provided the allegedly forged document or that of GMB. In other words, the burden of proof is more of the plaintiff than anyone else.

      GMB would not be disqualified from contesting in this month’s presidential election because he perjured, not even because he forged documents…those are separate criminal matters already pending against him…
      Buhari would be disqualified (disqualification is not a penalty for a criminal offense, but the consequence of flouting the electoral laws) because he barely complied with the provisions of the Electoral Act, 2010 and the 1999 Constitution, as amended, as well as INEC rules that govern every contestant in this election….
      If you have not read the provisions of the Electoral Act, especially s. 31 of same, which the claimants made adequate reference to, please go read.
      This matter in respect of Buhari’s disqualification, which is the subject of this report, is a (civil) pre-election suit and standard of proof in civil suits is based on balance of probability and not proof beyond reasonable doubt….
      Besides, it is only in respect of criminal liability that you talk about mens rea and actus reus; it is only in respect of criminal liability that you talk about intention (mens rea or guilty knowledge) the absence of which an alleged offender cannot be convicted on mere facts as to actus reus, and thus you have to prove voluntarism, willful offense, before an offender may be convicted for a criminal act (actus reus)…
      As already indicated, there is a pending criminal suit in respect of perjury and forgery that is being lodged against the APC presidential candidate at an Abuja Magistrate Court….
      Before I proceed, I refer you to relevant subsections of s.31 of the Electoral Act.
      S. 31(2): “The LIST OF INFORMATION submitted by each candidate SHALL BE ACCOMPANIED BY AN AFFIDAVIT SWORN TO BY THE CANDIDATE at the High Court of a State, indicating that he has fulfilled all the constitutional requirements for election into that office.”
      To break it down for you, that provisions places premium or primacy on “LIST OF INFORMATION.” This LIST OF INFORMATION (OR DOCUMENTS) is to be accompanied by “AN AFFIDAVIT SWORN TO BY THE CANDIDATE.”
      Clearly, whereas the DOCUMENTS are primary, the SWORN AFFIDAVIT is secondary, as it is not the DOCUMENTS that are to accompany the SWORN AFFIDAVIT, but the other way round…
      It is on record that till date Buhari has yet to attached any of his academic credentials to his INEC Form, and failure by the candidate to have and submit both the documents and the sworn affidavit is an infraction of the electoral law!
      In other words, neither the documents nor the affidavit can stand alone…..

      S. 31(6) provides: “If the Court determines that ANY INFORMATION CONTAINED IN THE AFFIDAVIT or any document submitted by that candidate is FALSE, the COURT SHALL ISSUE AN ORDER DISQUALIFYING THE CANDIDATE FROM CONTESTING THE ELECTION.”
      Analysis: The information contained in the affidavit deposed to by Buhari states: “All my academic qualifications (documents) as filled in my presidential form, President APC/001/2015, are currently with the Secretary, Military Boards as at the time of this affidavit…”
      In its reply to Buhari’s sworn affidavit, the military denied having in their custody the academic credentials of Buhari, saying, “Neither the original copy, Certified True Copy (CTC) nor statement of result of Major
      General Muhammadu Buhari’s WASC result is in his personal file.”
      The issue then is: seeing that the military has belied Buhari’s affidavit claims, can it be said that GMB lied under oath??
      Of course if it is proven that he lied under oath, he automatically stands disqualified pursuant to s.31 (6) EA…
      In proving “lying under oath,” I should think that the standard of proof may be as obtained in criminal matters, but I guess that to dismantle Buhari completely, the claimants would rather go out to prove that indeed Buhari has no certificate in the first place, before we start talking about having it kept in this or that person’s custody…
      The claimants would tender the reply by WAEC to a letter from Move-on Nigeria, which flatly denied knowledge of any candidate by the name Mohamed Buhari….
      The court might even order the subjection of Buhari’s alleged statement of result, as only posted in PREMIUM TIMES, for forensic investigation.
      The court might also issue an order on Buhari to proceed to apply to Cambridge University for his certificate….
      Suffice to say however that the strategies to dismantle Buhari are boundless in their possibilities….

      Thank you. Many of them who have suddenly become constitutional lawyers don’t really understand the intricacies of the law. I don’t believe Buhari never had his credentials with the Army – PDP could be at their best when it comes to doing some “backdoor job”. As Buhari and APC have explained, since his house was ransacked in 1985 when he was overthrown, leading to the loss of his credentials, he has been using affidavit, which is allowed in law and by Nigerian constitution. He didn’t need to ask the Army first if they had his credentials before swearing to the affidavit, because he was sure he submitted them properly to the Army — and Obasanjo confirmed it that the issue was raised by PDP when he was still the leader of the party in the past and that they investigated secretly and they were intact, and therefore they never raised any dust about it. Jonathan-led PDP only raised dust now after they had perfected their “backdoor job” with some bad eggs in the Army who helped in removing the certificate photocopy from Buhari’s file. This kind of thing happens to people’s application file in offices in Nigeria, but never expected it in the Nigerian Army. In many offices, your missing application documents or file will suddenly resurface after parting with some naira for those working in the office.

          Is it not tidier for our democracy to allow him to be defeated again at the poll? You see, we are gradually getting used to the activities of bombs in this country. Disqualifying a high-profile candidate for whatever reason at a time like this may thrill some section of the country, yet it is a catastrophic time bomb. I don’t know how old you are Etomi, I would love to remind you with due respect that save from religious induced crises, there was never a time in this country that we have had any major crisis not preceded by some shabby treatment meted out to the opposition during elections. For example, there was great jubilation in the camp of the government and its backers when Awo was jailed. But it led to the first coup, the pogroms and the civil war. Many of our youths today speak glibly about war. But there is a great difference between militancy and warfare. We should show wisdom by not giving credence to that suspicion that the East is ever poised for a showdown with the North. True, no one has a monopoly of trouble, but we can do without avoidable problem for now. People who feel that Buhari does not deserve to be our president should be allowed to vote against him. If however, after seeing clearly that GMB is as you said, a ‘fraud’ and we should still go ahead and elect him, then, we shall deserve whatever comes our way. After all, no one will escape the tragedy if the heavens should fall. The point I am making is that an aftermath of a defeated Buhari can be much, much easier to manage than that of his disqualification.

      As for me, Nigerian Masses will on Feb., 14, 2015, make it difficult if not impossible for such a dictator to coast home to easy electoral victory – “Aso Rock”. Nigerians have always learnt to reject failures, abuse of due process, and dictators.
      Ofcourse, Nigerians had stopped him(Buhari) three times consecutively in 2003, 2007 and 2011, therefore, nothing will stop Nigerians from rejecting him again in Feb., 14, Presidential Election. Nothing has changed in the life of Buhari. Once a soldier, is always a soldier.

When Jonathan was in the process of negotiation with Boko Haram, the then shekau, the leader of boko haram nominated buhari to lead their team to Saudi Arabia for the peace talk. What does that tell you?. There is something better than economy. When peace vanished in this country, no one will remember economy, corruption and electricity. Buhari always tell us that he will crush boko haram if he comes to power; yes, he can because he knows who to talk to.

        Please I do not think that anything can justify shunning a presidential debate at this time given that the stakes in this election seem far higher than what obtained in past elections…
        This election seem to me as even transcending the dramatis personae of the contest, i.e. GEJ and GMB…
        This election is about the make or break of Nigeria….
        And never has two wrongs made a right, which is why the citing of what happened in 2011 does not make having to repeat the act in 2015 tenable or justifiable…
        Besides I think it is disingenuous for you to say because GEJ or OBJ failed to declare their assets, then GMB is justified to shun a presidential debate….
        I hold that GEJ or any Nigerian president for that matter must declare their assets as constitutional prescribed; in just the same way as I hold that presidential debates preceding the ballot must be a categorical imperative in a democracy…
        The debate is simply service to Nigeria and Nigerians; it is not about Buhari himself or GEJ for that matter….
        The debate would afford Nigerians the opportunity to judge the candidates in terms of their depth, their rational power; their appreciation of the key issues of governance; their leadership qualities in the context of a democracy, etc, as the key weapon a leader may wield in a true democracy is not force or gun or command, but compelling intellect, i.e. leadership by superior, convincing and believable ideas…
        It is easy to read that a leader who shies away from debate is hiding a major inadequacy, which if the electorate discerns may decide quickly and wisely to query their choice…
        What is it that Buhari is hiding!?!
        I am curious….
        Perhaps if GEJ had submitted himself to a debate in 2011, Nigerians would have had a better opportunity of assessing him before casting their ballot for him….
        Well, here we are…
        Nigerians would have been able to judge him better…
        Thus, I call on the handlers of Buhari to do a rethink and convince him to come out for the debate….

    Jonathan and PDP are only looking for a good occasion to necessitate the postponement of the election as they have been clamouring for postponement since they became completely jittery of Buhari. Moreso all polls even those organised by Jonathan’s cronies overwhelming gave Jonathan a bottom result! They only want to achieve what the nuisance value Arthur Nzeribe did against the June 12 elections. We are waiting for the history on this matter.
