Tambuwal withdraws suit seeking restoration of security aides

Aminu Tambuwal

The Speaker of the House of Representatives, Aminu Tambuwal, on Monday withdrew his suit challenging the withdrawal of his security details by the Inspector-General of Police, IGP, Suleiman Abba.

The IGP had withdrawn the speaker’s security aides following his defection from the Peoples Democratic Party, PDP, to the All Progressive Congress, APC.

At the resumed hearing of the case on Monday, Mr. Tambuwal’s counsel, Tunji Abayomi, brought an application for discontinuance of the suit.

Mr. Abayomi informed the court that he was instructed by the speaker to make the withdrawal.

The counsel to the IGP and Attorney-General of the Federation, AGF, Ade Okeaya-Inneh, however opposed the application, and urged the court to dismiss the entire suit and award costs against Mr. Tambuwal.

He argued that parties had joined issues in the case by filing counter affidavits and filing replies on the merits of the suit.

Justice Ahmed Mohammed, in his ruling, struck out the suit accordingly.

The judge held that the defence counsel only responded to the preliminary motion for injunction to restrain the IGP from withdrawing his security details and not the motion on notice.

He, therefore, made no order as to costs.

Mr. Tambuwal had argued that the IGP had no constitutional powers to withdraw his security details without the order of a court.

He had also contended that he remained the Speaker of the House of Representatives since he had not been impeached by his fellow lawmakers.

  • TAWANDA INCOMMUNICADO

As the mellow drama slowly transforms to a political tragi-comedy. Tambuwal is digging his political grave with his own hands. He will be politically worthless after this episode !!

    • Chris1408

Which one is GEJ digging? Hopefully GEJ will dig one deep enough for him and his partners in corruption so can never see their likes ever again

      • Otile

Don’t distract people, this story is about Imam Tambuwal not GEJ. Stay focused.

        • Wähala

It’s now you want to remain focused, ba? Was it not Dumbo who initiated the crises by ordering the IGP to withdraw Tambuwal’s security detail… or who do you think is the Coward-in-Chief of the armed forces? A drunken mumu who could not even visit his Sou-South bcos a tout threatened to pop a balloon. Dumbo is in full focus in every evil that’s happening in Naija today, don’t ever forget that… kapisch?

          • Otile

I hate when you Yoruba people mug me with this kind of childish rant…dumb, omokri, kulu kulu kulu, gra gra gra, bla bla bla.

          • Otile

Learn how to spell university well, don’t display your poor spelling by writing unifasiti twice in 2 consecutive short questions? It says something about you.

          • endingNaija

Mumu otile Reno Omokri, I presume you know that a person like me who uses the English language to post the way I do to show the absurdities and hideous nature of your posts as otile/the truth/Tawanda/oleku abujakenneth etc must at least how to spell. Okay? So you re using style to dodge the fact that I am ridiculing the unifasiti of your Phd president-Goodluck Jonathan who went to a unifasiti and NOT a university!!! Please go and check all my posts and see for yourself. Given the level of reflection and quality of governance he has displayed your Ijaw president went to a unifasiti and NOT a university-I will not allow you dodge that fact. Yu hear otile Tawanda? I go laaf taya. See I do not know how to spell “laugh” and ‘tire” too since me I dey laafu my own jeje since I dey kampe!

          • Otile

Wallahi. You compounded your error by misspelling university again. This time around you wrote unifasiti 3 times. It is now crystal clear that you can’t spell university. Don’t pretend you are joking. What you don’t know, you don’t, and it shows.

          • endingNaija

Which unifasiti did your Ijaw president-Goodluck Jonathan buy his Phd sef? I go laafu taya today 4 ole!

      How do you figure?

    • endingNaija

Pele o Reno Wendel Omokri, you are still angry at Tambuwal-abi? When will you kulu (cool) temper? Let me borrow some of the creative phrases of Nigerian students when people like you well up with unnecessary pent up anger-the phrase is kulu (meaning cool) kulu kulu temper. So Tawanda na the truth na Reno Wendel Omokri na otile na oleku I say to una kulu kulu kulu temper kulu kulu kulu temper kulu kulu kulu temper-no gra gra gra please kulu temper!!! I juts dey dey kampe dey enjoy your anger ati anything wey you write!!!.

      • Otile

Do you not have any meaningful thing to say? I don’t know why your tribesman and master Wähala concurs with you in this kind of childish rant… Omokri, kulu kulu kulu, gra gra gra, bla bla bla.

        • endingNaija

What can be more meaningful than exposing your dubious and duplicitous selves-reno omokri as otile as tawanda as the truth as oleku as temmie as abujakenneth? Tell me!

          • Otile

You urgently need a psychiatric attention, boy.

          • endingNaija

my pet so you saw that exposure, being caught in the act pants down? Right? Anyway before I go I have this simple question: When is the head of “Pastor” Dr. Goodluck Jonathan’s campaign office in Israel “Pastor” Ayo Oristejafor going to tell us the names of the two Nigerians money launderers he used to launder $9.3m in his private jet? We know the name if the “Christian” Jew. He is Eyal Mesika. But we do not know the name of the other “Christian” Nigerian money launderers “Pastor” Oristejafor used. Please kindly inform on this when you are back e-rat and e-pet otile.

    • PROF

He will not be worthless after the hearing,he has always been worthless.

  • mike

,what if he becomes the next president? Would you rather bury yourself in the grave he dug?

    • Otile

He can only became the president of the Islamic Caliphate of Arewa if he manages to kill Imam Shekau in a duel.

      • Ayo Yussuff

        LOL,,,,,,,,,,,,,,,

      • Abdullahi Abba Bukar

Otile, just as we are presently witnessing GEJ the President of CAN in the present day Nigeria

        • Otile

Where have you been? GEJ is the elected President of the Republic of Nigeria, not CAN. In the last presidential election he defeated Imam Buhari in a landslide. GEJ did not come to power through a military coup. Are you visiting from Sudan or Somalia?

          • endingNaija

Ole, But Pastor President Dr. Pastor Goodluck Jonathan and Pastor Oritsejafor hold joint presidency of Christian Association of Nigeria? Is Pastor Goodluck Jonathan not the “Christian” candidate of the “Christian” party? Is that not the strategy to “win” the election by “winning” the “christian” votes?

          • Otile

Try to make some sense so that you can get an answer.

          • endingNaija

And have you PDP ati Goodluck Jonathan not made Israel the headquarters of the campaign office of the “christian” candidate “Pastor” Dr. Goodluck Jonathan? And is Goodlcuk Jonathan and PDP campaign office in Israel not being run by “Pastor” Ayo Oristejafor of CAN? Just answer my pet!

  • mike

Tambuwal is vibrant, articulate and intelligent. Jumping ship and crossing to the opposition is a move. Especially being fully aware that this move will infuriate the presidency and spur them into the impunity that they are well known for. This shows the young man has principles. If the pdp no longer operate in the same page with the honourable speaker, how would it amount to digging his own grave by leaving the pdp. Or is Nigeria a one party state?

    • TAWANDA INCOMMUNICADO

There is freedom of political association imprinted in our constitution so there is nothing wrong with any politician or Nigerian switching political association. Tambuwal was very dishonourable in his actions,he was a member of one party but a mole for another for a long time and he has taken his disdain to the electorate by attempting to run the house of Representatives from a minority party after cross-carpeting with the mandate given to him by the electorate in total disregard for the constitutional provisions dealing with the cross-carpeting of legislators.
Tambuwal’s actions are immoral, selfish and in fact unconstitutional. That is why he may pay a political price for his ill-conceived shenanigans. Tambuwal has paralyzed the legislative arm of governance and holding the whole country ransom. This wanton act of cheap blackmail is recklessly inconsiderate and irresponsible for a man whose ambition it is to be President !!

      • Wähala

Quote which part of the Constitution that says the House must be run by a member from the majority Party… and I will give you precedents where a member of the minority successfully led the House without rancor. There is no part of the Constitution that says carpet-crossing must result in automatic loss of seat, that’s why we’re waiting for the court ruling on cases before it. Charge-no-Bail internet lawyer, pro bono practitioner, we know your type… one @OC Okpunobi, Heathrow Taxi Stand Esq. far-far back on SR…
        Go-siddon! Olosi.

        • TAWANDA INCOMMUNICADO

The democratic immorality of the “Speaker” hijacking the mandate of the masses and defecting to a minority party without consent is even lesser than the flagrant disregard for the constitutional provision which makes it mandatory for any such defector to relinquish his or her seat.
The man and his co-conspirators constitute a clog in the wheels of our democracy….they are villains !

          • Wähala

Quote the Constitution and stop preaching morality to the choir!

          • TAWANDA INCOMMUNICADO

My motive here is to communicate to all legal lay-men as well. I will not go down that route of quoting provisions here,we are not in a law court and even if I did you cannot make legal sense of it !

          • Wähala

You will not, because you cannot… shikena! We are neither in a barber shop so stop spreading falsehood. With that, you lost the moral high grounds to preach morality to anyone, you are a liar!

          • TAWANDA INCOMMUNICADO

I will not go down that route. Those provisions are everywhere and easy to put down here in fact the case is in court so lets wait !

          • Otile

            True

          • TAWANDA INCOMMUNICADO

            Forget that miscreant !

            Gbam!

          • endingNaija

Tawanda Otile, do you remember Ume Ezeoke? Ume Ezeoke was the speaker of the house. He was a member of NPP when the NPN was the majority party in the house. Does that help you Tawanda o (ti) le?

          • Johnson

Tambuwal as a PDP speaker committed horrible adultery with APC. His attempted to now shamelessly marry his mistress (APC) and kill legal wife PDP has exposed his unfaithfulness. He will be unfaithful to Nigeria if he become President. He is not a reliable and contented man. If he is a truly leader he would have worked to rebuild PDP and to sabotage them as a member or else, he would have been man enough to resign as speaker and move on with his mistress APC in honour to Nigeria constitution.

        • Pet

I think you need to shut your filthy mouth on this commentary forum. You have been making irrational comments here.Who are you really? You and your sharia APC should go to hell! You northern Nigerian ingrates!

          • Otile

Believe it or not he is not a Northerner but a Yoruba man. The reason he sounds Northern is because he and his Yoruba APC kinsmen are subservient to Fulanis. He is ready to defend any Hausa Fulani with his life.

          • endingNaija

Otile na pest or are you a pet of Pet? Or Otile na Reno Omokri’s pet ? Actually which pet be Otile? Otile na Tawanda pet or pest? I just laaf small sha! Just a chuckle!

          • endingNaija

And by the way Reno, before I go to take a nap, where is the truth’s pest or pet? I have not read him for a while. You are making the truth to lie low and you will use the name at another time? Okay I understand Reno Omokri my pet, no problem. We go jam later.

          • endingNaija

Can you answer this question? If you cannot I will help you. Who is Ume Ezeoke? Ume Ezeoke was an NPP speaker of the House when NPN was the majority party. Does that help you pest or are you a pet?

          • Chima

Have you heard of ‘accord concordance”? the key word is “Accord’. It was by mutual agreement that is the majority will agree for that to happen. And that will mean the minority is helping the opposition somewhere. Minority don’t just become speaker without the majority. Infact the minority does not even present candidate for election after proclamation.

          • Wähala

            @Chima,
If elections are held in the House today, “accord concordance” will revisit the Legislators because Tambuwal was not even the PDP’s preferred candidate, remember? He was elected by a bipartisan majority and that’s the way to go, not frivolous Constitutional interpretations to suit party affiliations. So, you have a point and the key words are, “mutual agreement” which I think should prevail.

          • Chima

@Wahala, if you read the section 168 of the constitution on the issue of change of party by legislators order than the party they where elected, it is straight and simple you need no supreme court justice for interpretation. the key word is “shall” vacate. Unfortunately for Aboki even with his law background he allowed himself to be deceived, he should have done this when the 37 reps defected when it is debatable whether there was division or not NOT NOW. Aboki only succeeded in dribbling himself. Tambuwal is not even a member of the house any longer, Infact by law anything he does in the house or with the name of the house is void. @Wahala, if you are student of power you will know that the worst opponent is weak looking opponent like GEJ. You remember “green snake under green grass” very very dangerous.

          • Wähala

Then, why have the 37 Reps not returned their seats to the PDP…and how come Mimiko is still Governor? You see, only the courts can interpret the Constitution and as long as the case is in the docks, your guess is as good as mine. As per green snakes, toss a toad at it and wait for his head to swell before chopping it off – my grandfather’s advise.

          • Chima

Please lets deal apples -not mixed multitudes. We talking of legislators here. Now the difference between the 37 reps and Tambuwal is “time”. When those chaps left it was 50/50 game whether there is division or not- even there was one this backyard judgment secured down Ilorin, infact the respondents I am not even sure appeared that said there was a division then. Again nPDP was a known faction of PDP though the court refuse them recognition. But now all the contenders have ran away to other parties to ventilate their ambition and the party is well tucked almost 1 yr after. DO you know there is an affidavit sworn to by AGF and IG that Tambuwal is not a member of the 7th Assembly did they have the balance to do that with the 37 nada. Aboki may have his plans but you know when you jump around too much you “may” meet your waterloo. I understood they want to make a scape-goat of the guy to set an example because he is a big fish(No 2 highest lawmaker in the land). Are you hearing Gbajabiamialla and Co Nada. Leave all this small fries in the state

          • endingNaija

oh oh oh Chima, I SEE you! That your accord is UNKNOWN to the Nigerian constitution. Please show me where that accord is written. Second parties DO NOT elect speaker. Members of the house of rep elect their speakers. Third, BOTTOMLINE is that Ume Ezeoke was a speaker under Nigerian constitution and he came from a minority party in the house. These are what are know to the Nigerian law and not your hallucinations and emotions!

          • Chima

Oh sorry I responded to your comment, I thought it was from an identifiable forum member not knowing it was from one of those generalist without depth. Please pardon me I don’t need insults, it was an oversight. Please if I make this mistake again please ignore. UNTUTOREDNESS is a problem

          • Wähala

I think some people must be banned from thinking, you for sure…
A “pet” is an animal and where humans are concerned, you are classified as lower intelligent creatures. Who asked you to think out loud? For your info, I am the guy who hates kalakas from South Pacific islands where you Aborigines migrated to Nigeria from. Left to me, I would gather you drunks on your canoes and shoo you clowns back to the jungles you escaped from, animals cannot continue to mix-n-mingle with humans. • Wähala

S/He’s a very stoopid Aborigine baztard directing sh*t at a comment I wrote yesterday. Seems whenever that sapele water clears from their heads they jolt into topics they understand nada about. Nnanna, how I wish I can wrap my hands around his neck right now to prove to him how much “Love Thy Neighbor” means from me to them… his ancestors stole my grandfather’s houses in Pitakwa and you’re there preaching love/hate, I choose the “H” word dianyi, no gainsaying it!

          • TAWANDA INCOMMUNICADO

I was born in PH and my family lost 2 developed and 3 undeveloped properties to David Mark’s abandoned property scheme,my late Dad also fought as an infantry officer defending PH till he was captured and imprisoned as POW by federal troops on the day PH fell. If not for the ethnic cleansing of Igbos which followed the war,my whole family would still be living at PH……….But the anger and hate will not solve this issue,if you recall, the north and the SW all contributed to the injustice, let’s move on !!

          • Wähala

            Dianyi,
“move on” without me, hear? ‘Forgive us our sins that we may forgive those who have sinned against us’ is meaningful only when the sinner begs and atones for his sins, not “blanket forgiveness” if you know what that means. I’ve never noticed the chap and for him to make outrageous comment directed at me required resolute response to fend him and other Aborigines off me. Hopefully, he has learnt there’s a grey line in every rapport. The oko-oko deserved a foot deep in his slimy ahss… maka Chukwu!

Tawanda otile, Is mimko the gov of Ondo state still a “honorable” man after he DEFECATED (over the good Ondo state people) from Labor party to your party PDP?

    • Cypo

Comment on the case he instituted against the IGP and stop commenting out of point under discussion. He knew he was not going to win. He knew that he is no longer a member of the House of Reps. He knew is not the Speaker of the House anymore. So, ask yourself a simple question, why did he go to Court in the first place and why did he ask for discontinuation of the Case?

      • Obafemi Mike

You Can pretend not to know that he remains a member of the house until he resigns or his seat is declared vacant and also the speaker until he is impeached by the house. That is the law. Surely you cannot pretend not to know that before him, many from across the parties have decamped and they still retain their seats. Withdrawing the suit against igp is strategic. Cases on the issues are still in court

  • Wähala

Makes sense if he wants to concentrate on his political ambitions without the distractions of court-room drama… and, the attendant costs of going the distance since he could not even afford the EoI form to contest the presidency. On the flip side, he should have let the courts clip the feathers of that yeye IGP so he knows it’s not in his mandate to interpret the Laws of the land… that duty falls within the spheres of the 3rd. arm of Govt. in an ideal democracy, the Judiciary! Let’s just hope every local DPO does not read meaning into this and start taking laws into their hands by seeing themselves as mini-Magistrates of Law & Order… clowns!

    • iCubed

If you have a bugler in your house and you call the Police, instead of coming to arrest the bugler, they should go to the magistrate court to seek a judicial interpretation of the trespass laws of Nigeria since it’s not the Police mandate to interpret laws?
      …Just wondering

  • UOU

This Tambuwal with all the goodwill he has from people, is making mockery of himself. As a lawyer he should have known what the constitution says and demands of him, as speaker. He is proving to be a disturbed mind or over pampered semi rascal by allowing himself to grossly misled, misinformed and mesmerized, the result is very visible now and he may yet be severally bruised by the fight coming up in the Lower House. If he does not take time, disgrace awaits him soon

    • Otile

Well, what else to you expect from the so called APC lawyers. There are lawyers and there are low-asses.

    • Sword of Damocles

@UOU, the Speaker is trained as a lawyer, and if he is worth his salt in his profession, he should have anticipated this action and thus not include the prayer to the Court to grant an injunction overturning the IGP’s withdrawal of the Speaker’s detail, Thus i am of the belief that his court action to day was compelled by extenuating circumstances(not apparent/discernable at the of the filing of the suit). i need the Big minds of PT blog to figure out what has happened. I am happy. “Resistance to tyranny is obedience to God”- Thomas Jefferson, 3rd president of the United States of America.

    • Es3

Why did he withdraw the case??? He should have followed it through and see the result!!! Even at this, he has not escaped the result of his not-well-thought-out action yet!

UOU, You got it right because Tambuwal was pushed by APC to go to court!!! He completely missed the truth that as he declared for Janjaweed APC, that frivolous court cases, lies, deception and actions identifiable with madness are their trade mark?!

A real catch 22. One branch does not want to offend another branch by ruling on a question that deals with that branch, so the other branch is compelled by the branch that doesnt want to offend, to make the question ONLY about the other branch, afterall no one wants to be tyrannized. Is “passing the buck”, while affirming that the other branch’s business is strictly theirs, really bravery?

Do not be fooled by the plots of Northern muslims(fulani) to have their way in this country. What they want is power by all means. The do not mean well for me and you. Buhari said and I quote ‘
“I will continue to show openly and inside me the total commitment
to the Sharia movement that is sweeping all over Nigeria,”
‘God willing, we will not stop the agitation for the total implementation of the Sharia in the country,”
Jonathan is a weak president but he is better than people(fulani) with genocidal mindset. I want Nigeria to progress and have a strong president but we cannot just afford to put power in the hands of this wicked and intolerant fulani people. They are not even Nigerians. they are nomads that migrated from Sudan and so, they dont care if the country collapses.

We need to be very careful about the way we tackle the leadership problem in this country. The grand plan of this fulani people is to impose their will on us. Check out our constitution-sharia is already part of it. Check out our naira currency- Islamic inscription is already there. They said they will make the country ungovernable and they are succeeding. The have said they want an islamic country, If we dont resist it by every means possible they will have their way, and we loose in the long run. They were the ones that craeted the problems we are facing now. They have led the country as head of state for more than 30 years out of the over 50 years of existence of the country. They discourage western education for their subjects in their region because they feel it could lead to the encroachment of Christianity in their land. They are that wicked. Let us be wise or else………

Imagine! Oshiomhole to be a second fiddle to Tambuwawa? Wonderful. So, you will introduce Tambuwawa as President of Nigeria and with the same mouth, you go come introduce Comrade Oshiomhole as his Vice President. Wonders shall never end. Since when did sons begin to beget their Father? So you set up a university committee of which the Vice Chancellor is a member and you go ahead and make a sophomore the committee chairman. If dementia…and underscores the extent to which people can reason when obsessed with trepidation becos of threat of blood of Baboons & Dogs on the streets, thus acting and making misguided statements or suggestions as this, out of bizarre cowardice. Tambuwal just showed maturity in politics; a gentleman at its peak. Please tell them further that its not by aides but by leadership. The huge difference between a progressive and conservative.

    Change we need!

Why withdraw the suit, shey be him be Lawyer, a bi him dey sleep when him filed the case? The constitution is clear, an elected member of the legislature both national and state, loses his seat if he or she defects to another party other than the party that provided him the platform to contest, before his term expires. Tambuwal ceases being a member of the parliament.

If he is a truly leader he would have worked to rebuild PDP and to sabotage them as a member or else, he would have been man enough to resign as speaker and move on with his mistress APC in honour to Nigeria constitution

I have a question for you as a member of the campaign team of president Jonathan. This is the question: Mimiko , governor of Ondo state “DEFECATED” FROM LABOR PARTY TO PDP-RIGHT? Question: Is Mimiko still a “honorable” and “faithful” human being after he “DEFECATED” (ON THE GOOD ONDO STATE PEOPLE) on his(mimiko) way from Labor party to your PDP -mimiko’s new husband?-Just a question.

      • Johnson

Sir…look at the constitution, it clearly stated members of house of representatives NOT Governor. Or please show me in the constitution where it was mentioned that elected governors that change party should resign. I will be most happy to learn Sir.

        • Johnson

Just to clarify that I am not a member of PDP or any party, I am a concerned Nigeria.

          • Tunji Olarewaju

If truly you’re just a concerned Nigerian,it’ll bother you that we’re talking about the withdrawal of the security operatives of the Speaker of the NIGERIAN House of Representatives. If such could be done to him, doesn’t it bother you that God help the common folk?
If really it’s the NIGERIAN police, they should not be dragged into political squabbles for God’s sake!Or don’t you think so?

Johnson, it does not matter if you are not a card carrying member of PDP. What matters is that your position is the same as the position of the duplicitous characters, and opportunists in PDP. Now let me address your question in very simple matter. You rested the issue of Tambuwal on your skewed notion of ” adultery” when your party the PDP is an exteremly idolatorous and adulterous party. If the notion of adultery rests on being faithful, can you please tell me if Mimiko was being “faithful” and not being adulterous when he DEFECATED on the good people of Ondo state when he “DEFECATED” FROM LABOR PARTY TO PDP? I think that is the issue you raised hence my question. See Mr. Johnson? You may actually be accused of being highly adulterous for your DOUBLE standard. That explains why I said you and your party PDP are morally duplicitous on this issue and therefore dubious.
