House of Representatives cannot reconvene abruptly without Tambuwal’s permission – Spokesperson

The House of Representatives, which s currently on recess, cannot cut short its recess without the express approval of its speaker, Aminu Tambuwal, a spokesperson has said.

Zakari Mohammed, the spokesperson of the House, stated this in an email to journalists on Sunday evening.

PREMIUM TIMES and other media had reported moves by loyalists of President Goodluck Jonathan and the ruling Peoples Democratic Party, PDP, to reconvene the House before its scheduled resumption date of December 3.

The early resumption being proposed is believed to be to ensure Mr. Tambuwal is removed as Speaker by a PDP-majority House.

Mr. Tambuwal recently defected from the PDP to the opposition All Progressives Congress, APC. His security details have since been controversially withdrawn.

In his statement, Mr. Mohammed clarified the legal procedure to reconvene the House before December 3.

The House of Representatives adjourned sitting of its plenary on 28th of October to 3rd December 2014 to allow members of the House carry out pre Pre- Budget oversight activities in preparation for the 2015 Budget and also to meet the political calendar of all the political parties.

This adjournment was unanimously approved by all the Principal Officers of the House without dissent and the motion was moved by Mulikat- Adeola Akande, the Majority Leader .The Speaker, Aminu Waziri Tambuwal, CFR, approved with the Gavel.

There has been intense media focus on this adjournment and media inquiries on the appropriate procedure for re- convening of the House of Representatives from its Recess, if it becomes necessary. The following clarification has become imperative.

The procedure for reconvening or Re-Assembly of the House is contained in the House Standing Orders made pursuant to Section 60 of the 1999 Constitution of the Federal Republic of Nigeria, which empowers the House to regulate its own procedure, including the procedure for Summoning and Recess of the House.

Order V , Rule 18(2) of the Standing Orders of the House of Representatives provides as follows;

“ Whenever the House stands adjourned either to a date fixed by Resolution or the Rules of the House, and it is represented by the Leaders of the Political Parties in the House to the Speaker that the public interest requires that the House should meet on an earlier or a later date or time than that on which it stands adjourned, the Speaker MAY give notice accordingly, and the House shall meet on the date and at the time stated in the notice.”

This means that the Leaders of all the political parties in the House especially the Majority and Minority Leaders respectively MUST consent before the representation is made to the Speaker who has a discretion to agree or not.

    For those who are faulting the police action, I have questions. Whose duty is it to implement the laws of the land? Is not the Police and other law-enforcement agencies? When did the Police need to obtain a court verdict before doing their job? Is not for the persons involved to go to court and seek redress if they feel the Police have done their job
    unconstitutionally?

    In the absence of any other person to get Tambuwal to obey the Constitution, who else, if not the Police, should enforce the law? In Edo State, four members of the House moved from APC to PDP. The Speaker of the House of Assembly simply did the right thing by declaring their seats vacant, while they went to court to seek redress. That is the correct and democratic order of things in a society under the rule of law.

    Tambuwal and all members of the Senate and House of Reps who crossed from one party to the other in the past one
    year must vacate their seats pending court verdicts. Failure to do so amounts to a rape of the constitution. The Police must protect the constitution from these political rapists.”

      Pure and unadulterated balderdash!

      The House is on recess for pre-budget oversight activities! Not on holiday at the instance of Tambuwal. The motion for the recess was moved by Ms. Akande, as the majority leader and all parties assented to it before Mr. Tambuwal banged his gavel to seal it. If you must argue, at least understand the res of the matter first, not wade in with one eye shut tightly.

      As to your non sequitur on the role of the police, it remains nothing but a piece of jaundiced and myopic opinion. The role of the police is to enforce law; not to interpret it!

    Reports just coming in from Abuja inform that the Speaker of
    Nigeria’s House of Representatives, Alhaji Aminu Tambuwal has got a new
    security detail after the policemen protecting him was withdrawn by the Presidency last week.

    According to a news report aired by TV Continental in Lagos on
    Sunday, 2 November, 2014, about 60 members of the Oodua Peoples
    Congress, OPC, are now protecting Tambuwal in Abuja.

    The OPC is a Yoruba nationalist organisation situated in western Nigeria.

    Though details of this development are still being expected, it was
    gathered that the OPC members now follow Tambuwal to all his
    destinations.

    The House of Reps is presently on recess till 3 December.

    Speaker Tambuwal had described the removal of his security detail by the Inspector General of Police as a a ploy to bring harm to his person.Advertisement

    The lawmaker had few days ago dragged the the Inspector General of Police, Suleiman Abba to court for removing his security details.

    Tambuwal was said to have stormed the Federal High Court in Abuja
    along with his lawyers and members of the House at about 12:40 p.m on
    Friday to file a suit challenging the withdrawal of his security
    details.

    Tambuwal had on Tuesday, October 28, formally announced his defection from the PDP to the APC,shocking his colleagues.

    According to report, the PDP is planning a shocker for Tambuwal as he may be barred from entering his office.

    A top Presidency source explained that the decision to strip Tambuwal
    of all the rights and privileges was taken based on legal submission.
