Restore Tambuwal’s security now, NBA tells Nigeria Police chief

Aminu Tambuwal

The Nigeria Bar Association, NBA, has called on the Acting Inspector General of Police, Suleiman Abba, to immediately restore police escort and security detail to the Speaker of the House of Representatives, Aminu Tambuwal.

Two days after Mr. Tambuwal defected from Nigeria’s ruling Peoples Democratic Party, PDP, to the All Progressives Congress, APC, the Nigeria Police withdrew his security details.

The Police spokesperson, Emmanuel Ojukwu, had confirmed PREMIUM TIMES’ earlier report that Mr. Tambuwal was stripped of state protection because he decamped from the ruling PDP.

In a statement, Mr. Ojukwu said, “In view of the recent defection by the Right Honourable Aminu Waziri Tambuwal, CFR, the Speaker of the House of Representatives of the Federal Republic of Nigeria, from the People Democratic Party, PDP, to the All Progressive Congress, APC, and having regard to the clear provision of section 68(1)(g) of the 1999 Constitution of the Federal Republic of Nigeria as amended, the Nigeria Police Force, NPF, has redeployed its personnel attached to his office.”

But the NBA in a statement signed by its National President, Augustine Alegeh, strongly condemned the police for striping Mr. Tambuwal of his escort and security detail. The association said the Nigeria Police is not a court of law and therefore, lacked the competence to determine whether or not Mr. Tambuwal violated the provisions of the 1999 Constitution.

The lawyers’ body said that only the court has the exclusive reserve to determine whether Mr. Tambuwal violated any law by changing parties.

“The Nigeria Bar Association outrightly condemns this action as it is a breach of the constitutional duty of the police to provide police escort and security detail to the Honourable Speaker of the House of Representatives of the Federal Republic of Nigeria,” the NBA stated.

“The Rt. Honourable Aminu Tambuwal still remains the Speaker of the House of Representatives and he is entitled to the full paraphernalia of his office, including all his police escort and security detail.

“We must state that the mere fact that Rt. Honourable Aminu Tambuwal defected from one party to the other whilst being the Speaker of the House of Representatives, does not automatically strip him of his position as speaker of the House of Representatives and the attendant protection by the police.”

The association insisted that Mr. Tambuwal was not elected by any one political party, but by a majority of members of the House of Representatives.

It, therefore, called on Mr. Abba to restore the escort and security details to Mr. Tambuwal, adding that withdrawing his security aides portends great danger to the nation’s democracy.

“Our democracy must remain firmly rooted on the respect for due process and the rule of law,” the NBA stated.

the Nigerian Bar Assoc. needs to STOP all this “Stalin speak”. Can the Acting Inspector General of Police, Suleiman Abba really restore the Speaker’s detail without instructions from the Presidency(who ordered the detail removed in the first place)? Let them come out and lay the Constitutional breach on the door of the Executive(Co-equal branch of government). If the Executive doesnt want a Rule of Law Democracy, let them come out and state it without batting an eye. The NBA should forcibly speak out against tyranny if it values the Rule of Law. *months ago this same Executive usurped the Law when it suspended the then Head of the CBN(it got away with). Until the last set of service chiefs, the Executive was not even sending military appointees to head the Armed Forces to the NASS to be confirmed. The Executive SPENDS money not allocated by the body tasked by our Constitution to do so. In the country that our Constitution is modeled after, these actions constitute High Crimes & Misdemeanors warranting Impeachment & trial to remove from office. Let us remember the words of Thomas Jefferson, “that resistance to tyranny is obedience to God”

If people I RESPECT, or who had any modicum of HONOR were insulting me, i would be perturbed, but i know that you are brainless so i am PROUD that a so-called human like you is bothered by TRUTH. Any time you feel like using what our Creator gave you(A BRAIN), feel free to engage me if you can.

PDP government is synonymous to impunity! Every well meaning Nigerians needs to do everything possible under the law to ensure that they are voted out of office at all levels of government. Jonathan has consistently abuse the office of the presidency by consistently trampling of the fundamental rights of perceived opponents without recourse to the law. However, needs not remind him and his cohorts, that power is transient, come 2015! Power must change hands! And they shall all pay for their misdeeds.

    • Nuhu

It is either you are insane or you are a paid e-rat of APC. How much does ur State or ur dried and barrenNirthern Region in Sambisa contribute to Nigeria’s economy? You hate GEJ but u love his Niger-Delta free Oil money. Please call for d division of Nigeria so dat ur Buhari and APC can share same territory with Boko Haram.

      • Thecreed

I understand your frustration, the game is closing in on you, and you will soon be out of job. Come 2015! Power must change hands! My advice for you is to start thinking of something meaningful to do with your life, better late than never. A word they say is enough for the wise!

He was in that boat in bayelsa provided by GEJ. That is dividend of democracy. The boat that kills is transformative in Deri’s eye.

  • Cypo

Ohhhh, So NBA has become political and partisan. Chai, God help Nigeria. Why not advise the Police, APC and PDP. Why going ahead to claim that “Tambuwal was not elected under any Party but by majority of the elected members of the House”. Are members of NBA implying that Tambuwal was not sponsored by any Political Party in the 2011 National Assembly election, or that Tambuwal did not win the 2011 National Assembly election under any political party, or that Tambuwal presented himself to the House as an Independent elected member of the House, or that Tambuwal did not contest the Speakership of the House under any Political Party? No wonder justice dispensation in Nigeria is Cash-N-Carry. I am not i´n any way amazed by the NBA position.

    • Omo Akin

You have no clue as to what the learned President of the NBA is saying. If anything, the NBA president is closer to the PDP Governor of Delta State than anyone. It is sad that people like you will insinuate political motivation when anyone or body speaks the truth about the impunity of the Jonathan’s PDP government. When the Police declares the position of the Speaker of the House of Representative vacant, it is the ultimate in arrogation of non-existent power and if the association of lawyers in the country kept quiet, it would have been a shame.
Reasonable people can see that the level of impunity being demonstrated by Jonathan administration can imperil the Nigerian democracy. May be you think that it is impossible for a mass protest to force Jonathan out of Abuja. Read about Burkina Faso.

      • Cypo

Read my comment once more, and read the last 2 paragraphs of NBA statement, maybe and maybe you will understand my position.

        • jos aramide

But Goks has properly explained your misconception to you. No one reading your comments would fail to see the error except you perhaps. “…by any one party” is very different from “…under any party”.

          Just calm down sir.

    • Goks

Hello Mr. Cypo. I believe the position of NBA is very clear and in fact requires no misinterpretation or misconception. The NBA simply said “Mr. Tambuwal was not elected by any one political party, but by a majority of members of the House of Representatives” which to me is ‘common-sensical’. Your statement credited to the NBA that “Tambuwal was not elected under any party but by …” is incorrect and in fact has a different connotation to the NBA’s statement. The NBA never said “Tambuwal was not elected under any party”. The NBA in its wisdom couldn’t have said that because Tambuwal (like any other public officeholder) was elected under (sponsored) by a political party and he became the Speaker by majority vote of the House of Rep. including votes from PDP members. The defection of the Speaker from one party to another does not automatically terminates his status as the Speaker until the Court decides otherwise. If you must know, although the Constitution allows for defection but it has to be done within the constitutional framework. Currently, only the Court is constitutionally empowered to determine whether the Speaker’s defection is proper or not. Until the Court decides, Mr. Abba lacks the power to withdraw the Speaker’s security personnel. QED

Jonathan’s supporters have tried in vain to rewrite history, Nigerians know better, we live in the present, in the moment.

Majority supported Jona in 2011, we took a risk and he let us down woefully. The next election is going to be a referendum on Jona’s performance in the last 4years or should I say last 5 years. Jona failed, he has not been able to take any genuine bold steps (except politicking).

We have passed a vote of no confidence on you Mr Jona… Do the needful that leaders do elsewhere…At this rate of killings and politicking, I can;t afford to wait till 2015 to see a respectable leader start running Nigeria.

Jona;s supporters shy away from listing his achievements but I have helped them to make a list of what we have experienced from Jona:

    Fake Cease fire!
    Stella Odua bullet proof cars
Deziani’s globe trotting on chartered flight
Blew away all the foreign external reserve gains made by Obasanjo govt, now borrowing $1billion to buy Army equipment
Militarization of elections (Osun, Ekiti) while Boko haram continue their rampage
Stomach infrastructure instead of economic and real infrastructure development
Exploitation and deaths during immigration exam/recruitment
Dividing Nigerians along religious and ethnic lines
    Worst electricity generation in years
Initiated problem at Nigerian Governors forum by annulling their election
First lady’s initiated crisis in River state
Dia Ris God ooo embarrassment world wide
Illegal arms deals, seizure of Nigerian money in South Africa and the embarrassment that followed
Total failure in the handling of Boko haram
Jonathan’s visit to Joshua’s Synagogue rather than condemn killings
Jona’s “I don’t give a damn”, “stealing is not corruption”
    Kidnappings continue unabated
Militants like Asari Dokubo are becoming the face of Dumbos govt
Denial of Chibok girls kidnaping and the national embarrassment that followed,; refusing to visit Chobok community despite the calamity!
Pardoned Rogues and convicted thieves like Alamaisegha, Bode George, etc
Wife of Bode George now head of NAFDAC
Honoring Rogues while till today he has not honored doctors and health workers (even those who lost their lives) who saved Nigeria from Ebola
Jona surrounds himself by Rogues in robes, Asari Dokubo and clueless sycophants
SS people are in poverty while Dokubo, Tompolo, Clark are feeding fat on govt contracts and settlements
Until lately, Madam First Lady collected free money as Bayelsa state permanent secretary for a position she never did the work for one day.
Nigeria now rely on Countries like Chad (population less than OYO state) to help us with our security, Jona went on his knees to Chad
where is Gwoza sef? Is’t in Adamawa or Borno?” (Quoting the president days after Gwoza town and barrack were captured by Boko haram
Where is Gwoza sef? Is’t in Adamawa or Borno?” (Jona was quoted days after Gwoza town and barrack were captured by Boko haram)
Using Nigerian police for political and personal vendetta against former CBN governor- Sanusi, and now Speaker Tambulwa
Went to UN General Asse3mbly 2years ago, but was no where to be found (AWOL) when Nigeria was called to address the assembly. Nigerian’s chance to address was skipped without an explanation (He was rumored to be in the toilet or drunk)

    The list is endless.

  • Tom-Lawyer

The Nigerian Bar Association (NBA) shouldn’t take such ignorant stance again.
It is a false and un-educated proposition that only a court of law construes the laws.
All over the world agencies and parastatals interpret laws and apply them as such.
The views of such agencies are often entitled to deference in court on some matters.

  • Olu Ade

    Suleiman Abba Esq.

    Acting Inspector-General of Police,

    Police Headquarters,

    Louis Edet House,

    Abuja, FCT.

Since you were appointed the Acting Inspector-General of Police by the President of the Republic on July 31, 2014 the Nigeria Police Force has been involved in partisan politics to the detriment of law and order in the country. Permit me to draw your attention to three glaring cases of political bias recently displayed by the Police under your leadership.

Firstly, the Osun State governorship election which took place on August 9, 2014 was almost marred by the Police and other security forces which arrested and detained over 700 leaders of the All Progressive Congress (APC). Indeed, some electoral officers who were assumed to be members of the APC were also railroaded to police custody. But for the personal intervention of Professor Attahiru Jega, the Chairman of the Independent National Electoral Commission, the said electoral officers would not have been released. Thus, the election would have been disrupted by the police and other security forces whose duty it was to maintain law and order during the democratic exercise. However, the detained APC leaders who were released after the election have not been charged to court for breaching the provisions of the Electoral Act or any other law whatsoever.

Secondly, Mr. Joseph Mbu, the controversial Assistant Inspector-General of Police in charge of Zone 7 of the Nigeria Poilice Force announced a ban any rally demanding for #‎bringbackourgirls within the federal capital territory. The ban was designed to assuage the feelings of some officials of the Federal Government who are embarrassed by being reminded of their constitutional duty of rescuing the over 200 Chibok girls who were abducted 6 months ago by the nihilist boko haram sect. In a judgment delivered last week, the Federal Capital Territory High Court declared the ban illegal, null and void on the ground that it constituted an infringement of the fundamental rights of the patriotic campaigners to freedom of assembly and expression guaranteed by the Constitution. In spite of the judicial indictment you have not deemed it fit to call Mr. Mbu to order for the reckless abuse of police powers.

Thirdly, you caused the security details of Honourable Aminu Tambuwal, the Speaker of the House of Representatives to be withdrawn last week on the ground that he had decamped from the Peoples Democratic Party (PDP) to the APC. As if that was enough, you decided to usurp the judicial powers of the federation which are exclusively vested in the courts by section 6 of the Constitution when you claimed that the Speaker had lost his office and seat as a federal legislator having contravened section 68 (1) (g) of the Constitution. By your illegal pronouncement you disregarded section section 50 (2) (c) thereof which stipulates that the Speaker of the House of Representatives can only be removed by a resolution passed by votes on not less that two thirds majority of the members of the House.

No doubt, your actions and utterances in the circumstance have exposed the Police to unwarranted ridicule as Nigerians are not unaware of the fact that when the Ondo State legislators elected on the platform of the Labour Party (LP) decamped to the PDP last month your office did not declare their seats vacant. In particular, you did not withdraw the security details of Honourable Jumoke Akindele, the Speaker who led her colleagues to dump the LP for the PDP. In the same vein, Honourable Ahmadu Fintiri, the Speaker of the Adamawa State House of Assembly and his colleagues who decamped from the PDP to the APC and have since returned to PDP. You did not have cause to declare their seats vacant. Neither have you withdrawn the security details of the Honourable Fintiri.

Thus, by subjecting Honourable Aminu Tambuwal to selective persecution on ground that he decamped from the ruling party you violated his fundamental right to freedom from discrimination. As you are no doubt aware, it is a breach of section 42 (1) of the Constitution and Article 2 of the African Charter on Human and Peoples’ Rights to subject any citizen of Nigeria of a political opinion to disabilities, deprivation and restrictions to which other citizens who hold alternative views or opinions are not made subject. Since the security details of other Speakers who decamped from the APC and LP to the PDP have not been withdrawn those of Honourable Tambuwal were illegally withdrawn. They ought to be restored without any further delay.

From the information at my disposal your harassment of the Speaker was instigated by the Presidency. But having regard to section 215 (3) of the Constitution which enjoins you to carry out the “lawful directions” of the President of the Republic with respect to the maintenance and securing of public safety and public order the actions taken on the Speaker are illegal and unconstitutional in every material particular. Therefore, you should withdraw your pronouncement on the office and seat of Honourable Aminu Tambuwal and advise the ruling party to seek redress in the Federal High Court on the constitutional implications of the defection. Furthermore, unless he is removed by his colleagues in the House of Representatives or by a competent court in the land Honourable Tambuwal remains the Speaker of the House. Neither the Police nor any other agency of the Federal Government can be allowed to resort to self help on the matter.

As law and order in the country cannot be maintained by a compromised Police institution you may want to resign your appointment if you are not prepared to discharge your onerous constitutional responsibilities without fear or favour, affection or ill-will. Before making up your mind may I remind you of the eternal injunction of the Supreme Court in the case of Attorney-General of the Federation v Atiku Abubakar (2007) 10 NWLR (pt 1041) 1 at 183. As the undisguised bias of both the INEC and the Police could not be justified over the illegal removal of the Vice-President for decamping from the ruling party to one of the opposition political parties the apex court held inter alia:

“Having regard to the nature of the function which the Nigeria Police Force also performs, that body must also insulate itself such that impartiality and fairness may at all times be ascribed to it. A situation where both of them ( the Inspector-General of Police and the Independent National Electoral Commission INEC) appeal in the instant case is very much in bad taste. They have both thrown the quality of impartiality and fairness which they must possess to the winds. Their acts capable of eroding the public confidence in them. Unknown tob them, they may be said, by the the public, to be biased and therefore not worthy to be regarded as impartial umpires. This trend must not repeat itself for the good of the nation.”

Finally, if the trend of subverting the Constitution, the Police Act and the Electoral Act by your good self and other top police offices continues unabated we shall not hesitate to approach the Federal High Court to determine your competence and suitability to superintend and manage the Nigeria Police Force in the public interest.

    Yours Sincerely,

    Femi Falana SAN ‎

The NBA is on the right side of the law by voicing its opinion against the unconstitutional action of president Ebele Jonathan and his acting I.G.P.Suleman Aba for withdrawing the security details of the speaker of the House of Reps,Honourable Aminu Tambuwal. It was an unconstitutional action as the police IGP or SSS/army can not usurp the constitutional function of the Nigerian court to interprete any portion of the Nigerian constitution. The IGP erred in law by carrying out his boss, president Ebele Jonathan’s directive by withdrawal of the speaker’s security detail.

  • olawale

It’s really bad on our national image and the acting IG of police is so myopic to have acted to that extend. May God safe Nigeria from the hands of this boy-headed Moguls that keeps dragging us back in the face of the world.
