EXCLUSIVE: Linda Ikeji ignored my warnings — Aye Dee, man behind popular blog’s fall, speaks

As the initial shock over Google’s removal of popular news and entertainment site, Linda Ikeji blog, begins to wane, one of those instrumental to the shutdown of the site said Ms. Ikeji ignored his repeated complaints over copyright infringement and plagiarism.

Mukhtar Dan’Iyan, the Editor-in-Chief of US-based The 15 Past Eight Media Group, said he merely spoke up after the blog used his tweets about developments in the war against the Boko Haram insurgency without his permission.

“I spoke up about the unauthorised use of my intellectual property that was taken from my TL (time line),” Mr. Dan’Iyan, who tweets via @MrAyeDee, told PREMIUM TIMES in an interview, Wednesday.

“(I) filed a formal DMCA complaint to Google which hosted her site.

“One complaint is not enough. But safe to assume when Google looked through other examples of unauthorised IP usage and other IP owners filing complaints, it all added up.

“I emailed her (Linda Ikeji) repeatedly. And it was not the first time people had plagiarised my content, but usually, I reach out and they take it down,” Mr. Dan’Iyan added.

A Digital Copyright Millenium Act, DMCA, is an avenue to report content that you would like removed from Google’s services under applicable laws.

According to Mr. Dan’Iyan, Ms. Ikeji had used over 10,000 copyrighted pictures and stories over the past five years without the authorisation of the copyright owners.

Google took down the blog on Wednesday following multiple allegations of copyright infringement.

Ms. Ikeji did not respond to our enquiries Wednesday.

Mr. Dan’Iyan’s accusations and subsequent threats of organising a class action against the popular blogger drew the ire of the numerous fans who accused him of envy and hate.

In her response on Tuesday to the accusations, Ms. Ikeji dismissed the plagiarism allegations and accused Mr. Dan’Iyan of using another name, Emmanuel Efremov, to stalk her, as well as register almost ten of her domain names.

But Mr. Dan’Iyan said Mr. Efremov is one of the directors in his company.

“15Past8.com has owners like any other company. He’s one of them,” Mr. Dan’Iyan said.

“Emmanuel (Efremov) has never tried to sell anything to Linda, nor has he ever demanded any sort of money from her. In fact, I doubt he’s ever had any interaction with here even in passing.”

Efforts to reach Google on Wednesday were not successful.

While the class action against Ms. Ikeji (whose blog is still ranked No. 10 on the Alexa rankings of Top 500 sites in Nigeria) and Google is still gathering momentums, Mr. Dan’Iyan said he had backed out.

“People are sending stuff in, but hopefully, when she bounces back, as I know she will, she will be the paragon of accountability when it comes to using material,” he said.

“In other words, she’ll only use that which she got permission for, this way tempers would cool and lawsuit won’t proceed by aggrieved parties (of which I am no longer one).

“Personally, I want Linda to win and win big. Her story is a huge inspiration to many, and should continue to be, as long as she does things the right way.”

      Registering domain name is normal incase if you don’t know. if you are lucky you make millions out of it. People register a lot of domain names in anticipation that people will need them later. So that they will be sold off with some profit. That is just normal in cyber world.

      This is not readily about envy or the ‘PHD”concept some Nigerians believe in at times. This is about what is morally right and what is not. Copyright and plagiarism are serious issues and should not be seen as hatred or ‘beef’.

    Plagiarism is a serious crime and if Linda is let off with only shutting her blog, she got it easy. Whatever is worth doing is worth doing well and its a crime to use people’s materials without permission or acknowledgement to them. We might take it with kids glove in Nigeria but in the western world you’d get yourself a lot of lawsuits and would have to pay big. Ask people who studied abroad, (i did)even for something as little as course assignment you cannot just write someone’s work like that without reference. We were made to sign an agreement against plagiarism. If google shut her down, She not only did that to Aye Dee. There had to be much more instances. Please leave envy and greed or whatever out of it. What of Aye Dee, in the world of academia, politics and all do you know where his write up might have taken him? Plagiarism is theft. Do you know how much he would also have made? Put yourself in his shoes where someone else is reaping the fruits of your labour. He used his intellects to create a story, that is not easy.
    Linda made a mistake, without knowing I am sure. Its not hating, if he sued do you know how much he would have made of her? Everyone is hustling, but please hustle right. She would get back on her feet no big deal and would learn from her mistakes. With all these bloggers out there I knew it was sooner or later this would happen (did not suspect Linda though). Look up all these blog sites most of them just copy from others and its criminal, you do not know who even owns the story anymore. Others should be careful.
    Good luck to Linda. God bless and uplift her. There is no testimony without a trial. Its just a stepping stone to greater heights.
    P.S I do not know this Aye Dee. Linda I know is a blogger, thats all. There’s no bias to my statement. I am also a full blooded Nigerian chic.

      My reply to you is that plagiarism is not a crime, even though it is a civil offence….There is nothing Linda did that is joltingly offensive, save that some wretched blogger feels that for her to have lifted from him/her, they ought to share in her millions. Yet the same asses heckling her do far worse that she ever did. Linda has won awards for breaking the news, even exclusive to her blog…Pronto, you find Linda’s exclusives being rehashed in all the other blogs as well as mainstream newspapers, and she never crybaby about for credit…And the young woman felt if people do it to my stories and I didn’t make a mountain from it, its all good.         The fact that she doesn’t complain when her ‘exclusives’ are plagiarised and she does not complain does not give her the right to plagiarize other’s job. She should have sued them all and she can still do it if she has records. Plagiarism is an offence and it carries heavy punishments depending on the situation. Many writers have had to withdraw millions of books from circulation thereby causing serious losses to the writers and their publishers.

        I think she even got very easy, some of those guys whose work she has used can sue for compensation. Let’s not mix our love for her with facts.

You can’t say or argue more than you know. In Nigeria, any counter against presumed success is seen as jealousy and evil intention. That is why we are where we are. Although not your usual kind of “crime”, a person who plagiarises is subject to being sued for fraud or copyright infringement if prior creation can be proved on the prosecutor’s side. And depending on jurisdiction, conviction may include jail time, severe fine, or both. Either case does not exempt attempt at legal recovery of financial gains acquired by the infringer (which is directly related to the infringed item), or lost, in which case request for compensation for damages is pushed.

            The word “plagiarism” itself is a bland term, generalized to the extent that it’s lost a clear-cut definition. Think of it as a leading source; a link to the actual crime. The word wasn’t even in the English language until the 16th century.

            Finally, it’s a crying shame to read you end an otherwise good point with something as gibberish as “use plain old Dictionary”. Really? Use plain old dictionary to accurately define a term applied to cybercrime? Plain OLD dictionary in a modern day world? Even a child with a little common sense will laugh at your supposition and try to inform you that constitutions are always changing, and so are their terms and definitions.

          Mr. Frankspeach, the little Law I read in the university taught me that a CRIME (i.e. A VERY SERIOUS OFFENSE AGAINST THE STATE) is different by its nature from CIVIL OFFENSES. “We learn everyday.” That is the constant refrain of lawyers. I would be glad to learn whether PLAGIARISM is a FELONY, or MISDEMEANOR or SIMPLE OFFENSE. I would be glad to learn from you what section of the Criminal Code or Penal Code or EFCC/ICPC Act or FORFEITURE ACT or MONEY LAUNDERING ACT, etc that provides a clause against PLAGIARISM. Please oblige me the ingredients of the said CRIME, and the punishment, which the law provides against accused persons convicted of the CRIME. I would be glad if you refer me to judicial interventions or decided cases tried in the country’s courts in which a person accused of PLAGIARISM was pronounced guilty and the penal measure inflicted on such an offender. I am open to correction if I am wrong in saying PLAGIARISM is a CIVIL OFFENSE for which you can only claim DAMAGES (COMPENSATORY MONEY) if judgment is given in favor of a PLAINTIFF against a DEFENDANT.

    I read through all the comments on this report and i noted with a lot of concern that there was not one single objective reflection on the subject matter. The main focus of comments have been the typical Nigerian mentality of fallacy of begging the question, unecessary and unatural sentimentality. The main crox of the matter is that it was google that took down this website and not this gentleman, and if there were no infringements on the privacy rules of the terms of use that everyone agrees t before they can be registered, google would not have deemed it necessary to take that action. According to the report, this gentleman’s complaint was just one among many other previous ones which were already in google’s view. There are popular legal maxims of ‘ He who comes to equity must come with clean hands’, ‘Equity does not aid a volunteer’ ‘One who seeks equity must do equity’ among others. My point here is that Nigerians are found of always appealing to sentiments and leaving issues hanging. Is it because Linda Ikeji is not a politician? Should she therefore not be held accountable for infringments that she ought to know she should not have committed. Corruption is not only about government and politicians alone, everyone in Nigeria is corrupt in one form or the other and the earlier we start to check ourselves, the better for us as a people.

        It is particularly worrisome that a majority of commentators on this forum are the same higly educated and enlightened people who ought to know the implication of the kind of action google took. Even google themselves hae been sued severally for infringments on privacy laws, hence their zero tollerance for such acts. It appears to me that the problem or Nigerians generally is rooted in the fact that we are used to so much illegalities and lack of a true understanding of the ideal and acceptable ways of doing things that most people have come to accept the wrong as the right and the lines have been totally erased and anyone who goes against the tide by insisting on the rights things being done the right way is attacked,villified and accused of being jealous of the proceeds or success of impunity. Some even go futher to use religion,ethnicity and gender as an excuse to attack. So over time, the do gooders become the bad person simply because he deemed it fit to point out the obvious. Whatever the motive behind the expose, the fact still remains that if such a person did not put themselves in that situation, there wont have been anything to expose in the first instance. I support this again with the popular legal maxim of ‘ volenti non fit injuria’ – “to a willing person, injury is not done”.

      That’s Nigerians for you daddydon. That’s why many of us cannot succeed outside our hometown. That’s why many get deported or even do only blue collar jobs even if they get to step out of the country. I school in a foreign institution and I used to have issues in my first module on plagiarism. Even if it is just the title you copied, copy is copy. And until Nigerians can give objective feedback with ruthless pragmatism, many will not rise above mediocrity as they cannot succeed in environment that do not fawn their non-existing egos and bruised emotions. Quite sad! That’s why we are still crawling at 54. The “Everyone is doing it mentality” the “and what is there” syndrome. It would be a long while especially for the youths of today because if the elderly ones still have this mentality, it’s their children I pity.

        I’m so afraid for the very young ones that are growing up in this environment. It is not only in this instance, this concerns every aspect of living. The children now believe that they cant pass a simple exam if their parents dont pay someone to write it for them or allow them to cheat. When u ask a child to do a little errand, they will come back automatically expecting to be gratified for doing it, and if it involves some amount that requires the child to return the excess, the child automatically believes it is their right to appropriate the ‘change’ as a bribe for doing the errand. Corruption is everywhere and it is seriously condoned. A gateman will only allow is bosses visitos to see his boss if he gets a tip first. otherwise he will lie that oga is not at home. They do this sometimes to the detriment of the oga who is inside expecting the visitor, who may even be someone the oga depends on for help. The help is sent away right from the gate. Examples abound everywere. The question is when are Nigerias going to come hard on themselves to first identify that we have a big problem, then to start to solve it by every individual acting on their on personality to destroy this disease.

          Intellectual property rights are proprietary rights and copyright protects the monetary investment and creativity expended in creating protected works.

          For anyone who has been a student in the UK, for instance, the fear of TURNITIN is the beginning of wisdom in essay/ dissertation writing.

    You may not like my comment but I will make it still. The truth is that we complain of lack of rules and where there are rules, we want to be governed by something else. Rules are rules, she was plagiarizing and Google is a signatory to DMCA and they had to comply. This is not hatred towards her, she flouted the rules and she was punished, simple. If she had been referencing, I don’t think Google or anybody else would have had any reason to complain. Rule are rules and it’s not personal.

    Before some of you fire, I am a true admirer of Linda for what she has achieved but she goofed badly on this one. For those who have schooled in any western country, plagiarism is a serious issue and many careers have crumble as a result.       Linda crossed into the Big leagues and either wasn’t fully aware of the implications or wasn’t prepared for it. This is due to the “low-level entry” phenomena brought about by services like blogspot. As an IT person, i would have laughed off anybody who wanted to create anything serious on blogspot. But She, and others, have made it work!

      The fact that she probably didn’t need a designer, developer, web master, SECURITY, web hosting etc (all provided by google) kept her margins very high and made her rise very fast. I guess that ride might be over and now she has to join everybody else.

          Google’s has a no-tolerance policy (due to their own bouts with plagiarism) this is why it was relatively easy to shut her down.

          It will be harder to “shut her down” when she is self hosting.

      Yes, but the rules should apply to everyone, not just Linda. Why didn’t the so called rules apply within the last 5 years, as the so called Aye guy claims she has been doing it for the past 5 years. it’s simply because she announced how much she is worth when she bought her RR that people decided it was time to bring her down. In Nigeria, living a low life is the best. No one wants you to be better than them, that’s the truth.     I like linda and i have no doubt that she will be back bigger and better (its about time she left the blogspot nest).

    But i would like to say it couldnt have happened to a better person. I know Nigerians who dont even know that the “16 in 1” pirated DVDs they buy is illegal. Unfortunately, we need high profile people like this affected by LAW to teach us lessons.

    The issue of citation and ethical advert practices has always bothered me with her website and several other Nigerian blogs. She uses pictures with no citation, she publishes posts that are OBVIOUSLY ADVERTS and doesn’t declare so, and her excuse is that “Everybody does it”. Hopefully now this will make bloggers sit up.

    That said….meeeehn Linda, that range rover you bought BURNT plenty people oooo LOL…Envy is a disease

    You should know at what stage your business is, as it grows. So many people fail to put up the right structures that would make their business strive at different stages or don’t even know what stage they are in. You can’t continue to put a 5 year old in a baby Court. He’s out grown it. So does Linda. By now she should have gotten a hosted domain, content developers/writers, access to a company lawyer that would guide her works etc. Linda Ikeji’s blog is matured enough for such trials that is why it has come to face it and it is a shame to have found her culpable. Palgarism is an offence and no doubt the credibility of her write ups is already being questioned. Especially that other upcoming bloggers and young people are looking up to her. Please linda, stop wearing undersized clothes, you are bigger than that. Hope you learn to correct all this when you eventually bounce back. I always say is let’s all learn to do things right and we can avoid unnecessary palaver. please note that this is no hating but a constructive criticism from a fan who just picked interest in you bearly a month ago.
