FACT-CHECK: Documents show Kachikwu lied against Buhari, NNPC GMD in $2.89 billion contract claim

The claim by the Minister of State for Petroleum Resources, Ibe Kachikwu, that the Group Managing Director of the Nigerian National Petroleum Corporation, Maikanti Baru, inappropriately awarded contract for the N885 billion Ajaokuta-Kaduna-Kano (AKK) Gas pipeline project is false, an investigation by PREMIUM TIMES has shown.

Also untrue, our findings show, is Mr. Kachikwu’s claim that President Muhammadu Buhari approved the contract after Mr. Baru initiated an inappropriate award process that sidelined him (Mr. Kachikwu) and the NNPC board.

In his controversial August 30, 2017 memo to President Buhari, Mr. Baru had, among other allegations, accused Mr. Baru of flouting due process in the award of the $2.89 billion (about N885 billion at N306.3 to one U.S dollar) AKK contract.

But in a curious move, Mr. Kachikwu, on December 13, presented the same contract to the Federal Executive Council, seeking approval to award it.

When PREMIUM TIMES asked him why he sought approval for a contract he accused the NNPC of inappropriately awarding three months earlier, the minister said his action was meant to correct the irregularity in the initial award process carried out by Mr. Baru.

“What I wrote to the President in my memo, which was presented to FEC, was to remind him that these were some of the contracts he had already approved,” Mr. Kachikwu said .

“What I complained about (in memo to the President) was about due process not being following in the initial approvals obtained without seeking my concurrence or input.

“What I did was an inverse approval process, which is post-the fact, by taking the details of the contract tender back to the NNPC Board, briefed its members and obtained their buy-ins.

“The due process is that before contracts go to FEC, they should go first to the Board of the company, in this case NNPC, to give everyone the opportunity to make their inputs.”

But PREMIUM TIMES can report authoritatively today that Mr. Kachikwu was economical with the truth as far as this particular contract is concerned.

The contract was neither awarded by Mr. Baru nor was it ever approved by Mr. Buhari before that December 13 when the minister presented it before FEC.

In his memo to FEC, sighted by this newspaper, Mr. Kachikwu, contrary to what he told this newspaper, did not indicate anywhere that Mr. Buhari had earlier approved the contract, and that he only sought an “inverse approval process”.

To award a contract of that magnitude, which is being executed on a build and transfer basis through contractor financing model, the NNPC needed to obtain three key certificates from three separate federal agencies to proceed.

They are Due Process Certificate of “No Objection” from the Bureau of Public Procurement (BPP), a Certificate of Authorization from the Nigerian Content Development & Monitoring Board (NCDMB) and Outline Business Case (OBC) Compliance Certificate from the Infrastructure Concession Regulatory Commission (ICRC).

Our findings showed that the BPP Due Process Certificate and the NCDMB Certificate of Authorization Mr. Kachikwu attached to his memo to FEC were only issued on August 31, 2017 and October 6, 2017 respectively, days after the minister petitioned Mr. Buhari. It was only the OBC Compliance Certificate that was issued on July 10, 2017.

Those familiar with contracting procedures in the oil and gas industry said there was no way Mr. Baru could have awarded the contract without presenting those three certificates. Yet, the Minister had written to Mr. Buhari on August 30, accusing the NNPC GMD of wrongdoing.

In its October 9, 2017 response to Mr. Kachikwu’s August 30 complaint to Mr. Buhari, the NNPC had explained that the AKK Gas Pipeline Contract had not been awarded because the procurement process had not been completed.

The state-owned oil company explained that although Certificates from BPP and ICRC had been obtained, that of NCDMB was being awaited after which the contract would be presented to FEC for consideration and approval.

The corporation repeated that explanation on December 14 after Mr. Kachikwu again claimed the contract was long awarded and that he only sought an “inverse approval” from FEC.

The Corporation described as “most unfortunate the continued claim that there was an approval for the contract, which had to be represented to FEC to correct any infringement.

“The AKK pipeline contract tender followed due process,” the NNPC said. “The tender for the contract was considered and endorsed by NNPC Tenders Board NTB on July 12, for consideration by FEC in line with the tendering process that it should present all contracts for approval.

“It was never approved by Mr. President, nor considered by FEC prior to 13th December, 2017.”

CONCLUSION: Mr. Kachikwu’s memo to FEC does not support his claim that the AKK project was long awarded, in breach of due process.

Documents reviewed by this newspaper as well as interviews with those who should know also indicate that the NNPC followed due process in the award of the contract.

They also showed that the contract was never approved by Mr. Buhari before December 13, when the minister presented it before FEC.

    In a democracy punishment follows false declaration under the Public Service Rules of Nigeria.
    Mr. Ibe Kachikwu lacks honour and should be dismissed from cabinet forthwith and before the
    31st of December with a Senate resolution concurrently passed to bar him from public office
    for ten years. That is how democravy works. It is not just about voting, democracy is a system
    of reward and punishment regularly applied to acts and omissions. Voting is only 1% of the
    democratic process. I hereby publicly appeal to Federal Executive Council of Nigeria to do
    the needful and dismiss Ibe Kachikwu with ignominy from government never to return.
    Anyone who tells lies invariably becomes a thief in African culture. Kachikwu must go.

      Bukola Saraki did not read before opening his lousy mouth to utter ignorant nonsense –
      and because I have read the case file I will give kudos to the EFCC for a job well done
      and for maintaining the same standards as over here in the United States of America.

      As at today, according to the case file, Chief Innocent Chukwuma of Innoson Motors.
      is owing GTB bank five (5) billion Naira and has not taken any step to pay the debt down,
      suggesting to the bank in consequence that he intends to deliberately default and make
      away with a whopping five billion Naira. The EFCC is therefore legally authorized to step
      into the breach in such an obvious case of ECONOMIC SABOTAGE.

      If all bank customers took five (5) billion Naira without intention to repay,
      the economy would collapse in 90 days. The case records against Chief Innocent
      Chukwuma of Innoson Motors further suggests something else more egregious.

      Chief Innocent Chukwuma is alleged by Police investigators to have FORGED
      shipping documents and cleared goods at the Nigerian Ports to defeat the
      original bill of lading that GTB bank held as lien on the goods as guarantee
      of some sort.

      The goods were then allegedly sold and the proceeds pocketed by Chief Innocent Chukwuma
      and his co-conspirators without a kobo being paid to GTB bank to liquidate the five billion Naira loan
      that GTB bank granted Chief Innocent Chukwuma to import those goods. What can be more criminal
      than forgery an economic sabotage?

            My very good friend, GT Bank is wrong to have approached EFCC and EFCC was wrong arresting the guy. This is in court, currently at the Supreme court. Not all financial cases are criminal in nature and EFCC needs to make that distinction. You remember a time in Nigeria that if I owe you 20Naira gentlemanly you can just go buy coke for a corporal and he will follow you to my house with his baton and if care is not taken he can break head. Then came democracy and about 2005 when govt sanctioned some police. Now police will tell you to go to court or talk to your lawyer. So also EFCC ought to know what does not fall in.

            here are some: FHC/L/565C/2015; FHC/AWK/CS/139/2012; CA/E/288/2013; FHC/L/CS/603/2006; CA/I/258/2011; SC/694/2014; SC:839/2017 there are many more in betwen but last two are supreme court cases. One of the major issue is the judiciary as you can see some of the cases are 11yrs old.

          Do not embarass yourself. You don’t need to be a lawyer to know that forging shipping documents is financial crime. Owing a bank is civil but forgery or presentation of dud cheques or making false declaration in your shipping document is financial crime.

      I sensed some hint of mischief when the crude lifting pre-qualification exercise was categorized as procurement contract and lumped with JV financing approval to give a sensational amount of $25b. It is not fair, more so that the Minister is an experienced professional in the field. The crude lifting contract is just evaluating and appointing those to buy crude for the year. The price is quoted by platt and you must present International Bank Guarantee to lift crude. While a regional manager, in a marketing organisation, may not have authority to buy a table worth N100k, he can sell products worth millions once price has been given and no credit sales. Sales contracts are different from procurement contracts.

        Frankly I used to take as more reasonable person in this forum but it seems you are sensitive to anyone or any issue that has to be tribe related, why? Now if you notice from my comment I did not mention tribe, or did I? Now as far as records would show this man is doing his best and his records have shown so far, his crime was the leaked memo to Buhari stating his fears, which anyone in his shoes would have done, tribe or no tribe. Since we had the last scarcity till date there has been relatively good supply of the product across Nigeria. That you can also verify. But my reaction to this statement was based on the fact that the leaked memo was somehow taken care of by people blaming one another. If you read widely as I do you would have seen reports of the VC approving, some say Buhari approved on his sick bed, the MD of NNPC saying his is not obliged to report to Kachikwu and all that. We all saw this stories. This newspaper FACT-Check did not verify these documents then….or did they and decided to keep quiet? Now there’s a lingering fuel scarcity, some people are confident in Kachikwu that since all this while we had enjoyed continuous supply of the product. Some of us think he has done well to ensure the products available consistently for so long. When he had an outburst with a reporter the last time there was scarcity it was obvious he was frustrated and things were not working fine and he didnt hesitate to show it. Tinubu criticised him for not being diplomatic about his statements to the press regarding the office he presides over. Hence his apology and stated he is working on it to finding a lasting solution and after that things went well.

        I am drawn to believe that there is motive behind this report….my reason is simply that since the fracas of the leaked memo where he voiced his frustration, the current fuel scarcity has seen a lot people clamouring for a substantive Petroleum Minister. Many want the president to relinquish his powers as a minister to someone who is capable so that he can focus on other areas of governance. Many have also said Kachikwu has done pretty well in that capacity and should be given the chance to continue in his good works. Currently Kachikwu as been reported to have said the fuel crisis would end in 48 hours. This is more than a week on and its worse. Unfortunate the blame did not go to Kachikwu, it went to Buhari (Minister of Petroleum) and the NNPC. Some how it did not target Kachikwu. So now this documents targets Kachikwu specifically. A document which would have been published at the heat of the fracas of the leaked memo suddenly just appears during the fuel scarcity.

        Given the benefit of the doubt this online newspaper did not have access to it at that time. Maybe its a coincidence that they stumbled on it or they were just walking home from a hard days work and tripped and fell on the documents. The documents mysteriously just appeared to them on their front desk at the time we have a serious fuel crisis. Am afraid it smells fishy to me. Am not tribal, I have never been. Those who know me will attest to that. Some call me names for not supporting Igbo or IPOB. If you glance through my history you would see my comments. What this story sounds like is a target to paint someone bad. That is how politicians work if they want to discredit a person so that whatever position it may seem he will get will make the powers that be to change their mind. Also it may also discourage some shady deals in NNPC where he becomes the boss. This has nothing to do with tribe. If the documents were correct, it would have been found in the heat of the fracas I assure you that. These things you dont stumble over it. You are handed. If they wanted to discredit Kachikwu this would have come out during the fracas. It didnt because to me it didnt exist then. I can bet you this was produced recently and back-dated to make it look authentic, so as to cause the desired harm.

      He won’t fire him, but not for the reason you stated. Kachikwu helped with the resolution of the militancy in the Niger Delta. As you would have observed, Buhari never allows the negative to define his direct reports, especially when there are positives to draw from the same person.
      The key question is, who do you put there that is unblemished? That is the most difficult challenge we face as a country.

    I JUST WANT TO APPEAL TO EFCC to take a second look at the passport of the journalists working in Premium Times.Something is telling me they are not Nigerians. They may be foreign invaders using Nigerian names to deceive Nigeria. The one that says his name is Dapo Olorunyomi does not look like Nigerian at all, just take a second look at his photo. He may be from Congo Brazzaville (not Kinshasa) and that is why EFCC must help us to uncover the nationality
    in issue.

    We can’t be forced to be reading Congolese newspaper since we are not from Congo, and that is why we are shouting.
    Premium Times has never seen anything wrong in what President Muhamadu Buhari is doing to destroy Nigeria totally.
    Instead Premium Times will be looking for a way to report the news from another angle that Buhari is not at fault at all.

    Mr Ibe Kachikwu’s leaked letter to Buhari in the Nigerian press was discussed at length on this website with some people (including me) demanding that if Ibe Kachikwu’s account were true then Mr. Baru should be sacked.

    I recollect that from a PR standpoint, Mr. Baru had not made matter easy for himself: He never categorically denied awarding the contract, but instead went on to issue a rather egotistic statement about no law and rules requiring him to review or discus contractual matters with either the Minister of State or the NNPC Board, blah blah blah.

    But then I suspected that underlying Mr. Ibe Kachikwu malcontent might well be his suspicion that Mr. Baru was ‘chopping’ alone and behind his back and not sharing (à la Dasuki), hence the leaking of the letter to Buhari over the matter.

    I also recollect in the aforementioned discussion on this website, supporters of Ibe Kachikwu telling us what an upright man Mr. Ibe Kachikwu was;and how he had been education in the USA in some university; and how he is the most intelligent man in the Buhari administration. Well then, will this upright man now resign having been found out to have misrepresented the facts?

    After independent research in NNPC I found out it was also false. Matter of fact Baru had been heading NNPC internal anti corruption unit for over a decade. He’s the oldest serving GM. Dezani even offered him GMD then but he refused & told her he can’t do her bidding.
    Kachikwu is simply angry because before Baru was appointed, He Kachikwu was the Alpha Omega (GMD, Minister of State & Full Minister) all by himself. Buhari had no clue on the personal Deals he was making then.
    So he’s now so angry & mad.
