I will not answer your questions, Nigeria Police chief Idris tells senators

The Inspector General of Police, Ibrahim Idris, on Wednesday told senators investigating various allegations against him that he won’t answer any question as the matter is before the court.

The police boss stated this while appearing before a Senate ad-hoc committee investigating various allegations levelled against him by a senator, Isah Misau.

The police boss said his appearance before the committee was borne out of his respect for the Senate and not to answer questions from the lawmakers.

“I’m represented by a Senior Advocate of Nigeria here, that’s Alex Izyon,” Mr. Idris said.

“I will not make any other comment or answer any question in respect to the allegation (by Mr. Misau) and various civil and criminal cases pending in the law court. More especially, when the senator has already been arraigned in court in respect of these matters.”

PREMIUM TIMES reported how Mr. Misau is currently being prosecuted by the office of the attorney general of the federation for allegedly making false allegations against Mr. Idris.

Speaking further on Wednesday, Mr. Idris said, “I decided to appear before this Senate committee on the allegations out of the high respect I have for the Senate and my penchant for the rule of law.”

Mr. Idris cautioned the Senate against further probe into the matter stating that it contravenes the Senate’s standing order.

“Furthermore, it is expected that the Senate and the committee will refrain from making reference to the issue as it would be against order 41 (7) and 53 (5) of the Senate standing order 2015 as amended.”

Speaking on behalf of the police boss, Mr. Iziyon urged members of the committee to study documents earlier submitted to them by the police chief and abide by the standing order of the Senate.

“I have taken instructions from him (Idris). We’ve gotten the papers filed by the petitioner and we have responded to those allegations to show that we don’t have to hide and I have submitted 15 copies this morning to this honourable committee.

“When you have judicial remedies present and these matters are in court, any reference to it might lead to prejudice. The Senate in their own wisdom have this rule. That is why I am pleading with you to look into your own rule.

The chairman of the committee, Francis Alimikhena, noted that the matter was already before the committee before Mr. Idris approached the court.

“This committee was constituted before you went to court. In other words, the court is even interfering with affairs of this committee,” he said.

He added that the issue the committee is investigating includes virement which is not before any court of law.

The senators resolved to study the documents and re-invite the police chief to appear on another day.

HOW IT STARTED

Trouble started when Mr. Misau accused the police boss of not only diverting money meant for the purchase of Armoured Personnel Carriers, Sports Utility Vehicles and other exotic cars but also receiving bribe to promote officers including filling the force with personnel of his Nupe ethnic tribe.

The senator alleged that police officers paid as much as N2.5 million to get special promotions and postings.

He alleged that the police failed to account for the huge billions generated from providing security for private firms and privileged individuals.

The police chief had parried the allegations and went on to accuse the senator, a former police officer, of deserting the force.

The Police Service Commission, however, cleared the senator of desertion saying his resignation from the police was in order.

    Rather than investigate Misau’s very weighty allegations, Nigeria’s Attorney-General ran to court on behalf of this banjiba IGP knowing that the moment a matter is filed in court, it is the end of the matter because a mere preliminary objection may take 20 years to decide without even touching the substance of the matter. Illiterate certificate forger and perjurer Muhammadu Buhari’s regime is well on its way to being the most corrupt regime in the history of Nigeria.

      Parliament is not a resident of Nigeria, but a global law making institution of government, from where the executive derive its power.
      The big problem in Nigeria, is that most people who claim to be educated are common semi-illiterates. This trash will not happen in the USA Congress, else the President will have to work hard to stay in office.

Misau a senator alledges that the IG among many accusation impregnated a subordinate, married a subordinate, collect millions from Oil companies, collect bribe from subordinate before promotion, gave 2 SUVs to Aisha Buhari etc. This are mere allegations until proof in the court of law.     That a citizen goes to court to make a claim does not automatically oust the jurisdiction of the parliament of the people from undertaking its own independent probe or enquiry. Like in the infamous Senate Rules Book fiasco to indict Saraki and Ekweremadu, the Rules Book is a just a guide based on convention NOT statute nor constitutionally derived, for how any current session decides to run its business.
    So folks, you may proceed with your display of ignorance as you are paid to do but you will soon learn that the Senators are right that no court can bar them from the rightful exercise of their legislative functions and oversight.
    The IGP’s lawyer is just being clever by half and trying to earn his lucrative legal brief from Police funds that Mr. Idris is paying him. Na our money dem dey chop so.

      Have you ever observed that while any judge can summon any senator, the whole national assembly as a whole can’t summon any judge? This should give you an idea of who has the final say according to Nigerian constitution.

      If indeed the Senate is so powerful, they should have not problems rejecting the judiciary-based excuses and continuing with the probe.

        Constitutionally, the senate is also a court.. Mr Idris can only refuse to answer self incriminating questions but can stall senate functions based on his claim that the said case is already being litigated in a court of competent jurisdiction.

        Any court is empowered to summon any citizen including the President to appear before it. Same applies to the subpoena powers of the National Assembly. That a Senator, in certain instances, does not equate to a court ousting the jurisdiction of the legislature in exercising its oversight functions. These are concepts beyond the grasp of the hired guns of the BMC.

        That’s the best I can do for you in my limited time and space for regime apologists and their sundry morons engaged in propaganda.

          This shambolic Senate committee ought to postpone its legislative hearing.
          A criminal matter pending in court of law supersedes a civil case arising for
          legislative hearing. It is impossible to pick an allegation of bribery arising from
          the same criminal case in court as allegation made against the Police chief
          and still say it is not centrally the criminal matter pending in court when, in fact,
          it is an allegation made against the Police Chief by the accused person now
          standing court trial.

          The Senate can pretend or at least try to simulate some sense,
          and sound less illiterate than it does by learning how to think properly. An
          allegation touching on criminal defence is as much a part of a criminal trial
          in court as the offences charged.

          Nigerians are ashamed of the 109 senators they elected at general election because
          the elected Senators look alike, like mimics and dunces, with no exceptional Senator
          amongst them. Of course, a failed state typically looks like this. Reasoning flees the
          Senate chambers for theft and primitive acquisition to fill the space.

    I appreciate all your show of concerns probably out of patriotism but the painful thing is that most of us only rant here on the social media. We need to mobilize against these crooks in authority otherwise, they will continue to live above the law and a common taxi driver is shot in Wuse for failure to pay one tax of the other meanwhile, there are those who stole billions and are being honored and given chieftaincy titles.

    I think this senate invitation was done at the wrong time. If the matter was already in court, there’s no reason for the Senate to invite the IG on the same matter.

    The Senate should have been adequately advised. In the present circumstance, the Police IG made mincemeat of the Senate. That was unfortunate, even if the Police IG had had a case to answer.

    What I fail to understand is why the attorney general should persecute Misau when he made specific allegation about Idris. Why should it be presumed that Misau is telling lies without investigating the individual being accused. A thorough investigation of Idris needs to take place first. The attorney general is demeaning his position by being partisan in any accusation, this is not what the position demands.
    Why is it that Buhari’s appointees are considered above the law while poor ordinary people get ridiculous sentences for petty crimes. These accusations must not be allowed to die and should be visited whenever this government is kicked out of office, however long it takes.
    This is how they turned Jibrin v Dagora’s case on its head without thorough investigation, refused to investigate Buratai’s
    Dubai’s houses, have refused to investigate further the bungled case of sneaking-in Maina.
    In any other country the head of the army would have been long discharged under whose watch Boko Haram manages to replenish their stock by attacking army posts and carting away ammunitions. Why has this never been investigated. This country is run like a family business where the owners do what they like. What a shame.
