Abacha Loot: Nigerian activists demand prosecution of ex-Minister, Okonjo-Iweala

One of Nigeria’s most prominent anti-corruption coalitions, the Civil Society Network Against Corruption (CSNAC), has urged the chairman,Code of Conduct Bureau to immediately prosecute the immediate past Minister of Finance, Ngozi Okonjo-Iweala, for “abuse of office and contravention of institutionalised procedures for public office holders while in office”.

In a petition to the Bureau, signed by its chairman, Olanrewaju Suraju, the coalition criticised the illegal manner the former coordinating minister of the economy allegedly disbursed funds recovered from late Sanni Abacha.

The group also accused the former minister of having misled Nigerians with false information on the utilization of the said fund.

“In the past weeks, Nigerians have been inundated with revelations of how the former National Security Adviser Sambo Dasuki misappropriated the sum of $300million and £5.5 million which was meant for the purchase of arms and ammunition to enable the military combat the insurgency orchestrated by Boko Haram,” Mr. Suraju said.

“Further revelation and reports have also shown that the said funds from the recovered Abacha fund was illegally transferred to the Office of the National Security Adviser by the immediate past Minister of Finance and Coordinating Minister of the Economy, Dr. Ngozi Okonjo-Iweala.”

Arguing that since the said funds were not appropriated by the National Assembly before the transfers were made, the disbursement was illegal and unlawful.

The group continued, “In a letter dated the 20th of January, 2015, which was addressed to former president Goodluck Jonathan, the former finance Minister had sought his approval for the funds to be disbursed to the ONSA for procurement of arms to fight the Boko Haram insurgency.

“However, as the Coordinating Minister of the Economy, it behoves her to ensure that transfer of the said funds was carried out according to established laws and to also ensure that they were properly utilized. She therefore abdicated her responsibility to Dr. Jonathan to demand accounts of the funds from Mr. Dasuki,

“Furthermore at several fora, Dr. Iweala had misled Nigerians with false information on the utilization of proceeds of the recovered Abacha funds by the previous administration.

“She had on several occasions stated that the funds had been spent on road constructions, power generation, schools and other developmental projects across the country.”

CSNAC described Mrs. Okonjo-Iweala’s action as a clear case of abuse of powers and breach of provisions of Code of Conduct for public officers.

It quoted Paragraph 9, Part 1 of the Code of Conduct for Public Officers under the 5th Schedule to the Constitution of the Federal Republic of Nigeria (as amended) provides as saying:

“A public officer shall not do or direct to be done, in abuse of his office, any arbitrary act prejudicial to the rights of any other person knowing that such act is unlawful or contrary to any government policy.”

Mr. Suraju continued, “By transferring funds in clear violation of constitutional provisions, Dr. Iweala has clearly done an act contrary to government policy, thereby breaching the provisions of the Code of Conduct for public officers.

“If she had followed due process in the transfer of the funds by seeking the approval of the National Assembly, the country would have been saved from this huge mess. Thousands of Nigerians have and are still losing their lives and have become displaced in their own country due to the terrorist activities.

“Our gallant soldiers have been made to fight the war without adequate equipments and have been court martial for daring to complain. Yet, all of these happened due to the activities of unpatriotic and corrupt officials who were encouraged by the laxity and abuse of office on the part of the former finance minister.

“CSNAC is therefore by this petition demanding the prosecution of Dr. Okonjo-Iweala for abusing her office as finance minister by illegally transferring the said funds to the Office of the National Security Adviser.

“You will agree with us that public officers need to be made to realize that the powers conferred on them by their offices are not arbitrary and are subject to scrutiny and control at all times. The prosecution of Dr. Iweala will contribute immensely in conveying that message to all public officers.”

It is not clear at the time of this report whether the Code of Conduct Bureau had responded to the group.

A look at the rap sheet of fmr. NSA Sambo Dasuki, should tell discerning minds that accepting/utilizing the Abacha loot is not a part of it thus, no laws were broken. CSNAC should call on the CCB to disclose OBJ’s long disputed tax return papers so Nigerians will know how much the Ota Gorilla is worth; they should call on the EFCC to prosecute Baba Iyabo for using the Obasanjo Foundation for money laundering activities… this yeye Igbo-haters should call for the sacking and prosecution of Mr. Fowler who worked in Lagos and got the salary of a doctorate degree holder while actually being in possession of an honorary PhD he bought from online services. Dr. NOI has moved on to bigger and better things in life, and she is not Nigeria’s problem… Never was, she’s rather the solution to all Nigeria’s immediate problems if President Buhari pushes the right buttons and eexploits her new positions now.

    I saw this Olanrewaju Suraju on Channels TV’s flagship Sunrise programme yesterday morning acting like a child that has misplaced in his favourite toy. His countenance and response when asked about equity on the corruption fight of the current administration shows a man that is insincere and bereft of what corruption is all about. I find it infantile and ludicrous on his part to say that “when another administration comes after the present one, they should probe this government” . In essence, the anti-corruption fight should be focused on the opposition. What a twat!

            However, if you make an illegal u-turn and you run over and kill a child, I think you would agree that the “other people do it” argument can no longer hold. An illegal action has resulted in criminal damage – a person was killed or money was stolen.

Nor can it be argued from an originalism perspective that the constitution writers placed such procedural impediments just for the sake of it. Nigerian domestic originalism suggests that these procedural impediments were created to foster accountability in particular with the nation’s finances.

            Existing precedence suggests a lack of enforcement in the adherence to procedural appropriation provisions, however the absence of enforcement cannot justify an egregious breach of the letter of the provisions, the intent and spirit – financial accountability, behind its inclusion in the constitution.

            In short, the breaches associated with the arms gate affair (GEJ) are particularly egregious breaches of the letter, provision and spirit of the relevant sections of the constitution and are outside the boundaries of the law. Whereas breaches of the letter of appropriation procedures (Buhari) that are within the bounds of the spirit and intent of the constitutional provision of financial accountability remain within the boundaries of the law.

    Former President Goodluck Jonathan reportedly left N13.6 billion loot recovered from former Head of State, late Gen. Sani Abacha in the Nigerian treasury.

    Benue State Governor, Samuel Ortom, stated this to journalists at the end of the National Economic Council (NEC) meeting presided over by Vice President Yemi Osinbajo at the State House, Abuja; THE NATION reports.

There two different issues involved with Abacha’s returned loot – one was returned under Obasanjo which covered in the world bank report that was released to SERAP and the second pert is the one recovered under GEJ of which she showed evidence of authorisation for the transfer to NSA account.

      For accounting of releases. It is not the duty of finance ministry but Auditor Generals office which conducts audits of federal ministries. The greatest problems many Nigerians, including your type make is that you people have reduced governance to one man business where one person is expected to be everywhere and knows what happens in every ministries without asking the questions, why do we have policies and procedures in government.

      The policies are setup to regulate activities of individuals. What I expected people to be asking is, has the auditor General audited the relevant agencies where these revelations are coming from – if yes, did they observe the anomaly and reported same. In addition, did the auditor general lay before the NASS the reports as envisaged by the law.

      Ngoni Okonjo-Iweala should have resigned her appointment from GEJ’s Administration instead of allowing her reputation to be dragged down with the fraudsters in that government. Going by that Memo, she certainly would not do at the World Bank what she did.           Ngozi projected herself as somebody with global standards. As such, she did not belong in that government of fraudsters for fraudsters by fraudsters! As somebody with global standards, even if others do not abide by those standards, she should have operated by those global standards. Ngozi knew fully well the massive fraud going on within GEJ’s government, even though she may not have partaken in them, she simply turned a blind eye; and that memo clearly showed that, in addition to using it to protect herself.       Examining the newspaper’s statement, one can see the critical portions are:

      i) “At the time the compensation was paid, we had no inkling whatsoever under which expen­diture sub-head in the Presidency the fund was sourced and that it was allegedly part of the funds meant for the purchase of arms.”

      Meaning: The recipient of such funds ought to be concerned about the legitimacy of the source. By this, all who recieved from the same source (irrespective of sense of entitlement) are put on notice that The Sun Newspapers have raised the moral bar in the whole matter for the reason below…

      ii) “As a very responsible newspaper organization, which places premium on ethics, individual and corporate integrity, we are certainly embarrassed by the turn of events and the unfortunate insinuation of involvement in the illegal sharing of the nation’s commonwealth and the feasting on the blood of soldiers fighting the war against insurgency.”

      Meaning: If the monies shared under whatever subterfuge was meant to buy equipment for soldiers facing insurgent bullets, then it is blood money for which The Sun Newspapers wants no share in. Clear and succint.

      iii) “We have also given notice to our lawyers to immediately commence the process in court to redress the huge loss suffered through the actions of the military.”

    WHERE IS THE CHANGE IN NIGERIA?

    I just want to say things are getting worse in Nigeria. Power supply is nearing zero,
    as darkness overtakes Nigeria. Cost of living is rising on the back of inflation,
    as employment remains frozen in both private and private sectors. In many
    private companies, especially in real estate, construction and banks,
    retrenchment of workers has increased. Investments on the Stock
    Excjange lost 20% of their value since June this year just as the
    national currency has lost 45% of its exchange value since then.
    I am not sure this is what CHANGE means in real terms as promised
    by the ruling party (APC) but i am sure that past thefts by the regime
    of Goodluck Jonathan can’t account for today’s fall into the abyss.
    Incompetent management of the country today is the first to blame.

        Oil is now 31USD under Buhari not the 100USD-120USD under GEJ
        When oil was 100USD-120USD, Nigeria should have saved money and grew its federal reserves (as most responsible governments did around the world)
        Because Nigeria earns its money from oil it means Nigeria is earning less than a 1/4 what is used to earn. Revenues are VERY LOW.
        Because USD revenues are now low,there is greater demand for USD in the economy than the FGN can meet
        This demand is creating pressure on the USD reserves of the Govt
        The strength/value of the Naira is related by the volume of Nigeria’s USD reserves.

        The CBN has instituted drastic policies to try and reduce the demand for USD because CBN doesnt have as much USD as before to share and because the USD demand is putting pressure on the Naira thereby reducing the value of the Naira

        The importers of petrol we use in Nigeria need USD to buy petrol from abroad since we dont produce any petrol

        Petrol is not manufactured in Nigeria but imported to Nigeria and paid for in USD
        The importers are finding it hard to get USD to import fuel because the banks are more risk averse, this is creating delays in the import process etc

        These are some of the fundamental reasons we have problems with fuel apart from product diversion, unethical practices by marketers etc, etc.

        Frankly, our economy is in trouble. Next year will be tough. Unless we start to diversify our economy, stop importation of luxury goods and goods that can be produces locally, reform land use act, create more intervention funds for agric, push the investors in the power sector to do more etc; 2016 will be just like 2015 ik oil prices remain low.

        The 2016 budget is well structured to stimulate the economy. It will pump money into construction sector because that sector employs huge amounts of people directly/indirectly. We will have conditional transfer of cash to millions of Nigerians who in turn will spend more and this will help businesses sell more etc.

        We must consider facts without bias. Iweala was there and failed. Oil is now 31USD. DId she compel her former boss to save? If he didn’t save why didnt she throw a tantrum publicly so the whole world knew her position? Did she not resign from OBJ govt? Why did she not resign from GEJ govt if she was strongly opposed to his policies?

        ‘Dem Chop All Money Wey Dey Ground’.

The military prolly divulge her frustration with BH on those guys. In sane vein they told u some guys in the East are matching for Biafra, u swiftly remember Biafra civil war, then the news went ahead to inform u how the situation is being handled. Their leader remain in incarceration despite two court orders, and many of his kinsmen killed by the state security that promised to secure them… stopping at those news there, I hope investors will find Nigeria favourable in West Africa to invest “heavily” then 1 dollar will be equal 1 Naira.

Oil price started falling mid to late last year, not designed for Buhari or Nigeria, but due to uncontrolled sources and forces in the arena we, among other oil producing nations have found ourselves in this quagmire, including the big power in the game- Russia. The politics of Oil drop this time at the international level is another case to be discussed for another issue/topic. What we suffer nw is a power game from the West, that’s the sum. Of all the countries in this same quagmire with us, only Nigeria has been so consistent in clashing of teeth and has resulted to drawing global and local sympathy in lieu of drawing a sustainable remedy.

          2. You would have heard about the crisis that errand the exit of Ameachi and his goons in the PDP. Part of which was the issue of SWF. Saving and not saving. We can save ourselves just let’s share this money. Blah blah. Ameachi’s camp didn’t believe in saving for the federation, they wanted everything shared. But the president contrary to your claim here, insisted on saving in the SWF. They fought him to exit, now they’re the same people saving in the SWF under the same management they lapped with many allegations of mismanagement( $500million was given to them to manage of recent, no cry). Those same Governors are now the ones being bail out and still going to be bailed out by the fed govt. I ask you sir, where did the first bail out fund came from some weeks after Buhari took over? The break down showed some money were withdrawn from the NLNG account, some from the CBN, blah blah blah… who saved those ones? Remember the presidential fleet is still very much active, where did they get the money to maintain those 10 jets in weeks they resumed office to be flown around the world? I even want to believe the money spent on feeding in Aso Rock b4 d govt took off was taken from Buari’s one million Naira, sorry, 30 million Naira with Access bank… to make this argument short, the contract signed with remital was for what purpose exactly sir if that govt had squandered the nation’s treasury? A company got 1% on a transaction and it’s said to have made nothing less than #2.5billion at a go, still not all the monies have been recovered to the single treasury account by the company when their shenanigan deal was exposed. How much could we have been talking about here? Still d govt met empty treasury. Don’t you think to kill PDP outrightly and make it a snake not be met in the farm but killed by a strong rod, the Buhari administration should provide us the handing over note of that administration? Dogara made this call recently, several others did in the past including members of that cabinet, even their Boss, GEJ, but all to deaf ears. What could have exterminated PDP and GEJ more than producing us with facts and files relating to their vague and mendacious claims? Also sir, when Buhari said they met empty treasury, why don’t you ask sir, that, Mr. President how much was actually met? Is it really empty or he meant it literarily? If literarily, how much then was saved? If virtually empty practically, how did the govt ran it’s affairs before getting hold of herself( remember we’ve only been spending for 7months going no single production or production path; forget oil now). Just ask him to make public the hand over note given to them, we want to laugh their tomfoolery and cluelessness, at least as they made us belief. In that document we’ll all know how much was left in all govt covers from ministry of Pet. to Customs. There is no secrecy in knowing our collective worth and standing.
          Note: with the height and system of campaign for this last elections, do you expect the APC to tell Nigerians they actually met some huge amount of money in the treasury? Do you intend they tell Nigerians the actual ground they met, so as to lay off their many erroneous statements that misled the people during and after campaigns and show their true persons as conmen? Like I said in one of my replies here most of these allegations are coming out to be mendacious, outrageous and figments of their wicked imaginations ( El’Rufai, Oshiomole, APC most voracious zombies claims, how many of them av been found to be true? Buhari is heading the petroleum ministry now for over 7months, the same ministry Maduekwe headed, I don’t know if by Next year he would have gathered his facts against the woman for prosecution or public conviction as we’re witnessing of others now.

      @Debekeme, some of us choose to defend this woman because we know the truth and not for anything else. When you make ignorant comments like you have done above them we know something is amiss. First of all, in what way did she act inappropriately? Let’s reason objectively and not like a cow herd! The whole country was raging, bombings were happening everywhere, Chibok girls were supposedly kidnapped and APC and the fake campaigner Oby was making threats daily. CNN was covering this daily! They were saying elections may not hold because of BH. Jonathan formed a committee and determined money was needed urgently so that no one will say he is stalling so that elections wouldn’t hold. The committee directed her to release money urgently for this. So in your opinion she should have refused? Let us not reason from our behind!

      This issue is simple Olu. Just wait for her to be arrested and prosecuted. If that happens, she can’t defend herself then you can start this epistle we’ve all been lamenting since the independence of this country.     Oh dear! But none of the reports making the rounds have ever said Dr Okonjo Iweala stole a dime? She only appropriated funds based on orders. Now if those who were supposed to make judicious use of these money decides to allow themselves to be run by the devil like Dasuki turned out how in hell should that be her fault?
