U.S. likely to sanction Patience Jonathan, Orubebe, others over election incitement, rigging

The United States government appears set to sanction Nigeria’s ​first lady, Patience Jonathan, a former Niger Delta minister, Godsday Orubebe, ​and ​the ​governor of Katsina State, Ibrahim Shema, and other Nigerians accused of either disrupting the just concluded elections, or instigating violence.

The U.S. said Monday that it will impose visa restrictions on any Nigerian found to have incited violence or interfered with the electoral process.

The U.S. Assistant Secretary of State for African Affairs, Linda Thomas-Greenfield, said in a​ statement that the U.S. will shut its doors on people involved in any form of violence during the polls.

“Anyone found to have incited violence or interfered with electoral processes will be unwelcome in the United States and subject to visa sanctions,” Ms. Thomas-Greenfield said.

Although Ms. Thomas-Greenfield did not give names of those considered for sanctions, Mr. Orubebe, appears one of the most likely targets.

The former minister openly disrupted the process of collation of the presidential election results in Abuja on March 31, as the event was broadcast live by the international media.

Accusing the head of the Independent National Electoral Commission, Attahiru Jega, of bias, Mr. Orubebe for several minutes asked Mr. Jega to stand down before the process could continue.

The former minister received worldwide condemnation for his actions, and later apologised.

Mrs. Jonathan had said at the ​ruling ​Peoples Democratic Party Women Campaign in Calabar, Cross River State, early March, that anyone chanting change should be stoned.

“I’m telling you, anyone that comes and tell you change, stone that person,” she said. “What you did not do 19 kilikili, is now that age has caught up with you, you want to come and change? You can’t change rather you will turn back to a baby. You will turn back to a baby. From old age nothing, so nothing like change. Rather (it) is continuity.”

The sanctions may also target Mr. Shema of Katsina state, who was caught on tape prodding his supporters to attack and kill opposition members and their supporters. He described members of the opposition as “cockroaches”.

The deputy governor of Rivers State, Tele Ikuru, had also during a campaign rally in the state, called on
​​the ​people to fight and redeem the state from the All Progressives Congress, APC, even if it means shedding their blood.

“It is necessary for the sake of your fathers, for the sake of your mothers, for the sake of your brothers and sisters and for the sake of your children. Every Rivers man must stand up to fight this evil among us,” Mr. Ikuru said. “If it demands your blood, so be it.”

Also, in January, the Kaduna State governor, Mukhtar Yero, was caught on tape threatening violence against the APC.

Mr. Yero vowed swift “revenge” if ever attacked by any one “born of woman”.

The U.S. may also target the former militant leaders in the Niger Delta who threatened war if President Goodluck Jonathan lost the elections.

The ex-militant leaders, among them, Mujahid Dokubo-Asari, leader, Niger Delta Peoples Volunteer Force; Victor Ben Ebikabowei, aka, Boy Loaf; and Government Ekpudomenowei, aka, Tompolo, made the threat in January.

Several other politicians may also be sanctioned after investigations into dozens of election-related violence are completed.

Ms. Thomas-Greenfield said, while the elections were generally without a significant scale of violence, and irregularities in some parts of Nigeria, some people were resolved to undermine the will of Nigerians and interfere with electoral processes, resorting to violence and voter intimidation.

She said the U.S. regretted any loss of life and property during the process, adding that violence and rigging was unacceptable in a democratic electoral process.

She commended the Independent National Electoral Commission and its chair, Attahiru Jega. She also encouraged Nigeria and other nations to continue to explore the use of relevant technologies in future elections.

She said, “Despite some technical glitches, it is clear that technology and use of social media-INEC’s online posting of results for each polling unit, live tweeting of results, the use of biometric permanent voter cards and electronic card readers- improved efficiency and limited fraud.”

The US President, Barack Obama, had before Nigeria’s general elections said successful elections and democratic progress will help Nigeria meet the urgent challenges Nigerians face today.

Ms. Thomas-Greenfield said, “Now more than ever, it is up to all Nigerians to stay united so that Nigeria can move forward with a clear set of priorities for the future”.

She said the U.S. welcomed all commitments made by the outgoing and the incoming presidents towards a peaceful transition process.

“This next phase is critical as the world continues its hopeful watch for what happens in Nigeria,” she said.
She said the conclusion of a peaceful electoral process in Nigeria will serve as an example to other nation preparing for elections.

She said, “Nigerian democracy will be a beacon across the continent and beyond”.

Ms. Thomas-Greenfield said the US looked forward to the inauguration of the president elect, Muhammadu Buhari, on May 29 and the beginning of a new chapter of the relationship between the two countries.

    LAST Sunday’s visit of the United States Ambassador to Nigeria to the International Conference Centre, in Abuja, where the collation of results for the 2015 Presidential election was taking place, was a brazen breach of diplomatic protocol. It was a visit that should be condemned for what it represents: an undue interference in a sensitive and important internal affair of this country.

    James Entwistle, while at the ICC, was quoted as saying that the Permanent Voter Card employed in Nigeria’s 2015 elections, by the Independent National Electoral Commission, was of higher technological value than the one in use in his home state of Virginia in the US. “I think we need to come and study it so that we can use it in my country,” he said. Although seemingly well-intentioned and commendable on its face value, that statement, to say the least, was also patronising.

    While it is sometimes permissible, and indeed acceptable, to prod a reluctant country into taking actions perceived to be beneficial to the country, there should be a time to draw the line, especially on matters that have to do with the internal affairs of a sovereign state. If there are international rules and conventions governing conduct among nation states, such should be respected and applied in all circumstances. Policy options, especially on the choice of a political, economic, social and cultural system, and the formulation of foreign policy, fall into the category of matters which each state is permitted, by the principle of State sovereignty, to decide freely. It will be unimaginable for the Nigerian ambassador in the US to behave in a similar manner during an election in his host country.

    This brings to mind the ongoing spat between the White House and the Israeli Prime Minister, Benjamin Netanyahu, following the latter’s recent visit to the US, on the invitation of the Congress. The visit was termed to be too close to the last Israeli election, and would be taken for an endorsement of Netanyahu by the American government, thus conferring an undue advantage on him over other candidates. For this reason, the American President, Barack Obama, had refused to accord him the courtesy of an official welcome

    Every country has a right to decide whom it admits and whom it does not admit into its shores. USA has decided that certain persons who have exhibited certain behaviours would not be welcome. You do not have to visit the United States, but if you do want to, that country requires certain standards of conduct. If it upsets you, either stay away or learn to comply – period. There are also individuals from some other countries who, because of their behaviours in their country, are not admitted into the USA! Nothing to do with your sovereignty!

          I quite understand every bit of your position. However there are very strong differences: (1) when you call them to come, it is an invitation. (2) When they tell us how to avoid a situation, it can only be an advice at best BUT when the US Ambassador goes to the collation centre, where some Nigerian election results are being tallied and announced, it becomes an interference no different from what Orubebe did, and one must out of concern wonder at what an American Ambassador’s business is with our domestic elections and processes. I find Mr Ambassador’s conduct if true, to be highly unusual and wanting in diplomatic protocol.

            I do not believe that the ambassador of a foreign country entered the collation center without invitation. We invited him to witness what we were doing. If you invite someone to witness what you are doing, it must be that you expect that person to have an opinion. That opinion may or may not be favourable to you, but it is his opinion. If it is not favourable and you now say it is “interference” then you are being dishonest. There is absolutely no comparison between the ambassador and Orubebe. As I said, the ambassador could not have crashed his way into that centre. Neither did the ambassador make any statement at the centre to interfere with the process. The elections are over and the ambassador has expressed an opinion, and you call that interference?

            But by the way, how do you know we invited him? Where has it been said that we did? You seem to be very sure that we did, can you tell me when we did?

            Both local and international observers are accredited for observation purposes, the US Ambassador is not. The FGN cannot invite him because that would amount to interfering with the duties of an independent body. It is only INEC that has the power to invite the US Ambassador but why would they single out only the US Ambassador for invitation and on what grounds?

            Would you then agree that if indeed the US Ambassador crashed into that collation centre uninvited that his conduct would be no different from Orubebe’s? Yes, if the Ambassador crashed into the collation centre and made his opinion known based on that unlawful conduct and presence, it becomes interference.

            I agree that if the Ambassador crashed into the collation centre without being invited, that would be an interference. I think it extremely unlikely that he did – those people are far more disciplined than us. But if he did, I would like to know what our Security agents were doing. There were Nigerian Security personnel who should have allowed into that centre only those that had been approved. The fact that the Ambassador was allowed in is, in my view, an indication that he was welcome there. There was no report of any scuffle or even altercation about his entering the venue.

            My friend, United States does not need to invite foreign observers to its elections because the people believe in the transparency of that system. There are occasional irregularities there, but not enough to doubt who won a presidential election. It is us, Nigeria, that are trying to convince the world that we have come of age, and we do this by inviting outsiders to come see what we are doing. Whether we like it or not, we are the people trying to prove our own credibility to the world, and we should let the world say what they think of their observation. Arrogant patriotism would not get us far.

            Quite frankly, I do agree with you that it is probably unlikely that the Ambassador did crash into INEC’s collation centre, but then I can only speculate. However, America has been known to bully its way into situations like this, especially where developing nations are concerned. When you say he must have been welcome there, the question arises by who? If it was INEC, then why? Why would Jega give the Ambassador exceptional clearance and what was it meant to achieve?

            Whoever said observers are not involved with American elections? Florida; George Bush’s reelection bid with brother Jeb as Governor had both local and international observers from Germany and Austria witness that event. It led to the discovery of bloated or pimpled ballot papers. It does not become arrogant patriotism to have foreigners and locals abide by our election rules and guidelines nor does it become same to have them ride roughshod over us because we need to show we have come of age.

            There is no big deal for America to bar whosoever it desires from it shores, its their prerogative and I cannot quarrel with that. What I do quarrel with is the arrogant interference by a foreign entity with the conduct of our internal affairs.

            If INEC chose to invite the US Ambassador to the collation centre, then we should direct our venom to INEC for giving such a privilege to a particular country’s ambassador. And if an Ambassador is indeed invited to the centre, then as I said earlier, we should expect him or her to express an opinion. Yes, USA is a bully. But I not think that what the Ambassador said in this case amounts to bullying. Yes, I know the Florida voting saga and how the true results were perhaps not what were announced. I missed the fact that there were foreign observers there as well – thanks for reminding me. And, did those foreign observers express an opinion? Certainly.

            Overall, I feel that foreign criticisms have helped Nigeria to a large extent. I believe the threats by USA and UK of dragging Jonathan to the ICC if he derailed the elections had a part to play in his eventually conceding defeat. You can say it was “bullying”, but I bet many Nigerians did not mind it! And, if those that called for violence in Nigeria (and that includes traditional rulers) are punished by foreign countries, it can only help Nigeria. We are still struggling with discipline as a nation, and, without sacrificing our sovereignty, we can take on board some external criticism. But when we dismiss constructive external criticism as interference, that is arrogant patriotism.

            Oh, my dearest brother, I agree with you completely… well, almost completely. I don’t think it is healthy to ignore constructive international opinion, no, not at all. However, I think the line must be drawn between that and the complete takeover of our sovereignty by a foreign nation. There must be limits to what a foreign entity can or cannot do within the geographical space of any given nation.

When we allow this to happen, we must also necessarily ask where does this kind of blackmail stop?

            Does it mean every time the US wants something done or some-one imposed as president or for whatever reasons, the threat of ICC should be flung around? Moreover, the ability for the US to dictate who can be dragged to the Hague and sentenced, simply makes the ICC a tool of American foreign policy and imperialism.

            It does not bode well for us that the US can ‘threaten’ a sitting President with the ICC and have him capitulate to their wishes. For me, it amounts to us sacrificing our sovereignty and independence , for whatever it is still worth, to that foreign entity.

            Brother, the issue goes beyond Jonathan being blackmailed. Look at it this way: Look at internal wars that have been caused by leaders sabotaging the will of their people, and how those wars evantually became a problem for the regional and global communities. If by threatening a sitting leader you can stop him from creating crisis in his country, the UN would not be as stretched as it is today. See what the crisis in Ivory Coast cost ECOWAS countries and the global community. Can we really say that fomenting trouble in your country is entirely your internal affair? I think not. Imagine what would have happened if Orubebe’s thugs had harmed Jega and the elections pronounced inconclusive. I assure you, it would have been an exact replay of what happened in between January and July 1966, – and it would have become another UN crisis.

            If you want to call it blackmail, that is fine. But I see it as a gentle threat to help the global community. US and UK threatened Jonathan by saying something like “If by your interference in your country’s electoral process you cause bloodshed, we will drag you to the ICC.” Honestly, I think that was a fair threat, in the interest of the global community – and certainly of Nigeria!

            I do understand the point you are making and agree with quite a good number of them, I don’t fault your idealist convictions but I think I find your optimism a bit turbulent. Your convictions are ideal in a perfect global community where all parties thereto act responsibly, but sadly that does not hold true.

            The Ivorian issue was essentially France acting out to teach its colonial serf a lesson in obedience. And the favorite tool for imposing its choice for leadership was the ICC. America’s quest for global hegemony has paired it in wars against several countries all around our globe. Its global war against terrorism has lent it the excuse for invading any country at will. It has also allowed it to raise proxy armies be them conventional, mercenary or ‘terrorists’ that go in pursuit of terrorists.

            For every nation that has been invaded by America, you will find some vital natural resources beneath its soil or some other vital asset that America seriously covets or does not wish for it to be dealt to another country. It becomes difficult for the discerning to accept that all these wars are borne out of concern for a people rather what the examples of Iraq, Libya, Syria, Afghanistan, Pakistan, Ukraine and the rest of them teaches are that these wars, which have caused serious dislocations to various populations and societies, are borne out of imperialistic virtues and are all wars of conquest.

            To me therefore, America is far from the objective and impartial mediator that some would hope it is and being so, lacks the moral altitude and attitude for imposing its will or decisions on sovereign nations.

            I agree entirely with all the points you made. Particularly, I agree that Western position on issues is not always driven by global interests; quite often, there is an underlining self-interest. Else, why is the US so interested in the Middle East wars but could not care less about DRC?

            However, despite that, we should be able to distill from the blurred US objective what is good for us – even if it eventually benefits the US and/or UK. Today, the US has no interest as such in our oil any more. In fact they buy ZERO oil from us, and I do not believe they are interested in colonising us again. So, when they blackmail Jonathan over a possible ICC appearance should he cause mayhem in Nigeria, I see that blackmail as good for Nigeria. What is there for the US to gain other than to be able to say “that is another stable democracy”? I do not immediately see it. Maybe you do? It is this question I want us to ask each time we are criticised by the western countries – Is there something good for us in it, or is it essentially driven by western self-interest? Unfortunately, we are always too quick to dismiss criticisms as attempts at neo-colonisation.

            Lawyers are telling us that the case in court is not whether or not he is qualified to run
            with his work experience but that he is DISQUALIFIED by the 1999 Constitution for
            submitting false information to INEC. They are two separate issues. Disqualifying offence
            is the case in court, not whether without the disqualifying offence he might be qualified –
            which is now hypothetical question.

    into his Wasc matter. Buhari has a telephone. He could have phoned the
    Army Secretary first, to check if a copy of his Wasc certificate was on Army file,
    before filling out his INEC Form. Buhari did not do that. He could not do so since
    he knew he did not take any WAEC examination and he did not obtain any Wasc.
    It is very bad of anybody to blame the Army for coming out to tell the truth after
    Muhammadu Buhari lied against the Nigerian Army in an affidavit INEC made public.

    What the United States of America needs to know

    The 1999 constitution says nobody must submit false certificate to INEC. Buhari defied the law.
    He submitted FALSE certificate to INEC through declaratory statement verified on oath saying
    he obtained WASC in 1961. That is intentional violation of the 1999 Constitution of Nigeria.
    He must be punished for it under the law of the land. That is what democracy means.

    The 15.4 million people who voted for Buhari (representing 8.65% of Nigeria’s population)
    wasted their votes because everybody is presumed to know the law. Those 15.4m voters
    were told since December 2014 that Buhari has no proof of WASC. The 15.4m people still
    went out in the sun to vote for Buhari – as if they are too illiterate to know the consequence.

    By irresponsibly daring the country’s Constitution, the punishment for their own stupidity is
    nullification of all those 15.4 million votes to make them void. That is what the 1999 Constitution
    says must compulsorily happen next. The United States must support the Constitution of Nigeria.
