“50 Nigerians affected by xenophobic attacks in South Africa”

The Nigerian Union in South Africa has said it has concluded arrangements to resettle 50 Nigerians affected by the ongoing xenophobic attacks.

The President of the union, Ikechukwu Anyene, made this known in an interview with the News Agency of Nigeria (NAN) on phone from Pretoria, South Africa, on Saturday.

Mr. Anyene said the Nigerians were displaced at Jeppes Town, near Johannesburg.

“We met about 300 Nigerians in Jeppes town, near Johannesburg, who fled for their safety and about 50 of them do not have any place to stay.

“We are making arrangements with the Nigerian mission in South Africa to get them a place to stay for their safety.

“The Nigerian union has also presented relief materials to those affected by the attacks and we are in touch with various branch chapters of the union in the provinces on their safety and security,’’ he said.

According to him, Nigerian shops and businesses in Durban and Johannesburg have been looted and some burnt.

He said that two shops belonging to Nigerians in Durban were looted and they lost goods worth 400,000 Rand.

“In Jeppes Town, near Johannesburg, five shops were looted and one burnt while the estimated loss is put at One million Rand.

“The incidents have been reported to the police and we are still taking stock of attacks on Nigerians,’’ he said.

Mr. Anyene reiterated the union’s call to the Federal Government to put more pressure on the South African government to halt the attacks.

The Nigerian foreign minister had however claimed on Thursday that Nigerians had so far not been attacked, saying it would only evacuate Nigerians only if the situation gets worse.

“With the discussions I have been having with Nigeria’s Head of Mission in Pretoria, no Nigeria​n ​has so far been affected,” the Minister of Foreign Affairs, Aminu Wali said Thursday in Abuja.​

​”They informed me that they have called the Nigerian community and addressed them and told them to close their shops, stay home and keep out of trouble and obey the laws of South Africa.

“They have also confirmed that the South African authority has moved in to take actions that would forestall any further disturbance in South Africa,” Mr. Wali said.

Mr. Wali said it will move to evacuate Nigerian citizens if the xenophobic attacks get worse.

“If it gets worse it is the duty of our country to make sure our people are brought back, and we are taking that duty serious.

​”We are not prepared to allow any of our nationals to be subjected to such inhuman treatment.

“We are monitoring the situation and will now take action according to the situation that develops,” he said.
Xenophobia in South Africa dates back to 1994 and are mainly targeted at citizens of other African Countries.

In May 2008 a series of xenophobic attack left 62 people dead.

In the current attack, at least five people have been killed and hundreds forced to flee their homes in one of South Africa’s worst outbreaks of xenophobic violence in years.

    Xenophobia usually has a basis. Being foreign does not trigger it. There are causes.

            Buhari’s 15.4 million voters now groaning

            The 1999 constitution says nobody must submit false certificate to INEC. Buhari defied the law.
            He submitted FALSE certificate to INEC through declaratory statement verified on oath saying
            he obtained WASC in 1961. That is an intentional violation of the 1999 Constitution of Nigeria.
            He must be punished for it.

            The 15.4 million people who voted for Buhari (representing 8.65% of Nigeria’s population)
            wasted their votes because everybody is presumed to know the law. Those 15.4m voters
            were told since December 2014 that Buhari has no proof of WASC. The 15.4m people still
            went out in the sun to vote Buhari, as if they are too illiterate to know the consequence.

            By irresponsibly daring the country’s Constitution, the punishment for their own stupidity is
            nullification of all those 15.4 million votes to make them void. That is what the 1999 Constitution says.

    I never commented on the Buhari certificate case because Nigeria is immune to reason.
    Let the High Court do whatever it likes with the case brought before it on Buhari’s Wasc.
    I will also not comment on the court decision because Nigeria is an utterly amoral country.
    If Buhari is cleared of this charge of falsehood, do publish the WASC he tenders in court.

    Whatever he tenders in court as Wasc will become the legally acceptable Wasc in Nigeria.
    If it is handwritten or freshly signed that will be the new legally acceptable Wasc henceforth.
    All other Wasc certificates, printed and sealed by WAEC, shall thus become null and void
    .

    Buhari’s own Wasc (certificate) will be permanent record in Nigerian history for all times.
    Since WAEC said below it never issued any Wasc (certificate) to Buhari it means there’s
    another secret WAEC institute in in this world which nobody else in the world knows about.
    Please do your readers a favour. Help look for that other secret WAEC for Nigeria’s sake.
    It may just help calm down the xenophobia in South Africa directed at amoral Nigerians.

    I am not a GMB supporter but on this issue he will prevail in a court of law. Let’s do the legal analysis.
    Two Nigerian citizens file a suit in a federal court challenging Buhari’s. affidavit alleging that he lied under oath. They also alleged he did not have the requisite qualification which is WASC before he joined the military.
    The Nigerian constitution governing the issue of eligibility to contest for the presidency says the following: to be eligible for the office of the President, a candidate must attain the age of 35, and complete a secondary school education or its equivalent. Even the most casual of jurists will agree that it is not enough to state that one completed his or her secondary, one has to submit a qualifying document attesting to this fact. The constitution responds to this requirement by stating that a candidate must shows his or her qualification in two ways. (1) submit a document such as WASC or its equivalent to INEC(2) where such a document has been destroyed or lost due to unforeseen circumstance, a sworn affidavit attesting to the ownership of such document is sufficient.
    GMB did not meet the first section of the above stated. He met the second requirement. He swore an oath attesting to the completion of his secondary education, ownership of a WASC. By every legal standard, GMB met the requirements of the law.
    Now comes a law suit stating that GMB lied under oath. What are the merits of the law suit? The standard of review a court will employ under such a circumstance will be that of reasonable person. Will a reasonable person under the circumstance agree with the petitioners/plaintiff, that GMB lied under oath? The answer will always be no. Why?
    (1) The individuals who filed the law suit appear to be way younger than GMB.
    (2) None of them happen to have attended the said school GMB attended in 1960 or thereabouts
    (3) No living person who claimed to have attended the said school in 1960 has come forward to refute GMB’s affidavit.
    (4) No group of persons from the graduating class of 1960, with certified WASC have come forward to state that GMB was not part of the graduating class.
    (5) None of the petitioners graduated from the said school in 1960.
    Under the reasonable persons standard as applied by courts everywhere, the burden is on the petitioners to prove that GMB lied under oath. GMB followed the law by submitting a sworn affidavit. The petitioners cannot carry their burden. They have not submitted to the court any credible document countering GMB’s affidavit; they have not submitted any group of persons with credibility who will counter GMB’s affidavit. Above and beyond there is no smoking gun, such as a letter from the principle of the said school at the time when GMB claimed to be a student stating that GMB was not a student of his, or GMB attended secondary school but did not sit for the WASC.
    The petitioners suit in this case will be analogous to a law suit filed by any Nigerian who is upset that GMB tendered an affidavit rather than a certified copy of his WASC from London. One must have evidence that GMB lied under oath. It is not enough to state that GMB lied, such is a conclusory statement. A conclusory statement must be backed with facts to survive a thorough legal scrutiny. Without facts, one cannot carry his or her burden. Buhari is not required by Nigeria law to retrieve a certified copy of his certificate from the body that conducted the exam and submit same to the Nigerian public. It is up to GMB do so if he so choses. Until the constitution is amended, GMB followed the law.
    On this particular issue he will prevail in a court of law. A court will find that the suit against him has no merit.
