Jonathan lacks powers to deploy troops for elections – Court

President Goodluck Jonathan lacks the power to deploy soldiers for the conduct of election without the approval of the National Assembly, a federal court ruled Monday.

Justice Ibrahim Buba of the Federal High Court in Lagos held that the practice of deploying troops of the Nigerian Armed Forces in the conduct of elections when there is no uprising is “anti-democratic” and not in tandem with civil rule and constitutional democracy.

“The armed forces have no role in elections,” the judge said.

“The time has come for us to establish the culture of democratic rule in the country and to start to do the right thing particularly when it has to do with dealing with the electoral process which is one of the pillars of democracy.

“In spite of the behaviour of the political class, we should by all means try to keep armed personnel and military from being a part and parcel of the electoral process.

“The state is obligated to confine the military to their very demanding assignment, especially in this time of insurgencies by keeping them out of elections. The state is also obligated to ensure that citizens exercise their franchise freely and unmolested.”

Femi Gbajabiamila (APC, Lagos), a member of the House of Representatives, had filed the suit before the court seeking a declaration that deployment of soldiers during elections in illegal and unconstitutional.

Joined as respondents in the suit were Mr. Jonathan; the Chief of Defence Staff; the Chief of Army Staff; the Chief of Air Staff; the Chief of Naval Staff; and the Attorney-General of the Federation.

The deployment of soldiers during previous elections held in Ondo, Anambra, Ekiti, and Osun were contrary to the Nigerian Constitution, Mr. Gbajabiamila’s lawyer, Seni Adio, told the court.

The judge backed the lawyer’s arguments, noting that the president lacks the powers to deploy soldiers any time he wants.

Mr. Buba dismissed the respondents’ arguments that Mr. Gbajabiamila did not have the legal right to institute the suit and that the court lacked jurisdiction to entertain the suit.

He also dismissed their arguments that the soldiers are needed to ensure peaceful polls, noting that the military was not needed for such civil duties.

Recently, a Court of Appeal in Abuja barred the use of soldiers in the conduct of elections, stating that it was a violation of Section 217(2)(c) of the Constitution and Section 1 of the Armed Forces Act.

The appellate court had relied on a judgment by a Federal High Court in Sokoto last January also barring the use of armed forces in the conduct of elections.

Mr. Buba said that he was bound by the appellate court’s decision and quoted copiously from its ruling.

The judge said that the law does not make provision for the military to be involved in civil activities, and if soldiers must vote, it must be in their barracks.

He also said the appellate court directly interpreted the Constitution when it held that Sections 215 and 217 jointly limit the president’s power to deploy soldiers to the suppression of insurrection and to aid the police to restore order when it has broken down.

“I am bound by the decision of the Court of Appeal and equally persuaded by the decision of Federal High Court, Sokoto, which also persuaded the Court of Appeal.

“It is in this regard that the court will say that its duty in interpreting the constitution has been simplified and made easy by the decisions I have referred to extensively.”

Assuming he sends only two soldiers to support other security forces, the question becomes: ‘How many polling units are being used for this elections, and how many soldiers are in the Nigerian Army?’…obviously, we don’t have the manpower in the Army to man this elections. Therefore, the APC must be believed for accusing the Dumbo ati PDP of sowing military uniforms to be issued to political thugs to harass or scare away voters by pretending to be soldiers. The only way Dr. Dumbo can impeach me (&APC) is by obeying this court order even though he’s not on record for obeying previous court rulings on the matter. The judge is not saying as a fait accompli that soldiers cannot be deployed during elections but he will have to go through the national assembly and present his case in support of the deployment. Our national assembly is for the most part populated by nonentities who have abdicated their responsibilities as the protector of the constitution.

    JUSTICE IBRAHIM BUBA’S COURT ORDER IS NULL AND VOID

    Justice Buba is wrong on point of law. Section 217(2)(c) of the Constitution that he relied on is irrelevant.
    That section deals with provisioning and funding of the armed forces, not with deployment of the army.
    It is an act of illiteracy to transpose funding requirements into a separate category of deployment directives.
    President Jonathan should disregard this court order as a nullity. The Constitution does not bar Jonathan from
    deciding as Commander-in-Chief on the need to deploy the army to assist police authorities in law and order.
    That power of DEPLOYMENT was not granted to the National Assembly as it would be ultra vires a Parliament.
    President Jonathan is advised to disregard this ignorant court order for the purpose of securing law and order.

      Colonel Mariama, if indeed you were a retired soldier , then you should be an expert in security. In a democratic setting , military troops are not trained to be used in a civil setting. In advanced countries like America , there is an arm of military that is trained to perform civil duties. This is called National Guard.In times of crises or disasters, the troops of National Guard compliment the police. Each state in America has its National Guard and even a whole lot of them were deployed to fight in Afghanistan and other wars being prosecuted by the US.If the President goes ahead to deploy troops during election that could be a ground to nullify such election since the courts already made pronouncements about it.

    Before every election, APC goes to town shouting itself hoarse that the election will be rigged. It brings out all sorts of fictitious documents showing “beyond reasonable doubt” that the PDP, in collusion with the INEC, has perfected outrageous plans to rig the election. Then when it loses, it says “We told you so” and decides to contest the results frivolously in court. Apparently, the only election that is not rigged in Nigeria today is the one that APC wins. At least, we are yet to hear APC say it is going to court to contest the Osun results.

    Even Osinbajo wants security in and around polling areas and one disgruntled judge is spewing trash. We’ll GEJ is commander in chief of armed forces and will do what he likes cos it is his duty to ensure safety of voters and officials. Oshiomhole who congratulated GEJ for deploying the army during Edo election has been as quiet as grave yard because his Lord and master Thiefnubu thinks otherwise.

    (APC seems to forget in a hurry that troops have been deployed in some of the polls that took place recently including those they won. They include the Edo, Anambra, Osun and Ekiti. APC won in Osun and Edo states even when troops were deployed and did not complain. Their complaint over that of Ekiti is not understandable. Election is a game that must be won and lost. There is no point for the loser to be alleging rigging only to adjudge a poll free only if it wins. That is the characteristic of a bad loser. In Nigeria, we have so many bad losers. They are found in almost all the parties. But if someone strongly feels that he was rigged out, definitely, the person has every right to approach the courts for redress. I graduated from that school in 1989 so Aisha could not have graduated in 1989. Since she is 4 years ahead of me she must have graduated in 1984/85. Secondly I was born in 1972, so Aisha could not have been born in 1979 cos from the facts I gave u above she’s older than me. So whatever your political leaning you should be factual and objective in your analysis of people please.

      Youths in the All Progressives Congress (APC), Ekiti State, under the
      aegis of Ekiti APC Youths Congress (EAYC) have demanded explanations
      from leaders of the party over the spending of N25 million allegedly
      released for the production of 250,000 copies of audio and video
      recordings of the details of how the June 21, 2014 governorship
      election was allegedly rigged in favour of Governor Ayodele Fayose.

      Spokesperson of the party, Taiwo Olatubosun had said last week that
      250,000 copies of the audio and video Compact Discs (CDs) were printed
      and distributed.

      However, the APC youths in a release issued in Ado-Ekiti on Monday and
      jointly signed by Mr Tope Ogunkuade and Comrade Tunji Adeleye,
      Convener and Secretary respectively, said: “no single audio or video
      CD was produced.”

      The youths said they have been reliably informed that a sum of N25
      million was collected by Taiwo Olatubosun and three other leaders of
      the party to produce the CDs.

      They said they were alarmed that despite the huge sum of money
      collected, no single CD of the alleged rigging of the election was
      produced contrary to Olatunbosun’s claim that 250,000 copies were
      produced.

    Justice Buba is wrong on point of law. Section 217(2)(c) of the Constitution that he relied on is irrelevant.
    That section deals with provisioning and funding of the armed forces, not with deployment of the army.
    It is an act of illiteracy to transpose funding requirements into a separate category of deployment directives.
    President Jonathan should disregard this court order as a nullity. The Constitution does not bar Jonathan from
    deciding as Commander-in-Chief on the need to deploy the army to assist police authorities in law and order.
    That power of DEPLOYMENT was not granted to the National Assembly as it would be ultra vires a Parliament.
    President Jonathan is advised to disregard this ignorant court order for the purpose of securing law and order.

And such deployment must follow strictly the lay down rules and procedures entrenched in the Constitution. A contrary action is a vagrant violation of the Constitution.

    Any pundit at this critical point in time, who is not conclusively resolved that the Nigerian jinx, where a national ruling party has never lost to the Opposition, is being broken in the 2015 elections, should just go back to school. In the present circumstances, one should be preoccupied with prognostications, scenario extrapolations and anticipation of the shape of things to come post-election. Principal among these should be attempts at appreciating and interpreting the Buhari phenomenon. What are the social, political, developmental and historical auguries of a Buhari leadership of modern Nigeria?

    How did it come to be that one personage has remained the arrowhead of the alternative party, of a shadow government, for 15 unbroken years of Nigeria’s Fourth Republic; pitted unrelentingly in spirited political contention with presidents and candidates of a ruling party for those long years. A character not so much reckoned with deep ideological profundity, with little gift of the garb, eons of distance from the oratorical and propagandist genius of an Azikiwe, or the demagoguery of Biafra’s General Ojukwu, yet commands fanatical, and almost cult-like following.

    A character of modest disposition, who is not known to have plotted or strategized for power; never formed a political party in the like and manner of Action Group of Obafemi Awolowo, NEPU of Aminu Kano, Democratic-Republican Party of Thomas Jefferson, or Lincoln’s Republican Party; never conceived and initiated a national liberation or social rights movement in the image of the African National Congress(ANC) of South Africa, the Fatah of Yasir Arafat, the Irgun of an Avraham Tenohi, Mau-Mau of Jomo Kenyatta, or the Tupac Amaru of a Victor Campos in Peru, etc. Yet he has come to emerge the preeminent political leader of this dispensation; who for certain, and shorn of the leverage of state and party structures, is the most popular political personage in today’s Nigeria. A candidate who with practically just two associates, Tony Momoh and Buba Galadima, pooled the support of 12 million voters in 2011.

    General Buhari’s only intervention in Nigeria’s national history was just those twenty months, January 1984 to August 1985, but has remained more popular than any other erstwhile leader, civilian or military, Northern or Southern, including those that reigned for 8, 9 and eleven years. As a matter of fact, it is doubtful if Gowon, IBB and Obasanjo together can muster a total of twenty votes in any election, whether national or provincial.

    How did it so happen that a famed “truncator of Democracy” commands incomparably greater following than the Civilian leaders he overthrew? How come that a 20-month “dictatorship”, an era of “mass arrests and detentions in the Gulags, of Military horse whipping, of public executions, of draconian Decrees, of human rights abuses” did ironically generate so much goodwill for the prime masterminder and executioner, a goodwill that has lasted 30 years thereafter, and certainly would last a lifetime and even after; quantum goodwill that has kept him politically afloat for generations, and now finally and practically launching him to break a political jinx in Nigeria, the defeat of a Ruling party by an Opposition party.

    It has been posited time without number that the problem with Nigeria is one of leadership failure. But radical thinkers also insist that it is more that of failure of the intelligentsia. An intelligentsia that is so decrepit and comatose that it has failed consistently to appreciate and interpret the dynamics of change and history. Otherwise it would have come so clear that the phenomenal events of those 20 months “dictatorship” was a Revolution of historical proportions, the veritable Nigerian equivalent of the French or American Revolutions. Hence, we failed in totality to identify and latch on to its trajectory.

    It is an accurate historical assertion that the first generation Military Rule, 1966 to 1979 evolved, promoted and empowered a Ruling class that was neither capitalist, communalist, nor culturalist, but one that was degenerative, predatory, kleptomaniac, rapacious and praetorian. Over this period, 1966-1979, the productive developmental base of the Regions of the 1st Republic were totally destroyed. The Agricultural, Solid Minerals, Industrial Investments of those Regions were totally extinguished as Cocoa, Groundnut, Palm, Coal, Tin, Machine Tools structures were emasculated, and we were left with a gargantuan State structure which only business became the guzzling of petrodollars.

    It was a ruling class, with such rapacious disposition and propensities, elaborated by that Military era that was launched as practitioners to operate the structures of the Second Republic. The result was that from day one, what came on board was the very inversion of democracy, even under the façade of Civil rule. That Civilian Rule can be as far apart from true Democracy as the sun is from the moon is a peculiarly Nigerian contribution to world political culture..

    A mercenary civilian rule where there is no respect for transparency or public accountability, despite ‘all the ‘Due-Process” chorus; where over invoicing of contracts, and official manipulation and distortion of public accounts and expenditure become the culture of governance is the very antithesis of Democratic rule. A vandal civilian regime that monopolizes the state revenue, and converts it into the private business estate of its cabal is not a Democratic regime .

    A lawless civilian rule where the Constitution is breached at will, where disorder is institutionalized, and the Rule of Law is more honored in the breach than in the observance, where serving Presidents abdicate office without a handover to their Deputies, where Courts pronouncement are disregarded at will, and where the society is permanently on the brink of anarchy is a Counter Democracy.

    A repressive civilian rule where human and national rights are violated with impunity, and where official terror and genocide is conducted on individuals, groups and whole populations, is the very apostasy of Democracy. An authoritarian and dictatorial civilian regime that seeks to control and manipulate every public institution, and denies social and political expression to individuals and groups, through the manipulation of the Electoral system and the Electoral body, where political candidates are disqualified in a bid to make favored candidates sole candidates in an election, is a Contra Democracy.

    It is easy for the judge to pass any kind of judgment but it is sad that he didn’t put a lot into consideration. Whether we like it or not, there are people armed and ready to unleash mayhem on the nation, no matter who wins. Our prayer is that it should be minimal; we can’t rule that out. So when a judge bars troops from an election, what other alternative will he present for security purposes. I believe President Jonathan knows better.

      Why not train and equip your police to handle that job. Soldiers are not trained for such jobs as covering elections. The police are capable and well suited for such duties if well trained. We have had years of preparation, so what has the Federal Government done about preparing them? We are inviting bigger trouble. Just pray it does not tip over across the country. That would give the military the long awaited reason to sack the government and then suspend not only the elections but our constitution as well.

    The judge said “The state is also obligated to ensure that citizens exercise their franchise freely and unmolested.” How can this be achieved if security are not provided? Why not outline the constitutional ways of ensuring that citizens are not molested which the state must adopt aside from using the military?     Facts are emerging on why prominent Yoruba leaders have vowed not to vote for the candidate of the All Progressives Congress (APC), General Mohammadu Buhari (rtd.), in the March 28 presidential elections.

    Prominent Yoruba leaders and groups, including the two factions of the Oodua Peoples Congress (OPF), the Afenifere Renewal Group and individual Yoruba leaders have sent in a flurry of support and endorsement of the candidature of incumbent President Goodluck Ebele Jonathan of the Peoples Democratic Party (PDP)

    Sources close to the pan-Yoruba cultural group, Afenifere, have blamed the leader of the APC, Bola Ahmed Tinubu, for the woes that befell the South-West region in the present administration, especially as it concerns the loss of the Speakership of the House of Representatives.

    One of the sources claimed it was Asiwaju Bola Tinubu that sponsored current Speaker, Aminu Bello Tambuwal, against the only Yoruba candidate to the post, Mrs. Mulikat Akande.

    “The truth is that it was Tinubu’s backing of Tambuwal that eventually tipped the scale against the Yoruba nation. Because of that, the Yorubas are nowhere in the pecking order of this government. We are not the president, we are not the vice, we are not in the Senate and we are not in the House of Representatives. How do we support someone so selfish that he has to sell the privileges of the Yoruba nation to outsiders?” the source, who does not want to be named, said.

    He went on to list other alleged sins of Tinubu and was certain that no Yoruba person worth his heritage would support anything projected by the man that is also popularly called the Jagaban.

    According to the source, “The truth is that Tinubu has practically usurped the economy of Yoruba’s richest state. As we speak, the economy of Lagos is Tinubu and Tinubu is the economy of Lagos. We believe in equity and fairness and we are convinced Tinubu does not represent this.”

    The source added that the position of Prof. Yemi Osinbajo as vice presidnt
