Ex-General blasts Nigerian Army for sentencing 54 soldiers to death over mutiny

A retired army general, Ishola Williams, has condemned the Nigerian Army for imposing the death sentence on 54 soldiers accused of mutiny, saying the soldiers were justified in refusing to join operations without being properly equipped.

Mr. Williams said the soldiers were right in disobeying orders that would lead to certain death as a result of the failure of their commanding officers to provide them the necessary equipment.

On December 17, 2014 after a secret trial in Abuja, 54 soldiers of the 111 Special Forces battalion charged with criminal conspiracy to commit mutiny and mutiny were sentenced to death by firing squad by Nigerian Army’s 7 division General Court Martial.

The military said the soldiers disobeyed the order of their commanding officer to take part in an operation to dislodge Boko Haram terrorists from Delwa, a town close to Maiduguri.

Some of the accused soldiers testified that they refused to take part in the operation following the failure of the army to provide them with the necessary support equipment.

The soldiers were later transferred to Lagos where they await either the confirmation of the sentence, an appeal, a pardon or execution.

Military sources and the lawyer representing the soldiers, Femi Falana, told PREMIUM TIMES last week that they troops were held under deplorable conditions, and were denied food and care.

Contributing to a debate on an online group, AfricanWorldForum, about a statement by Governor Rotimi Ameachi of Rivers State, that the condemned soldiers had the right to protest the government’s failure to equip them, Mr. Williams, who resigned from the army as a major general, said the military hierarchy is prosecuting the soldiers to cover its failure.

“Those playing politics with the lives of these soldiers who were being sent to commit suicide in the name of fatherland and they refused, have to be ashamed,” he said. “The army’s top hierarchy is covering up its weaknesses by court-martialling these soldiers. The staff from the HQ (defence headquarters) and the generals are to blame. Period.

Mr. Williams was the Chief of Defence Operations, Planning and Training, at the Defence Headquarters before resigning in 1993.

“Anywhere in the world a soldier/soldiers is /are allowed to disobey orders which will lead to certain death because of poor officership and inadequate logistics,” he said.

According to him, in the military, “there are no bad soldiers but bad officers.”

Mr. Williams, a former honorary Secretary General of Transparency In Nigeria (TIN) and currently the executive secretary of a security research organisation, Pan African Strategic and Policy Research Group (PANAFSTRAG), said while he was in the military the soldiers he knew were not mutinous and a good court would dismiss the death sentence.

“The South African constitution allows soldiers to protest. The Nigerian soldiers that I know and commanded during my career are not mutinous and will not be mutinous.

“You may wish to speak to CJTF(Commander of the JTF) in Maiduguri to be able to indict these soldiers. In a good court of law the death sentence will be not upheld,” he said. “Stop playing Politricks and Polifun with the lives of young men who were put in harm’s way without the method and tools in an environment in which demons are going crazy.

“It is sad and wicked to be unfair to them. Why were the Court-Martial (CM) held in secret? Even the presidency has not made any statement on this issue because it knows the circumstances in which these soldiers were operating. In other climes, before the CM, the Concerned Service Chief and Commanders would have resigned their commissions.”

          Please something is worrying me. When Lt. General Aliyu Gusau (rtd) was appointed Defence Minister, – last year – our newspapers went wild with praises of “an intelligence guru” with magic wand to kill Boko Haram in a few weeks with ‘too much intelligence’. But see what happened! Boko Haram militias have conquered Nigeria more, and more quickly, than at any time since Boko Haram started fighting in 2009. What is the reason for this fiasco, please?

          Is too much intelligence supposed to lead to this mass failure? Is too much intelligence supposed to
          lead to serial defeat all over the place? I am asking all these questions because President Jonathan does not give us intelligent answers.

          I expected President Jonathan should have long reviewed the result of his appointing Lt. General Aliyu Gusau as Minister of Defence. So far, Jonathan has not said he’s ever done so. But unless we know the cause of Boko Haram’s current successes the capital city – Abuja – is not safe. Or is southern Nigeria far away from Boko Haram’s raid and invasion anytime soon. This is worrying!

    Ishola Williams is one of the most respected Nigerian Army Generals, past or present. If he says this, then I believe it. Amaechi was right after all, not minding the cheap shots fired at him by spokesman of the PDP/FG.

    A few days ago I asked on this forum: Where is the justice in sending soldiers to battle unequipped, only to sentence them to death for protesting against such orders? Williams has answered my question!

    My advise to people in the read and comment forum is to first read the article, assimilate it, make good understanding of it before you rush to react. Do not be blinded by sentiment because of either the person that the article was credited to is not in PDPig or APCsin, make wise use of the message, let the messenger off it. A retired General is saying what he knows having been there and risen to the highest rank of Nigerian army, yet a bloody civilian who does not know anything, absolutely nothing about the workings of the military would comment rubbish and be calling the retired General names. Its a shame.

    With due respect to Gen Williams, you got this one wrong. During your time in service, please tell us of any court martial that was held in pubic glare. You were in service when Mamman Vatsa was tried and executed. You were in service when Obasanjo was tried and jailed by Abacha. You were in service when Diya was tried and jailed. Were any of these trials held in public? NO.

    Secondly, you seem to be joining the bandwagon of international public opinion against death sentence. Yes, I know that is good for your UN career, but be careful in taking a public stance against your former constituency especially when the facts says differently from the way you portray them. You mentioned South African constitution allowing soldiers to refuse orders to go into battle for whatever reasons. You know fully well that that is not Nigerian Constitution nor is it the Armed Forces Act under which our military personnel are supposed to be guided in their action.

    I am not in support of sending soldiers to battle without the necessary arms, and I am sure no commander would do so. I will not believe the media claims to this effect. And for those who don’t know, the army do not send soldiers to fight without officers commanding them. So giving the impression that soldiers are being sent on suicide mission without arms is being mischievous. No officer worth his salt will lead men into battle without arms.

    From what I know of happenings on the ground, our officers and soldiers are not fighting with sticks. I am sure you have seen the army’s armoured vehicles being used by boko haram. Even a Shilka anti aircraft armoured vehicle was abandoned for boko haram in one instance. Haba. And you say the soldiers did not have arms to fight? Have you asked how and why the soldiers you seem to be defending abandoned these heavy military hardware for the enemy? Please get the full facts before adding your voice to the propaganda going on. You risk tarnishing your hard earned reputation before some of us who know and respect you.

If the government seeks to procure more weapons and equipment that does not mean it never had weapons to fight all these while. If you have followed my comments as you claim, you would also have seen where I had stated that we don’t have the best of weapons, but even at that, we are still better armed than the enemy and better trained. Go on YOUTUBE and watch the video where soldiers abandoned heavy military equipment and whole armoury to the enemy. How do you explain that? Have you not seen boko haram video where they are riding on the army tanks and armoured personnel carriers?

          The President has to come in because he is the C-in-C of the Armed Forces..except that is just ceremonial..he is your supreme commander if indeed you are in the Army..in the outbreak of a full war on Nigeria he automatically assumes the position of a General..

          Read the story on the attack of Boko Haram on Cameroon..they came in numbers of over 5,000 with an element of surprise and fought on many fronts to distract the Cameroonian army and eventually overwhelm them..they had to resort to aerial bombardments to dislodge them but not before leaving a military base with weapons behind which they later recaptured..if our soldiers did that you would call them cowards or mutineers..

          You said we don’t have the best of weapons..I tell you the problem is not weapons per se..but lack of tactical coordination and proper training..if you are indeed in the army and not just in the accounts department stealing military funds..you would know an army fights as it is trained..even Boko Haram trains regularly and come into battle with different tactics..also you would know they are never bad soldiers but bad officers…when Boko Haram attacks its always with an element of surprise and on multiple fronts ensuring you are distracted and can’t easily assemble forces to reinforce should they attack on just one front..

          If we had sensible commanders in the army..they would have long evacuated military hardware and weapons from army bases in far outpost which they can’t defend easily or send supplies and reinforcements too quickly..but our daft and archaic commanders would station 200 soldiers with military hardwares in far outposts like Gwoza. to maintain a semblance of being able to defend our territorial integrity and when BH attacks in full force with heavy close combat tactics..the boys have no other option but to flee and leave behind the hardwares..

          Evacuate villagers from far regions..remove military weapons and hardwares from such places to where you can secure them..then using coordinated aerial bombardments and infantry advancements go after the insurgents in areas they have taken up..training or hiding bases..and the insurgents would be the ones suffering heavy casualties not our soldiers..what about the commander who asked his troops to return at night when they advised him it was dangerous to do so..and would be better for them to come back during the day..what have you done to such commander?..has he been court-marshalled and sent to death yet?..the soldiers obeyed his orders and were ambushed and mostly killed including 12 officers..do you know how much it costs a nation to train an officer and then we lose 12 in one night because of a poor commander?..The US fought in Afghanistan for 14 years and only lost an officer this year..I repeat lost only one officer in 14 years..and he died from an Afghan soldier with Taliban sympathy who opened friendly fire on them during a ceremony..in fact he died trying to shield another Afghan officer from harms way when he noticed the soldier going berserk..and yet we losing Majors..Captains..Lt Colonels just like chickens..and you expect the soldiers not to disobey orders that are not well planned or without efficient weapons?..Kill those boys I dare you all..we waiting then you see if you all can live safely!!

            Hahahaha. Part oour problem is that the average Nigerian claims to be an expert in every field even when we don’t know. My friend your information is incomplete. US army did not lose just one officer in Afghanistan is 9 years. Go do your research well. And you don’t need to threaten me, I am not the chief of army staff whose responsibility it is to confirm the sentences.

            I will give you a simple example to educate you on the military operation. During the ECOMOG operations, I was a platoon commander deployed to command about 30 soldiers in a remote village. All I had as support weapons were and RPG launcher with 3 bombs and a 2 inch mortar tube with 2 bombs. My company HQ was over 30km away. I had no vehicle nor radio. I successfully defended the village against the rebels until my platoon was relieved. It was not that I didn’t know that we did not have the best of weapons, but the training of the Nigerian soldiers is such that we do much with little. Knowing that no army has all it needs to operate. The baseline is that the enemy should not be better equipped and you apply better tactics to achieve surprise and gain the upper hand. O repeat Boko Haram is not 50% as equipped as us even before the ongoing procurement of new weapons. I have tried to give you the main cause of soldiers running from battle or refusing to fight. Weapons issues is the least of the real reason. If you havery a military friend ask him what a shilka can do. Yet our soldiers abandoned it for the enemy in Bama. These are people fostered on the military by politicians in the name of employment, who are not ready to risk their lives. My friend, the army work is all about laying down your lives for your nation. Today we have soldiers who are not ready to do that. If you like get the very best of weapons, someone who do not have the passion for soldiering will still run away from battle. There is no room for mutiny in the military please. Those not familiar with the sensitive nature of military tradition should not destroy the Nigerian military please.

            The soldiers were not fighing with sticks but do they have enough equipment that matches that of BH. I personally wondered why Sambisa forest was not bombarded aerially before the kidnap of Chibok girls which gov is now using as excuse. Afterall, the Airforce claimed to have developed a spy drone that could have been used to locate BH.

            Have you seen Boko haram operation videos? If not search for them online. Then you can see the type of weapon they use. And then tell me if they are better or more than what the military has. I still maintain we have better weapons and equipment. At the risk of sounding hoarse, we have tanks, armoured personnel carriers, mortars, artillery, fighter jets, helicopter gunships, etc. Boko haran never had any such heavy equipment or weapons until some of these mutinieers started abandoning ours for them. The only heavy weapons Boko haram were using which they got fom the Libyian crisis were a few anti aircraft guns. Note that I am not by any means saying that it is easy to defeat an ideology based insurgency. No. Even the mighty US struggles when it comes to this.

            The point I have been at pains to make is that the minute number of soldiers who mutinied or refused to fight has no real defense the way some of us are trying to do here. We can appeal against their execution, but to say they did well is to say disband the military. Because if you do not punish them, them all others will do same and you end up not having a military.

            The problem with Nigeria is people like you who claim to be smart and give ill advise to imbeciles who rule over us..go and do your searches properly..the US I maintain lost only one officer a Major in Afghanistan after 12 years of fighting I should say.they’ve been there since 2002 when they went after the Taliban for the September 11 attacks..

            I insist to you and except you prove me wrong we clear facts..The US only lost one officer in their entire campaign in Afghanistan..in case you don’t understand they lost over 3,250 soldiers with many of them civilian contractors and Major-General Harold Greene the only high ranking service-member killed..but here we losing several officers day and night including Major-Generals..Majors and Lt Colonels..

            Yes I can understand your passion about the military and the anger that many of the recruitment carried out in the army in recent past was incompetently done..but you must also realise the training in our forces has been very incompetent for years now..You belatedly added in one of your replies after you had posted it that of over 20,000 soldiers its these few ones of less than 0.5% that are facing mutiny..if the percentage is that small those that not tell you its not mutiny..as a proper mutiny would have been carried out by hundreds and thousands of soldiers and not just a few..

            You gave an example of your mission in Liberia or Sierra Leone under ECOMOG..but those that not show the shame of our army?..if after such a mission we haven’t learnt any lesson and applied it adequately to our army why do we then have an army?..You had few equipments with no radio and vehicle and your company HQ was over 18 miles away (which is not that far though)..then how do we have the same scenario many decades later repeating itself in our army?

            In any case compare the distance between Bama or Gwoza to the nearest supply HQ and you know its a different battle to the one you fought…reinforcing Bama or Gwoza with supplies..ammunitions and soldiers would require aerial support like C-130 Hercules..and you better make sure there is a functional radio and you can use it quickly..but when you get attacked in far village by 500-1,000 hopeless terrorists..and you don’t have functional radios or modern communications gear..plus the supply centre is far off probably in Miaduguri or Yola because it has to be flown over and that is where the airfields are..then you can understand why we are losing against BH and the boys are refusing to die a needless death for a country that does not care for them..

            You haven’t answered my questions though..what has happened to former Major-General Abubakar of the 7th division Maimalari that commanded the deaths of 12 fellow officers..has he been court-marshalled and sentenced to death?..would you love to die in the hands of hopeless terrorists for an army that still lists over 3,000 dead or deserting soldiers as active service-men?..Is that the kind of army to be proud of and you would want to die for?..The same army that for close to 20 years since the end of active combat in the ECOMOG war has not learnt any lessons and applied it in their current battles with BH…the same way you were left with 30 men in a remote village with resupply 18miles away from you (if you travelling just 40miles/hour it would take you 10 minutes to arrive)..is the same way they are leaving a company of 200 soldiers in Bama to guard a Shilka (which is just an anti-aircraft battery) and BH doesn’t use aircrafts so whats the big deal you using it as propaganda?..The problem is a lack of tactical coordination and poor or no equipments…military wars and strategies have changed since the Iraq and Afghanistan invasion you can’t compare it with your mission in ECOMOG when you fought conventional soldiers/recruits even if at times they used guerrilla tactics..

            This ones use suicide bombers..IEDS..ant-tank guns..RPGS..and above all overawing numerical strength plus the element of surprise..just about anything to get an advantage..and they attack far and lonely military outposts with no immediate hope of resupplies or relief for fighting soldiers..hence they have to flee..you can’t compare this battle with BH and ECOMOG in anyway whatsoever except you are a cruel and evil man..

            Evacuate villages in far regions..remove military hardwares and weapons from regions you can’t defend, vulnerable to attacks..and can’t not be easily reinforced when under attack…then with coordinated aerial bombardments using a command and control centre with real time technology..identify targets on ground to be bombed through intelligence or officer on ground who give coordinates and quickly mobilise the aerial bombardments to bomb the targets before they escape..advance with infantry men with close support from the air..and nearby supply team for reinforcements..and you can then push back the insurgents and make their lives miserable..instead of dispatching a company of men to remote villages with no ready supplies even within 30km..just to create a semblance of security or being able to defend the country..then when hopeless BH terrorists attacks in numbers you expect the entire company to stay there and picked be off to death..because na dem spoil Nigeria ba? or na dem dey steal money for the top?..even you said in one of your replies that is I can stand and fight with terrorists with BH Islamic ideology I should join the army and help end the insurgency swiftly..That I take as evidence that you know within you that its not easy facing BH terrorists who have no reason to live..particularly if you are soldier with limited weapons and ammunitions..and your resupply HQ far away in Maiduguri.

            I dare the Chief of Army staff to kill those boys..if they feel they are from Bayelsa and can do anyhow and run back to their creeks while Nigeria burns..they would be surprised beyond imagination..once again I dare them to kill those boys..it would be a shocker for you all what happens next!!

            I will not bother to comment on your post anymore, but to show you how shallow your knowledge of military matter is with your insistence on casualty figures of US troops. Unfortunately, PT is blocking all my attempts all day to provide the exact link for you to see clearly the details of casualties of US forces in Afghanistan.

            CNN has a compilation of all US casualties showing picture of each individual, name, rank, age and circumstance under which they were killed. There are 70 pages listed on the site. On page 1 there are 4 officers while page 70 has 8 officers casualties.

            Google; Home and Away: Afghanistan and Iraq War Casualties. It’s a CNN site that contains the information I just summarized.

            Seek FACTS and be enlightened. Stop commenting blindly and making a mockery of yourself on social media. It s not too difficult to do a little research people…

            I was waiting for another episode to happen before replying you..since some of you in the army have become twitter generals..our MNJTF base in Baga was attacked some days back..and the Nigerian soldiers there held their ground and fought a fierce battle for several hours..when they ran out of ammunitions and no reinforcement arriving or aerial support in sight..they ran away for their dear lives and abandoned the base to BH..I guess people like FortB and our twitter generals in Abuja would charge them as usual for cowardice or mutiny..

            You wonder why there is no communication links with the command centre or nearest supply HQ for these soldiers to be able to get reinforcements in terms of troops and ammunitions..Its very clear now why we can’t defeat BH at the moment..our troops don’t get enough ammunitions..supplies..reinforcements of troops and aerial support..apparently since they are left without radio or communication equipments to ask for help when they come under attack..its a big shame!!

        Its in reference to the South African Constitution that the retired General quoted. I meant that the SA constitution that allows mutiny according to the general is not our own, nor is it our Armed Forces Act. Our laws expressly forbids mutiny or refusal of military personnel to perform military duties.

    This narrative of boko haram having more sophisticated weapons reminds me of the Nigerian police force a few years back that always tries to explain why robbers succeed in their operations, stating that armed robbers were better armed than they.

    Those of us who knew the truth merely laughed. Robbers use locally made weapons and a few AK 47 rifles while the police uses AK 47 rifles. So who was being economical with truth. Same thing is playing out with those mutinous soldiers and some people are falling for it.

    A mirror does not lie. Nigeria is in dire straights. It is not wise to kill over 70 young Nigerians in a tragic ode to the code of uniformed justice. Stability is the goal of all entities. In executing those young men it seems to me that a pandora’s box may be opened. methinks Nigeria has had enough of bloodshed. if spilling the blood of the traitors, looters & betrayers that have brought our beloved Nigeria to its knees is not worth it(AND IT IS NOT), why would Nigeria ever endeavor to spill any other blood? Even the blood of the looters & betrayers must not be spilled, as it honors our Nigeria,not to speak of the blood of our young men who found themselves ensnared in an unfortunate situation. No more spilling of ANY Nigerian blood. Especially as it regards BH(excluding the terrorists).

      Ugo, it’s very very unfair to say this. When you want to send some one to do something, you need to get him all he needs in order to carry out your assignment diligently. If you are a working class person, you will understand what I’m saying, you can’t do any thing perfect if all equipment and materials needed where not there. A medical lab scientist can not save life when there is nothing to work with in the lab. This applied to this soldiers who lack equipments to face the BH who are using sophisticated weapons.

    I expect these office Generals to lead the war instead of passing death sentences on soldiers who were asking for their right to be properly equipped even if they die at the war front, they will die gallantly but rather the authorities at DHQ are just busy siphoning all the resources including their allawee

    Please my fellow country men and women, let’s face the reality once, these soldiers were not at fault if one sees the sophisticated weapons these so called BH are using. You can only face your opponent when you have what it takes. No matter how much a teacher want to help his students, he can only do that when he has the materials, but when the materials are not there, he just have to let it be and he will end up producing a half baked students. A science students without laboratory or apparatus, will end up like a art or commercial students. Give them what they need and punished them for not doing there work.
