Jonathan plotting to reconvene House after withdrawing Tambuwal’s security detail – APC

The All Progressives Congress has called on President Goodluck Jonathan to show better understanding of democracy by immediately restoring the police security details the Inspector General of Police unlawfully withdrew from the Speaker of the Federal House of Representatives, Aminu Waziri Tambuwal.

In a statement issued in Abuja on Thursday by its National Publicity Secretary, Lai Mohammed, the party described the announcement of the withdrawal of the Speaker’s security details by the Inspector General of Police as a usurpation of the role of the judiciary by the Inspector General of Police especially bearing in mind that the question of the interpretation of Section 68(1)(g) of the Constitution on which the Inspector General of Police anchored his illegal act is currently before the courts for resolution.

The party said for the avoidance of doubt, the position, including the manner a person becomes the Speaker of the House of Representatives is to be found in the Constitution, and no constitutional provision or legislation says membership of the ruling or dominant party in the House is a pre-requisite.

“Furthermore, as the number four citizen of the Federal Republic of Nigeria, the security detail and apparatus attached to the person of the Speaker is not based on his lineage, person and or political leaning. It is on account of the position and the protection required for that position and in Nigeria’s best interest.

“This unfortunate use and deployment of Nigeria’s security forces in a partisan and political way portends danger and further weakens important institutions of governance and jeopardizes national security. Under President Jonathan, we now have a Police Force that is monitoring and making conclusions with respect to party membership, qualification, of an otherwise elected official. This is unheard of in any decent democracy.

“It is unfortunate that President Jonathan who had been a successive long term and unique beneficiary of our democracy and Constitution is now demonstrating the greatest disregard for the laws that govern and guide us as a people.

President Jonathan who is the only individual who benefited from the same Constitution to become a Governor from a Deputy Governor without an election and from a Vice President to President in similar legal circumstances now desecrates the same Constitution.

“The All Progressives Congress rejects this challenge to democracy and modern society. We reject President Jonathan’s illegality and call for respect and compliance with the law. We reject this meddling in the affairs of the Legislature especially given the resolution of President Jonathan and his close advisers yesterday at their meeting to ask the Deputy Speaker Emeka Ihedioha to unlawfully reconvene the House before the adjourned date.

May we remind President Goodluck Jonathan that under the House Rules, only a resolution by all principal officers of the House and not even the Speaker of the House can reconvene the House before the adjourned date not to talk of the Deputy Speaker.

Regrettably, the priority of President Goodluck Jonathan on the night that Mubi, a town with a population of about two million people in Adamawa state, fell to the Boko Haram insurgents was how to illegally remove the Aminu Tambuwal as the Speaker of the House of Representatives.

    What Jonathan does here makes it more difficult for a right-thinking civilian
    to lay down his life in defence of Jonathan’s government.

    Goodluck Jonathan embraces criminals to shame decent Nigerians calling for
    the application of the law of the land to nab criminals. Those he shames can’t be
    expected to have stakes in the continuance of his corrupt and immoral governance.
    I see Goodluck Jonathan as someone addicted to the perks of office in self-interest,
    and mostly for personal gains; someone willing and ready to take the country to the
    dogs once he assesses there’s a personal opportunity for him in partnering
    with a criminal for electoral votes at the next general election in February, 2015.
    The only times Jonathan ever sprung to action are when his electoral chances
    are at issue. Otherwise, Goodluck Jonathan is a laggard.

        So let’s get things straight. There is no confusion here. Let us put sentiments aside for a moment
        -PDP has a majority in the house and elected one of their members as Speaker.
        -The Speaker after many months of indecision, decides to decamp to APC.
        -The constitution says that any member elected on a party platform loses his seat when he decamps.
        -There is a Deputy Speaker whose role it is to act as Speaker whenever the Speaker is unavailable.
        -The Speaker waits till the very end of sitting to officially announces he has decamped, and adjourns the house for a month, creating what could become a constitutional crisis.
        Tambuwal, by decamping, has declared his seat in the House vacant and so has no grounds to hold onto the Speakers chair. The Deputy Speaker will preside over the House when it reconvenes. Anything else will lead to a constitutional crisis which is not needed at this point in time.

          Get your facts right, that of 1979 was purely an accord between NPN and NPP. Go back and read the reasons for the accord. NPN had just simple majority but wanted a stable Parliament and to do that against Awo UPN opposition, entered into working agreement with ZIK and his NPP whereby NPP was given the Speakership of the House, plus other Ministerial positions. The agreement saw Ambassador Mathew Mbu and other members of NPP appointed by the Shagari NPN led government.

      Apart from your comment which i strongly agree, this is a dangerous trend especially for the role of security agencies
      like the Nigerian Police to be made the enforcement arm of the PDP. It
      shows that the NPF from the top to the bottom, cannot guarantee free and
      fair elections in 2015 and frankly, this worries me. Unless there is a
      change and national institutions are made non-partisan, I’m afraid it is
      only a matter of time before Nigeria implodes.

        Chief Ume-Ezeoke burst into the political limelight when he emerged as the Speaker of the House of Representatives after the general elections of 1979. It was the first (and only time since then) that the head of an arm of our bicameral National Assembly would emerge from a political party that did not win the majority of seats in the parliament. Chief Ume-Ezeoke belonged to NPP which was 3rd in the House after NPN and UPN.

    Parliamentary vote on controversial bill has been cancelled in Burkina Faso.

    Thousands of protesters stormed the parliament on Thursday and set fire to the building, ahead of a vote on a motion to allow the president to stand for re-election, Reuters witnesses said.

    State television went off air after the incident. A handful of soldiers who were guarding the building shot in the air to try to disperse them but the crowds continued advancing and the soldiers fled, the witness said.

    The crowd then headed towards the prime ministers office as a government helicopter flew overhead, shooting tear gas canisters at protesters, a Reuters witness said.

    Lawmakers had been due to vote on Thursday a plan proposed by the government to change the constitution to allow President Blaise Compaore stand for re-election next year, when he was due to stand down due to a two-term limit. Most deputies had not yet arrived for the vote when protesters entered the building.

    “We did this because Blaise was trying to stay too long. We are tired of him,” said Seydou Kabre, a protester in the crowd headed to the prime minister’s office. “We want a change. He must go!”

    Protesters took the parliament building after police starting shooting in the air in a bid to disperse them. In the face of the surging crowd, police were forced to withdraw, witnesses said.

Section 68(1g) actually prescribe that someone who decamps losses his seat as a legislator.             (a) he becomes a member of another legislative house.

            (c) he ceases to be a citizen of Nigeria;

            (d) he becomes President, Vice-President, Governor, Deputy Governor or a Minister of the Government of the Federation or a Commissioner of the Government of a State or a Special Adviser.

            (e) save as otherwise prescribed by this Constitution, he becomes a member of a commission or other body established by this Constitution or by any other law.

            (f) without just cause he is absent from meetings of the House of which he is a member for a period amounting in the aggregate to more than one-third of the total number of days during which the House meets in any one year;

            (g) being a person whose election to the House was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that House was elected;

            Provided that his membership of the latter political party is not as a result of a division in the political party of which he was previously a member or of a merger of two or more political parties or factions by one of which he was previously sponsored; or

            (h) the President of the Senate or, as the case may be, the Speaker of the House of Representatives receives a certificate under the hand of the Chairman of the Independent National Electoral Commission stating that the provisions of section 69 of this Constitution have been complied with in respect of the recall of that member.

    The constitution that everyone keeps citing does not forbid a minority from leading a parliament. Simple. It does not matter if it hurts or if its morally questionable, the law is the law. You ask in which country does a minority lead the parliament? I would say a country whose constitution does not forbid it. APC has cleverly benefited from a loophole but that does not make it illegal? Does it make it moral? Well that is up for debate. Yet the fact still remains that the way the PDP and GEJ have tried to handle this setback is most troubling. If it is illegal then that is for the courts to decide, i believe they have already filled a case even. So was pulling his security detail necessary? Further, to clear any doubt on moral standing… i recall earlier this year when APC was in the majority (temporarily) after the mass defection. PDP refused to recognise APC as the majority. And even though APC was the Majority during that period they did not try to remove the speaker (PDP) who was then in the minority.

    The Legislature

    Part I

    National Assembly

    A – Composition and Staff of National Assembly

    47. There shall be a National Assembly for the Federation which shall consist of a Senate and a House of Representatives.

    48. The Senate shall consist of three Senators from each State and one from the Federal Capital Territory, Abuja.

    49. Subject to the provisions of this Constitution, the House of Representatives shall consist of three hundred and sixty members representing constituencies of nearly equal population as far as possible, provided that no constituency shall fall within more than one State.

    50. (1) There shall be:-

    (a) a President and a Deputy President of the Senate, who shall be elected by the members of that House from among themselves; and

    (b) a Speaker and a Deputy Speaker of the House of Representatives, who shall be elected by the members of that House from among themselves.

    (2) The President or Deputy President of the Senate or the Speaker or Deputy Speaker of the House of Representatives shall vacate his office –

    (a) if he ceases to be a member of the Senate or of the House of Representatives, as the case may be, otherwise than by reason of a dissolution of the Senate or the House of Representatives; or

    (b) when the House of which he was a member first sits after any dissolution of that House; or

    (c) if he is removed from office by a resolution of the Senate or of the House of Representatives, as the case may be, by the votes of not less than two-thirds majority of the members of that House.

      The issue is not about speakership position, but that he ceases to be a member of the House of Representatives immediately he decamps from the party on whose platform he was elected into the National Assembly in the first place. See Section 68 (1g) of the 1999 Constitution. I believe it is clear enough. The IGP quoted the constitutional provision under which the guards were withdrawn, that is because he ceased to be a legislator. And if he is no more a legislator, he cannot be a Speaker. I think that is the logic. Any Lawyer in the house?

          @Wahala, GEJ has violated the law several times in the past and nothing happened. He removed SLS despite the fact that the CBN Act says he needs 2/3rds of the Senate to do that. He has been spending governments funds without appropriation from NASS but nothing dey happen. The only person that has matched him is Amaechi. Fire for fire. Insult for insult. Thugs for thugs. I tell you, you cannot play by the rules with a tyrant.         The Section 68(1)(g) of the Constitution which refers to a member vacating his seat on grounds of defection, which the Inspector General of Police refers to,has a proviso which has been and still is a matter for judicial, in the case of the 37 PDP members who defected to APC, and not police interpretation.

        For the avoidance of doubt the question of whether or not there is a division or faction in the PDP has been resolved by Lord Justice Faji of the Ilorin Division of Federal High Court in suit FHC/ABJ/CS/605/2013 in which the court held that indeed there were factions in the PDP.

        Again in suit no FHC/ABJ/CS/ 605/2013, the Sokoto Division of the Federal High Court per Justice Aikawa, the judgment of the court was that there was not only Division but faction in the PDP which later merged with the APC.

        The 1999 Constitution nor the Police Act confers on the police force adjudicatory powers including the interpretation of the constitution.

        For the avoidance of doubt the Speaker of the House is elected by members from among themselves under Section 50(1) (b) of the constitution and vacates office under Section 50 (2) (a) (b) &(c), in the case of (c) by two-thirds majority of members of the House.

          The National leadership of Cattle rearers in
          the country operating under the aegis, Miyetti Allah Kautal Hore, said
          yesterday that they were solidly behind the president.

          According to the association, President Jonathan was their own for appointing one of them as his Special Adviser.

          Speaking yesterday on behalf of the group when they paid a solidarity
          visit on the Special Adviser to President Goodluck Jonathan on
          Political Matters, Professor Rufai Ahmed Alkali, its national
          secretary, Engineer Saleh Hassan, stressed that members of the
          association are ready to support the government in bringing peace
          between the cattle dealers and farmers across the nation.

          This was as they canvassed support for the implementation of the transformation agenda of the present administration.

          Meanwhile, Prof. Ahmed Alkali has told them that to show support for the
          president, they must obtain their voters cards and vote for Jonathan
          and all PDP candidates, even as he also called on them to embrace
          education, as it remained the only way to significantly improve on their
          well being.

          Myetti Allah, which is made up of Fulani cattle breeders and
          pastorarists, however hailed President Jonathan’s Transformation
          Agenda, especially the aspect that concerns agriculture which they noted
          has impacted on their cattle yield, even as they said that their
          members were being misunderstood nationwide, which was why there had
          been series of clashes between Fulani pastorarists and farmers, adding
          that due to their firm belief in self determination, they decided to
          partner with government, especially in the advancement of the
          agricultural sector of the Transformation Agenda.

          The body yesterday installed Professor Alkali as its Grand Patron Led
          by Alhaji Abdullahi Bello the national president and Engr. Salleh
          Hassan, national secretary, the group affirmed that they would “be
          working with government in bringing about lasting peace between us and
          farmers all over the country”.

          Noting that the visit to Alkali was a show of solidarity to the
          President “for bringing one of us into office”, said, “the only thing we
          can do is to come here as a group to appreciate you.

          “When we give you the report of the team led by a Deputy Inspector
          General of Police (DIG) on the crises, you will find out that what you
          read in the papers are all false and aimed at tarnishing our image.

          “We are willing to partner with the government in the transformation
          agenda, especially in the area of agriculture. This government is our
          own. You are one of us and we are not shy to openly identify one who has
          excelled in service to this country.”

          Responding, Prof. Alkali who promised to constantly engage them in
          dialogue,said, “I thank you for this solidarity to Mr. President and the
          honour conferred on me. You have said so at several fora both in
          ‘Fulfude’ and other languages. You have said you are in support of Mr.
          President in what he is doing and that you mean it.

      ‘Fulani Herdsmen, Others Donate N98.1m For Jonathan’s Form’

      President Goodluck Jonathan will
      today pick the Peoples Democratic Party (PDP) nomination form for the
      2015 presidential election.

      This is even as he has realised of
      N98.165million as donations made to him by both corporate and individual
      donors to enable him pay the required N22 million for the PDP
      presidential nomination fee and expression of interest form.

      While
      Miyetti Allah Kautal Hore, the national body of Fulani herdsmen,
      donated the sum of N5million, with other groups like National
      Association of Widows donating hundreds of thousands of naira, the PDP
      Governors’ Forum and the Transformation Ambassadors of Nigeria (TAN)
      donated the highest amount of N22million each.

      Special adviser to
      the president on media and publicity, Dr Reuben Abati, who stated this
      while briefing State House correspondents, said the president thanked
      all Nigerians, including members of the PDP, his friends, associates,
      and all other groups who out of appreciation of the achievements of his
      administration in the last four years, had been urging him to seek a
      second term in office.

      Abati said, “The president is also grateful
      to all the persons, groups and communities that have sent donations and
      made pledges to assist him to pay the required N22million for the PDP
      Presidential Nomination Fee and Expression of Interest Form”.

      Noting
      that Jonathan acknowledged and accepted with immense gratitude, the
      token of those who donated, Abati gave the list of donors and the amount
      they donated as follows: Mr Kennedy Ikenna Odoeme N5, 000, Mr Ezemagu
      Sunday Nnamdi N10, 000, PDP Governors –N22million, Transformation
      Ambassadors of Nigeria (TAN) – N22million, Ogbia LGA Stakeholders,
      Bayelsa State – N5million and Otuoke Community Stakeholders – N2million.

      Others
      include Brass LGA Stakeholders, Bayelsa State – N50, 000, Bayelsa State
      PDP Stakeholders- N5million, Northern Youths Forum – N2million, Central
      Market Traders Union, Kaduna State – N1million, among others.

    There shall be a National Assembly for the Federation which shall consist of a Senate and a House of Representatives.

    (a) a President and a Deputy President of the Senate, who shall be elected by the members of that House from among themselves; and

    (b) a Speaker and a Deputy Speaker of the House of Representatives, who shall be elected by the members of that House from among themselves.

    (2) The President or Deputy President of the Senate or the Speaker or Deputy Speaker of the House of Representatives shall vacate his office –

    (a) if he ceases to be a member of the Senate or of the House of Representatives, as the case may be, otherwise than by reason of a dissolution of the Senate or the House of Representatives; or

    (b) when the House of which he was a member first sits after any dissolution of that House; or

    (c) if he is removed from office by a resolution of the Senate or of the House of Representatives, as the case may be, by the votes of not less than two-thirds majority of the members of that House.

    So where did PDP find the supposedly “loophole” or authority in law, in asking Hon. Tambuwal to resign? The only option left for them, is to rally their members and see if they can muster the required number when plenary resumes in December, in order to satisfy Section 50, subsection 2 C as highlighted above.

    Gbajiabimila and APC declared themselves principal officers of the house when some PDP members allegedly decamped to APC, so why are they crying wolf now that PDP decalred that by virtue of the standing rule of legislature worldwide that the speaker must come from majority party, PDP has declared that Tambuwal has ceased to be Speaker.

    Illogical as always. If my daughter was born on Dec 25, will I fail to celebrate her birth because the day was once used to worship Nimrod? Should Jesus’ day become idolatry becuase the day was once used to worship idols? In idolatry nations, every day of the week and of the year have been so corrupted. Does that mean once there is idol worship in anyway, the day automatically belongs to the devil regardless of age and whatever is now done on the day?

    Jesus was not born on Dec 25, on what specific day was he born? Chrismas was not mentioned in the bible, so is your claim on Feast of Terbanacle. If you are right to claim that other important events have happened around the same day, should it have been too difficult for the bible to just make it incontrovertible that Jesus was born during the feast?

    It is neither scholarly nor theological to be so manipulative. It’s actually worse than heresy.
