Presidency orders Ekiti courts shut until after Fayose’s inauguration

There were strong indications Thursday that the Presidency has given orders to the military and the police to keep the courts in Ekiti State shut until the inauguration of the state governor-elect, Ayo Fayose on October 16.
 
The move, which counters the directive of the National Judicial Council, NJC, to the courts to resume on Wednesday, is aimed at ensuring the inauguration of the governor-elect without any inhibition by way of injunction or judgment in the ongoing case challenging Mr. Fayose’s eligibility for the recent governorship election in the state.
 
The courts in Ekiti were shut down last month following the invasion of the premises of the headquarters of the State Judiciary by thugs allegedly loyal to Mr. Fayose, who was the candidate of the Peoples Democratic Party, PDP, in the poll.
 
The thugs had beaten up two judges – J.A. Adeyeye and I.A. Ogunyemi – during the invasion between September 22 and 24, forcing the state Chief Judge, Ayodeji Daramola, to petition the NJC, accusing the governor-elect of being behind the incidents.
 
However, Mr. Fayose, in a separate petition to the NJC, alleged that the judges had been bribed by the outgoing governor, Kayode Fayemi and his party, the All Progressives Congress, APC, to give judgement against him in the case.  
 
The Council directed that the governor-elect be made to appear to explain his role in the attack of the judges and the state judiciary while those involved in the attack be dealt with in accordance with the law.

PREMIUM TIMES gathered that although Mr. Daramola was ready to re-open the courts as directed by the NJC, he was, however, frustrated by the State Police Commissioner, Taiwo Lakanu and others, believed to be acting on the orders of the Presidency.
 
It was learnt that the Presidency, through some of its top officials, asked Mr. Lakanu, the Commander, 32 Artillery Brigade, Akure, Aliyu Momoh, a Brigadier General; the Garrison Commander, I. Adonkie, and the Head of the State Security Service, SSS, Samuel Tamuno to ensure that the courts do not open to prevent any judgement on the matter.

It was in obedience to the presidency’s directive that Mr. Lakanu allegedly informed Mr. Daramola that a bomb had been planted in the premises to justify its continued closure, sources familiar with the matter, including officials of the presidency, told this newspaper.
 
The security agencies are now claiming that there are attempts to bomb the courts and that the place must be protected.

Following the alleged bomb threat, army trucks were used to block the roads and prevent access to the court.

“Based on this spurious bomb threat, they locked up the gates and used Army trucks to block the roads and prevent access,” our sources revealed,” one of our sources said.

They reportedly met subsequently to review their strategy and agreed to fully implement the order from the Presidency to shut down the courts.
 
The source said, “In fact now, soldiers have also been stationed outside the capital Ado Ekiti to man other court premises in what is a total clampdown on the judiciary. This gangsterism against the judiciary portends great danger and only the judiciary can put an end to it.”

Mr. Lakanu confirmed the continued closure of the court premises until October 16 to PREMIUM TIMES, but refused to say who gave the order.
 
“Yes, it (court) will remain shut until October 15 or 16. I’m presently there,” he told this newspaper in a telephone interview Thursday evening.
 
On who gave the order, Mr. Lakanu said, “That I cannot be able to speak.”
 
The Commissioner debunked claims that the police action was in anyway tampering with the jurisdiction of the judiciary, saying “I am not working at the court.”
 
Repeated efforts to speak with officials of the Ekiti State chapter of the PDP were not successful as the Chairman, Makanjuola Ogundipe and the Secretary refused to answer or return repeated calls to their mobile telephones.
 
However, the APC Chairman in the state, Jide Awe said the police and the military, by their action, were flouting the directive of the NJC.  

“The headquarters of the courts has been sealed off even though NJC gave an order that court should resume,” Mr. Awe told PREMIUM TIMES on telephone Thursday evening.
 
“The courts have been sealed off and the military are now there, but we don’t know on whose orders.

“It is lamentable. If the president is our Commander-in-Chief, then your information may be true. As far as we are concerned we don’t know on whose orders.
 
“A president who knows the rule of law and the importance of the judiciary should know the implications of what is happening. What we are experiencing is in abeyance with the rule of law.
 
“It is not good for the entire country, not only Ekiti. People that are aggrieved should be allowed to go to court and be heard. They beat judges up, tore their suits, scatter their offices. Even Jesus Christ was humble in the way he treated the Pilate how much more a mortal of the 21st century.”
 
Olayinka Olabode, the media aide to the outgoing governor, told PREMIUM TIMES that though the government was not aware who ordered the continued closure of the courts, the action of the police had been funny.
 
“Although we cannot say who gave the order, we know the police are behaving funny as far as that issue of the court is concerned.”

The Special Adviser to the President on Media, Reuben Abati, did not answer or return calls made to him Friday morning.

    Dear Editor,

    I do not support the deadly series of upper cuts landed on Justice Ogunyemi.
    But i support the temporary closure of Ekiti state high court for public order.
    It is not spurious that an attempt might be made to bomb the court premises.
    The signs have been clear all along that the Ekiti judiciary shows partisanship.
    If there is no intention to prevent Ayo Fayose’s inauguration by the APC party,
    why raise dust over a one-week court of the court closure until October 16th at noon?

      I think the Ekiti courts should have been shut after the two judges were beaten up right inside the court premises. It does not make sense to me that the courts were kept open, unless the intention was to invite more severe beatings for the remaining Judges. As i understand it, justice is not a concept which only lawyers and judges can know – far from it. Anyone having average intelligence can think out the justice of a case. Once judges were being slapped all around in that Ekiti state high court the judiciary has forfeited the confidence of the people.

      Justice must be rooted in the conscience of the people. Ekiti state exemplifies the rot in the judiciary today, as useless politicians bribe and suborn judges to do invited biddings for a bargain. That corrupt rot is not exclusive to criminals in the garb of politicians or to Ekiti state. For even moreso in Delta state, high court judges are routinely slapped, flogged and locked up in car booth before being driven into thick bushes for more severe torture, before they are eventually ransomed after several days in captivity. Let us not raise a false flag of ‘rule of law’ over this heap of ruins. Nigerians – this house has fallen!

    The state chief judge gave an order shuting down all the courts in ekiti state…he was being half wise.. .now he has realised the the governor elect do not need to come to the court to be swore in but rather the chief judge needs to go Ekiti government house to swear the governor elect into office…
    Count the presidency out of this…it is a purely ekiti state affair…
    Failure of the judge to show up for the swearing can lead to his arrest and dismissal because of the constitutional crises that will arise…
    The speaker will not be allowed to act as governor while an elected person is being denied his office

    It is God that is working! The Ekiti Chief Judge closed down the courts in Ekiti; so why are they complaining? The Rivers Gov has shut down their courts ever since and these democracy activists do not see anything wrong with that but they want to see Ekiti’s own. An election took place and Fayose won in a landslide manner by beating an incumbent 16-0 in all Local Govts and more than 90% of all wards. Ekiti people are not fools. They have given their mandate.

    In ideal democracies especially the US system we claim to emulate, there are three arms of Government and the Judiciary is one and an independent one at that. If it is allowed to be trampled-on in Ekiti State as it is being done in Rivers State today, regardless how long it lasts… justice must/should not be denied. Fayose can get sworn-in jeje if that brings peace, but is it temporary reprieve? Any Justice can sack him like Fintiri of Adamawa State and the whole cycle of violence will be re-enacted. My suggestion is to use that security and ensure the smooth running of the Judiciary rather than impede it. As-is, Fayose is inadvertently turning the Judiciary against his in-coming Govt because no government operates with only security operatives… i.e, how long do the PDP intend to close the courts whoever gave the order from above is irrelevant. All these abuses are why the international community thinks Nigeria does not have a functional government and thus, deny us access to simple things like buying arms!

      Dude..The courts in the United States do not intervene in daily political controversies. The courts have in place several doctrines that are designed to insulate it from politics among which are: 1. Political question. 2. Non justiciability. 3. Separation of power. In addition, each court has solid rules on case assignment, geographical limitation of court jurisdiction and strict rules on exparte orders. For instance, if judge has been assigned a case, no other judge or court can issue orders that will delay, obfuscate and void the primarily assigned judge or court of its jurisdiction.
      Compare that to our country where a judge in Lagos can issue an exparte order against the prosecution of case subsisting in an Abuja court! These Nigerian judges have brought shame to the judiciary and Nigeria as a whole and deserves no sympathy.

      Our judges intellectual reasoning is unsophisticated, take for example the Adamawa imbrogolio, the deputy governor issued a letter of resignation to the legislature, the peoples house and primar supreme among organs of government, yet, instead of the court to see value and wisdom of the said action, the court decided to adhere to interpretation regidity, thereby denying a teaching moment for constitutional growth in Nigeria. Nigerians must learn that a constitution cannot be interpreted as a Code or Statute. The standard of interpretation is different. Whereas, the courts must follow the plain languages in a statute. Its different in constitutional interpretation. ….why? It’s because courts must account for history, prosperity and national purpose when interpreting the constitution. It’s not enough to just read verbatim what’s stated in the Constitution. In the United States, the supreme court has established the “penumbra” doctrine. ..penumbra means shadow. ..in approaching constitutional reasoning with history, a sense of justice and Fairplay and a sense of the continued journey in forging an ever more just society.

      7. Boko Haram means ‘Book/Knowledge is Bad’. Do you know that the PDP’s minister of Education Mallam Ibrahim Shekarau burnt literature books as governor of Kano State in 2007? That’s part of the roots of Boko Haram.

      8. All the attempts by the clueless and corrupt PDP regime which budgeted and embezzled over four trillion naira ($25 billion dollars) in four years meant for security while rescuing 300 Chibok Christian girls from the hands of Boko Haram is a fantasy.

      9. Senator Ali Modu Sheriff, founder of Boko Haram, is a member of PDP.

      10. Senator Ali Ndume, another PDP member, was dragged to court by Nigeria’s secret police because he was romancing with Boko Haram members. In his affidavit before a Nigerian High Court the senator claimed that the Vice President of Nigeria authorized him to be kissing Boko Haram members.

      11. Senator Sanni Yerimah, the man who introduced Sharia law into Nigeria as Governor of Zamfara State, an activity that led to the formation of Boko Haram, is now a key sponsor and financier of PDP and the list continues.

      12. Nigeria’s President Goodluck Jonathan had told Nigerians in January 2012 at an inter-denominational church service that Boko Haram sponsors are in his government. The president even expressed fear that they could bomb or kill him anytime.

      13. Few months after Jonathan’s statement, his National Security Adviser, Lt Gen Owoiye Azazi at a conference in Asaba, capital of oil rich Delta State, told an audience that Boko Haram sponsors are in the PDP.

      14. Few months later Azazi was sacked and when he failed to go home but preferring to poke nose on security matters, he was killed in a military helicopter accident with the only Christian governor in North-West.

      15. It is obvious that the ruling PDP wants to turn Christians against Muslims in Nigeria, and turning Northerners against southerners in Nigeria by trying to kill Buhari. If Buhari had been assassinated, the northerners will abandon the PDP Boko Haram members among their people and descend on Igbo businessmen and women and slaughter them in their tens of thousands, the Igbos will in turn slaughter back some northerners and another civil war will start.

      16. In the event of a Buhari assassination, Muslims will rise up against Christians in anger and Christians will respond promptly, leading to another religious conflict in Africa’s most populous nation.

      17. I DON’T NEED TO BE A GRADUATE TO KNOW THAT: I’m not going to vote for someone who once had no shoes and no school bag as a student but now has lots of shoes and bags but made students go on strike for about Eight (8) Months.

      but still has plans to rule a country of about one hundred and seventy million (170 million) people. I’m not going to vote for a grown up man who took advice from a Seventeen (17) year old girl before he could make his own decisions.

      5. The Jonathan Presidency begged Major General Buhari to settle the case with Reuben Abati and the Guardian out of court.

      6. General Buhari obliged and settled out of court. Reuben Abati with The Guardian published an unreserved apology to Buhari in the Guardian of 11th July, 2013.

      7. Late General Azazi, as National Security Adviser, blamed the PDP for the Boko Haram violence. He was sacked and subsequently killed alongside the only Christian Governor in the North-West, in a military helicopter.

      8. Jonathan admits that his PDP cabinet has many Boko Haram members

    2. In journalism etiquette there is a grand rule were past precedents are referred to, premium times didn’t care to mention. In apc controlled rivers state, the judiciary has remained closed for 6 months now under the directive of amaechi, i didn’t see premium times say anything about that.

Dr Fayemi is being made to look and act desperate despite conceding, and congratulating Mr. Fayose while pledging to join hands in the development of the State. The use of the courts and some cheap judges to truncate the will of the people is to say the lease, very disheartening and portends great danger for our limping democracy. Dr Fayemi should do an introspection, and stick to the great speech he made after the election, for which he was widely applauded. Enough of this attempt to create confusion in Ekiti!

    Why would President Jonathan (assuming he is as intellectually deficient, dictatorial and power hungry as the report drives one to believe) want to put himself in bad light in a matter that’s within public scrutiny? Criticisms are okay when given constructively; no bile is ever good enough to substitute truth because we don’t like the persona of an official. Awosan’s (no Dr. Writes the bad verses I read) comments hardly address issues other than insulting President Jonathan.

      Look at the issue this way: the courts are barricaded by the police and military boys. Which level of government controls these security institutions? The federal government of course. If you try to absolve the federal govt of any involvement, then what you are saying indirectly is that we are now in a loose society without leadership control such that any institution can decide to run amok without difference to the commander-in-chief. Yet, if you say that’s not the case, then it means The presidency must have given the directives for the courts to be barricaded. Either way you look at it, you cannot exonerate the federal government. However, you may say that Gej did not instruct (personally) that the courts be shut and barricaded. But then, the best thing for him to do now would be to give instructions for those soldiers and police to disappear fast from that vicinity. It will go a long way neon firming him as a democrat. Conversely, if he does nothing, it would mean that he is just a typical politician who puts the interest of his political affiliations above national interest.

        Even if your position were correct, it doesn’t absolve this paper from doing its investigation and coming out with a balanced report. It is not under the pressure of time to report conjectures and serve them as truth. Any discerning reader will pick several holes in this story. Unfortunately, we are a nation of hasty commentators. More facts are emerging.
        You may have got further information (after this news report) that the NLC owns up to this closure. Do you think Premium Times will recant this story? Unlikely. They hardly do. How many of us who first bought into this story and wrote what we thought ought to be will change. What’s the chance to ‘unwrite’ what we already served?
        Security issues are not usually discussed on newspaper pages as they can be easily compromised. If you doubt that just check how long it is taking Nigeria to contain Boko Haram. Many of us rush to judgment on things we don’t have any understanding of. If you think you can play soccer better, get in the mix. Prove your worth and get selected to play; don’t stay by the sidelines making denigrating comments.

          You know what the problem is, we tend to assume that once you are not part of government, any comment that sounds anti-government is sheer ignorance. No outsider can make appropriate comments. I disagree with that line of thought. Yes, an insider may have access to some privileged information but that does not make mean an outside observer cannot still give an informed opinion. Often times, what you need is simple logic to explain certain things. Let me give this example: one of the reasons why the last acting governor lost his case at the high court was that the judge correctly opined that he (the acting governor) could not produce the original resignation letter purportedly written by the then deputy governor to the impeached governor, despite claims that he did so. The judge said it was unacceptable because the acting governor could have used his position to get the letter out from the very government house where it was supposed to have been delivered and where he (the acting governor) was living during the court sittings. For me, that was simple logic. Anyone who chooses to play smart Alec would say things are not as easy as that to expect the acting governor to just produce a letter from the government house. Maybe, but not when the chips are down.

          The same principle applies to some of these national issues vis-a-vis closure of courts in ekiti. Yes, we might not be insiders to know a lot of things going on within government but some actions can be correctly explained logically. One of the things any responsible government is expected to do is to ensure that impunity does not reign in the land. If the courts are shut with the help of police and military personnel and such instruction did not emanate from the presidency, then the presidency ought to let the whole nation know and equally identify those behind the illegality and deal with them appropriately. If the government (or presidency) does not do that, then it means that they are responsible for the action! For me, the police and military cannot get involved in any matter without a go-ahead from the presidency. It doesn’t matter what defence anyone wants to put up.

    I don’t hold brief for both parties. Why is the outgoing governor attempting to use the judiciary to frustrate Fayose’s inauguration as new governor? Nigerian politicians don’t want to accept defeat after any election. When this outgoing governor said he would not contest his defeat, people wrote encomiums on him little knowing that the defeated governor was hatching plans to frustrate his Nemesis, Ayo Fayose. People looked up at the APC as a ‘gentleman’s political party’. Now we are knowing better. Since his defeat at the polls this outgoing governor had been making spurious and ridiculous official decisions aimed at making life difficult for his coming successor and planting ‘bombs’ and ‘booby traps’ that would make the state ungovernable for Fayose. These are ungentlemanly acts. It would not be surprising if it was found that Ekiti State’s treasury is at the red and the state owing trillions of naira; but should this happen the federal machines should be set in motion to arrest the outgoing governor over this.

      Kayode Fayemi’s failure to pay staff salaries for two (2) months, suggests insolvency, which in turn suggests mis-management of Ekiti state cash flow by the incompetent Kayode Fayemi who’s been massively voted out.

      A competent governor does not default on fixed item recurrent expenditure, like wages. Folks have said it
