Anxiety across Nigeria as cases seeking Buhari’s disqualification hold today

There is palpable tension in the polity as the suits seeking the disqualification of the presidential candidate of the All Progressives Congress, Muhammadu Buhari, in the March 28 election come up for hearing at the Federal High Court, Abuja, on Tuesday.

There are no fewer than 10 suits seeking Mr. Buhari’s disqualification from the race on different grounds. All have now been consolidated for a hearing since they are all seeking the same relief.

Justice Adeniyi Ademola had on March 19 adjourned hearing on the suit to March 24.

In one of the suits, Chukwunweike Okafor is seeking an order compelling the Independent National Electoral Commission to remove or delete Mr. Buhari’s name and that of the APC from the list of persons and political parties eligible for the office of President.

In the suit, Mr. Buhari, the APC and INEC were listed as first, second and third defendants, respectively.

Mr. Okafor asked the court to hold that the information supplied by the APC flag-bearer in Form C.F 001 that his West African School Certificate was with the Nigerian Army was false and should be disqualified from the race.

In another suit, Max Ozoaka asked the court to disqualify Mr. Buhari on the ground that the INEC Form Cf 001 the APC candidate submitted to INEC was incomplete.

He contended that Mr. Buhari failed to accompany the form with all relevant academic credentials.

Mr. Ozoaka also raised objections regarding some of the information contained in other documents submitted by the APC candidate, including voter’s card.

Addressing the court at the last hearing, Mr. Buhari’s team of lawyers, comprising five Senior Advocate of Nigeria, led by Wole Olanipekun, said all the suits were targeted at stopping the APC presidential flag bearer from participating in the election.

The lawyers also contended that no court has the power to stop INEC from conducting the presidential election on March 28.

They asked the court not to allow itself to be used for the purpose, stating that Section 87 (11) of the Electoral Act cautions courts not to do anything or take action or issue any injunction that will stop the holding of primary or general elections.

“My lord, it appears that this matter is targeted at stopping the presidential election, if that is the case my lord. This court should not be used for that purpose,” Mr. Olanipekun said.

Earlier, counsel to Mr. Okafor, Mike Ozekhome, SAN, had asked the court to expedite hearing on the suit to enable it determine the fate of the APC candidate before the poll.

He reminded the court that the election was only nine days away, adding, “We have a plethora of court processes that are already filed in this matter.”

Mr. Ozekhome added, “The position of the law as adumbrated in a legion of cases, starting from the apex court, is that in an action commenced by originating summons such as ours, which is meant to construct certain section of the Electoral Act and the constitution, the originating summons should be taken together and cumulatively with process challenging the jurisdiction of this court to hear the suit.

“This matter should be expeditiously heard and determined before March 28 so that we don’t have situation of having a pretender put on the throne.”

His submission however angered Mr. Olanipekun, who argued that the suits were pre-election matters that could be heard and determined after the election.

According to him, “There is no law, authority or decision that compels any court to give judgement in a pre-election matter before the election itself. The matter is not time-bound, it is not like election petition.

“My lord, the Supreme Court has held that pre-election matter remains a live issue before or after election. What we are saying is that the court is not encouraged to rush pre-election matters because it is said that justice rushed is justice crushed.

“That was the decision in the Ibe Vs Onuora, 1998, at page 558 and page 363. Moreover, section 158 © of the Evidence Act enjoins your lordship to take judicial notice of newspaper publications.”

Counsel to the APC, Lateef Fagbemi had argued that the issue of legality of the service of the court process on defendants should be determined first.

Hasan Liman, counsel to INEC, objected to the consolidation of the originating summons and the preliminary objections for hearing. He also asked the court to insist that all the parties to the suits should file their pleadings.

        Chief, morning. I have a degree both in accounting and in law. I would say i’m a rational and logically minded man.
        The issue is this; Is Buhari qualified to contest? ie; does he possess the minimum entry requirements to line up and contest?
        The answer to that is yes, check the constitution. According to the constitution, Buhari doesnt even need a degree (ANY DEGREE) to contest. The constitution says so. If INEC assesses him as fit to contest having evaluated him in entirety; INEC has the discretionary powers to clear him to contest. The other issue is this; the law requires that he submits the originals of his certificates to INEC before he is cleared. My position (i may be wrong) is that the affidavit he submitted in lieu of the certificate adequately addresses that issue. He subsequently followed up by applying to his school to send the certificate for submission to INEC. Now, if the certificate if forged, fake etc is left to those who doubt to prove.

        if i honestly in my heart felt Buhari isn’t qualified to run, i would say so. At this point, what we need in Aso Rock is a man that will never allow anything against the interest of Nigeria to get his approval. A man who will never allow scams in NNPC that sees the Kerosine that the poor use to cook to become a billion USD pipe for stealing. That will never allow pensions of old people be stolen. That will fire a minister who engages in employment scams like Moro.     Our Igbo people don’t appear to have any strategic vision, instead they dwell excessively on the myopic objective of making money at every opportunity. In this instance, you hear of names like Okafor, Ozoaka etc trying to truncate the democratic process, all because of the promise of money and power. In 1993, Arthur Nzeribe of the infamous Association for Better Nigeria played the same role.

    Recently, MASSOB, an organisation that doesn’t believe in the existence of Nigeria as a nation, rather than focusing on its objective to “liberate” the Igbos and create the sovereign state of Biafra, started campaigning for the removal of Jega, the INEC’s chairman. Again, this is driven by Mr. Jonathan’s bribe. Why would an organization that doesn’t believe in the existence of Nigeria get itself involved in how elections are conducted in the country? This is not to say that we don’t have this sort of people in Yorubaland but they appear to be well contained as not to damage the strategic vision of that ethnic group.

    Given this situation, where the Igbos have become a mere tool in hands of whoever can pay for their service, how do they as group think that one of their own will ever become the President of Nigeria? This is my question.

    It would be disruptive to decide it after election, assuming the case shall have been moot.

    I am from Imo State but was born and grew up in Rivers.     I can’t believe that Nigerians can be so naive. WAEC does not issue certificates more than once. If the General’s certificate has been stolen by someone or something in the NA, that is not enough reason for disqualification, all he needs is sworn affidavit, which has already tendered.
    If necessary, he may add a confirmation ie statement of result which he has done too.
    So I do not know which law the Judge is to quote to disqualify him.

    Mere academic gymnasium! No “just” court in Nigeria or anywhere in the world can disqualify Buhari, because the Constitution is not ambiguous in letting us know that Buhari is qualified – a presidential candidate must be educated up to secondary certificate level. Past cases have shown that the presentation of the certificate is immaterial inasmuch as it can be established the candidate is educated to that level, which Buhari’s school has authenticated. So, Jonathan’s proxies MUST be able to prove that Buhari was not educated to that level. Similarly, difference in spelling of name is immaterial here, since Buhari is not the originator of the master result sheet from where his result was copied by the school, except there is somebody who now comes up to say he’s the one bearing the name on the result and that the result belongs to him. Moreso, the electoral act is subsumed to the Constitution, which does not include that a candidate must attach photocopy of certificate to prove that he/she is educated to the required level. Anywhere it appears an act of the national assembly seems to be at variance with the constitution, the constitution takes preeminence. So, I insist, Jonathan’s proxies are just wasting their time and that of the court. It’s mere academic gymnasium. Finally, this is a case that bothers essentially on the interpretation of the constitution, meaning it can be pursued to the supreme court — although I’m aware that a rascal judge could give a rascal judgement at the High court to cause pandemonium in the polity, knowing that that would have shortchanged Buhari successfully in the election before any appeal could be filed or taken at upper court. And it’s on this note of rascality, which is the trademark of “Unjustice” Ademola handling the present case, that makes some people to feel some tension. Otherwise, i.e., without any rascality being played out, no need to worry. However, God won’t allow Ademola this time around.

    The judiciary is not playing its role properly in safeguarding Nigeria’s nascent democracy,these spurious cases should be dispensed with as soon as possible with sanctions applied against the plaintiffs.

    If need be, Nigerian democrats must arm themselves to fight and kill all the coupists.

        A Washington-based influential think-tank in the United States of America (USA),
        the Brookings Institution, has said the odds in Nigeria’s presidential election favor
        President Goodluck Jonathan of the Peoples Democratic Party (PDP). Though the

    They are just wasting time. Buhari is Nigeria’s next President. The matter will die a natural death in court. This is just another distraction few days to election. APC should increase the mobilization of voters (door to door campaign) exercise already yielding fruits. PDP want to rule by hook or crook. They are now afraid of free and credible election platform.     my predictions are as follows
    1 Buhari would be allowed to contest the elections on the 28th because by law the substantive case can be decided after the election. However he would be disqualified after the elections must have held.
    The grounds for disqualification would be that he lied under oath when he claimed that his certificate was with the military board.
    2 the fundamental question to ask is does GMB have the WASC ? If he does then all these cases in court would just die a natural death because he would simply produce the certificate. however my suspicion is that the General does not have the WASC.
    He may have conducted the biggest 419 in Nigerian history.
    Bringing the entire nation to a crises position on this singular issue when in point of fact he does not have the certificate.
    3 I also predict that Buhari would loose the election on the 28th because most Nigerians are not comfortable with his arrogance on this very simple issue.
    He has demonstrated a degree of rigidity that shows that deep inside he still is a dictator who believes it is his way or the highway.
    he almost acts like he is doing Nigeria a favor by contesting.
    Buhari has let the Entire Nation down
    He has told a big lie that would cost him this election
    And like the grand old duke of York who marched 10 thousand men up a hill. Buhari would have to march his men down the hill in shame.
    Poor APC they should have fielded a person like Kwakwanso or el Rufia for the presidency.
    They would have stood a far better chance at winning.
    Anyway 2019 is not too far.
