Tribunal dismisses Omisore’s petition against Aregbesola

The election Petition Tribunal sitting in Osun on Friday dismissed the petition filed by the candidate of the Peoples Democratic Party, Iyiola Omisore, seeking to nullify the result of the governorship election in the state, the Nigerian Politics Online is reporting.

The Independent National Electoral Commission had returned Rauf Aregbesola of the All Progressives Congress as winner of the August 9, 2014 governorship election, a verdict challenged by Mr. Omisore.

In its ruling, according to Nigeria Politics Online (whose reporter was in court), the tribunal held that the witnesses called by the petitioner did not provide compelling evidence to support the petitioner’s claim of corrupt practices during the election.

The tribunal also held that there was nothing to show that the election was conducted without substantial compliance with the provisions of the Electoral Act.

“The testimonies of these witnesses are unsatisfactory and PDP forensic analyst did not show that ballot papers were not used accordingly,” the Chairman of the tribunal, Justice Elizabeth Ikpejime‎, said.

“As such, their testimonies failed to support their claims. None of them gave evidence on the issue of multiple voting, which they earlier claimed. The panel also held that issue of multiple voting was not found in his examination. On allegations of over-voting, no single evidence of over voting was proved. Similarly, on the allegations that O’Yes was used as INEC officials, there is no such evidence.”

The panel also held that the inability of the petitioner to prove his allegation that security operatives were compromised during the election further damaged the substance of the petition.

Mr. Omisore had on August 29 petitioned the Election Petitions Tribunal sitting in Osogbo to challenge the victory of Mr. Aregbesola.

The PDP candidate’s petition, which was in three volumes, claimed that the election was rigged in favour of Mr. Aregbesola, and that some members of the O-YES were used as INEC ad hoc staff, while some security agents were compromised.

To emerge winner of the August 9 election contested by 20 political parties, Mr. Aregbesola polled a total of 394,684 votes, winning the highest number of votes in 22 of the 30 Local Government Areas of the state.

Mr. Omisore, His closest challenger, polled 292,747 votes to come second. He won in eight local government areas.

The candidate of the Labour Party [LP], Fatai Akinbade, received a paltry 8,898 votes to come a distant third.

    What is the rational in a judgement like this, when there are proofs to the contrary. It is certain that there are some elements within and outside the shores of Nigeria that are behind this. It seems highly suspicious and also questionable, when evidently, about, 100,000 votes got added to the APC votes!

    Seriously, I must say it loud, that I don’t have anything against Gov. Aregbesola per see, but on matters of law, and also on matters of integrity, I find t difficult to reconcile this judicial decision, based on the evidence that Senator Omisore’s team of lawyers used to support their case

    Seriously, there is something that does not add up somewhere, and those that are behind it don’t understand its implication.

    Interestingly, there are Nigerians, that are not in the league of legal luminaries status, or that has got the that level of SAN, but when a party can be seen to have in one way or the other puts itself into office v through inflation and, manipulation of election result then there is the need for caution and thorough investigation.

    The truth of it is that Nigerians can longer be taken for granted. If a candidate dies nit win an election then so be it. It does not matter what part he or she belongs to. In matters like this,

    Nigeria can’t afford to get out of honesty, as to ensure that public office holders that are given the responsibilities of the resources of our states, really got duly elected, otherwise, we are not there yet!

    My prayer is that men of the learned profession, i.e . particularly our judiciary would ensure that as far as law is concerned that there is no miscarriage of justice, otherwise God’s anger against them becomes inevitable.

    Please, appreciate that, I am not in any way against the Judges that decided on this case, but on matters that bothers on strict adherence to principles of law, and judicial precedence, there is perhaps the need for careful and thorough
    review and examination.

    As a person, I never in fact got worried about it, and that is the cause of the proceedings because if there are ‘ prema facie’ evidences’,i.e. ‘satisfactory proofs’ that the election result figures, got inflated , it then indicates that such votes are balloon votes, and should not count.

    That is my humble submission. I trust that this has been useful and also all together helpful.

    Abiodun why this lie? So you added it and want it removed. Your principal Omisore lacks the integrity to lead a ward. Wait till 2018 for the next gubernatorial election in Osun. The rigging that was done in Ekiti failed in Osun. For your information, PDP used financial inducement, military harrasment of APC members, used fake militants as security personnel, etc., yet Omisore was defeated clean and clear.

    It is true that some of the comments on this social media, are not based on reality! You don’t know the level of involvement that some has got to,because they like to be one way or the other in charge of the resources of our states! One should not bother about names, because if a judicial decision is not based on honesty,and strict adherence to equitableness, it will result in oppression in one way or the other upon the people of such a state.
    To an extent,though, it is noticeable that, some of us are wicked ,and we don’t know it. I don’t know about backdoors, or seeking judgement without equity, but somehow I have a bit of understanding about rightreousness.
    However, on a personal note, if a politician did not win an election, then it didn’t win it. That is why so much funding is given to INEC to ensure there is free and trusthworthy election.
    I am not a legal expert, but if it is true that the result of the governosrhip election in Osun State was in way inflated, in favour of a particular party, then that is no cause for celebration of whatsoever!
    That means, as the law of the Nigerian constitution permits, it should be rectified to the degree that the prosecutor argues and presents its case;but then this tribunaljudgement that logically and sufficiently seems contradictory. This is not about this political party or that party,but about fairness and equitableness.

    If seriously you care to know, truth will always win, no matter how long it takes! It is just a matter of time! Some of us
    are economic with the truth, and whether you and I like it or not it is righteousness that upholds a nation! Well, you’ve not seen my post on any of this social forum for some months or so, and I had to do as led through the Holy Spirit.

    However, if you don’t know it, I’ve been somehow involved in this, since the days of the late , Gen Sanni Abacha, hence,
    to an extent, I think I know my bearing a bit with regards to this our present political dispensation. You see, if you
    sow righteousness, you will reap sure reward- and that is the raw truth about it.

    As a matter of fact, I know when some of the players today in politics were in exile- and also, I know about when they got pardoned to return back to Nigeria! In fact I read about it when Major Almustapha was sent to prison, and he spent years there and eventually was released.

    In addition to that, I know that some our politician today, never thought it t this political dispensation that Nigeria is presently, somehow in it’s process would get so far! Hence, in the past couple of years, if you can go through memory lane, you would know about some of what they’ve been saying!

    Well, kudos to all of them for there is none that is perfect. However, on ‘matters of integrity’ if a politician did not win an election, and seriously and seriously, or genuinely and genuinely, or perhaps tI should say truly and truly
    he did not win it, then that settles it. That is what is known in ‘the School of God’s Best, as righteousness!

    Therefore, what is the argument and lies about if an election result was inflated? Please hear this properly, in any relationship be it personal or in any business relationship that what its salt, integrity or honesty, i.e. truth is of essence. It is not about any of you into running assumption, but dealing with one another on the basis of integrity and honesty. And where necessary contractual obligation must be put in place so that you can understand your part of the obligation!

    Therefore, I must say that I have never met Senator Iyiola Omisore, face to face on this planet. However, when I listened to his comment, I had a feeling that he did know anything about the allegation that he was sent to prison for. Some of us know how to pray, and we pray, if we care dare to enquire from God, perhaps. He will reveal that
    to us!

    Also, he is not in any way my principal, but I only as a matter of preference felt that he is the right candidate for the Governorship of Osun State- and then they went to the polls, and the result as we read through the social media is that there was inflated votes on it.

    Is that not a material fact as far as the law is concerned/? That is a matter of individual conscience. Interestingly, up until that election, I never bothered about what has been happening in Osun State. However, when I heard about that of Fakulnle Major, Sam & Sarah, and those about Kelegbe Abi O gbe O e, I in fact went on the defense of former Governor
    Oyinlola, but alas, a couple of days or so to election, the Kelegbe that they were singing about, got him to him, to the amazement of some that had supported him for years! Well, I must say this loud and clear, Kelegbe can’t come near this, because it has its bearing and consonant from the Holy Writ!

    Also, respectfully to those in the political arena, no ill will, but as for me, I ‘m not into that sort of things, if you are not straightforward, then we can’t possibly be that intimate. If you walk with the wise then you shall be wise. That refers to such that has genuine humility as part of their countenance! My prayer is that may your road be straight! I belong to true righteousness! I hope and pray that this has been useful, and also somehow helpful! God Bless Nigeria!

    You would love this, and that is for sure! I noticed that the spell check did not pick, as it were, some of those wrongly typed words in those early comments.
    Also, I wrote them in passing, and there was less visibility there, where I typed them! Hence, the reason for some of the alphabet that are not in it.
    However, I think it is appropriate that I correct any of the mispelt words, and then repost it! I have been extreemely busy, and also had to do as led through the Holy Spirit.
