Jonathan, PDP behind fresh move to impeach Al-Makura – APC

The All Progressives Congress [APC] has condemned the renewed plan by the Nasarawa House of Assembly to impeach Gov. Tanko Al-Makura, saying the state lawmakers are bent on thumbing their nose at the Constitution in their desperation to remove the Governor, who has been cleared of the charges against him by a duly constituted impeachment panel.

In a statement issued in Ilorin on Sunday by its National Publicity Secretary, Lai Mohammed, the party said it would amount to an illegality for the lawmakers to draft a pliant Vacation Judge, as it has been reported, to set up another panel to probe the same 16 allegations over which the Governor has been absolved of any wrongdoing.

It said the Constitution is clear that only the Chief Judge of the state can set up such a panel, upon receiving a request from the Speaker of the House of Assembly, hence any attempt to draft a Vacation Judge to set up another panel will mean working against the spirit and letter of the same Constitution that gave the legislature the impeachment power in the first instance.

APC also said Gov. Al-Makura cannot be impeached on the basis of the same allegations, noting that if indeed the lawmakers want to follow the Constitution, they will have to find a new set of alleged impeachable offences against the Governor, notify him appropriately and then forward their request to the Chief Judge, not to a Vacation Judge.
”That this latest move by the legislators, who are now marooned in Abuja instead of their base in Lafia, is being instigated by the PDP is not in doubt, irrespective of the unconvincing and tepid denial from the party. That this illegality is being contemplated under the watch of President Goodluck Jonathan is clear for all to see. In fact, it is in line with the culture of lawlessness and impunity for which the Jonathan Administration has now become infamous.

”This is the only reason why the Minister of Information, Mr. Labaran Maku, from Nasarawa State could be goading the state legislature to disregard the Constitution of the Federal Republic of Nigeria in its avowed determination to remove the Governor, for no reason other than he belongs to the opposition. The Minister is well aware that he is functioning in an atmosphere that encourages impunity, and that the President will not sanction him for encouraging illegality.

”It is also as clear as daylight that the kind of money being dangled at the lawmakers to impeach Gov. Al-Makura at all costs could only have come from a deep purse or a war chest. With almost 30 million Naira and other perks being reportedly offered to each lawmaker just to take out an opposition Governor, it is clear in whose interest and at whose behest such is being done,” the party said.

It said that from Police officer Joseph Mbu, who trampled the Constitution and virtually seized the reins of government during his tenure as the Commissioner of Police in Rivers, to Marilyn Ogar, a supposed spokesperson of the DSS who has now become a spokesperson for the PDP, impunity is the name of the game under the Jonathan Administration.

”The puppeteers of the marooned Nasarawa legislators had better called them to order before they precipitate a Constitutional crisis in the state and do a grievous harm to our democracy. The lawmakers have tried and failed to remove Gov. Al-Makura. Let them now return to Lafia and continue with their constitutional duties. They must give peace a chance,” the APC said.

    What in the world is wrong with the PDP and its leaders? Why won’t President Jonathan call his dogs of war to order? Why must the ruling party go after opposition Governors?

    The Nasarawa lawmakers should admit that they have been out-foxed by a smarter Gov. Al-Makura, tuck their tails in between their legs and return to Lafia in shame…..to await their recall by the voters in their constituencies.

    As for President Jonathan, Osun should have shown him that the power of the people supersedes all the force that a desperate President can muster.

    Nasarawa has provided another reason for Nigerians to vote out this President in 2015!

    The law is trite that where a constitution or statute provides for a particular way of doing a thing, that way alone and more remains the only valid way of doing that thing. The law makers in Nasarawa state must stop deceiving themselves and come to terms with the hard reality that their so called impeachment plan had failed and died a natural death. Am shocked that they went into this adventure without any exit plan or option in order to save their faces. In the firt place, service of the impeachment notice was never effected on each member as required by the constitution before requesting the CJ to set up the committee, that is if the service on the Governor was valid. Again, the CJ, with respect was never suppose to have constituted the committee, reason being that conditions precedent were not met by legislators. Thus, the entire saga is a mess having been predicated on nothing and nobody, no matter how powerful can clothe the illegal process with any iota of legality. Lai Mohammed argument is legally sound and sustainable. A vacation Judge is incompetent to be used to recommence any impeachment. Only the CJ and no more can be involved and not on the basis of the old charges. May the legislators be properly guided. Am from Nasarawa state which is why I took my time to try to guide them aright as a lawyer.

      Let the President be sitting down and looking, apologies to Late Chief Bola Ige. If he is not careful the National Assembly will soon get a vacation judge from the Supreme Court to start impeachment moves against him. What he is doing is dangerous. I am pretty sure if an impeachment move is initiated against him, he will have no one to speak for him. He should learn from El- Malaki of Iraq. The same way Aso Rock is behaving so El-Malaki behaved. He was warned to stop destabilising Iraq but he refused. See how he ended up.

      PC Governor Murtala Nyako was Impeached a day ago by PDP led members of Adamawa State House of Assembly. Many observers including the opposition APC has been pointing fingers to President Jonathan and the PDP for being the mastermind. However, let us go memory lane and analyse the “Deeds” of Former Lagos State Governor and APC leader Senator Bola Ahmed Tinubu towards his estranged political subordinates- Specifically His Deputies.

      1. AKERELE BUCKNOR KOFOWOROLA: She was a Senator and Was elected alongside Bola Ahmed Tinubu in 1999 on the AD platform. In 2002, she declared her Interest to vie the 2003 Lagos State Governor seat against her boss. Bola Tinubu was infuriated, he lobbied the Lagos State House to commence impeachement proceedings against her. Buknor resigned her position as Deputy Governor, she also left the party, Alliance for Democracy. That was the last we heard of her politically.

      2. Mr. FEMI PEDRO was picked by Bola Tinubu in 2002 as Buknor’s successor. Jointly, they won 2003 Lagos Governorship election. After the formation of Action Congress by majorly sponsored by Atiku Abubakar and Tinubu, Pedro Signified interest to succeed his boss like others in the 2007 Guber election. Then Governor Tinubu told all the contenders to support the Candidacy of his Chief of Staff, Babatunde Raji Fashola. Pedro was adamant, he defected to Labour Party. Next was IMPEACHMENT against Pedro by Lagos State House. Sensing that he couldn’t survive the impeachment moves, he RESIGNED his position as Deputy Governor of Lagos State on the day he was to be IMPEACHED. However, Governor Tinubu refused to collect his Resignation Letter…Few MINUTES later, the House IMPEACHED him for “Insubordination and Gross Misconduct”. Bola Tinubu OPENED the floodgate for Political Witch-hunt. He was the FIRST Governor Since Lagos History to Have 3 Deputies within a Span of 8 Years. Why is His Party complaining?
