‎BREAKING: Nasarawa Impeachment fails as panel dismisses all charges against ‎Governor Al-Makura

The lawmakers had vowed not to appear before the panel.

The seven-member panel investigating allegations of gross misconduct against Governor Umaru Al-Makura has dismissed all the charges.

The panel dismissed the charges after concluding its work and listening to the counsel to the Assembly on Tuesday morning.

The State Assembly had on Monday declared the inauguration of the panel by the State Chief Judge, Suleiman Dikko, as unconstitutional saying it would stay away from the probe.

But on Tuesday, the Assembly made a u-turn, and sent a legal team led by Ocha Ulegede to represent it before the panel.

The other members of the Assembly’s legal team were John Mathew, P. A. Daffi, Steven Idikwu, Ache Obande and Abraham Aruta.

The legal team arrived at the venue of the sitting around 8.45 a.m. and took the seats marked for the state assembly.

The legal team said the panel was breaching the Nigerian constitution.

Mr. Ulegede then presented a protest letter written by the legislators and argued that some members of the panel were also members of a political party and that their appointments negated the provision of Section 188 in the composition of the panel.

He said that the provision did not give the Chief Judge absolute power to appoint members of the panel.

Mr. Ulegede also said the provision stated that panel members must not belong to any political party, be a government appointee or be a person with questionable character.

The legal team said the panel had no right to set guidelines for the conduct of the sitting.

“Section 188 of the constitution spelt out clearly how the panel should be composed. They are three fundamental issues among which is that member of the panel cannot be a card carrying member of a political party. They cannot hold government appointment and that the panel does not have the power to set the rules of proceeding guiding the sitting”.

The legislators’ legal team said two members of the seven-member panel, Abdu Usman and Mohammed Keana, are members of the Peoples Democratic Part, PDP.

The legal team also said Joel Galadima is on the payroll of the state government.

Mr. Ulegede told the panel that the house does not recognize the panel and then requested to leave the premises.

After the panel heard the protest of the counsel to the State Assembly, it went on a brief recess.

When it resumed from the recess, the panel, which had listened to Mr. Al-Makura on Monday, dismissed the 16 charges against the governor.

    WHY CHIEF JUDGE SULEIMAN DIKKO OF NASARAWA STATE MUST GO!

    There were no proceedings, and so, a dismissal of the charges by the
    Impeachment Investigational Panel was illegal. The Panel had
    no jurisdiction to dismiss the charges. Its dismissal order is null and
    void. A panel constituted maliciously by the Chief Judge of a state
    had no jurisdiction ab initio and its orders are null and void to the same extent.

    Whenever a complaint is laid under Section 188, that a Chief Judge violated
    the 1999 Constitution of Nigeria by empanelling constitutionally

    dis-qualified members to investigate an impeachment motion passed

    by a State House of Assembly, a responsible Judge should pause

    to recheck the constitutional challenges.

    By adamantly refusing to investigate so as to assure himself that he was
    not violating the 1999 Constitution, the CHIEF JUDGE OF NASARAWA STATE (SULAIMAN DIKKO)
    MERITS SUSPENSION FROM OFFICE ON AN URGENT APPLICATION OF THE STATE
    HOUSE OF ASSEMBLY TO THE NATIONAL JUDICIAL COMMISSION FOR HIS ACTING
    RECKLESSLY WITH INTENT to violate the 1999 Constitution. This is sufficient ground

    under Nigeria law to dismiss the errant Chief Judge, Sulaiman Dikko, from office for life.

        Please can you present your case on this matter and compare it with the panel set up in adamawa. Also explain how the actions done in Adamawa are legally correct and the one in Nasarawa not correct. Having in mind that nobody wears a party id card round his neck.

        But questions arises whether the House have the constitutional basis to so do or even the CJ who derives his powers to set up the panel does not have the Constitutional backing to dissolve the panel.

        This is because while S. 188 (5) empowered the CJ to perform the function of the empanelling Seven persons who, in his option, are of questionable characters, no section of the 1999 Constitution of the FRN (as amended) gives the House the powers to call for the dissolution of the panel. And indeed, no constitutional provision empowering the CJ to dissolve the panel he set up in the first place.

        In other word, the panel, after being dully set up, assumed a life of its own and it is only a competent Court of Law that can bring that life to an end. Nothing short of this is a complete ultra constitutional measures that cannot stand any judicial test.

        And regarding the misgivings about the composition of the panel of people they referred to as unfit for such assignment, the House must know that it is no longer within its purview to raise such question because their powers over the entire process ended when the Speaker, exercising his Powers provided in S.188 (5) of the Constitution.

    I am not interested in any story about PDP or APC. These parties are just criminal conspiracies against the treasury of Nigeria. These political don’t interest me one bit. In fact these political parties are of no use to Nigeria. They have not been and will never be a solution to Nigeria’s problems. The political parties may impeach or kill themselves for all i care.
