Boko Haram: Fani-Kayode lied, APC says; threatens legal action

The All Progressives Congress, APC, has asked Femi Fani-Kayode to retract his comment alleging that the APC, through its National Publicity Secretary, Lai Mohammed, condemned the Federal Government for proscribing the terror group Boko Haram or face a legal action.

In a statement issued in Lagos on Monday by its National Publicity Secretary, Lai Mohammed, the party said at no time did it issue a statement condemning the proscription of Boko Haram, and challenged Mr. Fani-Kayode to produce such a statement if he was so sure the APC issued it.

It quoted Mr. Mohammed as saying: ”I have caused my attorneys to formally write both Fani-Kayode and Channel television, where he made his allegation, to retract the statement and apologize, failing which I will sue for defamation of character.”

”Our position on Boko Haram has been well articulated for anyone who cares to know, but at no time did we condemn the government for proscribing it. When the state of emergency was declared on three northern states, we criticized it and we stand by that. But we did not condemn the proscription of Boko Haram. We are not Boko Haram sympathizers and we cannot be under any circumstance,” the APC said.

The party also condemned Mr. Fani-Kayode’s description of Boko Haram as the armed wing of the APC, saying the statement is most irresponsible, uncharitable, and without basis.

”Equally irresponsible and condemnable is Mr. Fani-Kayode’s deliberate distortion of statements made in the past by Gen. Muhammadu Buhari to mean that he or his party is a sympathizer of Boko Haram,” the party said.

It said Mr. Fani-Kayode’s latter day castigation of opposition politicians, after he returned to his vomit and repudiated all the damaging statements he made publicly in the past about the PDP and the Jonathan Administration, is not based on any altruistic considerations.

”It is common knowledge that Mr. Fani-Kayode has been charged by the Federal Government with money laundering. The trial is almost ending, and he knows he faces a certain jail term if convicted.

”It is therefore not impossible that Mr. Fani-Kayode may be seeking to ingratiate himself to the FG by using various media platforms to destroy the APC through accusing its leaders of being Boko Haram sponsors or that the party is bent on fielding a Muslim/Muslim ticket in next year’s presidential elections.

”Unfortunately, in his eagerness to please the FG and cut a deal to avoid going to jail, he has resorted to pathological lies aimed at calling the dog a bad name in order to hang it. Whatever evidence he has to prove that our party is a sponsor of Boko Haram, he should be prepared to tender such in court,” APC said.

    ACN: Boko Haram’s Proscription Order Extra-constitutional

    The Action Congress of Nigeria (ACN) has expressed concern
    that the recent proscription order against Boko Haram and Ansaru may stifle
    press freedom and tamper with the fundamental human rights of Nigerians.

    The party said as desirable as the measure might be in
    tackling the terrorist organisations, implementation of the order might be used
    to gag the media from objective coverage of the military operations against
    Boko Haram.

    In a statement Sunday by its National Publicity Secretary,
    Alhaji Lai Mohammed, the party said the order had made it easy for the federal
    government to clamp down on the opposition, which its sees more as an irritant
    than an indispensable part of democracy.

    ”We hate to say this has turned out to be prescient, in
    view of the dangerous provisions of the Boko Haram and Ansaru’s proscription
    order. The order’s assault on the press
    freedom and the constitutionally guaranteed rights of ordinary Nigerians is
    unprecedented in the country’s history. We therefore call on the federal
    government to take a second look at this order, with a view to resolving any
    conflict it may have with the constitution of the Federal Republic of
    Nigeria,” the ACN said.

    It therefore called on media professional bodies to
    challenge the order in court to save journalists from long jail terms simply
    for carrying out their constitutional duties.

    In the alternative, the ACN called on the federal government
    to clarify the knotty and vague areas of the open-ended order that may end up
    punishing journalists and infringing on the civil liberties of the citizens
    more than it will curtail the activities of the sects.

    ”Against the background of insinuations in government
    circles, let us be clear that we do not condone the activities of these sects
    that have killed and maimed innocent Nigerians and turned a section of the
    country into a battlefield. Terrorism in all its ramifications is condemnable,
    and no responsible government will allow any group, no matter its name,
    grievances or ideology, to carry out terrorist acts unchecked.

    ”But we believe that whatever action government takes –
    even in an emergency – must pass the constitutional test, especially since the
    relevant sections of the constitution have not been suspended,” the party
    said.

    It added that the offensive section of the order is Section
    5 (1), which prescribes a term of imprisonment of not less than 20 years ”for
    any person who knowingly, in any manner, directly or indirectly, solicits or
    renders support for the commission of an act of terrorism or to a terrorist
    group”.

    ACN said “support”, as defined by the order,
    includes ”incitement to commit a terrorist act through the Internet, or any
    electronic means or through the use of printed materials or dissemination of
    terrorist information”.

    ”Is this subsection not in conflict with Chapter II Section
    22 of the Nigeria constitution which says ‘The press, radio, television and
    other agencies of the mass media, shall AT ALL TIMES BE FREE (emphasis ours) to
    uphold the fundamental objectives contained in this chapter and uphold the
    responsibility and accountability of the government to the people?’

    ”By stifling the press, is the order not abridging a part
    of the fundamental human rights guaranteed every citizen under Chapter Four of
    the Nigerian constitution in Section 39 (1), which states thus: ‘Every person
    shall be entitled to freedom of expression including freedom to hold opinions
    and to receive and impart ideas and information.

    ”Can journalists escape being sentenced to 20-year jail
    term for publishing statements issued by the sects? Can they freely report on
    videos periodically posted on YouTube by Boko Haram leader Shekau? Can the
    media freely report the kind of massacre that took place in Baga in April
    without being held liable for ‘supporting’ terrorism? Can radio and television
    stations organise talk shows on terrorism without the discussants being held
    liable for ‘supporting’ terrorism?

    ”Can the opposition criticise the government’s strategies
    against the terrorist sects, through its regular intervention, without being
    perceived as offering support to the sects? Does this order cover the satellite
    broadcast channels that can be accessed in many homes across the country? Who
    determines when this order has been breached? These are some of the questions
    that arise under the proscription order,” the party said.

    According to ACN, Nigeria
    must take a cue from other countries, especially the United States,
    which are also battling terrorism, adding that the media in those countries
    have continued to report freely on the activities of the global terrorist
    organisation, Al-Qaeda, despite the horrendous attacks it has carried out in
    the US and Europe, among others.

    Proscription of Boko Haram: ACN, misinforming the public – Presidency

    In a statement issued by Dr.
    Doyin Okupe, the Senior Special Assistant (Public Affairs) to President
    Goodluck Jonathan, the Presidency said, “ the intention of the law nor
    the contents of the order can be interpreted except by professional
    mischief makers to mean a suppression of press freedom. For the
    avoidance of doubt, the order is not meant to stop journalists from
    carrying out their duties or function of news gathering or reporting as
    they differ from terrorist activities. Rather, the order is out to
    criminalise acts of incitement by anyone, group of persons or
    institutions to commit terrorist acts through dissemination of terrorist
    information,”

    It would be recalled that the CAN through its Spokesman, Lai
    Mohammed, a few days ago stated that the order banning the two
    terrorist groups limits press freedom.

    According to the Statement, “This latest effort by Alhaji Lai
    Mohammed and the ACN not only betrays desperation on the part of the
    party but is equally lacking in sound judgment. What its present action
    suggests is that were the ACN in power it would have done nothing to
    stop the needless destruction of lives and property by the terrorist
    group proscribed by the Federal Government.

    “Are we to believe then that the ACN is unhappy with present peace
    and calm enjoyed by residents of the states under emergency rule? Are we
    to conclude that Alhaji Lai Mohammed and his party are uncomfortable
    with the fact that following the intervention of our military, that
    children have returned to school and that markets have reopened for
    business?

    By stating that the offensive section of the Order is Section 5 (1),
    which prescribes a term of imprisonment of not less than 20 years for
    any person who knowingly, in any manner, directly or indirectly,
    solicits or renders support for the commission of an act of terrorism or
    to a terrorist group”, is the ACN suggesting that terror should
    continue unabated and unchecked?

    Is the party suggesting that
    government folds its arms and let its citizens be murdered in cold blood
    and properties destroyed at will?

    If the grouse of the ACN is with
    the word “support”, we expect Lai Mohammed and his party to clearly
    understand the difference between reporting activities as news and
    dissemination of information on behalf of terrorists.

    Our concern with the ACN’s
    statement is the misinformation they are giving Nigerians on the
    stifling of press freedom. Neither the intention of the law nor the
    contents of the order can be interpreted except by professional mischief
    makers to mean a suppression of press freedom.

    For the avoidance of doubt, the
    order is not meant to stop journalists from carrying out their duties or
    function of news gathering or reporting as they differ from terrorist
    activities. Rather, the order is out to criminalise acts of incitement
    by anyone, group of persons or institutions to commit terrorist acts
    through dissemination of terrorist information.

    For the last two years, the ACN and
    Lai Mohammed in particular, have tried to misrepresent President
    Goodluck Jonathan and spread gross misinformation about his policies and
    actions. Unfortunately, their efforts have all failed.

    It is only a jaundiced organisation
    with no clear perspective on governance or respect for truth that will
    state that the only transformation observable is that of transforming
    from a democratically elected president to an emperor or despot. The
    declaration is bestial, puerile and irresponsible. Never in the history
    of this country has a president laid much emphasis on political
    liberalism than President Jonathan has done.

    The ACN, which Lai Mohammed
    represents, has often been described as a tyrannical political
    institution run by an association of despots and a clearly undemocratic
    leadership.

    The Transformation Agenda of this
    administration as evinced by the mid-term report of President Jonathan
    is not only unprecedented but also unrivalled by any administration,
    whether federal, state or local government past or present, in the
    annals of our nation.

    If the ACN cannot copy it, they should at least have the decency and humility to acknowledge it”, the statement concluded
