The couple was granted bail by the Abuja court.
The police on Tuesday arraigned Romanus Mba and his wife, Philomena, in a Dutse Magistrates’ Court, Abuja, for “criminal force, assault and mischief’’.
The police prosecutor, Igonor Ocholi, told the court that the case was reported at the Kubwa Police Station, Abuja, on May 27 by Omerigue Edwin of Kukuba, Kubwa.
Mr. Oholi said that Mr. Edwin complained to the police that on May 26, the couple, with one Simon, who is now at large, assaulted and inflicted injuries on him and damaged his Yamaha generator.
“All these happened without any provocation,’’ the prosecutor told the court.
He said the offences contravened the provisions of sections 263, 265 and 322 of the Penal Code.
Section 265 states that whoever assaults or uses criminal force on any person otherwise than on gross and sudden provocation by that person shall be punished with imprisonment or with fine or with both.
Similarly, Section 327 says whoever commits mischief shall be punished with imprisonment or with fine or with both.
The accused, however, pleaded not guilty to the charges leveled against them; and the prosecutor applied for an adjournment to enable him assemble his witnesses.
The counsel to the accused persons, Moses Ayorgu, applied for bail for his clients, saying that they would not jump bail.
“If granted bail, the accused will neither jump bail nor commit any other offence, and they have a reasonable surety to sign their bail bond,’’ Mr. Ayorgu said.
The Magistrate, Nweke Chukwuemeka, granted the accused bail in the sum of N100, 000 each with one surety each in like sum.
“The sureties must reside within the jurisdiction of this court,’’ Mr. Chukwuemeka said, and adjourned the case to June 18 for hearing.
