The hawkers pleaded guilty to the charges.
An Abuja Grade Two Area Court in Kado on Tuesday sentenced Adamu Muntari and Abdullahi Yusuf to 11 weeks in prison after they pleaded guilty to a three-count charge.
Police prosecutor Simon Ibrahim said the convict should be tried summarily under Section 157, sub-section 1 of the Criminal Procedure Code.
Section 157 (1) states that “if the accused admits that he has committed the offence of which he is accused, his admission shall be recorded as nearly as possible in the words used by him and if he shows no sufficient cause why he should not be convicted the court may convict him accordingly.’’
Muntari, 20, and Yusuf, 18, both hawkers at Jabi Motor Garage, Abuja, were tried on a three-count charge of joint act, criminal trespass and theft.
The News Agency of Nigeria (NAN) reports that the convicts were, however, given an option to pay N3,000 fine by the presiding officer, Ahmed Ado.
The prosecutor had earlier told the court that a report was lodged by Nnamdi Nnalu of Don-P Plaza, Jabi, Abuja, against the duo at the Utako Police Station on May 5.
He said the convicts had gone into Don-P Plaza premises, which was still under construction, and stole some buried cables.
Mr. Ibrahim said that in the process, they damaged some cables valued at N120,000, adding that during police investigation, a sack containing the cables was recovered from them.
He said the offence contravened the provisions of sections 79, 287 and 342 of the Penal Code.
The convicts, who had both pleaded guilty, begged the court for leniency.
