The prosecutor had filed a suit against Google and Nigeria blogger, Ladun Liadi, over a libelous publication.
A Lagos High Court sitting in Igbosere on Monday adjourned hearing in a N500 million libel case filed against a global internet service provider and search engine – Google – to June 18.
The Chairman of Anabel Group, Nicholas Okoye, had on April 24 filed the suit against Google, for improper editorial censorship over a libelous publication.
Ladun Liadi, a blog operator and Google Nigeria are joined in the suit as first and third defendants.
The second and third defendants – Google Incorporation and Google Nigeria – had challenged the court’s jurisdiction to hear the matter.
Counsel to the claimant, Emeka Okwosa, also filed an application for an interlocutory injunction to prevent the defendants from further publishing libelous documents until judgment was given.
However, counsel to the first defendant, A.I. Enaefo, told the court that his client had fully complied and that there was no evidence that the libellous publication had been downloaded.
“My client has complied with that and up to this moment, there is still nothing to show that the libellous publication had been downloaded,” he said.
Counsel to the second and third defendants, E.K. Bahabo, urged the court to strike out the name of the third defendant – Google Nigeria.
“We have filed two applications challenging the court’s jurisdiction to hear the matter and that the name of the third defendant should be struck out,” Mr. Bahabo.
Justice Adebayo Oyabanji, after listening to both parties, adjourned the case to June 18 for hearing of the motion challenging the court’s jurisdiction to hear the case.
