Abuja Court orders release of accused, awards N500, 000 compensation

A Federal Capital Territory, Abuja, High Court, sitting in Kubwa on Tuesday ordered the police to release one Umar Jubrin who has been in detention since September, 2012 for allegedly buying a stolen car.

The Presiding Judge, Yusuf Halilu, also ordered the police to pay Mr. Jubrin N500,000 as compensation.

“The court hereby declares that the respondents have violated the applicant’s fundamental rights to liberty and dignity of the human person and orders that the applicant be released on bail.

 “The court hereby awards N500,000 against the respondents,’’ Mr. Halilu ruled.

The suit was instituted on January 11 through an affidavit deposed to by the applicant’s wife, Saratu Jubrin.

The affidavit had listed the Inspector-General of Police; Commissioner of Police in Abuja; Area Commander, Kubwa; and the officer in charge of Special Anti-Robbery Squad as respondents.

The applicant’s counsel, Obi Duruzo, asked the court to declare that the respondents had violated the applicant’s fundamental rights to liberty and dignity as a human being.

Mr. Duruzo also asked the court to order that the accused be granted bail or charged to court.

The counsel equally sought an order of perpetual injunction restraining the respondents from further arresting the applicant and an award of N50 million for damages.

According to Mr. Duruzo, the accused is a businessman who sold fairly used cars.

“On Sept. 22, 2012, he was arrested on a trump up allegation of buying a stolen car from Messers Mark Uche and Chukwuemeka Duru.

“At the time the applicant bought the car, he was unaware that it was stolen,’’ Duruzo said.

He said that Mr. Jubrin took the police to the people who sold the car to him but he was neither released nor charged to court.
