Ex-PDP National Auditor, Bode Mustapha, challenges sack in court

Mr. Mustapha was the National Auditor of Nigeria’s ruling party.

The sacked National Auditor of the Peoples Democratic Party, PDP, Bode Mustapha, on Monday challenged a High Court judgment that removed him as the National Auditor.

Mr. Mustapha approached an Abeokuta High Court to seek a stay of execution on the judgment that removed him as the national auditor of the party.

The politician was removed as the national auditor by an order of a Lagos High Court. The PDP acting on the court order, relieved Mr. Mustapha, a loyalist of former President Olusegun Obasanjo, of his position on Friday.

Speaking to journalists, counsel to the sacked auditor, Gboyega Oyewole, explained that the position of any member of the National Working Committee can only be determined by a national convention and not through a zonal congress.

“What we are saying is that the office of the National Auditor General can only be filled by an election at the National convention and not at the zonal congress by the provision of the constitution of

the party.

“The National Auditor or any member of the National working Committee can only be elected at the National convention and not zonal congresses like these people are trying to insinuate,” he said.

The lawyer also took a swipe at the respondents in the case, the Buruji Kashamu faction of the Ogun PDP, who were represented at the court on Monday even when they had not been served with the court processes.

He said that the appearance of the counsel and the filing of preliminary objection by the defense counsel was an indication of their desperation in the whole case adding that the action was an abuse of court process and suspicious.

“We have not served any of the defendants in the action with the process, we wonder why they are coming to court with a preliminary objection when they have not been served with any of the processes and that is why we said the action is very suspicious and an abuse of court process.

“That is surprising and that is the hallmark of their desperation they have been showing in relation to all these matters. It is a very strange one, where parties have not been served and they are already

filing processes in the matter,” he noted.
