Court orders Kano to pay N20m damages for doctor’s negligence

The doctor’s negligence caused a patient’s death, the judge ruled.

A Kano State High Court on Friday ordered the State Government to pay N20 million as damages to the family of one Maijidda Aminu, now late.

The late Aminu died of alleged negligence while on admission at the Abdullahi Wase Hospital, Kano in April 2008.

The hospital is owned by the Kano State Government.

The father of the deceased, Ali Babba-Dan’agundi, instituted a legal action against the hospital for alleged negligence by its staff handling Aminu’s case.

The family alleged that when late Aminu was brought to the hospital for treatment, the doctor on duty was nowhere to be found.

The family also alleged that the doctor was in his private clinic on the day in question.

However, before he, the doctor, could be called to attend to the patient, the patient died.

Delivering judgment on Friday, the Judge, Aisha Mahmud, awarded the sum as damages to the family of the deceased.

She said in view of the evidence before her, she was satisfied that there was negligence on the part of the doctor on duty.

The judge also ordered the hospital’s management to give the father of the deceased a copy of the report of the findings of the committee set up by the hospital’s management to investigate the case.

During the case, two witnesses testified for the plaintiff while seven witnesses testified for the defendants.

    THE JUDGE PASSED HER JUDGEMENT AND I DON’T HAVE ANYTHING AGAINST THAT SINCE I DON’T KNOW THE EVIDENCE BEFORE HER. THE DOCTOR PROBABLY MAY HAVE BEEN FORCED TO PERSONALLY PAY ABOUT 2 TIMES THAT AMOUNT UNDER ISLAMIC LAW IF FOUND GUILTY IN PROFESSIONAL NEGLIGENCE THAT RESULTED IN TO DEATH OF A PATIENT.
    I HAVE SEEN CASES LIKE THIS WHERE SENTIMENT OVER TAKES RATIONAL REASONING. THE DEATH OF MAIJIDDA WAS VERY TRAGIC, BUT THINGS MUST BE EXAMINE FROM OBJECTIVE POINT OF VIEW. THERE IS NEED TO KNOW JOB DESCRIPTION AMONG THE VARIOUS HEALTH WORKERS WITHIN THE HOSPITAL. IF A PATIENT IS BROUGHT IN TO EMERGENCY ROOM, RESPONSE TIME IS RAPID BECAUSE THE TEAM, WITH A DOCTOR AS THE HEAD, IS ALREADY INFORMED BY AMBULANCE STAFF ABOUT THE CASE. THE TEAM THUS CONTINUE RESUSCITATION AND CARRIES OUT DIAGNOSTIC INVESTIGATIONS MEANWHILE IT MAKES CONTACT WITH A SPECIALIST THAT CAN MANAGE THE CASE MORE EFFECTIVELY. IN NIGERIA BECAUSE OF PAUCITY OF DOCTORS, NURSES AND OTHER PARAMEDICS ARE TRAINED IN THE ART OF RESUSCITATION AND TO ADMINISTER SUCH BEFORE THE DOCTOR ARRIVES. THIS IS SO BECAUSE IT IS NOT NEW TO SEE AN ENTIRE HOSPITAL WITH ONLY ONE DOCTOR WORKING, WHERE THERE ARE FEW USUALLY ONLY ONE REMAINS FOR CALL ALTERNATING WITH HIS COLLEAGUES. MOST TIMES WHEN PEOPLE BRING THEIR PATIENT, THE FIRST THING THEY ASK IS WHERE IS THE DOCTOR. IT IS NOT UNCOMMON TO SEE PATIENTS NEEDING OXYGEN NOT GIVEN, NEEDING FLUID NOT GIVEN, EVEN VITAL SIGNS NOT TAKEN AND IV CANNULAR NOT SECURED. EVERY BODY IS WAITING FOR THE ALL KNOWING DOCTOR TO MAKE A TRIUMPHANT ENTRY. THAT IS WRONG, DOCTORS AND OTHER PARA MEDICS WORK AS A UNIT WITH THE FORMER PROVIDING THE CEREBRAL INPUT.
