Why I blocked SSS from searching judge’s residence – Wike

Governor Nyesom Wike has explained why he intervened early Saturday as the State Security Services laid siege on the home of a federal judge in Port Harcourt.

Operatives of the SSS launched an overnight assault on the residences of senior judges across the country between Friday and Saturday in search of evidence linking the judges to corruption.

Multiple sources said the clampdown began in Gombe State where the SSS arrested Muazu Pindiga who served on the elections tribunal in Rivers State.

The operation continued in Abuja on Friday night into early Saturday morning.

Mr. Wike arrived as the operation to arrest Justice Mohammed Liman, residing at Number 35 Forces Avenue in Port Harcourt, began, the governor’s spokesperson, Simeon Nwakaudu, said in a statement.

Mr. Wike was quoted as telling journalists that he would not allow the SSS and other security agencies perpetrate “needless impunity” in the state.

He said if the security agencies had a lawful directive to implement, they must follow due process.

“Not under my watch will I allow this kind of impunity to take place,” the governor was quoted as saying. “That is why we are here. I don’t know which judge they were detailed to abduct. I didn’t bother myself to know which judge. All I am interested in is that, at this level, it is not allowed.”

“He is not a criminal and he is not an armed robber. If the person has committed an offence, invite him. It is only when he refuses to honour the invitation that you can adopt this commando style.”

Mr. Wike said he had been threatened by armed agents who wanted to attack him.

“The Commissioner of Police is here, the Director of DSS is here. Their operatives cocked their guns and threatened to shoot me. I have never seen that before. Again, this is to tell you what we are facing. We know that more will come. For us in this state, we shall continue to resist it,” he said.

Mr. Wike added: “It doesn’t matter what it will cost. When you talk about liberty, sacrifices must be made. We are not trying to stop an arrest. All we are saying is that things must be done decently and in line with the rule of law.

“Rivers State is under siege. For you to see a governor out at this time of the day, something is wrong. A siege is an understatement. If this type of thing happens next time, the people will resist it to the last.”

    The DSS were wrong!!if a judge does anything wrong, it is the NJC that punishes him! Not Dss did that even have a warrant for arrest?! From who? And why? They should invite him if the need arises!! This is oppression! The government is trying to force judges to convict their political enemies even if they r not guilty! They want judges to give speedy and biased judgements when they want it! This is dictatorship! All arms of the government are supposed to be equals!

Why can’t we stop all these sentimental postures and act base on substance rather than chasing shadow? For anybody that would be arrested, there MUST be a charge/an offence again the person. Why can’t we wait to see what the issue behind the new is?

    Preventing law enforcement from doing their job is a criminal offence. Anything can happen to gov Wike while he is preventing law enforcement from carrying out their lawful duties . Why does the police or the secret service have to “invite” you?They have any evidence of wrong doing against you, they get a court order and have you arrested and not “invited” as Gov Wike wants. In the USA, they will even have you in handcuffs.

        The FBI raided at least seven locations across Philadelphia Friday in an investigation that has already ensnared John Dougherty, his politically powerful union, at least one councilman and reportedly touches the Philadelphia mayor’s office and the state Supreme Court.

        Dougherty, the business manager of the International Brotherhood of Electrical Workers Local 98, returned to his South Philly home in the morning hours to find it being searched by the FBI and state police. The feds also raided his South Philly bar, the headquarters of the union, and the South Jersey home of its president. The office of City Councilman Bobby Henon, a close ally and major beneficiary of Dougherty, was also searched by the feds. Henon is a board member of IBEW Local 98, and a lone FBI agent sat outside Henon’s office Friday morning and refused to comment, saying only “the office is closed today.”

        Federal agents left each location they raided with boxes of paperwork, including a truckload of documents from the IBEW headquarters on Spring Garden Street.

        Nevada Supreme Court Justice Nancy Saitta “tipped off” a key government target to FBI-led raids in an investigation of massive homeowners association fraud, according to a sworn deposition obtained by the Las Vegas Review-Journal.
        In the deposition, Lisa Kim, who ran a company that managed HOAs linked to the long-running investigation, testified that the FBI’s target, the late lawyer Nancy Quon, told her about the tip on Sept. 24, 2008, the first of two days of court-approved law enforcement searches across the valley.
        “I was literally sitting at my office in tears … and I received a text message from Nancy Quon that said that she had been tipped off by Justice Saitta that the feds were serving search warrants, ” Kim testified. “And I said … ‘They are at my office now. And that was it. And that’s the last time I got a text or anything from Nancy.’”
        The next day investigators searched Quon’s office. She did not tell Kim how Saitta — who has denied the allegation — would have learned about the raids, which by then had attracted media attention.

        Quon became wealthy as a high-profile construction defect lawyer. But her notoriety also caught the attention of the government, which made her a top target of the HOA investigation. The case focused on a wide-ranging scheme to take over HOA boards through election rigging so that her law firm could land lucrative contracts to sue for construction defects. Work repairing the defects was then steered to a construction company owned by her friend, Leon Benzer. Prosecutors alleged the conspiracy went on from 2003 to 2009.
        Quon killed herself in March 2012 under the weight of the investigation and was not charged. Benzer pleaded guilty last year as the mastermind of the scheme and was sentenced to 15 years in federal prison.
        Saitta, who was first elected to the Supreme Court in 2006, presided over construction defect cases while she was a Clark County District Court judge. Quon often appeared before her.

        A spokeswoman for Saitta said the justice had nothing to add to a previous statement she made about Quon. Last year when testimony surfaced at an HOA trial that an unidentified Supreme Court justice had tipped off Quon to the raids, all of the justices, including Saitta, issued denials.

        “I have never spoken to Nancy Quon about this or any other investigation, civil or criminal, and would certainly deny any allegations that there was such a conversation,” Saitta said.

        Paul Deyhle, executive director of the Nevada Judicial Discipline Commission, said his panel has jurisdiction to investigate allegations of professional misconduct involving the Supreme Court.

        The commission could launch action against Saitta if someone files a complaint or if information comes to the commission from the public domain, such as in a news story, Deyhle said.

        State law allows for a complaint to move forward if there is “objectively verifiable evidence from which a reasonable inference could be drawn that any misconduct occurred,” Deyhle said.

          Just curious– Do we have a Juciciary Diciplinary Committee in Nigeria , made up mainly of non judges ? These people can accept case of fraud etc , lodged against members of the bench.
          This will put the fear of God in our wayward judges. The era of pay money into my overseas bank account if you want to win this. case is over.
          However baggering into people’s houses without some form of legal justification is not a good idea.

          In the kind of system, we are practicing, there is a separation of power among the three branches of govt. one branch cannot be intimidating another branch because of the so called corruption. if you believe the judges are corrupt, go to another court and have a proper search warrant issued for you to do your job. You cannot just burg into people’s houses because you believe they are corrupt and looking for evidence. Do it the proper way; that’s why most of the corruption cases are not going anywhere because Nigeria law enforcement officers are quick to jump the gun, they make an arrest and then investigate. Criminal justice 101, you investigate before making an arrest. You only make an arrest only in some instances that happened in front of you as an officer of the law. I am a law enforcement officer in the states, and am sometimes applaud on how criminal cases are burgled based on a sloppy investigation in Naija by our law enforcement officers

            My bro, I understand your point very well, we all know there’s corruption in our country, but they should do it in the proper way that is suppose to be done by getting a proper search warrant before going into these houses and also getting an arrest warrant. All it takes to get these warrants is less than 30mins for our govt., any law enforcement officer just goes in front of the judge and sworn an affidavit that they needed to investigate criminal activities further and needed a search warrant. That’s all any democratically elected govt. does, not use Gestapo tactics.

    Two Supreme Court Justices in Nigeria thrown into jail

    Justices Sylvester Ngwuta and John Okoro arrested at their official residences

        Friday’s swoop by the Agents of State Security Service (DSS), on about seven judges, was reminiscent of what the FBI did in 1991 to quash corruption that was eating the Judiary in some parts of the United States.

        Operation Greylord was launched in Chicago’s Cook County and agents descended on their targets catching them off-guard at home. By the time the simutenious arrests were completed, 17 judges, 48 lawyers, 10 Deputy Sheriffs, 8 policemen,11 Court officials and one member of the state’s legislature were in custody.

        Of the 17 judges, 15 were convicted, wth the stiffest hunging over the head of Judge Reginald Holzer, who recieved 18 year-jail term for accepting over $200,000 bribes from multiple lawyers. Three other judges could not stand the shame and therefore committed suicide, including one of the most influencial judges at the time, Judge Allen Rosin.

        The DSS action was long overdue. The judicial system in this country has become a rot. It has severally, through the courts and in connivance with leading lawyers, subverted democracy for a price. Closer to home, I know that the Federal High Court sitting in Jos, had in 2008 for an alleged fee, annulled the election of Governor Nyako of Adamawa State. But three months later, the Adamawa people proved to the judiciary that they could also judge for themselves. They voted Nyako in the rerun by an overwhelming historic victory, winning 224 out of the 226 wards.

        On the National scene, President Buhari himself was a victim of courts subjugation. Twice he challenged the results of the presidential elections to which he was a candidate, but the government of the day allegedly bribed the courts to disfavour his case.

        The judicial compromise had been in most cases done brazenly, just like the involvement of Governor Nyesom Wike of Rivers State, who, mobilized the State’s Commissioner of Police that allegedly brought with him three trucks load of armed policemen, to prevent agents of the DSS from arresting Judge Abdullahi Liman along with a stash of $2 million cash that he allegedly kept in the house.

        Though by now other corrupt judges and their lawyer mutual friends in this criminal enterprise would have removed from their homes or office premises any implicating evidences, including cash, similar raids should continue, but the DSS should not involve the police in the operation. They cannot be trusted.

        By the way, there is a need for IG to reshuffle states police commissioners and deploy only those that are ready to bury their greed and work for the good of this country.

        As for the wolf cry by the NBA, they should be ignored. Let them shut the courts, but that will not stop security agencies from executing arrests. Too bad that any judge being held now will be at the mercy of the threat action by the NBA. It means he will continue to rot in jail until the courts are opened. *Opinion of the writer pls*

Otherwise, disband the Police, the Armed Forces, Para Military Forces, the Courts so that we know we are in the jungle.     If agencies of the Federal Government decide to arrest a Federal High Court Judge( not a state high court judge oh) for any reason, what is the business of a state Governor in obstructing or “resisting” the arrest as Governor Wike himself said he did?
    With all sense of responsibility, I think that Governor Wike has set a very dangerous precedent that is capable of resulting into catastrophic consequences on the powers of the Federal Government vis-a-vis the states in the constitution.
    Unscrupulous politicians in the states may now capitalize on the seeming weakness of BUHARI’s Presidency to re-enact Wike’s brazen and irresponsible affront on federal government agencies legitimately going about their duties if nothing drastic is done to correct the anomaly that transpired in Port Harcourt saturday night.
    It’s up to the Presidency to act or to go to sleep as if nothing happened. But a dangerous seed has been sown!
