ICC Probe: Okonjo-Iweala says Falana ‘integrity-challenged charlatan’

Former finance minister, Ngozi Okonjo-Iweala, has reacted to a call by senior lawyer, Femi Falana, for her prosecution for crimes against humanity.

Mr. Falana had written to the International Criminal Court urging the trial of past and serving military and civilian Nigerian officials, indicted in an ongoing investigation into the diversion of billions of money meant for purchase of arms to fight Boko Haram.

“The failure of a former Finance Minister, Ngozi Okonjo-Iweala to prevent widespread and systematic corruption including the re-looting of the Abacha loot amounts to complicity under the Rome Statute, and therefore fits the legal requirements of a crime against humanity,” Mr. Falana, a senior advocate of Nigeria wrote.

In her reaction Monday, Mrs. Okonjo-Iweala dismissed the call as a “desperate joke by an integrity challenged charlatan”.

The malicious attempt by Lagos Lawyer, Femi Falana to mix Dr Ngozi Okonjo-Iweala up in issues that have nothing to do with her in his letter to the International Criminal Court (ICC) is a desperate joke by an integrity challenged charlatan (ICC).

This misadventure shows that the so-called learned lawyer does not have any idea of what the mandate of the ICC is about.

He has resorted to this action because his previous efforts to tarnish her name – through his discredited NGO, SERAP and petitions to the EFCC – failed because they were lacking in credibility.

This latest effort to try to attach her name falsely confirms that Femi Falana is nothing but a tool of corrupt elements whose interests were hurt by the work Dr. Okonjo-Iweala did in fighting corruption while she was in office.

These elements have now made a habit of making false allegations against Dr Okonjo-Iweala whenever she receives any national or international recognition for her work. The pattern is clear and Nigerians should be alert to it. But Dr Okonjo-Iweala will not be intimidated from going on with her life and performing her duties. She will not give in to cowardly and unmanly bullying.

Falana’s latest attempt to implicate Dr Okonjo-Iweala falsely suggests that he is suffering from an ailment that may be described as Chronic Cerebral Amnesia (CCA) because he simply has no grasp of the facts.

Here are the facts:

FACT NO 1: OKONJO-IWEALA HAS NOTHING TO DO WITH THE $2.1 BILLION ARMS CONTROVERSY

Contrary to Falana’s lies, Dr. Okonjo-Iweala has absolutely nothing to do with the alleged misuse of $2.1billion by the office of the former National Security Adviser. Falana and his sponsors are simply trying to invent a connection where there is none.

The January 20, 2015 memo in which Dr Okonjo-Iweala sought and received the approval of former President Jonathan for the release of part of the newly returned Abacha funds to the NSA for purchase of arms is totally separate from the $2.1 billion issue.

The memo which is now in the public domain speaks for itself. The release of the resources was in response to an approval by the former President following a meeting chaired by him after a committee had considered the request.

The memo clearly documented Dr Okonjo-Iweala’s insistence that the proper procedure be followed, subject to appropriation and according to financial regulations. Dr. Okonjo-Iweala went further to state that the former NSA should account for the funds to the former President since she is not a member of the Security Council. The attempt to link Okonjo-Iweala to the $2.1billion issue is therefore dead on arrival.

FACT NO 2: OKONJO-IWEALA WAS NOT IN GOVERNMENT WHEN MOST OF THE ABACHA FUNDS WERE RECOVERED

Falana and his sponsors have claimed that billions of dollars of Abacha funds were recovered and that Dr Okonjo-Iweala should account for the recovered funds.

The fact is that some of the funds recovery was done under the regime of General Abdulsalami Abubakar and the first term of President Olusegun Obasanjo when Dr Okonjo-Iweala was not even in government.

During the time Dr Okonjo-Iweala was Finance Minister in the second Obasanjo administration, $500m was recovered. As documented by the Field Study conducted by the World Bank with the assistance of national and international NGOs, this amount was properly applied.

Falana’s insistence on the contrary shows how despicable he is and how he is ready to ignore facts and concoct a fiction in the service of his sponsors.

FACT 3: OKONJO-IWEALA LEFT STRONG LEGACIES AS A CHAMPION OF TRANSPARENCY AND THE FIGHT AGAINST ​CORRUPTION WHILE IN GOVERNMENT

It is on record that Dr. Okonjo-Iweala championed transparency and vigorously fought corruption during her two terms as Minister. Among other actions, starting from the second Obasanjo administration, she, for the first time in Nigeria’s history, published monthly revenue allocations to all tiers of government for Nigerians to see.

​​While serving in the Obasanjo administration, she requested the assistance of the World Bank and DFID, the UK’s development agency to build institutions and systems that could block leakages from the treasury. This work stalled after she left office in 2006. In August 2011 when she returned under the Jonathan government, with the assistance of the Ministry of Finance Team, she re-invigorated the establishment and use of the Integrated Personnel and Payroll Management Systems (IPPIS), the Government Integrated Financial Management System (GIFMIS) and the Treasury Single Account (TSA), all of which saved the country billions of naira by drastically reducing avenues for corruption in the public service. These facts are well documented in successive World Bank, DFID and IMF Article 4 Reports.

It is gratifying that the present government has adopted and is further building on these systems for the benefit of the country.

FACT NO 4: DR. OKONJO-IWEALA’S MOTHER WAS KIDNAPPED AND ALMOST KILLED BECAUSE OF THE FORMER MINISTER’S STANCE AGAINST CORRUPTION

Falana is callous beyond belief for ignoring a fact of recent Nigerian history: the kidnap of Professor Kamene Okonjo, the then 83 year old mother of Dr Okonjo-Iweala by agents of fuel subsidy fraudsters who were angry that the former Minister had blocked them from defrauding the country further.

The kidnappers had told the traumatised old woman that they were sent to punish Okonjo-Iweala for refusing to pay some oil marketers. It is on record with the State Security Services that the kidnappers initially demanded the resignation of Dr Okonjo-Iweala in return for the release of her mother. Thank God Professor Okonjo is still alive to tell her story today and she will not be silenced.

It is extremely insensitive and, in fact, inhumane for Falana and his sponsors to level false accusations against someone like Dr Okonjo-Iweala who went through this kind of searing personal ordeal for her principled fight against corruption.

CONCLUSION

Falana’s attempt to implicate Dr Okonjo-Iweala falsely is a disservice to law, justice and the image of the country. It is sad that a person who had earned some prominence as a human rights lawyer now tramples on the human rights of others as a political jobber.

He and his sponsors are engaged in nothing but media harassment, cyber bullying and intimidation against innocent persons like Dr Okonjo-Iweala for political and pecuniary gain. That is why Nigerians should not give in to Falana’s self-imposed Chronic Cerebral Amnesia (CCA).

            The exchange rate has continued to depreciate because the government has reduced interest rates while at the same time it is proposing an increase in government spending- 6 trillion Naira of which 2 trillion would be borrowed.
            This government intends to spend itself out of the recession . The immediate impact is an increase in money supply. Without taking into account the external sector component.
            That is why the Naira has continued to depreciate.

            I will ignore for the moment your uncouthness and shall respond only for the benefit of readers. The value of the naira is a manifestation of the net in and outflows of exports/imports, FDI, hot money, interest rate (in the event that Nigeria attracts significant amounts of money chasing higher rates of return in interest (otherwise called “hot money”) etc. Nigeria (with its use of the current forex exchange rate) has made it unattractive for foreign investors to invest foreign currency derived FDI or investments into Nigeria’s stock exchange because (1) they believe the exchange rate is over valued and due for an imminent correction, (2) they believe that it may be difficult to extricate their investments from Nigeria because of the CBN’s use of the antiquated fixed exchange rate. The entire world already knows about the precipitous fall in the value of oil and the revenue challenge Nigeria currently has. All these factors puts adverse pressure on the value of the naira.

            The fall in value (as discussed) is a symptom of the problems a country has in its balance of payments and a possible lack of confidence investors have in its policies. It is also a symptom of the lack of funds available to the CBN to sell dollars in exchange for naira and stabilize the naira. The former government spent most of our reserves, saved nothing, increased our debt burden and granted untold waivers. In short, Nigeria is left with less than 29 billion dollars. At this point the defence of the naira is no longer practical. The naira will have to be left to depreciate with the hope that the depreciation of the naira will be a short term problem that will be balanced out by massive inflows of FDI and foreign investments into our bond and stock markets.             The economy at the moment is weak. There is weak demand and that is affecting industries, employment and ultimately FG revenues accrued through taxation. A strong naira is no longer (and should no longer) be the main goal here. The main goal should be to stimulate the economy and to keep GDP growth moving along. In that respect, increased government spending, lower interest rates (for the benefit of the domestic manufacturers and domestic borrowers and not to attract “hot money” chasing high rates of interest (which does not come to Nigeria in any event)) and reduced taxation should be the goals. In Nigeria, most people do not pay taxes. It therefore has to ensure that tax coverage is broadened whilst the level of taxes stay the same.

            Maintaining a strong naira but have an economy where all industries are going under because there is no demand for goods and no jobs for people is counter productive. The naira has to find its level.

            Granted, an increase in money supply is a side product of increased govt spending. The CBN will have to monitor money supply indices in order to know when to reduce money in circulation in the economy the moment the economy starts to overheat. At the moment, that is the least of Nigeria’s problems. It is fighting off a recession. Injection of stimulus is the way to go. Stimulus is done by lowering interest rates, allowing banks to keep more money, and allowing more money supply into the economy (monetary tools) and by added government spending and lower taxation (fiscal tool).

            At the moment, No change to taxation has been made. There is a proposal to increase VAT and extend coverage. The budget has not been passed so there has been no change to FG spending. It is following the budget used by the previous govt. Nigeria at the moment is being controlled by the monetary tools of the CBN.

            I do not need your lectures on matters of economics nor do I need to know that you are doing or have a PH.d in economics. Nor does the revelation add or detract from what was written by you above.

    not been able to say anything meaningful on that.

    Ngozi, as I’ve often told your passionate supporters, cursing and swearing at those who raise these questions won’t stop the questions from coming. The questions will keep coming, because many of them are valid questions.

I have a lot of respect for her as an achiever, but if you are being accused on integrity issues, the international awards you have won do not count at all. Neither does she have to go personal in using all kinds of derogatory language against her accuser. With all due respect, such reactions smack of immaturity. I fail to appreciate why she does not expect that she would be asked to account for monies paid out under her watch as Minister and more importantly her response is absurd………. There is so much you can take when the so called ‘prominent’ persons continue to make unsubstantiated allegations against you. It’s a known fact that there is an organized witch hunt of Ndigbo who served under Jonathan by the Yoruba elites and press. If this Falana have any evidence of financial crime against her the courts and other agencies are there and not this macabre dance. However, I never get involved in discussions with those who always see a tribal conspiracy in everything. Crime is crime, and has no tribe. One of the biggest hindrances to Nigeria’s development is that people see tribe in everything. A criminal is being brought to justice and suddenly it is seen as tribal persecution. If the suspect is Igbo, then it is a “Tinubu” conspiracy. A Finance Minister under whose watch the country was looted blind is being asked to explain her role, and it is being seen as another tribal conspiracy! I just don’t have the nerve to engage such narrow minds.

        The tribal conspiracy theory is, unfortunately, the legacy from our older generation – especially those 70 and above who have over time twisted and massaged the civil war story.     What Nigeria desperately needs now, at a time of global oil price dip is a brilliant economic strategy to diversify Nigeria’s economy. 80%, if not 90%, of Buhari’s efforts should be directed towards that goal. The kind of press releases we ought to read from the Buhari team should be about efforts of his government to alleviate poverty and joblessness through agriculture, industry, mining, manufacturing etc. while attracting foreign investment into these important sectors. As corrupt as Jonathan’s government was, it crafted the industrial development policy, agricultural transformation, ICT policy etc. Up until now, the Buhari administration has not sponsored a single bill in the National Assembly to demonstrate its seriously on key issues of industrialization, infrastructure development etc. After the presidential media chat, a Nigerian commentator said he was impressed Buhari could link security to development; what mediocrity? I would be surprised if we elected a President over an economy worth over half a trillion dollars who couldn’t figure that out. Come-on Nigerians, stop elevating mediocrity! If we continue this way, and do not put this government on its toes, by the time we wake up from our slumber the Naira would be N500 to a dollar.

    While an anti-corruption campaign is good, it must be done within the ambit of rule of law. Further, this particular anti-corruption campaign is ill-timed. In the 21st century, no serious nation fights corruption with a strongman, but with strong institutions, processes and systems. This is the point the intelligentsia which Dr Ngozi Okonjo-Iweala belong have made. The Treasury Single Account – TSA, Integrated Personnel Payroll and Information System – IPPIS, Fertilizer Procurement Wallet System etc are all systems developed by Jonathan’s ministers (Drs. Iweala and Adesina). These institutions, processes and systems will indirectly fix corruption; they will make it easy to fight corruption because the lines would have been clearly drawn. It would be easy to identify those who crossed the line. In the present circumstance, the lines are not clearly drawn and therefore nothing meaningful will come out of these court cases. They are mere waste of time. The judiciary is already hinting at lapses in the cases brought before it; not necessarily because the judiciary is corrupt, but because there are no clearly drawn lines. The judiciary functions under certain constraints, whereby someone is not pronounced guilty just because the majority feel he’s guilty but based on the weight of evidence which proves the accused has crossed the line. In summary, what we need the most are policies, institutions, processes and initiatives that would enhance economic growth through diversification while plugging leakages in our economy.

    Ngozi Okonjo- Iweala was a prominent member of the Jonathan administration.
