Online Petition asking Buhari to resign gathers momentum

An online petition calling on President Muhammadu Buhari to resign for disobeying court orders to release some high-profile detainees has gathered over 600 signatories in just over 48 hours of being created.

The petition, created by lawyer, Carol Ajie, followed comment by Mr. Buhari that a former National Security Adviser, Sambo Dasuki, who is being prosecuted in relation to an alleged misappropriation of $2.1 billion; and the leader of separatist group, Indigenous People of Biafra, Nnamdi Kanu, despite court orders that they should be freed during last Wednesday Presidential media chat.

So far, the petition has collected 680 signatures out of its 1,000 person target.

“On May 29th 2015, a former Military Dictator, Muhammadu Buhari, sequel to a contested election in March 2015 against a sitting President in Nigeria, the first time in Africa, an incumbent handed power peaceably, smoothly, heroically to a political rival,” the petition posted on Change.org read.

“Whereupon Mr Buhari then took the Oath of Allegiance to protect the Constitution of the Federal Republic of Nigeria 1999 and the President’s Oath of office to discharge his duties faithfully, in accordance with the Constitution and the Laws of Nigeria.

“Within President Buhari’s first year in office, too soon after he took the revered Oaths, he and state agents acting under his supervision, now demonstrate total lack of respect for Court Orders and at his maiden media chat on Wednesday 30th Dec., instant, Mr President made puerile attempts to justify these breaches, he said inter alia that some persons his regime locked up in cells dehumanized against court orders, Nnamdi Kanu had travelled without his passports.

The petitioner argued that the government should have deported Mr. Kanu or release him after detaining him for a period of not more than seven days instead of holding him indefinitely as stipulated by the Immigration Act or the Administration of Criminal Justice Act.

“But under the Immigration Act, the President or the Minister may deport anyone who travels without a valid travel document or detain for a period not exceeding 7 days. In holding Mr. Kanu beyond the required period they have infracted on the Immigration Act, the Administration of Criminal Justice Act, the Constitution of the Federal Republic of Nigeria 1999 and subsisting court orders.”

She further stated that Mr. Kanu’s agitation for the emergence of a breakaway country called the Republic of Biafra is in line with the right of self-determination as stipulated by the United Nations Covenant on Civil and Political Rights, which Nigeria is a signatory to.

“With regard to issues of “self determination”, the crux of Nnamdi Kanu’s campaign of the Independent People of Biafra, IPOB, having communicated IPOB’s intent to all and the United Nations as required by UN Covenant on Civil and Political Rights ratified by Nigeria, that people of any community or group may wish to exercise the right of self-determination with a view to pursuing their economic, social and cultural development; aware that their dignity as human persons had deteriorated and been consciously degraded under the present dispensation, sadly appearing power inebriate.”

She, therefore, called on Mr. Buhari to resign as President if he is not prepared to obey court orders or risk being impeached from office.

The Presidency declined to respond to the petition.

An official said it would be inappropriate for the presidency to dignify such a petition with a response.

He however said, “The truth is there are fresh charges against the detainees,” the official said.

“They were simply rearrested after they were released folowing the filing of fresh charges against them. So we don’t know what people are talking about when they talk about the government disobeying court order.”

    I am no political apologist but I think in a democracy, court orders are expected to be obeyed and the rule of law upheld but if these detainees were released and rearrested under fresh charges, the Government cannot be accused of acting against the law. It has become a war of wits. The accused are trying to use the technicality of the law to escape detention but Government, convinced that they deserve to be prosecuted, has slammed them with fresh charges. The truth is that it takes a really determined leader to fight corruption in Nigeria. We have such a man in President Buhari who, I think, needs to be encouraged in his crusade to rid the nation of corruption. Nigerian leaders have continued to steal from the public treasury because they always get away with it. If several high profile thieves are thrown into prison for their theft, others will learn a lesson. On Kanu’s case, I was 8 when the Nigerian civil war started and I witnessed a little of the terrifying ills of war. Any talk of Biafra therefore evokes terrifying memories in my mind. I think no one who witnessed those dark days would feel otherwise. Even though the movement to actualize a sovereign state of Biafra is supposedly peaceful, flashes of violence have from time to time been reported in connection with it. Besides, inciting people to secede from a legitimate entity like Nigeria is nothing nut treasonable, the claim to the right to self determination notwithstanding. I am also not quite sure it is in the interest of the Igbo or any other section of the nation to break away from the Nigerian entity. I believe they need the other parts of Nigeria for their highly enterprising spirit to continue to thrive. It is tempting to think that once they achieve “sovereignty”, all their woes will be over but even they themselves know that is a pipe dream because the proposed Biafran nation is not ethnically homogeneous. I see real, real fight for supremacy ruining the show. No one is saying that they do not have good reasons for their agitation but if they strongly want Biafra, let it be put to vote as was done in the case of Quebec in Canada.

The UN charter on self determination was the reasons why French West Africa governed by France as a single administrative unit with HQs in Dakar became
    Senegal, Mali, Burkina Faso, Ivory coast, Benin, Togo, Niger. Reasons why, Southern Cameroon left Nigeria in 1961 and British East Africa
    became 20 small nations at Independence. The motions and discussions for Independence were not based on the whims and caprices of individuals but involved deep thoughts, planning, thinking, debates in parliaments.When the motion was moved for Nigeria`s Independence, Southern Cameroon moved a motion not be part of Nigeria. We never heard ZIK and Eastern Nigerians politicians, representatives, Chiefs or legal minds raised any counter motion to withdraw from Nigeria, even at Independence or when Nigeria became a Republic.

There were several persons granted bail but never released by the Jonathan`s govt. To wit, the APC ICT
    staff arrested by DSS, were kept in DSS custody till few days to Jonathan`s exit in spite of court orders. Nobody called for Jonathan`s resignation or impeachment. Large swat of Nigerian territory bigger than SE were seized and occupied by insurgents,millions declared refugees, displaced and now IDPS, scores killed during a a scam NIS recruitment, National Assembly invaded , parliamentarians tear gazed and prevented from gaining access into their chambers. There were no calls for impeachment on all these impeachable offenses. He was democratically elected by Nigerians as their President for 4 years to protect and defend Nigeria`s territorial integrity and to protect lives and property of every citizen. The constitution of Nigeria provides on how any citizen could renounce his or her citizenship.The
    first symbolic step of Kanu and his apologists could have been for them to publicly burn their Nigerian passports, voters Id cards, relocate to

The laws of Nigeria just like in the USA and UK provides for every organization, group or radio station to be duly registered and regulated with the relevant Govt agencies..     The UN itself cannot set up any of its offices in Nigeria without signing Headquarters Agreement with the Federal Govt of Nigeria. There is no groupings, bodies, organisations, institutions that are not registered or regulated in the UK and USA where you reside and practice. Is there any media houses broadcasting illegally there? Yet, you would prefer Nigeria to accept every form of illegality including threats to her survival and citizens. In any Federal system like us, it is lot easier to define and identify issues bordering on marginalisation. The Federal govt has MDAs. Under MDAs we have Ministers, Perm Secs, Directors, DGs, Ambassadors, Board Chairmen etc. Give us a table and ratio of IGBOS appointed vis a vis other tribes and geo-political zones. On the issue of presence of Federal Govt agencies, research institutes, tertiary institutions, law schools, military facilities, international airports etc give us a table of those located in SE vis a vis other zones. Are Ibos refused recruitment into the NA, NPF, Customs,Immigration, Road safety etc? Volunteer statistics of the number of Igbos in these services vis a vis other tribes and geo political zones. In terms of appointments. Is there any positions from Governor General, President, Military Head of state, VP, military second in command, IGP, COAS, COMPTROLLERS, SGF, Senate/ deputy Presidents, Speakers/ deputy speaker, Ministers in all the Ministries, Ambassadors, Presidential candidates, PDP, APP, Chairmen, Governor of CBN,INEC Chairmen etc that have not occupied by Igbos? Even tribes from other geo-political zones who contributed more men and soldiers to fight the civil war have not smelt any of those positions. In terms of road and other projects; marginalization would have been meaningful if the SE were in opposition in the last 16 years. But the SE was under PDP and even Anambra under APGA was an appendage of the PDP. There ecological funds were mainly shared to PDP states. Are SE states refused Federal allocations? 3 SE states are oil producing and integrated into NDDC projects and programmes. There is no SE state that have constructed any airport, Olympic size stadia or any signature projects in the last 16 years. No SE state in the last 16 years have hosted any Super Eagle match, any national events, beauty pageant or music awards. Less endowed states like Kogi, kwara, Jigawa, Edo have constructed stadia and some airports. Cross river with little resources and no oil fields since Bakassi went to cameroon is more prosperous, developed and a modern state than any SE states. Compare Abia, Anambra and Akwa Ibom all oil producing? Uyo hitherto a back water village has been transformed into Dubai whilst Aba which used to be the commercial nerve centre for SS, SE , Cameroon, Gabon and Eq Guinea metamorphosed under PDP into a ghetto. The Abia state Governor sacked all non indigenes from AS Public service. The hanging bridge Fashola constructed in Lagos is as long as the 2nd river bridge. Why can`t Anambra and 2 other SE states construct a bridge across river niger and toll it, if they have any interest for their people? If Jonathan had won would the SE be singing biafra songs? During the campaigns, every Igbo politician, traditional ruler, business man, socio cultural groups were campaign organisations for Jonathan and PDP. Jonathan was not only a son but an inlaw. TAN an Igbo organisation was in charge of Jonathan campaigns. They published all sort of achievements under Jonathan.No songs of marginalization then as the Igbos have never had it so good? The error most of us commit is that, since PMB is from the North and moslem, he should not appoint any other Northerner or moslem. We failed to appreciate the fact that, we have 6 geo-political zones each with 5 or 6 states. That, we are in a multi party democracy of which appointments and positions in the executive, legislative are driven by the constitution of the FGN, prerogatives of the President, Governor and dictates of the ruling party or zoning formula. Nobody raised any eyebrow or cried of marginalisation when Anyim, Ngozi, stella and Diezani were made SGF and super ministers all Igbos by either birth or marriage. Nobody raised any issue when 90% of GEJ`s SA were christians from SS and SE including his NSA from Bayelsa state. Nobody raised any eye brow when Jonathan replaced an Igbo as COAS with someone from River state? There were no fuses when the President and Minister of petroleum came from same state and Minister for Finance and Governor of CBN came from same tribe and senatorial district by birth. There were no fuse when all the maritime contracts including surveillance of our waters,pipelines were awarded to Ijaws and to OPC and massob before elections. Let the SE people look inward and ask their leaders especially the PDP to explain what they did with all the resources and appointments in the last 16 years? Under Jonathan, Lagos state had no Minister of state until Koro was appointed as Minister of state. Aganga representing Lagos was from Edo state. 70% of the juicy committees at the NASS were headed by SS and SE. We await your publication.

          Mr Ayo.Who is marginalising biafrans?.Every state has 3 senators and at least 24 members of the house of assembly.The number of members of house of reps varies from state to state,but that is beside the point.All the appointed and elective positions in the five biafran states are held by biafrans.Yet in Lagos,there are biafrans representing the good people of Lagos state at the National Assembly.A biafran was a commissioner in Lagos for nine years.Many biafrans are employed in the civil and public services of Lagos,including the judiciary as judges and magistrates.If you go to Alauas secretariat in Ikeja,you will see many biafrans working there.
          biafrans are not prohibited from speaking their language or practising their traditions and culture (Okija shrine and Osu caste)
          When the biafrans’ personal lord and saviour( or boy boy,more like) badluck jonadaft was allegedly,in power.the ministers of power,finance and coordinating minister of the embezzlers,aviation,health,labour,state for foreign affairs,were biafrans.
          The secretary to the government of the federation, the deputy senate president and deputy speaker house of reps were biafrans.
          The chief executive officers of the following organisations were all biafrans:
          Nigerian Energy Regulatory Commission, Nigerian Communications Commission,Central bank governor,Securities and Exchange Commission,Nigerian Stock Exchange,Investment and Securities Tribunal,Sovereign Wealth Investment Authority,Debt Management Office,Nigerian Broadcasting Commission,Nigerian Airspace Management Authority etc etc etc etc.
          Please note that the Federal Airports Authority has eight executive directors out of which five are biafrans,can you imagine.
          By necessity,the foregoing can not and does not purport to be an exhaustive list of the positions held by biafrans
          How can any one in good conscience say biafrans have been or are being marginalsed.
          Please note that 9 years after their self-inflicted civil war,a biafran was elected the vice-president and another biafran was the speaker house of reps(this was between 1979 and 1983)
          In 1992,a biafran was elected as the deputy speaker of the house of reps.
          Between 1999 and 2007,five biafrans were elected as senate presidents.
          If biafrans claim they are marginalised because no biafran has been elected president,then I will tell you that over 300 ethnic groups in Nigeria have been marginalised too.This is because only four ethnic groups in Nigeria have had their sons being elected as the chief executive of Nigeria viz:
          1.Sayawa : Tafawa-Balewa
          2.Fulani : Shagari, Yar’adua and Buhari
          3.Yoruba : Obasanjo
          4. Ijaw : badluck jonadaft aka Fortunato.
          All the other leaders we have had were military rulers who were selected based on the role they played in the coup that brought them to power,or some other criteria not known to us “bloody civilians”,and one of them was a biafran,Ironsi,whose incompetence was so glaring that it can not be exaggerated.
          If my memory serves me right,biafrans have always been in the officer cadre of the military and nothing stopped them from attaining the position of head of state,like their peers.
          If biafrans expect we Nigerians to coronate one of them as president because of all their wailing,then they need to wake up and smell the coffee.It aint gonna happen.
          They have to go out there and canvass for votes and if the majority of voters vote for a biafran as president,so be it.But it will never happen after all the gratuitous insults they have showered on every ethnic group and the activities of morons like nnamdi kanu and his band of criminals.Noboby trusts biafrans because they are criminals.If a biafran becomes the president,they will sell the country and after that,they will break away and grab the south south,the non-ibo majority of whom want nothing to do with biafra.

        Ndume was charged with` unsubstantiated` charges of complicity to BH activities, granted bail, remanded into kuje prison and when his bail conditions were met, he was released. Upon his release the FGN never pressed any new or fresh charges against him. He was not charged for treasonable felony. The Federal High Court in March 2012 later suspended the trial for want of evidences. Ndume`s case is different from that of Kanu in scope, ocular evidences, charges and levels of involvement. Kanu is the leader, head and chief propagandist of an organisation whose objectives borders on planning succession, over throwing a constitutional govt, dismembering Nigeria and threatening and plans to kill other tribes. Kanu has never denied any of his speeches, broadcasts and leadership of an illegal group planing to kill other tribes, dismember Nigeria and create a state of Biafra. It is immaterial before the law when Kanu agitations started but when it became a threat to the sovereign state of Nigeria. What is material to law are his messages, speeches, activities and when he was arrested. An organization could be form as a pressure group but could subsequently metamorphosed into a political party or terrorist group. If all these illegal organisations, militant groups flourished and their leadership recognized under Jonathan, it means Nigeria under Jonathan was a haven for terrorists, organised crimes, corruption, money launderers and terrorist financiers. Will anyone wonder, why OPC , Niger Delta militants, Massob and cultism flourished in Nigeria. Will anyone doubt, why Nigerian ranked 44th in Africa as the most dangerous place to live in Africa above Somalia, South Sudan, DRC and CAR.Will anyone doubt why he associated with Massob , OPC leaders and awarded them security contracts. Recall that, OPC and Massob also publicly endorsed Jonathan and assiduously campaigned for Jonathan. Massob might have called for sit down protests , but also organised anti -jega and card readers protests and campaigned for Jonathan.. Broadcasting illegally in any jurisdiction is a crime and against International and national laws. The so-called Radio change was a pirate radio station floated by PDP and Dasuki to cause the arrest of APC leaders especially Tinubu. If such a radio station existed, why were the operators not identified and arrested by the DSS? Did the SE really voted for Jonathan overwhelming or they rigged overwhelming for him in 2012? I am a servant of the truth.

    I really pity commentators who see nothing wrong in disobedience of court orders by the president. Remember the world is a global village and the international community is watching. Once it is perceived as it seems that democracy which is the darling of the world powers today is being turned into despotism in Nigeria, Nigeria will be in trouble. The earlier Buhari is told the truth the better. Allowing this accused bail does not in any way spoil his case. He can still achieve whatever he wants including getting them jailed if found guilty, but disobeying court orders is already painting him black. He should watch it.

The president acted unpresidential when he came up with the assertion the Dasuki mishandled finances meant for fighting insurgence in the northeast, recanting how many people may have died based on the action of Dasuki …. That to me was petty and sentimental for a president to condescend to…… First we all know if it were for money the war would have been over a long long time …. The federal government should publish how much has been already spent on the war ….. Nigeria is loosing over $1m everyday in the war in the northeast.

      The president himself should be tried for his involvement in sponsoring the insurgent group, all the insurgent controlled area gave the president over 97% votes….. It is on record that on the assumption of office more 60% of Boko haram fighter voluntarily dropped their weapon….. The president is accusing the Dasuki for diverting some money for private use but the president forget that many watchers believe tacitly supported the insurgent group and that he is a sponsor and believer in their cause. And a lot evidence points to that…. We all know Dasuki fought the insurgence when no northern would dare to, even the president. Dasuki is Nigerian hero who defiled the thinking of many in the north to help southern president resist the brigandage going on in the north…. Our believe is that Buhari is hunting him because Dasuki frustration of the Buhari loyalist from further embeassing a seating president out of power…. Time will tell between Dasuki and Buhari who did the country the greater evil whether the one who used some of the security vote to sponsor a campaign or the very sponsor of the insurgency …. Who is indeed responsible for the killings Dasuki or Buhari?

        Indeed Buhari collected $300,000 as initial compensatory payment following Boko Haram attack on his person sometime in 2014. His bullet proof car worth Millions was also replaced with new ones by Dasuki…

        Same compensatory payment was entrusted on and delivered through Nduka Obaigbena to media houses affected by boko haram attacks….

        Taking advantage of his office as president, however he has denied collecting the sum from Dasuki while admitting receiving the cars (convenient picking and choosing, you may say). Since he is above investigation or indeed trial, Dasuki is on his own as no one dares attempt to prove or disprove Dasuki’s claim in respect of Buhari…

        Sad enough though whereas his worshipful supporters are quick to condemn with the harshest burst of emotions all persons roped in the so-called Dasukigate, they have not been slow in suspending their doubts or pillory of Buhari’s hypocritical and mendacious denial….

    Carol Ajie’s reasoning is on shaky ground with this petition. Nnamdi Kanu committed many offences: the immigration one is one of the lesser ones. The main one is soliciting for arms against Nigeria and openly and on tape (physical evidence) planning secession, asking for funding and collecting funds, then he moved past planning stage he set up transmitters on Nigerian soil in furtherance of his secessionist plan and he has identified the area of land mass and the peoples that would be dragged into his Biafra and not only that, he arrived in Nigeria to recruit people, because that to me is why he came into the country. So he is to be charged for treasonable felony. The State withdrew the lesser charge and took him to another court to charge him with another charge and he refused to give a plea upon which the judge asked the case to be reassigned. So which bail is he still screaming about. When the judge granted him bail he had not been charged with treason, otherwise no judge would have given him bail. Now that he has been charged with treason he is as good as not getting bail, so where did the DSS go wrong? I am always curious when people who know the law say funny things like Carol Ajie is saying. Then on Dasuki, like I said on another forum which led me to this site, Dasuki will continue to be granted bail, bailed and re arrested for as long as there are more cases arising from his grand larceny.

Hence an accused person’s right to personal liberty cannot be curtailed in perpetuity unless and until he’s pronounced guilty by a competent court not the head of the executive. Pursuant to the right to fair hearing, an accused person is presumed innocent until proven guilty; not guilty until proven innocent…

        3. The rule of law not rule of man or men constitute the democratic order….

        4. Constitutionalism…

        5. Free and fair periodic elections as retaining the means for guaranteeing peaceful political succession…

        6. Free speech and a free and vibrant press, among others….

        But in just seven months into his election as the country’s president, all we have seen Buhari do is terrify and bedraggle the democratic ethos all in the name of fighting corruption….

    The issue about your country Nigeria is that it is a unique country and does unique things. No one should be above the law, no mater the name they bear. The courts are there to protect the president and the citizens of the country. The court should be obeyed. That is the issue that is at stake. It is not about how people feel about it. Today it is about somebody you may know whom the rulers of your country have refused to obey the orders of the court and release them. Tomorrow you may be the one who will be denied justice. Dictatorship creeps in gradually when the institutions that grantee them are despised and reasonable people out of sentiments choose to keep quiet. The courts should be obeyed.
