FACT CHECK: Is Nigerian govt violating court orders by detaining Biafra leader Nnamdi Kanu?

On February 28, some prominent Nigerians led by former Central Bank Governor, Charles Soludo, addressed a press conference where they demanded the release of Nnamdi Kanu, the leader of the Indigenous People of Biafra, IPOB, who has been in detention for over one year on allegations of treason.

Mr. Soludo’s group, Uzuku Umunna, which also included former presidential candidate, Pat Utomi and former chairman of the electricity regulatory commission, Sam Amadi, gave reasons for their demand; one of which is the alleged ‘illegality’ of holding Mr. Kanu in detention despite ‘court orders.’

“A situation where the state refuses to obey clear and legitimate court orders for his release and holds him until it gets a favourable order; moves the goalposts endlessly through endless amendment of the charges against him; and now seeks to try him in secret clearly constitutes circumstances that would fall well short of the constitutional guarantees of due process,” Mr. Soludo, who spoke on behalf of the group, said.

The call by the Uzuku Umunna is similar to that by other Nigerians who have challenged the federal government to seek better ways to resolve the Biafra agitation in the south-east; with many insisting Mr. Kanu’s detention is illegal as it allegedly violates court orders.

But, does his detention violate any court order?

FACT CHECK

Like Mr. Soludo, Mr. Kanu’s lawyer and indeed Mr. Kanu have reiterated that stance since an Abuja Division of the Federal High Court ordered his (Kanu’s) release on December 17, 2015.

Reacting to his continuous detention, Mr. Kanu and his lawyers accused several judges of refusing to toe the line of the December 17 judgement by Justice Adeniyi Ademola, in a bid to fulfil the aspiration of the current government.

“After Kanu was granted bail on December 17, the president was heard saying at the presidential media chat that he (Mr. Kanu) will not leave the prison cell for any reason. That bail was made known to Federal Government on 18th December 2015 but they failed to grant the bail,” said Mr. Kanu’s lawyer, Ifeanyi Ejiofor.

The defendants also filed various requests, both at the Appeal Court and the Community Court of Justice of the Economic Community of West Africa, ECOWAS, demanding that the judgements sanctioning the continued detention of Mr. Kanu be regarded as a flagrant abuse of the order made by a court of coordinate jurisdiction.

The argument by Mr. Kanu’s lawyer was that the defendant was granted bail by the court but was not allowed to enjoy the bail till the prosecution secured a contrary order from the same court.

The above excerpts from Mr. Soludo’s remarks regarding Mr. Kanu’s detention echoes the point of view of Mr. Ejiofor, and indeed the IPOB leader on the matter.

REVIEWING COURT RULINGS

The first court ruling discharging Mr. Kanu was on December 16, 2015.

On December 16, 2015, a Magistrate Court in Abuja discharged Mr. Kanu, after he was first arraigned, following the withdrawal of the charges against him by the prosecution.

The Magistrate, Shuaibu Usman, struck out all criminal charges levelled against Mr. Kanu after counsel to the State Security Service, Moses Idakwo, filed for discontinuation of the matter on the instruction of his client.

Mr. Usman said since the SSS, through its lawyer, had filed for a discontinuation of the case, he had no option than to discharge the accused.

Mr. Idakwo had in that court hearing stated that further investigations by the SSS had shown that charges against Mr. Kanu could not be entertained by a Magistrate Court due to lack of jurisdiction.

A day later, a Federal High Court presided by Justice Adeniyi Ademola directed that ‘Mr. Kanu be charged to court or set free in the absence of a valid charge against him before a court of law’.

Delivering his judgement on December 17, Mr. Ademola hinged the grounds for his decision on the fact that the defendant had not been charged before a court of law.

The judge further said it was against the provisions of law for any party, including the state, to hold an accused captive for so long without a valid charge.

In other words, the judge said Mr. Kanu was to either be promptly released or charged to court.

A day after Mr. Ademola’s ruling, the federal government filed fresh charges against Mr. Kanu at the Federal High Court, in what appears an obedience to the court order.

The Federal Government filed a formal charge against Mr. Kanu on December 18, 2015. The new case was filed at the Abuja Division of the Federal High Court.

In that first charge at the Federal High Court, Mr. Kanu was accused of committing various offences bordering on alleged treason.

Reacting to the new charge, Mr. Kanu cast a vote of no confidence in the court, saying he preferred to remain in prison than to be subjected to a court hearing whose decision would not be respected.

Following Mr. Kanu’s remarks about the court, the judge, Ahmed Mohammed, recused himself from the matter, resulting in the transfer of the case file to the chief judge who then reassigned the matter to Justice John Tsoho, another judge of the Federal High Court, FHC, in Abuja.

REPEATED BAIL REFUSAL

On January 29, 2016 the court presided over by Mr. Tsoho refused Mr. Kanu’s application for bail, allowing his continued detention in prison.

On May 25, 2016, Mr. Kanu’s request to be granted bail at an appellate court in Abuja was also refused by a three-member panel of justices of the Appeal Court led by Abdul Aboki.

According to the judges, Mr. Kanu’s dual citizenship would increase the chances of him leaving the country, thereby jeopardising his case.

They also ruled that the allegation of terrorism earlier included in the charge against the defendants made it imperative that they should not be allowed bail.

On June 21, 2016, Mr. Kanu made another request for the replacement of Mr. Tsoho as  judge in his trial. The case was adjourned till September 26, when the first defendant reiterated his request asking that the judge be investigated.

In a petition addressed to the National Judicial Council and made available to journalists, Mr. Kanu said the conduct of Mr. Tsoho amounted to judicial rascality.

He cited the revocation of a previous decision against secret trial by the judge, as well as failure of the court to promptly avail the defence of court proceedings as grounds for the alleged offences in Mr. Kanu’s petition.

Subsequently, on that day, Mr. Tsoho withdrew from participating in the matter.

On November 17, 2016 Mr. Kanu made another request for bail after his case was transferred to Justice Binta Nyako’s court.

On December 1, 2016, the court refused Mr. Kanu’s application for bail yet again.

After his charge was amended to exclude terrorism allegation on March 1, Mr. Kanu again demanded to be granted bail.

The request, made at the FHC in Abuja, venue of his ongoing trial, will be decided on April 25.  There will be hearing on April 27 on a similar application pending at the ECOWAS court.

Mr. Kanu was first arrested on October 14, 2015 upon his return to Nigeria.

He was detained in the custody of the SSS until January 20, 2016 when the Federal High Court  ordered he be transferred to Kuje Prison where he has since remained.

While the continuous detention of Mr. Kanu may not be illegal and not in contravention of any court order, the calls by prominent Nigerians including the Uzuku Umunna, for a political solution to the Biafra agitation remains.

CONCLUSION: The Nigerian government is not violating any known Nigerian law by holding on to Mr. Kanu. His bail applications were refused, and the pending ones are yet to be decided.

      The image of the BUHARI-led APC
      government is now completely sunk in the gutters. The Buhai government is being
      angrily likened to a daft goat without any sense. The popular opinion on the
      streets is that President Buhari has made Nigeria more lawless and worse than
      it was under Goodluck Jonathan so much so that Nigerians say they will vote for
      Jonathan in 2019 if he is the candidate of the PDP party. This is a measure of
      the dis-appointment and anger stoked by President Buhari whose government is
      deemed an all-round failure in ethics and competence.

      Dr. Junaid Muhammed recently told the media that the majorly illiterate
      Hausa/Fulani states of north-west are limbering up to vote AGAINST Muhammed
      Buhari and throw him out of office as the worst president Nigeria’s ever had.
      This corroborates what I am trying to say here. The Buhari government is dead.
      Nothing good can come from its smelly corpse. Nigerians should learn from the
      mistake of voting a near-illiterate as president of the republic and resolve
      never again. The Buhari government is so corrupt that billions of Naira are
      being stolen every day in government offices. The corruption of the Buhari
      government makes his exit from power a necessity for Nigeria’s existential
      need.

          plans and is now mired in corruptive thefts. Just few months ago, in January
          this year, another Buhari appointee, Osita Aboloma, the D-G Standards
          Organization of Nigeria
          (S.O.N), reportedly issued authorization to
          some importers to bring in five (5) billion Naira worth of fake or defective
          car tyres into Nigeria. The tyres were then shipped in and made to legally pass
          through Customs because the importers had S.O.N certification on quality
          approval. Since we know that private profit is the motive of economic and
          financial crimes we don’t need to ask how much bribe was paid by the importers.
          All we know is Nigeria is in all sorts of troubles under the thumb of a very
          corrupt Buhari administration.

      I just watched a documentary on Discover channel, and I watched how the American Government threw a challenge to the Engineering companies on the eve of World War 2 by setting a deadline of 49 days within which the companies should DESIGN & MANUFACTURE a War time rugged Car. A company took the challenge and the Jeep was born. That was in 1940s. BUT 77years after, a brainless dumb sick man has put Nigeria on reverse gear with everything falling apart – incarcerations of political opponents, indiscriminate mass murders and mass burial by the Army (confirmed by Amnesty Int’l) etc, etc… and sick minds like you can’t rationalize but support blindly. When countries are busy setting up industries and large scale manufacturing centers/laboratories, Nigeria is investing on Pilgrimages and grazing routes. Nigeria still imports every single bullet, gun, gunpowder, and any form of armament for its military. Yet, we have 180 million people and billions of Dollars buried in toilets and other locations in private buildings all over Nigeria.

      Now a part of Nigeria says it wants to secede and you shameless lazy parasites are resisting. You want them to remain stagnant like Nigeria where dumb heads can become president? Biafra has come to stay. Lets wait till 2019, I hope Buhari or anybody from the North will step foot on Biafra land to campaign. Lets wait and see!

    What is puzzling to me is the insistence on fighting the inevitable decoupling of a hodgepodge of incompatible ethnic nationalities known as Nigeria.     As a proud Biafran one must not fail to express his indignation as regards the lingering injustice, marginalisation and psychological trauma the Igbos have been subjected to by the ruling elite in Nigeria.
    The hostility and animosity toward us continues unabated even up to this
    day. They hate us yet they don’t want us to go our seperate way. We
    must hate them in kind and force our way out of the federal zoo they
    call a nation. Exposing the monumental century-old Lugardian lie
    unilaterally told in 1914 should rather constitute a “task that must be
    done” than keeping Nigeria one. The ‘gospel’ according to ‘prophet’
    Gowon (preached decades ago and now by ‘saint’ Buhari) must be proven
    wrong!

    The Nigerian federation as presently constituted was not
    made or meant to favour our people’s general aspirations. It’s a
    confused so-called country with irreconcilable ethnic and religious
    differences. Only a peaceful or violent dismemberment could provide a
    lasting solution to the question of identity and diversity. To hell with
    unity! The federal ‘marriage’ of convenience or inconvenience isn’t
    working and can never work! Using brute force to make it work is akin to
    kicking a dead horse!

    Something terrible had happened some weeks back (precisely 27th
    February 2017) to a gentle Biafran at the Murtala Mohammed
    International Airport in Ikeja, Lagos. Upon his arrival from the United
    States one Charles Chuma Opara, a prominent member of the Movement for
    the Actualisation of the Sovereign State of Biafra, (MASSOB), was
    pounced on by operatives of the State Security Services (SSS) promptly
    arresting and detaining him. His crime? Belonging to MASSOB and being a
    brother to Ikechukwu Opara, another active prominent member of MASSOB in
    the US. The SSS had desperately sought information as to the activities
    of the seperatist movement based at home and abroad.

    And to obtain the information Charles, a Pastor, was
    blindfolded and taken to an unknown destination. And during gruelling
    moments of interrogation the SSS goons used horse-whips, night-sticks
    and riffle butts on his head and body! He was asked violently to give
    names and addresses of MASSOB militants in America. They refused the
    polite request of the man of God to call his family or a lawyer and even
    refused him treatment after days of excruciating torture sessions. They
    told him that he was on their hit-list like his brother. According to
    Pastor Opara he was lucky to have escaped from captivity because of one
    sympathetic SSS man who discreetly intervened on his behalf upon
    learning of his ecclesiastical calling. He was hospitalised for days as he recuperated from the manhandling and humiliation.

    The respected man of God is alive to tell the dreadful story
    but thousands of his compatriots of Biafran origin were not so lucky.
    Many had lost limbs and lives and others languishing in prisons across
    the federation for asking for Biafra! The security forces are always too
    happy to employ brutal means to quell any agitation for Biafra. They
    fire live bullets into the crowd often killing unarmed demonstrators and
    taking prisoners. And gloating over their murderous exploits! Some
    international human rights organisations like the Amnesty International
    had risen in strong condemnation of this flagrant violation of the
    people’s right to demonstrate in a democracy.

    But the spirit behind Biafra remains
    immortal! The idea is a great one in all its glory; it can never die for
    whatever reason least of all state repression or intimidation.

    It would be recalled that in 2003 the SSS
    operatives had stormed the village home of Charles Opara demanding to
    know his and Ikechukwu’s whereabouts from their aged mother and brother
    Emeka. They were both arrested, tortured and subjected to interrogation.
    Though the late Mrs Opara was released later Emeka remained in
    detention and up until now he’s reported missing! Mrs Opara died as a
    result of this SSS invasion and cruel methods and tactics!
    Nnamdi Kanu, the leader of the Independent Peoples of Biafra (IPOB)
    still remains in solitary confinement for years running for his vocal
    advocacy for Biafran independence. Despite court orders releasing him on
    bail the Buhari regime is still holding him captive. He was arrested
    and charged to court but judge after judge had found him worthy of bail
    yet he’s still suffering detention in the Buhari gulag!

    Buhari has never been known to be a friend of the Igbos. In
    deeds and utterances he has manifested, time after time, his loathsome
    disposition towards our dreams and hopes. His abhorrence of
    the Biafran idea is proven by the scorn and derision with which he
    treats the agitation for freedom. It goes to demonstrate clearly his
    resolve never to let our people go like Pharoah did to the Jewish people
    during the years of slavery in Egypt. But today Israel has reached the
    ‘promised land’ with or without a Moses!

    Buhari dislikes our natural guts, cultural
    greatness and economic wizardry hence the need for the continuation of
    the barbarism and subjugation. But everything that has a beginning must
    have an end. We’re too great a people under the Almighty God to accept
    permanently to be glorified second-class citizens in the land of our
    fathers and fore-fathers. Freedom must, therefore, ring from Onitsha to
    Owerri, Aba to Abakaliki, Enugu to Umuahia. The boundless energy and
    ingenuity of our people can only be released in full under the Biafran
    nationhood.

    If the Fulani terrorists (herdsmen, madmen, gunmen
    et al) could be invading households and villages — as thieves in the
    night — setting homes and farmlands on fire, raping, maiming and
    killing innocent citizens and evading arrest and justice then one
    wonders why those fighting for independence non-violently should be
    hounded down, tortured, imprisoned or killed gruesomely at the slightest
    provocation. Many towns and villages had fallen victim of this
    marauding terrorism with governments doing little or nothing to curb the
    violent invasions and encroachments. No one has ever heard of any
    Fulani herdsman being arrested or prosecuted for committing arson, rape
    or homicide anywhere!

    Is it a crime, if one may ask, the genuine
    agitation for self-determination of a people? Isn’t it legitimate and
    normal in the case of Biafra? No one can ever succeed to force
    togetherness upon a people determined to govern themselves otherwise. No
    one can wish it away either! The dream is still very much alive in the
    hearts and minds of millions of our people despite the organized state
    terrorism to quench the fire. Personally I’ve got no doubt in my mind
    that we shall overcome somehow, someday.

    Some instances would suffice here to buttress a relative
    point. Bangladesh and Pakistan were formerly ruled by Indians under the
    Indian sovereignty but today they both rule themselves after prolonged
    battles for self-determination. South Sudan fought years of brutal war
    with the Arabic establishment in Khartoum to liberate themselves from
    the Sudanese cultural and political domination. Today Juba has achieved
    national independence in tears and blood! Kosovo once suffered from the
    Serbian administrative diktat only for external forces led by the United
    States to bomb Slobodan Milosevic, the late “Butcher of the Balkans”
    into submission.

    The defunct USSR existed, much like Nigeria now, as a
    convoluted federation. Dreams and hopes were stifled and suffocated as
    peoples struggled to bring down the unsustainable system that put them
    in an open prison against their will. Today out of the ‘womb’ of the
    USSR were born nations like Ukraine and Georgia. Few people had shed
    tears (if any) for the disappearance of the Soviet Union. Perhaps only
    Vladmir Putin, the Russian strongman, in elusive search of global
    military dominion, that regrets the fall of the Soviet state nonsense.
    If Nigeria collapses today maybe only the Hausa/Fulani would have any
    cause, for obvious reasons, to mourn the demise of the “mere
    geographical expression”.

    We, Biafrans, we challenge the indisposed lanky Mallam from Daura
    pretending to be presiding over a divided federal house to put his
    credibility on the line by organising a referendum in the south-east to
    test the popularity or otherwise of the quest for freedom of our people.
    I dare say the outcome will definitely vindicate MASSOB and IPOB. The
    ‘yes’ to secession, without any iota of doubt, will win the majority
    vote. If the Katsina sick old man and his northern anti-Biafra elements
    believe in the unity in diversity they’re hypocritically preaching then
    the way to go is for the people to decide for or against as it’s done
    democratically elsewhere.

    To Premium Times and Evelyn Okakwu, the supposed writer of this news article…Nnamdi Kanu is not the “leader of Biafra” as there is no entity currently in existence known as Biafra. There’s agitation for Biafra but there’s no Biafra today. So labeling Nnamdi Kanu the leader of Biafra is a wilful attempt to misrepresentation.

    The headline could easily have been, “Nnamdi Kanu, the Biafra agitator.” Nnamdi Kanu is one individual, like many others, who believes there should be a country called Biafra. He is not leading a any group. He was exercising his right under the freedom speech provision of the constitution.

    Is BIAFRA really a bad idea, let’s see!

    First of all i care for the imprisonment of Nnamdi Kanu because i care for humanity.
    This detailed newsreport shows his bail application was denied at the third attempt.
    We are not told of a subsequent order of court latterly granting him bail from prison.
    Therefore Nnamdi Kanu is still in lawful prison custody by the order of a court of law.

    But is his imprisonment since the year 2015 legitimate despite that it is legally made?
    The facts are not clear and won’t be until the SSS discloses the threat he constitutes.
    Those disclosures will only be more properly made in the course of the criminal trial.
    For now I will withhold judgment on the legitimacy of his legal incarceration in prison.

    I withhold judgment too because IPOB Biafran Movement has carried on the campaign.
    The IPOB campaign is for independence of a futuristic separate country called BIAFRA.
    According to IPOB the Biafra country will cut Nigeria by a third from Kogi to Cross Rivers.
    Biafra is Igbo homeland that’s not approved by states lying between Kogi and Cross Rivers.
    And so Biafra is tribal imposition on those states, warranting Police protection against IPOB.
    In consequence, Biafra is a bad idea because it implies Igbo supremacy by ethnic imposition.

    I believe FG is wrong to have kept Kanu this long, without trial. With that said, even if Biafra agitation is limited to the 5-states in SE, it won’t happen. Carving parts of another state like Kogi, Cross-River’s state and/or any other parts of SS is even worse. So, IPOB/MASSOB/BIM is/are in between the rock and a hard place. Any nation, group of people or ethnic group has the right to self-determination. However, a peaceful approach must be used to prevent any bloodshed.

          I have to admit that I was deceived when the story about Philip Emeagwali appeared. I thought that he was a genuine black genius. After all, even on a continent where statistics and data show the average IQ is 70 and the standard deviation is 12, one black in 3.5 million will have an IQ higher than 130, one black in 368 million will have an IQ higher than 140, it was a great thing for Africa to have a ‘genius’ recognized.

          Anyway, I’m ashamed to admit that I was suckered by the talk about Emeagwali inventing the supercomputer by watching the way bees build their hives. I didn’t understand the reasoning entirely, but it was something about the hexagonal shape of the beehive cells that, when you used it in computer memory, made the throughput a lot faster. It turns out that was all just jive.

          In 1989, Emeagwali was one of nine people to share a Gordon Bell Prize, worth about $1000. The Gordon Bell Prize is one of many small-time prizes that people who use computers can win, and it is the basis for a lot of hyperinflated self-promotional bogus claims that Emeagwali later made.

          The controlled media, including CNN, picked up on Emeagwali’s antics and gave them uncritical prestige. Suddenly, we were hearing that Emeagwali invented the idea of parallel processing. He did not. We heard that Emeagwali invented the supercomputer. He did not. We heard that he invented the Internet. He did not. We were invited to believe that Emeagwali’s Gordon Bell Prize was some kind of major achievement, on a par with the Nobel Prize. It is no such thing. There are even pseudobiographical anecdotes about Emeagwali to be found online, many of them intended to convey the idea that Emeagwali is one of the most brilliant men ever to live, on a par with, say, Karl Friedrich Gauss. He is not.

          It’s all lies, mostly invented by Emeagwali and the controllers, and amplified by the Zionist media. I should have known better than to believe it. Well, I do know better now. Emeagwali has no Ph.D., having failed twice to convince the University of Michigan that he deserves one. He failed to convince a judge that he was the victim of racism in the matter of his being denied a Ph.D., so he wasn’t even able to use the courts to force the University of Michigan into giving him a doctorate, which probably means he fell far, far short of deserving one.

          Emeagwali did succeed in flummoxing some Nigerian government officials whose heads were even bonier than his that he deserved to have his image engraved on an official Nigerian postage stamp.

          While he was hyped with all this free Zionist publicity, he managed to get Bill Clinton to certify him as an official genius, which just goes to show you what a big liar Clinton is, in case you missed all those other lies he told us on television in the 1990s.

          Going back to his one actual claim to fame, small as it is, Emeagwali would not even have gotten his fractional part of that Gordon Bell Prize if the judges had not succumbed to a desire to make a minority group feel “included.” The contest was for economic efficiency in high speed computing, and the competitors, a team from Mobil Corporation, produced an entry that ran twice as fast as Emeagwali’s, with significantly more cost efficiency. The judges didn’t want Mobil to have all the prize recognition, though, so they cut Emeagwali in for a share out of sympathy.

          Now, the very fact that Philip Emeagwali can even program a computer puts him ahead of nearly all of his brethren the planet. But that’s small praise. Emeagwali isn’t a man who can be satisfied with small praise, so he tried to raise a worldwide fraud in which he gave himself some very big praise. And, since it was convenient to their “shame the white majority” agenda, the Zionist media used Emeagwali to echo his “great Black genius” lies internationally through broadcast and print media.
