Malabu $1.1 billion Scandal: Court orders OPL 245 returned to Nigerian government

The Economic and Financial Crimes Commission, EFCC, has secured a court order mandating the return of OPL 245 to the Nigerian government.

The order was granted by Justice John Tsoho of the Federal High Court on Thursday morning, pending “the conclusion of investigations…” by the EFCC.

OPL 245, considered the largest oil block in Africa with over 9 billion barrels of crude, has been a subject of investigations in at least five different countries.

Two oil giants, Shell and Eni, in 2011 paid about $1.1 billion into a Nigerian government account in London to take control of the oil block.

Over 70 per cent of the money was subsequently transferred in controversial circumstances into Malabu accounts controlled by a former petroleum minister, Dan Etete. Mr. Etete transferred over half of what he got into accounts of phoney companies controlled by Aliyu Abubakar, a man wanted for fraud in Italy and whom the EFCC already charged for fraud.

administration including Mr. Jonathan and his attorney general, Bello Adoke.

Both men have denied any wrongdoings.

The EFCC had in December last year filed fraud and money laundering charges against Messrs. Etete, Abubakar, and Adoke.

 

A week after, Italian prosecutors also indicated their decision to file charges against Shell and Eni, their officials, and Mr. Etete for their roles in the scandal.

      Why do you ask those questions. Buhari government acts swiftly when people from 5% part of the country is involved while he pretends that he does not know something is happening when it involves people from 975 part of the country.

      I do not care why they order return of the allocated oil block back to government or not. What the citizens want is transparent administration of justice. I see this as just distraction for the citizenry not focus on the pertinent question of where is Buhari having his break and how is he faring?

      It is only in Nigeria that president will travel out and no public media will be reporting his day to day activities – after someone will tell us that Buhari is a man of integrity and transparency.

      Can Buhari stop being controversial is his action?

      You should know that the only interest is on OPL 245 for obvious reasons. Unfortunately, rather than the aggrieved shareholders of Malabu to go to Court and make their Claims against Dan Etete for whatever they feel they are entitled, they would rather use a govt agency against the FGN that granted Licence to Malabu. OMG, we will see when and how this drama will end. Naija a country full of surprises.

      The first principle – that fraud unravels everything – was never really understood by the Nigerian judiciary
      which in one instance witnessed a federal high court immunizing Sanusi Lamido Sanusi from statutorily ordered investigations and going as mad as ordering EFCC investigators to pay damages of fifty million Naira or so
      to Sanusi Lamido Sanusi for daring to investigate him for fraudulent behaviour.

      After that silly order it was par for the course the Judges in the courts will be arrested and eventually jailed,
      (as already unfolding or happening), for breaching public trust, besides being routinely kidnapped and
      slapped all around by more aggrieved Nigerians, fully armed for revenge.

      As things stand, not a few ENI/Agip shareholders
      could be jumping into lakes and brooks in Milan and Venice, and into the
      several creeks coursing around Italy, because the effect of this order by
      Nigeria’s court is that ENI/Agip paid Dan Etete 1.4 billion dollars for nothing.

      The entire 1.4 billion dollars is now deemed lost but may be recovered only by
      Eni/Agip suing Dan Etete to recover the money deemed lost and paid to buy
      nothing. If then Eni/Agip sues Dan Etete and Malabu Oil to recover the 1.4
      billion dollars, Dan Etete will in turn sue all those who partook in sharing
      the 1.4 billion dollars with him (virtually as a loot); for otherwise, Dan Etete
      would be liable to repay the whole amount. That is the game-changing
      consequence of today’s court order.
