Justice Ademola blames Attorney General for arrest, says he signed document at gunpoint

One of seven senior Nigerian judges arrested by the State Security Service, SSS, last weekend, Adeniyi Ademola, has accused the Attorney General, Abubakar Malami, of being behind his ordeal.

Mr. Ademola said the immediate reason for his arrest was his decision to grant bail to former National Security Adviser, Sambo Dasuki, and A pro-Biafra leader, Nnamdi Kanu.

But he cited a longstanding friction with Mr. Malami as a reason too.

In his letter to the Chief Justice of Nigeria, Mahmud Mohammed, four days after the raid at his Abuja residence, Mr. Ademola said he was assaulted during the midnight operation by SSS operatives.

The SSS accuses Mr. Ademola and the other judges of corruption.

Mr. Ademola denied the allegation, and said in his letter that he was targeted because he ruled against the SSS in some controversial cases such as the ones involving Messrs. Dasuki and Kanu.

The two men are held by the SSS on separate charges of corruption and treason.

“The search of my residence was based on these allegations: “(i) Petition of Hon. Jenkins Duvie dated 4th of April 2016 to the National Judicial Council (NJC); (ii) Granting bail to Col. Sambo Dasuki and the unconditional release of Nnamdi Kanu. (iii) Using my office to secure my wife’s appointment as the Head of Civil Service Lagos State through Senator Bola Tinubu,” Mr. Ademola said.

The letter was first published by a news website, thebriefng.com. PREMIUM TIMES confirmed its authenticity.

Mr. Ademola said about 45 operatives of SSS stormed his residence and whisked him away in the dead of night, without telling him his offenses or presenting a warrant of arrest.

He said the SSS connived with the Attorney-General and Minister of Justice, Abubakar Malami to use his decisions on the bench against him.

“What is more intriguing in this whole episode is that I see it as a vendetta/revenge from the Hon. Attorney General of the Federation, Abubakar Malami (SAN).

“Whilst I was in Kano between 2004-2008 as a Federal High Court judge, he was involved in a professional misconduct necessitating his arrest and detention by my order.

“However, with the intervention of Nigerian Bar Association (NBA), Kano Branch, the allegation of misconduct was later withdrawn by me.

“Consequently, the National Judicial Council (NJC) referred Abubakar Malami (SAN) to the NBA Disciplinary Committee for disciplinary action,” Mr. Ademola said.

Mr. Ademola said the case cost Mr. Malami his initial prospects of becoming a senior advocate of Nigeria.

“It was as a result of this he was denied the Rank of SAN by the Legal Practitioners Privileges Committee for a period of four years until when he produced a fake letter of apology, purportedly addressed to me.

“It was then he was conferred with the rank. Since the above incident, Abubakar Malami (SAN) has threatened to revenge and swore to do anything to bring me down,” the judge said.

Mr. Ademola denied the allegations against him, including charges that he was in possession of unlicensed firearms.

Mr. Ademola provided details of how he was frightened after operatives arrived at his home in the middle of the night and how they conducted their operation before leaving the property in “shambles”.

“I saw at about 45 masked officers of the State Security Services, all heavily armed pointing their guns at me,” he said.

“They flashed a document purported to be a search warrant and ordered me to sign a document claiming that they had already conducted a search downstairs.

“They also added that I was totally under their control today as I have always made orders against them,” Mr. Ademola said.

Mr. Malami’s spokesman did not respond to PREMIUM TIMES’ request for comment on Saturday evening.

Mr. Ademola said operatives later presented him with a list of items that were found in his home which could be used as exhibits, but he initially declined to sign the paper.

“They threatened me if I did not sign it they would not leave me alone and whatever they did to me at that point would be recorded that I will not be alive to tell the story of what transpired between me and them that night.

“For fear and interest of my life, and unknown persons with masks on their faces, I collected the written items and signed the document,” Mr. Ademola said.

The judge said he has been putting up at a hotel in downtown Abuja and sought permission to proceed on leave during which he intended to pursue a remediation for alleged breach of his fundamental rights by the SSS.

”My Lord, with this infringement of my fundamental right, I seek for the leave to commence an action against the State Security Service to enforce my right that was breached,” Mr. Ademola said.

Supreme Court judges, Inyang Okoro and Sylvester Ngwuta were arrested in Abuja. Federal High Court judges, Mr. Ademola and Mohammed Tsamiya were also arrested in Abuja.

Others arrested included, Kabir Auta, Kano; Muazu Pindiga, Gombe; and Innocent Umezulike in Enugu.

The operatives were also involved in a botched attempt to arrest another judge in Port Harcourt.

All the seven judges were released on self-recognisance while agents prepare charges for their arraignment.

The clampdown has pitted the NJC against the Muhammadu Buhari government.

After three days of discussion, the body formally condemned the action of the SSS in a statement Thursday, vowing to reject any attempt to intimidate the judiciary.

The SSS saw no wrongdoing in its action, saying it found huge stash of money, denominated in naira and other foreign currencies, from the judges’ homes during the raid.

Whoever does not know what sting operation means should consult dictionary or google. After that you can come back here and tell us if DSS actually carried out STING OPERATION or not. Back to Saraki’s trials, several allegations were levelled against him by the prosecution but once Saraki lawyer began his defense, the same prosecution witness began to dance Macabre Dance in the duck

    I laughed after reading this funny story. If demola isn’t corrupt, why would he order the release of dasuki with more than 1000% undisputed evidence and self confession of fraud of billions of dollars? I read the whole folktale but he didn’t mention how he got the millions of foreign currencies found in his house and the bribes he got in cotonou, Togo and other nearby suburbs.

      Sheyman, its so sad that the constitution and law are being turned on their heads in this country. Why do you ask for bail when arrested by the police? Does the law not provide for an accused to be held within a specified period and then charged to court? When in court his plea is taken, bail follows if the judge gives bail conditions. Don’t worry, one day will find yourself in court and no bail will be granted to you.

        There have been judges passing judgements against opposition at random even when they (judges) are standing trials by EFCC. They want to be seen as playing good boy to the govt so they keep handing out embarrassing judgements to please the authorities. One heading a tribunal is even on trial for N10m bribery yet he has not been arrested. For as long as the other judge keeps on ruling against the opposition he is a good boy, so sad

      No(2) has to do with lagos state..which is the fortress of the ‘Lion of Bourdilon’.
      This is interpreted to mean a ‘connection’ betwn the judge and ‘the lion’.
      This ‘affects’ the FG because the ‘Lion of Bourdilon’ is gradually being declared persona-non-grata(by the FG cabal) in the party he was made to believe he was the ‘national leader’.

On the other hand Justice Ibrahim Auta, the Chief Judge of the federal high court ( who presided over the kangaroo court that sentenced Dele Giwa to death) was also implicated in the same bribe money obtained by Justice Ademola yet he was left alone. I hope for the sake of Nigria that Ademola J is wrong but if he is right then the DSS are in trouble and the fight against corruption is really just the ACN fighting the PDP.

    Nigerians please and please obey and find solution to your problems.
    There will remain confusion, disunity and immense hardship all through Buhari’s regime. Not my wish but what Nigerians will witness because Buhari has no good mission or vision for the country.

    The only things that can change these things from continuing are:

    1) Buhari must admit openly he has been manipulating the system instead of proffering solutions. This, he will never do.

    2) After that, he must sincerely look for qualified Nigerians to assist his steering this ship of Nigeria instead of APC members who knew next to nothing about their ministries.

    3) He must allow the judiciary and the national assembly stand each separately as independent arm of the government.

    4) He must fight corruption not pretending he is not corrupt, but because they have all installed and benefited from corruption and God is not happy with any of them. The implication is there should be no sacred cows being protected directly or indirectly by him.

    5) If Nigerians want God to intervene not minding Buhari, they must love and accept themselves as one people above ethnic or religious affiliations.

    6) They must agree Buhari is no messiah to save Nigeria from its predicaments.

    Finally, the choice is either in the hands of Nigerians to do the two things advice or continue to suffer all through Buhari’s regime or for Buhari to comply with the outlined instructions so that God can lead Nigeria out of its sufferings.///////

    Justice Ademola said it was he,
    as the presiding judge, who sent Abubakar Malami – Buhari appointed
    attorney general – to prison in Kano for grossly illicit conduct. It follows that
    permanent records exist at the Nigerian prisons of Abubakar Malami –
    which President Buhari could not have been unaware of before announcing
    Abubakar Malami as his ‘meticulously’ selected attorney general and as Chief
    Law Officer of Nigeria. What a scandal. What a shame on President Buhari’s
    judgment.

    We may never know the truth in all these, the fog is thick. The judiciary in Nigeria has mortally wounded herself, any sense of dignity is eroded on the platform of naked corruption. Not all judges are corrupt, but the good ones who have not sold their conscience or soil their fingers might never be known because no one will believe them if they so declare. It is a pity.

    If Ademola could lie that he was in Benin when DSS came calling, how and why should we believe that 24 hours in DSS custody is not what led to all these fabrications? I care less for Malami but where everything fell apart is, how would he say that Malami presented a fake apology letter which led to him getting “SANed” and Ademola looked on?
    This judge seems to me like a hardened crook, he had guns pointed at him and yet he could count how many masked men even as he said he was frightened. SR has posted the warrants of arrests and he should have verified before he lied yet again.

Seven days after the fact, Mr. Ademola has come up with a concocted story of a long-standing misunderstanding between him (on one side) and Attorney General of Nigeria/DSS (on the other). Nonsense!, Why does it take SEVEN days for a learned judge to break the story to the public? In the court where he delivers judgments to the highest bidder, witnesses are NOT needed, but here in the court of public opinion, he must bring forth witnesses to corroborate his seemingly fictitious story of being targeted as a result of his numerous controversial court rulings and that he endorsed implicating list of items found in his house at gun-point. He did NOT categorically state that, the incriminating items found in house were planted by the DSS, neither, did he explain how they got to his house. What a judge!! A very poor job of concocting a story. Ademola must go. These are judges who notoriously ruined many states in Nigeria by setting election results aside and then imposing politicians who heavily bribed them as state governors and senators. He has a major responsibility to explain how he came about the money found in his house or convincingly explain how the money ended up in his house without his knowledge and how he signed at gun-point that the money was his!!

    Above all, in all of Justice Ademola’s long tales, he failed to claim that the DSS did not find any incriminating thing in the house. Why that noisy silence on such a critical element in the entire saga?

          is the question. In as much as there has not been trial of any sought, the DSS
          as the prosecutors deserves no right of going to the media to shout of any

        My privilege as Nigerian-licensed Solicitor abroad was breached by Justice Adeniyi Ademola
        of the Federal High Court, Abuja, who is reported by his stewards to have fled upstairs
        immediately the SSS team arrived his gate. According to his stewards, Justice Admola
        instructed and said whilst fleeing upstairs that the stewards should tell lies to SSS
        that he – Justice Ademola – has traveled out of Abuja to Benin city in Edo state.
        His stewards did as instructed.

        But the SSS insisted that the stewards should phone Justice Ademola in their presence to be sure.
        They did and Justice Ademola repeated the lies on phone that he was answering the phone call
        from Benin city in Edo state, whereas he was upstairs; locked in his bedroom.

        With GPS tracking the SSS located where Justice Ademola was hiding – right inside the house-
        and the SSS operatives moved to break the door to his bedroom where the Judge was hiding,
        arrested him and bundled him straight into prison.

What you have is his grand father’s photo- a highly respected judicial icon who must be turning in his grave as his name is being desecrated by his grandson. How disgraceful! The explanation being given the younger Ademola is ridculous -hogwash!

    The senior lawyers jumping in the defence of the suspected judges are a whole bunch of nuissance and corruption enablers. They are always hand in gloves with some judges to pervert the course of justice, which is inimical to the social and economic progress of our nation. They will pay for their wrongdoings here or hereafter. Their ‘cash for justice’ style is all too well known. They lack the intellect of the bar and bench of yesteryears. No decent person would respect these lawyers who have high jacked the leadership of the bar. While Nigerian are complaining about the poor state of the judicial process, the fatcat lawyers are hell bent on maintaining the status quo. Pity, the judiciary is so messed up. In which court(s) are these suspected judges going to be tried? This administration has their hands full.

      permanent records exist at the Nigerian prisons of Abubakar Malami –
      which President Buhari could not have been unaware of before announcing
      Abubakar Malami as his ‘meticulously’ selected attorney general and as Chief
      Law Officer of Nigeria. What a scandal. What a shame on President Buhari’s

      I for one would not be surprised when the judges will be acquitted on technicalities. Reason being that, though the judges are corrupt, those controlling the dss are corrupt too. They formed the core of pmb’s inner circle. AGF and his co-travelers are in self preservation mould, they took up the job of EFCC in hope to “kill 2 birds with one stone”. Another thing to consider is that the judiciary machinary is already in self-pity mode, all hands on deck 24/7 to birth technicalities; for, justices must be trampled with mercy.

The judges can now see how impoverished Nigerians are being made to endorse fabricated stories brought to their courts by men of our security agencies. This could be why this present bizarre scenario. But the facts to my mind are these:1 the judges are accused of corruption in the course of their jobs; stacking various monies in their homes. 2. The judges homes were raided at about midnight .3. The NBA and NJC both bodies regulating legal and judicial practice in Nigeria have condemned the procedure taken by the sss in this matter. I will advocate for the sss to pursue the matter procedurally to its logical conclusion while the attorney general be taken back to the disciplinary committee of the NBA for his role in this Saga. My humble submission. God bless us.

    If justice Ademola, is among the suspected bribery culprit judges well! judge Ademola, must be removed by the NJC from the bench.Corruption crimes can not be disguised or cover-up.Any judge or justice found to be involved in bribes for favourable judgement scheme must be removed as NJC appears toi be ineffective about corruption crimes accused judges/justices.
