Buhari speaks on arrest of judges; says corruption, not judiciary under attack

President Muhammadu Buhari has made his first official reaction to the arrest of seven senior judges between Friday night and Saturday morning.

Mr. Buhari said the raids on the judges residence by the State Security Service, SSS, was an assault on corruption and not on the judiciary.

Seven judges, including two of the Supreme Court, were arrested in the raids, condemned by lawyers and rights groups, and are expected to be charged to court from tomorrow.

The president in a statement by his media adviser, Garba Shehu, described the raids as ‘surgical’ saying due process was followed in the arrests.

“The Presidency has received assurances from the DSS that all due processes of the law, including the possession of search and arrest warrants were obtained before the searches,” he said.

The Presidency assures that the President reserves his highest respect for the institution of the judiciary as the third arm of government.

To this end, the President will not do anything to undermine its independence.

President Buhari remains a committed democrat, in words and in his actions, and will not take any action in violation of the constitution.

The recent surgical operation against some judicial officers is specifically targeted at corruption and not at the judiciary as an institution.

In a robust democracy such as ours, there is bound to be a plurality of opinions on any given issue, but there is a convergence of views that the country has a corruption problem that needs to be corrected.

But reports by a section of the media are giving us cause for concern.

In undertaking the task of reporting, the media should be careful about the fault lines they open. It is wrong to present this incident as a confrontation between the executive and judicial arms of government.

The Presidency has received assurances from the DSS that all due processes of the law, including the possession of search and arrest warrants were obtained before the searches.

To suggest that the government is acting outside the law in a dictatorial manner is to breach the interest of the state.

      our constitution did not make room for referendum in determining anything, it is the role of the National Assembly to amend the constitution to allow for referendum in the next amendment. On the issue of testing to see if you want to remain in Nigeria, why dont the you guys speak to your governors, members of the National Assembly from your region to press for it or at least ensure referendum is inserted in the next amendment.

    In its latest act of dictatorship & disrespect for the rule of law, the Directorate of State Security (DSS) raided the homes of several Judges of the Federal High Court and Justice of the Supreme Court in the early hours of October 8th, 2016.

    In one swoop, raided the homes of Justices Walter Onnoghen & Sylvanus Ngwuta of the Supreme Court as well as the homes of Justices Adebiyi Ademola, Muazu Pindiga and Nnamdi Dimgba of the Federal High Court. DSS agents spent time breaking down the gate of Justice Dimgba’s house with a sledgehammer before beating his brother to pulp when they could not find him. At this time, Justices Ademola & Pindiga have been arrested and detained.

    This is new addition to a long list of actions that show that the administration of President Muhammadu Buhari has no respect for the rule of law, the principles of separation of powers and is only interested in using the apparatus of state to harass real and perceived enemies.

    Many will recall the disdain with which President Buhari has spoken about the judiciary and the legal profession in Nigeria. On January 31, 2016 at a meeting in Addis Ababa, Ethiopia he told an astounded audience that the judiciary was his main headache in achieving some of his plans. To buttress his point, he cited how the judiciary ruled against him in his previous bids to become President.

    If Judges are corrupt, nobody is asking for them to be shielded. The issue at stake is the modus operandi of their arrest. Going by the SSS Act, they are meant to be only seen and not heard – period. SSS is meant to work in the background, discreetly gathering evidence & intelligence, etc after which they now call on the Police to effect arrest, including searches, which are then used in prosecution. SSS is not meant to go to Judges houses scaling fences at 1 AM!!!

    THAT IS WHY SSS IS USUALLY REFERRED TO AS THE SECRET POLICE!
    But nowadays, it seems SSS now struggles hard to become both “open” and “street” police. This is going beyond their boundaries. And this is where this Falana chap got it all wrong. Daura of SSS cannot collect or gather intelligence at any time and always want to run a One Man Show in Govt by never wanting to share such info with other Security Organs who equally have a role to play. Consequently, let no one be equally surprised that all other Agencies including Police too will no longer share their own info or intelligence too. Meanwhile, the country needs all intelligence to be pooled constantly/periodically for the analysts at the top to spot any/all security risks, trends, or patterns.
    The SSS could have arrested these individuals in their Judges chambers using the Police, obtain the necessary warrants, go to the houses with Police and the Judges to effect the searches, charge them to Court with any exhibits found, produce their evidences garnered from their so-called “sting operation” (which usually involves audio/video recordings of these Judges accepting or carrying the cash etc) and get the police to prosecute through the Attorney General.
    SSS has no powers of prosecution! So, let us see how the SSS will explain in Court how they ransacked the Judges houses and got money at al WITHOUT POLICEMEN PRESENT!

        Be rest assured that the crucial issues that would first be argued in Court will be the procedure of arrest. (1) Did SSS follow the right procedures? (2) Even if the Attorney-General is used by SSS to prosecute, are the statements written in SSS offices admissible in a Nigerian Court of Law? (3) SSS says it recovered a lot of loot – fine. But were there any Policemen present? (4) Was proper procedure followed in removal of assets/exhibits by SSS? etc etc
        Perhaps I need you to educate me with specific extracts….!

        Why on earth, would the SSS be going on such a major expedition at 1am AND NOT OFFICIALLY INFORM THE COMM OF POLICE IN A STATE when they are an Agency without Govt-given Uniforms, and are never really distinguishable from Armed Robbers???
        The CP & his Police only went there on receipt of complaint. They did not go there on the invitation of SSS – please get it right. And I am certain that even the CP must have been shocked when he saw the State Director of SSS at the scene. You just cannot go into any State in armed-robber style WITHOUT informing the CP of that State.

        But then let us even forget the CP for a minute here. What if, while SSS was doing climbing the fence and doing their stuff at 1am a Police Patrol Van just happened to pass by – what do you think would have happened?

      Check out the enabling law that established the DSS.

      It has acted within the ambit of the law.

      When the NJC was presented with evidence of corruption in the judiciary, its reaction was tepid and only recommended the removal of 3 (tiri o) judges. This was despite knowing how corrupt the whole thing is.

      The police were marginally involved in the arrests and they also leaked the info about the impending arrests.

      So you can see the extent to which the rot has pervaded.

      Let Buhari continue on this track for the sake of Nigeria. People need to be afraid of the consequences of their actions.

Nigerians are daily nursing the highest expectations on President M. Buhari to try and work out very hard or do extra-ordinarily more in solving deep corruptions diseases/virus accumulated from over the past years. So, the Nigerian president has to take a bold steps towards cracking very hard all those preventive corruption sources that were making his anti-corruption policy thrust extremely difficult. The high court judges and supreme court judges always confidentially believed that they are SEMI-GODS and untouchable under our today’s planet and in Nigeria prevailing laws and constitutional laws. It is about time that they have to be shown the way or being reminded, that even though they are the final arbiters as court judges in all legal and judicial cases or matters before their respective courts, they are not above the law of the land themselves in Nigeria.

          even have an idea that their names had been used by the judges to open such
          accounts. But you see under the Bank Verification Number, you must put in your
          passports, name, signature and others. So, for some of the judges, who used
          fake names and their wives names to open the accounts into which they paid in
          the proceeds of crime, they foolishly appended their signatures or used their
          pictures, something that gave them out.

            In my own view, a general dislike for President Muhamadu Buhari for worsening standards of living

            It should not seep. It is possible to hate Muhamadu Buhari and stand with the SSS on corruption.

            These Supreme court judges are moral contaminants fit for lock-up for years in a prison custody.

We saw how (late) Audu Abubakar who was standing trial for alleged N11billion while in office as Kogi governor ‘allegedly’ promised to refund the money if elected again.     If they are corrupt, they should be investigated, arrested and prosecuted. The DSS should do their best to follow the law. Midnight raids is a normal thing in most civilized countries to catch a culprit and most importantly, seize evidence. According to the DSS, the search yielded some positive results. I’m glad the administration is bold enough to make this move and we (the Nigerian people) support it. Nigeria needs to be cleansed of massive corruption. Most people know and acknowledge that a lot of these judges are corrupt. This is a move in the right direction. We need more credible people to get involved in politics and rescue our country.

        Please refer to the case of the Illinois Governor that attempted sell Barack Obama’s senate seat…… His home was raided in the middle of the night and he was arrested and prosecuted. Also, refer to the case of Congressman Jefferson…. His home was raided and he was arrested. All these happened in America….. From your handle, it appears you may reside in the USA….. check out the facts. I can go on with more examples in your backyard. You primarily raid a home in the middle of the night to seize and preserve evidence that is crucial to a case. What is a judge doing with $500k in his home? Can his salary support that? Do you think we don’t have corrupt Judges? What do you proffer as a solution to rid our Judicial system of corrupt Judges? I’m of the opinion that probable cause was established when they found the huge stash of money. These Judges should be prosecuted and jailed for their crimes.

        • How do you prosecute with evidence collected illegally. Those cases you mentioned are untenable in this scenario. Do your research well before feeding us with half truths.Security agencies in the US or any civilized Nation will not raid and abduct citizens without court issued warrant. Any evidence collected by buhari’s Gestapo without properly executed court warrant is illegal in court.

      I support fighting corruption. i do not support this methodology for the simple reason that you will not get a conviction in any court of law if you do not due process. We have not learnt this and will never learn it. Let me know when they get the first conviction from the war on corruption. It is 17 months and counting.

      Those people blaming the DSS are the direct beneficiaries of the existing corrupt system we have in Nigeria. They want the status quo to remain where justice is for the highest bidder. It is only the poor that are convicted because they don’t have money to hire SAN who will bribe judges. To DSS I say good job and continue with your good job. You have the backing of the majority. To those that say Judiciary should go on strike. They are free to go on strike. The government will apply no work no pay. At the end of the day those arrested now will face be taken before judge for prosecution.

    I will prefer people who have experienced the issue on this discussion. On my part, the company I work for has done more than ten cases in the recent past in Lagos. Most of these cases were won and we do not know the judges nor magistrates that took the decisions. Our lawyers did not ask for settlement of the judicial officers too. So it becomes difficult for me to understand this current hue and cry about outlandish corruption in the system. My summary therefore is let contributors send in their direct experiences so that we can aggregate views and know how far this problem has gone.

      Ibori was discharged and aquited in Nigeria only for him to be convicted and jailed in the UK.
      The jugde that aquited him here should have also been charged to court, because you would wonder how he decided not to see the evidences seen by the UK court, and even by we Nigerians!!!

    Amazing how we have accepted corruption as our way of life in this country. Fairness and justice is longer guaranteed and some people are saying it’s ok. EFCC cases are pending for years, openly corrupt politicians charged are either discharged or their cases pends till eternity, yet it is ok. The law is not a respecter of persons and so it should be. Let’s go after anyone that is corrupt, judges, police, army, politicians etc and take back our country.

    STILL ON THE JUDICIARY. Here is my thought:
    Some people are talking about DIGNITY. That is, treat the Judges with dignity and not like an ordinary citizen! My response is this: A judge who specialises in trading his Judgements, Decisions, Orders and Directions for money at the expense of justice deserves NO DIGNITY left in his personality. He should be treated like a common criminal.
    In as much as we don’t expect SAINTS to be our Judges, certainly we can not settle for DEVILS as Judges. Many of these Judges are worse than the devil. It only takes a Devil to perverse the course of justice on the altar of bribery and corruption.
    The irony of this shame is that their wages and conditions of service have been greatly improved upon since the advent of the Civil Rule in 1999. So a Judge who still goes about selling his ‘justice’ is not doing so because of any necessity but because of pure GREED, QUEST FOR MATERIAL ACQUISITION and INSATIABLE LUST FOR MONEY.
    May their shame know no limits.
