SPECIAL REPORT: Ex-Govs Akpabio, Amaechi, Suntai received billions in waivers to buy aircraft, 200 BMW cars

While they held sway in their respective states, three former governors of Akwa Ibom, Rivers and Taraba received waivers to buy different ranges of aircrafts that included a Bombardier private jet and a Bell 407 Helicopter, PREMIUM TIMES can authoritatively report.

The governors and other serving government officials circumvented paying duties even as they imported, under various guises, luxury automobiles that included BMW, Ford, Range Rover, Lexus and Jaguar. The waivers were granted in the names of their states.

Between 2011 and May 2014, a total of N215 Billion in import duty exemptions were granted in four years under the leadership of ex-President Goodluck Jonathan.

Data obtained from the Budget Office of the Federation detail a fiscal policy recklessness that made duty waivers in Nigeria to become synonymous with cronyism, racketeering, political patronage and outright brigandage.

Whilst some of the waivers may have been well-meaning and granted for the purposes of stimulating local production, economic growth and job creation, the data show that some of those who benefited did not deserve such concessions.

In 2013 former governor of Rivers State, Rotimi Amaechi, now Minister of Transport, got waivers to buy one Bombardier aircraft Global Vision 5,000 series and two Bell 412 Axis Helicopters.

The three items attracted a total import duties of N2, 182,619,909.00 (Two billion, one hundred and eighty-two million, six hundred and nineteen thousand, nine hundred and nine Naira) but this was waived off by the Customs.

A year earlier in 2012, the Akwa Ibom State government, ran at the time by Godswill Akpabio, who is now a serving Senator, received waiver to purchase a G450 5N 4241 Aircraft. The economic necessity for the aircraft was not stated. This particular acquisition attracted import duty of N271, 256,000.00 (Two hundred and seventy-one million and Two hundred and fifty-six thousand Naira) but was not paid in view of the waiver.

Similarly, former Governor Danbaba Suntai, acting in the name of  Taraba State, received waiver in 2012 to buy a Bell 407 Helicopter. The import duty on the helicopter was N13, 064,546.00 (Thirteen million, sixty-four thousand, and five hundred and forty-six naira). In October of the same year, Mr. Suntai became involved with another aircraft owned by the Taraba State government, this time a Cessna 208 5N-BMJ which crashed on a flight from Jalingo to Yola.

Year after year, virtually everyone with access to the corridor of power did their best to take advantage of the waiver regime of the President Jonathan government. Names and incongruous items combined in a clear defeat of the same economic policy the concessions were meant to promote.

Waivers were granted for the importation of Mercedes Benz cars and personal effects like refrigerators, tiles, marbles, beddings, chairs, cups and sunglasses. One sub-head in the Budget Office data unbelievably reads: “Specialized items such as custom made carpets, timber dining chairs etc”.

These items were imported at zero-duty in the name of the Federal Capital Territory.

Seizing the moment, the Rivers State Government, in 2011 under Mr. Amaechi imported 200 units of luxury cars, including “BMW, Ford and other brands”.

There was no agricultural machinery nor any economic enhancement tool in the Rivers’ import. The sum of N503.3 million was not paid as a result of the waiver, thus there was no discouragement of any sort for state executives that chose to waste taxpayers’ sweats on luxury goods.

The Lagos State government, under Babatunde Fashola, soon joined the fray, importing, in 2012, 300 units of BMW, Ford, Land Rover, Range Rover, Lexus, Mercedes and Jaguar. For Lagos State however, it was explained that the automobiles were for the 18th National Sports Festival. A total of N772 million in duty was waived.

A few months ago, the Senate Ad hoc Committee on Import Duty Waivers, Concessions and Grants announced it had uncovered fraud in the administration of import duty waivers on rice, sugar, other foods items and automobiles.

The committee, in its report, named frontline companies, including Dangote Limited, Kersuk Farms, Bua Group, Elephant Group, Milan Group and Golden Penny.

It also named specific government agencies such as the Ministry of Finance, Nigeria Customs Service (NCS), Ministry of Industry, Trade and Investment, Nigeria Export Promotion Council (NPC), Ministry of Agriculture and Rural Development and Federal Inland Revenue Service as complicit in the waiver racketeering.

The Customs and Excise Management Act prescribes that some imported goods could be granted duty exemptions if they are meant to boost local manufacturing of goods for export.

To this end, agricultural implements, and machineries for key sectors like Water Resources, Steel, Gas and Aviation are usually exempted from duty. It remains puzzling how this Act was interpreted to justify waivers granted government officials to import cars and personal effects.

Save for 2014, waivers granted between 2011 and 2013 were littered with cars and personal effects imported at zero-duty by unnamed officials of the Ministry of Aviation and Ministry of Foreign Affairs. These personal imports are different from those made specifically by Ministries, Departments or Agencies.

Individual officials curiously obtained waivers to import “Mercedes Benz and personal effects”, “Honda car and personal effects”, “Toyota Verso and personal effects”, “Hyundai Tuscan and personal effects” and “Toyota RAV4 and personal effects”.

Also listed were “Nissan Car and personal effects”, 4 Runner Toyota car, Nissan Pathfinder, Mitsubishi Car, Toyota Camry, Furniture, Toyota Corolla, Mercedes Benz GL 450 and personal effects, Mercedes Benz A170, Honda Accord, Toyota Sienna and personal effects, and Ford Edge vehicle.

        The current governor of Rivers State – Wike – should tell us if he does not currently use the helicopter Amaechi bought for the state.
        By the way, some may consider a helicopter wasteful for a state. However, if you are governor of a state that is largely riverine and inaccessible by road, you would appreciate why a helicopter is not a luxury for a governor that needs to reach various parts of the state quickly.

      That is the fact that should not be ignored. I don’t believe those aircraft were purchased in the names of the individuals mentioned. If they were purchased in the names of the states, then the waivers could be defended.

That is why dubious people can pretend to be procuring things for a government just to get waivers. I assure you no court can convict anyone of wrongdoing in not paying duties for things purchased in the name of the Federal or State government.

    What I despised about GEJ was his weakness and daftness to the point of stµpidity. Given Amaechi’s disrespect and contempt for him, with most heads of states, Amaechi would most likely be in jail for grand theft and corruption as we see here.

    GEJ’s weak character meant that he is now receiving insults by even from toilet cleaners. His people, the Ijaws are fishermen among other things. And you can’t survive in the sea if you have a weak character like GEJ. Indeed GEJ’s weak character is the opposite of most Ijaw people — a people known for their toughness, stubbornness and and no-nonsense. Lacking the Ijaw character, indeed one has to ask if GEJ was Ijaw at all.

    Anyway, Amaechi is still going on like a toy running on Duracell batteries. Why not? Buhari collected protection money from him to run his election campaign. So now we have the President of the Federal Republic of Nigeria harbouring and protecting a first-class thief and embezzler.

        Are you implying that GEJ himself personally — and not the respective departments or institutions — granted the waivers?

          1- A waiver was put in place by the directive of the economic team approved by the president.
          2- The Waiver became an economic framework in line with the president’s directive
          3- The same waiver listed items that qualify and are stated as exclusive items that will stimulate economic growth and approved by the president
          4- The need to bring CUPS< BEDSHEETS and SUNGLASSES likewise got the approval of the same presidency.
          Even as he is not omniscient, his directives are omni-CORRUPT(indeed our corruption is everywhere and at the same time) if non exclusive items are approved by the same presidency. I don't care who the president is, the country is bigger than anyone of us. Why implement a framework if it will be abused by those to be bound by same? You made the issue about GEJ and how spineless he was, all I did was to let you see that what happened and when it happened indicate they were friends then and the fact anyone who had access to him took a piece of him back then, does that make him God as you have retorted?

            If you cant understand the concept of waivers as enumerated, how then will you ascribe you initial position that I responded to?
            If you likewise cant have a recollection of how close they were when the aircraft was purchased, then you can conveniently forget this conversation. Amechi’s issue was not even with GEJ, it was with his wife, then sides were taken and the drama began. The same aircraft later was grounded based on orders from above…does that show you a god complex now? Do you make alliances with your enemies even if its politics? There are always lines of intersections in politics even if ideologies differ but they call themselves not enemies and so they are not just allies especially if they are in the same party and buy into same objectives. When objectives differ, they are called factions so get you politics 101 correct. You always assume you are right and no one is ever right all the time.

Reality is that, there is something they see or fear once they arrive that aso rock, which disconnects them from every other person or citizen perhaps they would not even imagine such thing being outside so the answer still is, disintegration or separation, at least we can begin with restructuring.           Toward the end of your post about Buhari and Jonathan seeing things that we don’t and fearing them might have something spiritual behind it. It could very well be occultism. If you go to kingdomnewsng dot com and read the articles under the prophecy section, it might give you some insight to what I am speaking of. Nonetheless, breaking up Nigeria is not going to fix this problem. It will instead follow itself to the rump states that come from Nigeria. Perhaps this is the goal of some in this system.     If you don’t believe me, ask yourself how come over 70% of all those holding public offices under APC today are ex-members of the PDP? Have we been told how much Amaechi——–Fashola and Tinubu contributed to the election of Buhar? Check all the ministers, governors, NASS members etc, over 70% of them left the PDP and were welcomed into the APC with an open arm and handed a baptism which washed away their sins and turned them to saints.

    If the APC strongly believes the PDP destroyed Nigeria, why welcome the same people into their party? Does this make any sense? Or is it just the acronym “PDP” that is the problem? Their target is Ijaw man GEJ.

    The whole fault here lies with Jonathan. If granted waiver in this circumstance I believe all the people posting comments would have probably outdone these governors and the rest of them. Go back to where the first waiver was granted and you will see that once the floodgate is opened, people will start doing bizairre things.

    But who did the writer try to mk more guilty? Akpabio. Balanced reporting is not only giving different side equal critique and coverage but also ensuring that parties in a news item are treated same. In the news Fashola is “secretly ” mentioned and the writer didn’t consider his picture appropriate even when the waiver he obtained is far above that of Akwa ibom and Taraba.
    And considering that these states waivers are just so insignificant to the 200+bn mentioned i think it would’ve been more appropriate to be detailed on who gets what in figures.

    That said it amount to nought if waiver was granted and utilized. The important thing is whether those govs in particular turned around to deduct it from their state’s money. Govt tax in this form doesn’t really do anything apart from seemingly increasing revenue. Any govt that pays loses while those who don’t gain. So if u r frm any of these states u ll b thankful that it isn’t paid. Because what ll return to the state is just a fraction of the total after sharing by federal states n local govts.
    Consider frm above that 2bn of rivers state money goes back to the federation acc, what ll eventually return to rivers state may not be up too 50m. So its good for individual states to seek waiver. Assuming they put the waiver money to good use

    Waivers can actually be more effective than subsidies if the policy is religiously implemented.

    First, they lied that Jonathan bought no single weapon for the military to prosecute the war on terror. When this lie could no longer stick, they amended it and claimed he actually bought some weapon but that they were substandard and were all backfiring and killing soldiers who were supposed to use them to fight boko haram. When Nigerians queried which weapon the APC government used to achieve ‘technical victory’ over boko haram since the ones acquired by Jonathan were all fake, the lying minister of information; Lai Muhammed contradicted himself again by admitting the Jonathan govt bought some good military hardware but that the prices were hugely exaggerated. Na one government dey churn out all those wicked puerile lies ooo.

    Meanwhile, we all saw the newly acquired military hardwares the GEJ administration secured from Russia after the U.S and her allies refused selling us weapon as a result of petition written to them in which El-rufai, Murtala Nyako (ex-Adamawa state governor) and some Northern/APC leaders accused GEJ of using the military to reduce the population of the North under the guise of fighting Boko haram. And we all witnessed as our soldiers used those weapons to liberate all our territories held by boko haram and sent the terrorists disguising as females to escape their superior firepower. Nigerians were all hash-tagging #NeverAgain as the military were combing the Sambisa forest in search of the boko haram boys.

    All these happened a little over a year ago. We could’t have forgotten, could we OOOOOH YEEE HYPOCRITES?
