#Dasukigate: Court sends ex-Defence Chief, Alex Badeh, to prison

Alex Badeh
Alex Badeh

A Federal High Court, sitting in Abuja, has ordered a former Chief of Defence Staff, Alex Badeh, remanded at the Kuje Maximum Prison, pending the determination of his bail application on March 10.

Justice Okon Abang gave the ruling Monday after Mr. Badeh was arraigned for alleged  fraud, relating to the diversion of N3.9 billion meant for the purchase of arms for the Nigerian military.

Mr. Abang struck out the bail application filed by Mr. Badeh’s counsel, Samuel Zibiri, on the grounds that it was filed ahead of his client’s (Mr. Badeh’s) arraignment.

The  judge further ruled that the hearing for Mr. Badeh’s bail would commence on March 10, adding that it was important for the application to be determined before the commencement of trial.

The judge said the trial of the substantive case,  billed to commence on March 14, would be on a day to day basis.

Mr. Badeh was to be arraigned before Justice  Abang on Thursday, March 3, but the case was shifted to March 7 owing to the absence of the judge.

Mr. Badeh, a retired Air Chief Marshal, was arraigned on a 10-count charge bordering on money laundering, criminal breach of trust and corruption.

The Economic and Financial Crimes Commission is accusing Mr. Badeh, of using funds assigned to the Nigerian Air Force to purchase a mansion in Abuja.

The commission said the purchase was done with the dollar equivalent of N1.4 billion.

“Mr. Badeh, while being the CDS, among other things between January and December, 2013, allegedly used dollar equivalent of the sum of N1.4billion (One Billion, One Hundred Million Naira) removed from the accounts of the Nigerian Air Force to purchase a mansion situated at No. 6, Ogun River Street, Off Danube Street, Maitama, Abuja,” the EFCC said in a statement Thursday.

The offence is in contravention of Section 15 (2) (d) of the Money Laundering (Prohibition) Act, 2011 (as amended) and punishable under Section 15(3) of the same Act, the anti-graft body said.

The former defence chief denied allegations of corruption against him.

On Thursday, Mr. Badeh, who has been in detention for about three weeks, accused the EFCC of “persecuting” him and conducting a media trial against him.

Mr. Badeh said he had repeatedly assured the commission of his readiness to cooperate with the investigation, yet was detained for a prolonged time without being arraigned in court.

      He is BAD, Eh.

Bad is too good a word for him. He is worst than bad.

  • Omoba1

The judge sends him to prison only to grant him bail on March 10, which would be just 3 days from today. He gets bail, goes home and continue to enjoy life before the commencement of his trial.

So far, zero conviction rate on all corrupt cases and even if there is conviction, the judge may give 5 – 10 years prison terms. The accused goes to prison, returns after 10 years richer, how you may ask – Undiscovered loot hidden in Banks at interest rate of 5% sum that up for 10 years.

    Corruption pays in Nigeria.

    • Julius

No, not this time. He will be convicted and all his illegal wealth will be forfeited . Watch !. Those properties will be sold off and his bank account, his wife, children bank account will be closed and the money returned to the government coffer. You do know that some of them are refunding their loots already.

      • Omoba1

Will he conviction terms commiserate with the crime committed? I just gave an example of the prison term he may serve. 10 years is not sufficient for the victims of Boko Haram and miltary men who died fighting without arms.

How many proxy accounts EFCC was able to identify. As at today, $1million dollars was recovered from one of his houses. How many are stashed away in other houses or with girl friends or male friends?

        • Julius

True, but, 1 step at a time. We shall see how they are proceeding with the case. I still believe that he will be convicted and the looted funds returned.

        • Jon Lawrence

So what is your brightest idea then? Do nothing, because EFCC cannot find everything. Which law enforcement agency in the world can find every single crime committed. You don’t really have to comment . Its not a must.

    • isioku

You are completely misguided and it really doesn’t take much to enlighten yourself on the procedure and law before misleading the public. All financial crimes not being capital offences are bailable so Badeh is entitled to bail. When he is convicted, all the monies and property in question will be ordered forfeited to the FG. He does not benefit from it or receive interest accruing thereon. Please, get your facts right before commenting in a public discourse

    • Jon Lawrence

Whether they get 24 hours prison is not the issue. Trial and sentencing of pen robbers masquerading as leaders is far better than the culture before when they usually get high sounding chieftaincy titles and honorary degrees with the same proceeds of their criminalities rather than prison. A quarter bread will always be far better than no bread at all.
As for your 5% interest nonsense, try and educate yourself a bit. He won’t keep anything related to his crime if convicted.

    COMMENT
Few years ago it was Exxonmobil spill in Akwa Ibom, just like the Bodo oil Spill and many others before and after. It was never cleaned up. And now we have the Shell oil spill in Forcados – Niger Delta …and the rivers as all polluted as I write. No clean up is under way and the environmental terrorist – Shell company has refused to take responsibility and the Buhari government is as dumb as ever.

While the corruption continues in the oil sector and the indigent Niger Deltans struggle to survive in the midst of plenty, newspapers like Premium Times focus on sham storiesand headlines as above to prop up an academically challenged Buhari who has no clue about what governance is about….The economy of Nigeria is in shambles and Buhari has no answer. No one expects him to. He is just not educated enough to. BUT we must now learn from this experience how disastrous it can be to allow academically challenged people into the corridors of power. Unfortunately, many Nigerians believe in miracles.

Please forward details of the conditions of the oil spill to the CNN and International environmental groups for further investigation. President Buhari only act to protect Fulani’s interests. Mile 12 in Lagos burning alive of Yoruba’s by the military backed Fulani’s/Hausa is the latest version of the impunity.

There is the danger in this country today because when someone goes to the dock, the next thing is prison. What differentiates human beings from animals is the rule of law. Both parties and sides must be heard. God did not condemn, God did not convict, God did not sentence Adam and Eve in the Garden of Eden without hearing them. The danger of Nigerians wanting any person just to be convicted is that if it is Mr A today, it could be Mr B tomorrow. So we have to be careful. Sadly Badey and Dasuki thought if they help Buhari to power all will be well with them—They hardly knew that Monsters like Buhari ever believe in Justice and equality b4 the law-

    • Jon Lawrence

When this your so called danger was exclusively reserved for ordinary street bank robbers, pinheads like you never see anything wrong with it. Now the ground has becoming level that law is a leveller, you supporters of corruption cannot be quiet. They are not supposed to get even a bail by the seriousness of their charge. They supposed to remanded in prison. That how its done in the United State and other places Allen Stanford did not get any bail until he was jailed for life, despite he is not a public servant.
Now that you had decided to throw God into the mix, as many corrupt Nigerians and their supporters usually do. Then let me remind you that Adam and Eve were immediately banished outside the garden of Eden into areas full of torns, to fend for themselves even before their final judgement. So stop profaning God’s name with your meaningless analogy.

Ask him if all these things are not eluding us since 1985 uptil now. we used to have land line, running watr, stable electricity etc, even enough food:—-Remember, when the Ghanians came to us for survuval and when ae are now running to them for education and meaningful living? Ask IZON please and also others, who can not differenciste the difference between having law and repairing law. We don´t have a functioning law, cause of these people. You only remembered rule of law when your co-criminals are remanded in prison. But when you guys are stealing our yams you didn’t remember rule of law. Efulefu. Devil’s advocate.

  • Fadama

GEJ allowed so many mind blowing levels of corruption and stealing to go unchecked. Was he not aware or simply bothered not to act? Those close to him should ask him these questions and report back to us. I am eager to know.

  • Tafidan Dogon Daji

This case is more or less, political. No matter the decoration,i disagree to look at the face of the case that it’s Armsgate or Dasukigate.
The money in question was meant for the PDP 2015 reelections and nothing more, but the arena was coloured for political reasons and to also destroy the names of the Dasukis.
The case is bailable in nature on which i plead with our courts severally and individually to grant all the accused bail for smooth and accelerated hearing.

    • Jon Lawrence

Here come another supporter of corruption, trying hard to explain how stealing is still not a bad thing. Tomorrow you will be first to complain about lack of this or lack of that.

Where are we n the ECONOMY? Enough of the diversionary tactics. PT beware!!!!!!!!!!

As long as we have an academically challenged man claiming to be the leader of 190m Nigerians many absurdities as we see today will continue unabated. With Nigeria now an Islamic republic where there lies any hope? Indeed the dangers in allowing the academic inferiors to get close to power are legion. I hope Nigerians have learned.

    • Jon Lawrence

Finding rogues right inside the economy and dealing with them is the first part and the most important part of any serious economy. It is like a farmer finding those beetles inside the yam barn to destroy them first before anything else, if not all his labour shall be in vain.
He may be academically challenged in your myopic sense of reasoning but I can live with that. I rather had an academically challenged good person to look after my money than the man with a basket load of degrees but with a sticky scissors fingers.

  • tundemash

This is OLODOnomics in action. Governance by jailing people.

    • Jon Lawrence

Thieves in Nigeria are finding it weird that a government in Nigeria has appetite towards helping the law put criminals where they rightly belong. Welcome to the new dawn/reality.

  • Jon Lawrence

Have you ever heard on any Nigerian accused or charged for a crime, no matter how weighty of the charge that plead guilty and plead for leniency or forgiveness? Never!
Even if they are accused of stealing a piece of meat that was still dangling from their mouth, they will always claim of having done nothing wrong.

    • udemeobong

You are right. It shows the extend of wickedness in our society. I have always said and eill continue to say again, that what we are experincing has nothing to do with corruption, but wickedness and satanism that knew no bound. In other countries world wide, we hear of corruption, but not in the magnitude of that of Nigeria.

Premium Times stop deceiving people here. We dont see the ACM the way you see him. There are definitely other reasons why he is being procecuted

  • Excisionist

This is a very sad day for Nigeria. Air Chief Marshal Alex Bade is a victim of Buhari’s vindictive policy ! Bade is being punished not because of any crime he committed but because during his tenure, the army said that it was not in possession of Buhari’s or any other officer’s School Certificate. An “anti-corruption” president punishing someone for not being corrupt. Secondly, Bade is being punished because he is a Christian and because he seriously fought against an Islamic insurgency Boko Haram.

Abdulrahman Danbazua who supplied arms to BH was rewarded by the “ant-corruption” president with the post of Internal Minister. Meanwhile Abdulrahman Danbazua is arming Fulani herdsmen and using helicopter to cover them. This man is restraining the police and army from taking action agains the herdsmen and other Islamic terrorists. Meanwhile the National Assembly is watching and doing nothing.

Buhari described CAN as bigot because it is opposed to Nigeria joining Islamic countries as an Islamic country. It is a message to northern Christians that if you don’t remain in servitude we will deal with you. Can anyone see the hypocrisy of the so called “Northern Elders Forum” when they use “Northerners” as rallying call?

I call for civil action against Buhari and Danbazua in order to make their administration ungovernable. Nigerians should rise up against Buhari’s vindictive policies. Civil servants and security officials should realize that they swore to defend Nigeria and not Buhari or his evil lieutenant Abdurahman Danbazua. Rise against Buhari, rise against Islamization, rise against Fulani herdsmen. Rise against evil. Those planning for anti-corrupion march on March 31 should not march with Buhari but AGAINSt Buhari, because he is corruption personified.

When officers and soldiers of the courage of Major Okar and Co strike, Nigerians should rally up on their side and use everything they have to support them and to defeat and banish the insensitive, wicked tyrants from the desert.

To Air Chief Marshal Bade, I say, be patient brother. People treated like you eventually emerge stronger. You may be Nigeria’s president in your live time. Be patient brother.
