The former National Security Adviser, Sambo Dasuki, who is accused of misusing billions of naira meant for the fight against Boko Haram militants, opened up Friday at Abuja High Court, blaming President Muhammadu Buhari for his arrest and detention without trial since December 29, 2015.

Mr. Dasuki, who spoke through his counsel, Joseph Daudu, said President Buhari instigated his detention unjustly against the bail granted him by three different courts, through his comment during a presidential media chat in December 2015.

In an affidavit filed in support of his application at the court, Mr. Dasuki said the president betrayed his emotions during the media chat when he openly told Nigerians that he (Dasuki) and Nnamdi Kanu, the pro-Biafra leader, could not be released on bail because they would jump bail.

Mr. Dasuki said he had been held incommunicado since his re-arrest.

He therefore asked Justice Peter Affen to prohibit his further trial until the federal government purged itself of the contempt of court which prevented him from filing effective defence because of his continued detention by the State Security Service, SSS, without having access to his lawyers.

Mr. Dasuki exhibited several newspaper cuttings in support of his motion to stop his trial, saying the newspaper publications contained Mr. Buhari comments that he should not be allowed to go home even if granted bail by any court.

Mr. Daudu, who led a retinue of lawyers on behalf of his client, urged Justice Affen to enforce his order which granted bail to Mr. Dasuki adding that justice is for all parties in any court action.

Mr. Daudu also stated that the claim that the former NSA was being held by the SSS and not the Economic and Financial Crimes Commission (EFCC) could not hold water because the federal government was the complainant in the charge against Mr. Dasuki and that both the SSS and EFCC are agents of the Federal Government.

In opposing the application, the counsel to the Federal Government. Rotimi Jacob told Justice Affen that the charge against Mr. Dasuki was at the instance of the EFCC and not the SSS.

He denied that the federal government disobeyed the court on the ground that on December 29, 2015 when the bail conditions were perfected, Mr. Dasuki was released by the prison authority at Kuje but was however rearrested by another government agency.

Mr. Jacob asked the court not to grant Mr. Dasuki’s application because the SSS that rearrested him was not a party to the charges before Justice Affen who granted him the bail.

On the newspaper publications, Mr. Jacob said they were not tenable before the court because they were not certified as required by law.

After listening to the parties, Justice Affen fixed March 4, 2016 to give a ruling on the application.

I actually recalled Jonathan using him (being a prince from Sokoto) as an alibi and a proof that his administration could NOT have had a hand in the attempted assassination of Buhari in 2014…so it is going to be a loooong night for this Dasuki!

    If it was in the developed world that Buhari made that comment, Dasuki case would have been damaged beyond repair. But in Nigeria anything goes. And I am beginning to notice that Nigerians are overlooking so many of Buhari infractions. He holds courts in contempt, interferes with foreign exchange, harasses opposition with security, bungles the budget etc, yet he is not being held to account. Instead we are scrambling looking for who to blame!

    Did in fact allow case like Dasuki to be bailable.
    The idea that people charged or accused of crime that are non capital offence should remain in jail, based on president indirect order is foreign to democratic system of government. Dasuki could spend the rest of his life in jail if the allegation against him are proven in court.
    He should be allowed to get bail with restrictions.
    Dasuki is innocent until proven guilty. That’s the starting point.

But it can’t go to trial when he doesn’t have access to his lawyer and they have refused to release him on bail when the court has ordered it. So, how is thr president leading by example here?

      Even if what you are saying is true and not some contorted form of the facts, such payments and automobile allocation to Buhari were legitimate expenses the FGN owes to all former rulers.
      Dasuki’s use of federal funds for personal and PDP party related expenses was not legitimate or legal.

    For too long criminals and looters have evaded justice by exploiting our very weak and corrupt judiciary. Thank God EFCC have learnt their lesson and now split up the charges and charge each offender multiple times. At least if Judge A is corrupt, judge B might not be. in 2009 James ibori was discharged and acquitted of all 170 charges brought against him at federal hight court Asaba, three years later the same man would take a plea deal in the UK, pleading guilty to 10 out of only 25 charges brought against him. Word is that he even tried to bribe the investigating officer but he couldn’t influence the judge of course. That was when i lost faith in our Judiciary. So i support multiple trials 100%
