EFCC slams charges on Nigerian senior lawyer, Ricky Tarfa, ‘for obstruction of justice’

The Economic and Financial Crimes Commission is set to arraign a Senior Advocate of Nigeria, SAN, Ricky Tarfa, on a two- count charge bordering on obstruction of justice and attempting to pervert the course of justice.

Mr. Tarfa was arrested on Friday, February 5, by operatives of the EFCC in Lagos, where he allegedly hid two suspects – Nazaire Sorou Gnanhoue and Modeste Finagnon, both Beninoise – in his Mercedes Benz Sports Utility car, thereby shielding them from being arrested and willfully obstructing the course of justice.

The suspects were alleged to have fraudulently converted some sophisticated manufacturing equipment belonging to Rana Prestige Nigeria Limited for their own use.

Besides, they are being investigated for alleged tax evasion running into millions of naira.

An operative of the Commission who was officially detailed to effect their arrest was reportedly prevented from carrying out his duty by Mr. Tarfa.

The senior lawyer would also be arraigned for illegally and unethically communicating with a judge (name withheld) in a suit involving the EFCC and two companies.

    Less than 24 hours after he was granted administrative bail from his unlawful arrest and incarceration from the Economic and Financial Crimes Commission (EFCC) office, Lagos lawyer, Rickey Tarfa(SAN) yesterday approached Federal High Court, Lagos accompanied by 32 Senior Advocates of Nigeria, led by the former President, Nigerian Bar Association(NBA), Chief Wole Olanipekun asking the court to compel the anti-graft agency and his Acting Chairman, Ibrahim Mustapha Magu to pay him N2.5billion’

    Apart from the monetary compensation, Tarfa also asked the court to compel the defendants which included Moses Awolusi, the operatives that illegally arrested him and the Deputy Director Operations, EFCC, Lagos office, Iliyasu Kwarbai, to release his two mobile handsets deceitfully collected from him on Friday, February, 5 2016 at their Ikoyi office in Lagos to the court for the purpose of destructing all information, data and other retrievable materials stored in the two handsets.

    He also sought an order urged the court to direct the defendants to release his Mercedes Benz SUV with registration No. KJA 700CG unlawfully seized from him.

    The Senior Advocate also asked the court to order EFCC, Magu and two other defendants to publicly apologize to him in at least two widely circulated national newspapers, social media and the Nigerian Television Authority (NTA) as well as Channels Television within 24 hours from the day of the judgment of the suit. Besides, he asked for an order of perpetual injunction restraining all the defendants and their agents from further violating his rights apart from the payment of N20million for the cost of this suit.

    The 52 paragraph affidavits in support of the suit was sworn to by the Head of Rickey Tarfa Chambers, Mr. John Olusegun Odubela who narrated the genesis of Tarfa’s ordeal as a witness to the gestapo tactics employed by the anti-graft agency. Whether family affair or not as is claimed by him, there must have been a petition which the EFCC is acting on. If they don’t have anything to hide they shouldn’t be afraid of facing the Law. Truth of the matter is that many of these lawyers – senior ones at that – are merely conduit pipes for money laundering offences. It’s no longer business as usual. Period!

    As you can see, body language is surely not
    the antidote to corruption. Nobody in the outside world has said corruption has
    decreased in Nigeria since 29th May 2015 as a result of Buhari’s body language.
    Far from it. Corruption has increased several-fold instead.

    Within two months of Buhari’s resumption of duty,
    the civil servants he relied on with fulsome praise made for the treasury
    and looted it. Other civil servants secretly inserted as much 3 Trillion Naira
    into Buhari’s budget to make future theft large enough to buy houses overseas.

    So much for body language. When a lawyer styled as Senior Advocate of Nigeria
    is charged to court here to be hiding criminal suspects in his car boot, there’s need
    for something more sensible than mere body language.

      EFCC? Is that the law of contract? Or is that the law of tort or what? Nobody
      reading this report overseas will think much of the justice system in Nigeria.
      It is bereft of honour and character on the part of the lawyers and Judges
      alike. That can’t be a justice system, to be frank, it’s no more than a coalition of
      criminals in wig and gown. This lawyer should be disbarred, convicted and given
      maximum jail sentence, as deterrence to many others like him.

    one in doubt where the people stand against the Buhari regime’s messes.
    Since October 1st 1960 Nigerians have not witnessed worse continuous
    darkness, without electricity, than under the daft Raji Babatunde Fashola –

    Nigerians wrongly believe that it’s a president of a country who decides the national ethics; no it is not, it is people.

    The Nigerian Bar Association, NBA and senior lawyers in the country, have condemned the recent arrest and continued detention of a Senior Advocate of Nigeria, Mr. Rickey-Tarfa, SAN, by the Economic and Financial Crimes Commission EFCC, since Friday without releasing him on bail. Former President of the NBA, Oluwarotimi Akeredolu , SAN, commenting on the issue said; “I think that this is an unfortunate development, a situation where lawyers are arrested in court while performing their lawful duties, this must be condemned in unequivocal terms. However, this is the work of an agency, no government can allow this, especially when you have a senior lawyer, a Senior Advocate of Nigeria as the Vice-President, the government will do its best to avoid such things. It is the work of overzealous agents, we will call on the Vice-President to intervene and ensure his release. “Since the NBA President has intervened, they should release him to NBA President for him to appear on Monday to answer to whatever charges they have against him. He is a Senior Advocate of Nigeria, he cannot jump bail, This is utter disregard for the rule of law and the sanctity of the legal profession guaranteed by the Constitution.” Another former President of the NBA, Mr. Joseph Bodunrin Daudu, SAN, said: “ Well, you see, this is what we face with the current EFCC. Let’s get the facts straight, all of us who are defending accused persons are now endangered species, all of us are being investigated by the EFCC, so we are all waiting for the day they will come and carry us.” Reacting, the law firm, Rickey Tarfa &Co. in a statement signed by its Partner and Head of Chambers, Mr. John Olusegun Odubela, said: “It is germane to state that the matter before the court has no bearing with corruption related issue. It is purely between a husband and wife struggling for the control of a manufacturing company they jointly promoted.It is purely a matrimonial issue that went sour.”

    EFCC Probes Ngozi Okonjo-Iweala for corruption

    The Economic and Financial Crimes Commission (EFCC) Monday disclosed that it was investigating former Finance Minister, Dr. Ngozi Okonjo-Iweala, and her Petroleum Resources counterpart, Mrs. Diezani Alison-Madueke. The Chairman of EFCC, Mr. Ibrahim Magu, told the House of Representatives Committee on EFCC, headed by Hon. Oladele Kayode, that a close associate of Alison-Madueke and Mr. Kola Aluko, was also under the commission’s radar.

Many of these SAN and very senior lawyers are simply a DISGRACE to the professional. The only thing they can boast of is ‘TOO MUCH MONEY’, they lack integrity and character because their Honour is always for Sale. It will be good to send as many as possible of these people to JAIL and also revoke their SAN title as was done to that disgraceful Attorney General under Yaradua.

    The Nigerian Bar Association, NBA and senior lawyers in the country, have condemned the recent arrest and continued detention of a Senior Advocate of Nigeria, Mr. Rickey-Tarfa, SAN, by the Economic and Financial Crimes Commission EFCC, since Friday without releasing him on bail. Former President of the NBA, Oluwarotimi Akeredolu , SAN, commenting on the issue said; “I think that this is an unfortunate development, a situation where lawyers are arrested in court while performing their lawful duties, this must be condemned in unequivocal terms. However, this is the work of an agency, no government can allow this, especially when you have a senior lawyer, a Senior Advocate of Nigeria as the Vice-President, the government will do its best to avoid such things. It is the work of overzealous agents, we will call on the Vice-President to intervene and ensure his release. “Since the NBA President has intervened, they should release him to NBA President for him to appear on Monday to answer to whatever charges they have against him. He is a Senior Advocate of Nigeria, he cannot jump bail, This is utter disregard for the rule of law and the sanctity of the legal profession guaranteed by the Constitution.” Another former President of the NBA, Mr. Joseph Bodunrin Daudu, SAN, said: “ Well, you see, this is what we face with the current EFCC. Let’s get the facts straight, all of us who are defending accused persons are now endangered species, all of us are being investigated by the EFCC, so we are all waiting for the day they will come and carry us.” Reacting, the law firm, Rickey Tarfa &Co. in a statement signed by its Partner and Head of Chambers, Mr. John Olusegun Odubela, said: “It is germane to state that the matter before the court has no bearing with corruption related issue. It is purely between a husband and wife struggling for the control of a manufacturing company they jointly promoted.It is purely a matrimonial issue that went sour.”

      EFCC witness fails to give evidence that Metuh ate own statement

      **Document read in court showed Metuh’s transaction passed through due process.

      **No document linking $2m given to Ararume with Dasuki’s fund.

      EFCC witness Detective Junaid Saeed entered the witness box at 9:03. Witness averred that he is with special Taskforce team

      According to him;

      After oral interviews, Metuh was asked if he was willing to make statement and a sheet of paper was given to him with cautionary word. When he concluded writing the statement, which was in four sheets he handed it over to me and I read what he wrote and I gave it to other team members after I returned to him for endorsement.

      He endorsed the first and second sheet and when he was to endorse the third sheet…..He suddenly tore the sheet, the pieces recovered and registered with the commission. I immediately made entry of the incident into report sheet and EFCC duty record.

      Because of this I declined giving him the fourth sheet to endorse because I did not want him to tear it. He requested to volunteer another statement, which he did after I gave him a sheet with cautionary words and he volunteered another statement.

      Interview and investigation carried out confirmed that CNC were used to carry out media campaign activities of PDP on the instruction of the first defendant, ditto Abba Dabo.

      It was found out that Dasuki withdrew N10b and converted to 14.7m dollars and gave to the ADC of the former President and the special Adviser to the President to share to PDP top notches for PDP special convention. The 2m dollars given to Ararume by Metuh is strongly linked to the disbursement of N14.7 m shared out to PDP members.

    Who will root out lawyers like Ricky Tarfa? That’s the question, a very big question.

    Nigeria is an extremely dirty country. Being dirty is not a problem if there are cleaners to do a good job. The biggest problem with dirt is when even the best cleaners are also dirty too. It means no one can get the dirts away as even the cleaners will spread more dirts in the process of doing their cleaning job.

    Now, Governor Chimaroke Nnamani’s case has stayed in the courts for almost 9 years years now, without any conviction. Not even a trial yet. It has been from one adjournment to another and one retirement one judge and the transfer of the case to another judge. Ricky Tarfa is the lawyer behind the entire embarrassing case that should make every Nigerian ashamed of our criminal justice. All the companies through which Chimaroke stole from Enugu state have been shut down and retaken by the government. Yet, Chimaroke Nnamani’s case has not even gone to trial in more than 8 years of being charged with heinous economic crimes which are quite easy to prove.

    Orji Kalu’s case is the same; and the same applies to many others.

    How did we come to this sorry state in which even the most respected members of the most respected professions are so shamelessly demeaning themselves and so desperately criminal?

    Bello Adoke has heavy criminal questions about him; Mike Aondoakaa is same; an American team of investors (BFIG) have also produced evidence to show that Damien Dodo; former Attorney-General and Commissioner for Justice in Lagos State,
    Olasupo Shasore; chairman, National Lottery Regulatory Commission and
    Principal Counsel, DD Dodo & Co, Damian Dodo; as well as the
    managing partner, Obla & Co., Godwin Obla; Chief Bayo Ojo; Bello Adoke; were all lawyers who secretly flew into London on a private jet in order to hold meetings in the aircraft for the sole purpose of making sure that a judgment of the Supreme Court would not be obeyed by their clients after their client lost a very bad case at the Supreme Court – a case that would be won only in an animal farm. These are some of our best lawyers, but they are corrupt.

    During election petition cases, many of the lawyers are paid with bags of Ghana-Must-Go bags as if the country have no banks or that the law firms of these lawyers have no bank accounts. Why is Nigeria like this?

    And you start asking yourself, which National Judicial Council is CSNAC talking about? Is it the same National Judicial Council that raped justice on Justice Ayo Salami’s case? Is it the same one that has many of the corrupt senior lawyers and bribe-taking retired justices as members?
