Dasukigate: How Metuh’s company was paid for “security services” — Witness

A witness has told the Federal High Court in Abuja that the money paid by a former National Security Adviser, Sambo Dasuki, to a company owned by the spokesperson of the Peoples Democratic Party, PDP, Olisa Metuh, was for “security services”.

Mr. Metuh is accused of receiving N400 million from Mr. Dasuki, for which investigators say was part of $2.1 billion voted for the purchase of arms to fight Boko Haram, but diverted and shared to politicians and government loyalists.

The claim about “security services” payment to Mr. Metuh’s Dextra Investment Limited, was made by Bali Ndam, a legal adviser in the office of the NSA, responsible for drafting memos, vetting contracts, among others.

Mr. Ndam appeared as the third prosecution witness. The details of the security services were not clear.

Mr. Ndam said the NSA’s office, had in January, transmitted a letter to the Economic and Financial Crimes Commission, EFCC, giving names of companies it awarded contracts to.

He said the letter included 78 companies and individuals, amongst them, Dextra Investment Limited.

There were however arguments over the communications between the EFCC and the NSA’s office.

Mr. Ndam told the court that the EFCC requested for the payment mandate to the companies, in a letter dated January 13, 2016, signed by Ibrahim M. Musa.

He said a list of e-payment mandate was sent to the EFCC on January 14, and the letter was signed by M. Abdulrahim, a Group Captain.

Mr. Ndam said another letter was written to the EFCC, and was signed by Lieutenant Colonel AA Ibrahim, the special adviser to the NSA.

But responding, Mr. Metuh’s counsel, Onyeachi Ikpeazu, told the court that the witness could not present as evidence, a document authored by another person.

Mr. Ikpeazu also said documents attached to the letter dated January 14, 2016, which were computer-generated, did not meet the provisions of section 84 of the Evidence Act.

He told the court that according to sections 84, sub sections (2) and sub section (4), ‘a’, ‘b’ and ‘c,’ any such document must be certified as true copy.

Mr. Ikpeazu also noted that the title of the document was different from what Mr. Ndam claimed.

He said the name of the document in his possession was “Payment companies with no contract”, while that mentioned by Mr. Ndam was “Payment of contracts without award”

He therefore prayed the court to reject the document.

But in his response, Sylvanus Tahir, prayed the court to discountenance the request made by Mr. Ikpeazu

He said the documents tendered were all public documents, which are all relevant to their arguments.

He added that the duplicate documents which needed certification had all been certified, while the original documents did not need certification.

The Judge, Okon Abang, overruled Mr. Ikpeazu’s objection.
He said the documents before the court were correspondents whose nature did not require certification.

He also said the fact that the witness misread the name of the document, did not affect its content.

He ruled that the documents be tagged, exhibits ‘A’, ‘B’ and ‘C’.

The case will continue, Wednesday.

      Last week, when the ICPC dragged Senator Sani Yerima Bakura, the former two-term governor of Zamfara State before the Justice Shinkafi High Court at Gusau, the Zamfara capital to answer to a 19-count charges of stealing over one billion naira from the coffers of the state government when he was governor, the words of the late female activist swept back to me. For me and most Nigerians, it was a great shame that such a ‘devout man’ who officially introduced the Islamic jurisprudence into governance in 2000, should be associated with stealing of public funds. It was even a greater shame that he should be tried in a “Boko” court, instead of the Sharia court which he had elevated to a superlative pedestal.

      For those who have forgotten, in 2000, the Sani Yerima Sharia administration in Zamfara State, had dragged Mallam Buba Jangebe, convicted for stealing one cow by a Sharia court to have his arm amputated under the observation of the State commissioner for religious affairs. In spite of the clamour by human rights activitists in Nigeria and abroad, Governor Yerima would not yield, and had argued at the time that Jangebe was happy about his punishment because, as a true Muslim, he saw his crude punishment as a way of true atonement before his Creator.

      Even though the second amputation did not attract as much attention as the first, it is a fact that in May of 2001, another Sharia Court in Zamfara State, found another thief, a 30-year old Mallam Lawali Isa guilty of breaking into a shop and stealing nine bicycles. In an interview, sometime long after the amputation incident, Mallam Isa said that he had considered the Sharia matter as a joke until on May 3, 2001 when his hand was amputated at the General Hospital, Gummi under the watchful eyes of Yerima’s Commissioner for Religious Affairs, Alhaji Ibrahim Wakala. The amputation was effected by a trained medical doctor, Dr. Bello Buzu Kaura Namoda.

      In the most improbable case that Senator Yerima is found guilty of the charges, he will earn only a five year jail term in a prison, where, as in case with all big men in prison, he would be living large as if he were in a palace. It should not also be forgotten that in 2006, Yerima was also charged for fraud by EFCC but because of his subsisting immunity then, being a governor, he was not dragged to court. But even after he finished his term, EFCC conveniently chose to forget him, and he, instead, proceeded to the Senate where he is among those making laws for the ordinary Nigerians, as for people like him, laws are of no consequence.

      Rather than answer or rue for his alleged indecent acts in government, Yerima would stun the country when he imported a 13-year old minor as a ‘wife’ from Egypt. He rode roughshod over all the ‘noise’ made over his adult delinquency, as for him, his act was in tandem with Islamic norms, as in any case, the founder of the religion, the Holy Prophet Muhammad had taken his wife at the age of nine! Senator Yerima, however, refused to accept that there are at least daughter for marriage at that age.

      Most Nigerians support this on-going anti-graft war to the hilt. However, most of these people, including this writer, insist that the efforts will dissolve and crumble if it is not waged on all fronts, and beyond the pure legal thing which it is now. Rather, it will make better sense and become more effective when it is fought at both the moral, social, cultural, religious and other levels, because it is only then would Nigerians possess it and make it their own fight. Why does the ICPC not appreciate that their prosecution of Sani Yerima would have better legal and psychological impact if they had dragged the former governor to a Sharia court instead of the regular court from where he will definitely escape scot-free?

      In an interview, Mallam Isa who now ‘manages life’ as a beggar had reasoned that, “those who cut my hand for stealing bicycles, should be beheaded if they are found to have stolen public funds. If they said that I used my hand to steal the bicycles, then those of them who used their heads to concoct how to steal public funds should be beheaded. Simple.”

      Not many can fault the bicycle thief’s logic. It resounded sonorously with the sentiments of Hajia Gambo when I interacted with her in 1989.

      Today, Buba Jangebe might have accepted his fate like a common man for whom religion will always be the opium, even as he is lucky to have obtained employment as a messenger at a local hospital at his Talata Mafara Local government home base. So, have other ordinary Nigerians who have remained at the receiving end of a system that – head or tail – is skewed in their disfavour. Sani Yerima’s show trial at the High Court is one of the things wrong or missing in the current anti-corruption investigations and trials.

      President Buhari has raised the hopes of majority of Nigerians that those who have brought the country to its knees through corruption will be ferreted out and punished. Part of that punishment should be psychological and emotional; a lot will be achieved by shaming the miscreants, as would have been the case if Yerima had been dragged to a sharia court and it would make the day for Nigerians to see his arms amputated.

    As the editor of the Lagos-based Newbreed magazine, I had travelled on an assignment to Zaria, specifically to visit the Wusasa family abode of the Gowons, where I interviewed the old mother of the former head of state (then on exile) and his elder brother. During my sojourn in Zaria, somebody reminded me of the fiery Hajia Gambo Sawaba, and I had hastened to her abode, where I got an award-winning interview with her. I remember particularly how she had railed against the male politicians – military and civilians – who she described as hypocrites.

    I recall her grouse over how Islam was being manipulated against the poor and downtrodden. She drew my attention to the fact that it was getting fashionable for politicians to use the Sharia judicial system to oppress the poor. That was the first time that I knew for real that thieves had their hands chopped off when convicted by the Sharia court for stealing. The pre-independence activist roared, “they are the people who rob the nation, states and the local governments dry; they are the people that sleep with people’s wives, yet nobody drags them to the Sharia courts to get their hands chopped off”. Hajia Gambo Sawaba insisted that those big rogues do not only deserve to have their hands chopped off, she advocated that “their heads and penises should also be chopped off”.

    “To that extent, the presidency stands rightly accused of bad faith in addition to the grave charge of dereliction of duty,” the APC chieftain posited.

    Few days after Buhari presented the 2016 Appropriation bill of N6.08 trillion to the joint session of the National Assembly, the APC had described the budgetary figures as “curious” and “padded”, adding that the budgetary proposal lacked any traits of change.

      It was to change dollars to naira investment without getting caught. There is a program on discovery channel “I almost get away with it”. It can be qualified as security service because nobody knew until Mr. Mugu became EFCC chairman. Mr. Metuh should have taken plead bargain. The way this case is going he may go to jail and loose the money including his house.

    If Olisa Metuh was paid for security services, what, then, is his crime? Did he hold a gun to Dasuki’s head before the money was transferred or what? Even though I condemn Metuh for chewing up his statement, I still don’t get why he is being tried. Nigerians should not be surprised if Metuh is eventually discharged and acquitted of these difficult-to-prove allegations of money laundering and abuse of public trust. The allegations simply don’t add up and cannot withstand any serious legal scrutiny.
