Metuh gets N300 million bail for “tearing own statement”

A Federal Capital Territory High Court has granted bail to the National Publicity Secretary of the Peoples Democratic Party, PDP, Olisa Metuh.

The court however said Mr. Metuh is to provide a bail bond of N300 million, with two sureties each, with like sum.

He added that the sureties should have assets within the FCT.

Mr. Metuh was brought before the court on a two-count charge of alleged destruction of his statement, at the office of the Economic and Financial Crimes Commission, EFCC.

The case is different from another seven-count charge of alleged fraud against him.

Mr. Metuh had earlier been given a N400 million bail for the first case.

For the new case involving his statement, Justice Ishaq Bello on Friday adjourned the bail application for Monday.

He added that information would be passed on whether he could hear both counsel for the application, Friday.

He ordered Mr. Metuh’s return to the Kuje Prison.

        You have shown your ignorance on a matter that you do not have sound knowledge of, please ask people that knows how bail conditions work in Nigeria and you’ll understand that no money is actually deposited rather the relevant people use their collateral (evaluation) to secure such bail.

        Who do you think will deposit money to EFCC for all bail granted by court, it is all documents, in some instance, people get bank guaranty document against those people’s collateral and such guaranty document is presented to court as the bail amount. Please grow up

      Do you know what it means for someone to seek compensation, Metuh can still approach court for redress if he is eventually acquitted. What is currently happening is obvious to everyone that Buhari is just controlling the judiciary and it only a matter of time, the whole thing will be obvious to all.

      Keeping Metuh in detention, has it solved any problem, what is happening is initial Gragra which will not stand strong scrutiny in court, you need strong evidence to prove a criminal case beyond reasonable doubt in court.

      I will repeat again, it will be near impossible for this case to be concluded in court against the accused without calling GEJ as witness, and that is when Buhari and his gullible fans will need to cite relevant laws of the country that was broken when the order to transfer such fund from NSA security vote to some of the accused people – that something is morally wrong does not always mean such thing is illegal.

      The use of security vote is like granting of import waivers which is at the discretion of the president, I expect Buhari to propose a new bill that will regulate disbursement of such fund and not this charade. Just this week Buhari gave some money to Golden Eaglet players that won cup in 1985, does it mean that in 2015 budget that is still been implement that we have a sub-head for giving donations to such players – my obvious is No, but president have done it and he must source for the money through any sub-head, it then means that in future next president will start arresting these Golden Eaglet players that have just received this donations but it was never appropriated in the current budget? food for thougth

    All of these are part of the evil plot to humiliate and keep Metuh in prison. It is very clear this is persecution and not prosecution. The judiciary has presented itself as tool. What comes around goes around. What if table turns how will this judge justify such a devilish discretion.

    The Nigerian Judiciary is being muzzled by the Executive and it is rather unfortunate that this pseudo form of oppression is allowed to fester in our democracy. If we believe in Democracy then the war against Impunity and Corruption must not infringe on our fundamental rights as Nigerians,and therein lies the quest for Civility!

      I think we are taking democracy to where it does not belong. Anyone is free to destroy his/her own property – including a statement you made to the police or any constituted authority (provided you have not handed that property over to the constituted authority or its representative). Once you have handed over the statement, (even if the statement is left on a table) it is no more your property; it is now government property. In the case of a statement, it is a “material witness” – (that is why you will be told that you could stay silent because anything you say will be used against you in a court of law) – it is criminal and you might be charged with, and convicted of impeding the investigation of a crime. There is virtually no country in the world where that is not a crime. Mr Metuh should know that. Being detained could be stressful and that could have made him to kinda “lose it”. Destroying a material witness (the statement) could buttress the prosecution’s claim that the guy has no intention of having his day in court and therefore is a flight risk.

        My dear Olisa Metuh did wrong when he tore his testimony, there’s no argument about that. But how many people are slammed a bail of N300M for destroying govt property? This case is a deliberate attempt to persecute a corrupt outspoken critic

          I understand your point even if you do not get mine. I was not addressing the appropriateness or otherwise of the bail amount. I was addressing the infatuation of the populace with democracy.
          Now about the bail amount, it is obvious that the government believes Metuh is a high flight risk, and would vehemently oppose his bail. Apparently, the judge believes in the “rule of law”, but was not convinced that Metuh will not “jet”. In deference to the rule of law, he set the bail high enough to give him an incentive not to “jet”. Usually in settings like this, the sureties would be arrested if the person they posted surety for disappears.

          The law is totaritarian on criminals and petty thieves. Let the court pronounce Metuh’s guilt or innosence. If he is guilty he served his term in prison. If free he how’s away and run to courts for damages.

        I know why that is the case. The EFCC is under the presidency. If EFCC had respected the court orders issued to her like in the days of Jonathan, then nobody will think that it is Buhari who is violating the orders. In the case that EFCC violates court orders and Buhari who has the overall power over the her (unlike the courts) did not call her to order, then it is right to argue that Buhari is culpable – his antecedents as a former military dictator won’t help him either.

          That is an academic exercise and has nothing to do with how governments aught to work.
          In a good system the President has limits just as the courts,, the police , EFCC, the universities work within their prescribed statutes. If it was the practice of former Presidents to interfere Buhari would not. They have been allowed to work within the laws that established them including the presidency. Each is accountable for his deeds or misdeeds within the law.

    Where is uniformity here? “According to the charge, Mr. Yerima diverted N1billion,…. He also allegedly diverted N684 million alongside other accomplices.” This is a total of 1.7 Billion Naira, yet –

    “Mr. Yerima was given a bail of N100 million, after he pleaded not guilty to a 19-count charge of fraud alleged…”.

    Whilst Metuh that took a ‘measly’ N400 million is given a bail of same amount of N400 MILLION! It LOOKS, sounds and smells like a political or possibly vendetta decision to me. If it is not, what yardsticks or guidelines directs these judges?

      Yerima stole state government funds while Metuh received money from arms procurement funds and was alledged to have used it for another purpose. Tearing own statement is another offence and the court set different bail conditions. Metuh is a lawyer he should know all these.

      You have a right outlook to the situation 600m is very unnecessary, the judge’s decision tells a lot of story, I am not pro PDP, I am pro good government and anti -corruption, but I think this is way too far fetched.
