How Jonathan, Okonjo-Iweala illegally diverted N61.4 billion Abacha loot to NSA, Sambo Dasuki

The immediate past Minister of Finance, Ngozi Okonjo-Iweala, illegally approved the transfer of at least N61.4 billion ($300 million and £5.5 million) from funds recovered from late dictator, Sani Abacha, to the Office of the National Security Adviser, Sambo Dasuki, few weeks to the 2015 presidential election, PREMIUM TIMES can authoritatively report today.

The former Minister signed off on the transfer but then closed her eyes to how the funds were spent, requesting then President Goodluck Jonathan to directly demand accountability from Mr. Dasuki, according to documents seen by this newspaper.

The funds were never appropriated before they were transferred, a clear violation of Nigeria’s fiscal responsibility law.

Mr. Dasuki, alongside the former governor of Sokoto State, Attahiru Bafarawa, and founder of DAAR communications, owners of Africa Independent Television and Raypower radio network, Raymond Dokpesi, are being investigated for their roles in the disbursement of $2.1 billion and N643 billion meant for the procurement of arms to fight the raging insurgency in Nigeria’s north east region.

The recovered Abacha loot are funds returned to the Nigerian government from monies stolen from the country’s treasury by Mr. Abacha.

The late dictator stole an estimated $5 billion from Nigeria and the money is being returned in tranches after agreements with countries such as Switzerland and the United States. It is believed that not less than $700 million has been repatriated from Switzerland alone. It is not clear how much has been recovered in total.

But a letter signed by Mrs Okonjo-Iweala, seen by PREMIUM TIMES, showed that 50 per cent of the recently recovered Abacha loot was allotted for “urgent security need” such as the procurement of arms and ammunition while the other half was set aside to be used for development purposes.

The letter, dated January 20, 2015, which was addressed to Mr Jonathan, revealed that the money was transferred following a January 12, 2015 request by the office of the NSA under Mr Dasuki for funds for the procurement of arms and ammunition as well as intelligence equipment.

“Please find a request by the National Security Adviser (NSA) for the transfer of $300 million and £5.5 million of the recovered Abacha funds to an ONSA [Office of the National Security Adviser] operations account,” the letter read.

“The NSA has explained that this is to enable the purchase of ammunition, security, and other intelligence equipment for the security agencies in order to enable them fully confront the ongoing Boko Haram threat.

“His request is sequel to the meeting you chaired with the committee on the use of recovered funds where the decision was made that recovered Abacha funds would be split 50-50 between urgent security needs to confront Boko Haram and development need (including a portion for the Future Generations window of the Sovereign Wealth Fund),” Mrs Okojo-Iweala wrote.

She added that the letter was to seek Mr Jonathan’s approval for the funds to be disbursed to the ONSA.

The former minister further explained that the money being transferred formed part of the Federal Government Independent Revenue.

However, instead of insisting on overseeing how the disbursed funds were spent as the country’s chief financial officer, she abdicated her responsibility, saying she expected Mr Dasuki to account directly to Mr Jonathan.

“This letter is to seek your approval to borrow these funds, for now, to disburse to the NSA. These funds form part of the projected Federal Government Independent Revenue, to be appropriated, in the light and for accountability, given the peculiar nature of security and intelligence transactions, we would expect the NSA to account to Your Excellency for the utilisation of the funds,” she concluded.

In a January 30, 2015 letter, Mr. Jonathan approved the transfer.

Governor Adams Oshiomhole vindicated

This latest disclosure appears to have vindicated Edo State Governor, Adams Oshiomhole, who last week called for the prosecution of Mrs. Okonjo-Iweala for transferring funds that were not appropriated.

The governor stated that neither the president nor the minister has power to unilaterally transfer funds that were not appropriated by the National Assembly.

He therefore argued that Mr. Jonathan and Mrs Okonjo-Iweala should be charged alongside Messrs Dasuki, Dokpesi and Bafawara for allegedly misappropriating funds meant for arms procurement.

“The issue is whether the Nigerian President under the constitution has the power to approve funds belonging to local, state and federal government- funds that have not been appropriated by the National Assembly. That is a criminal offense for which Okonjo-Iweala ought to face criminal prosecution. These things are just discussed and wished away. For me, I will stick for the truth and don’t care what people will say,” Mr. Oshiomhole said.

“Talking about revelation, look at the letter credited to Dasuki – the immediate past National Security Adviser. In his defence which I read in your paper, he seems to admit that money was spent but it was approved by the President. Does the Nigerian constitution empower the President to spend money which has not been appropriated by the National Assembly? And they took cash from the CBN. The Money Laundering Act says if you take cash in excess of N5 million transaction, it is money laundering and it is criminal.

“So, by Dasuki’s letter, he has also confirmed that Okonjo-Iweala is privy to spending money never appropriated and therefore criminal, and that cash were being moved contrary to the money laundering act. Just using Dasuki’s own defence, you can see a case of conspiracy has been established between Dasuki, Okonjo-Iweala and all those involved in that transaction,” Mr. Oshiomhole said.

But in a stern statement, where she described Mr Oshiomhole as reckless, Mrs Okonjo-Iweala asked the federal government to call the governor to order.

She stated that she had “absolutely nothing to do with” the $2.1 billion arms procurement money.

“It is unconscionable for the governor to embark on a campaign of lies against her because she thwarted his dubious loan request,” she said.

    Fashola during his first news conference tagged “Setting the Agenda for Delivering Change” said that Goodluck Jonathan has constructed more roads than any president ever in Nigeria.

    He also acknowledged that the Transformation in the power sector is above 50% and that he would try to build on it.

    Minister of State for Works, Adebayo Adeyeye, also said that Jonathan’s administration has recorded more success in the provision of motorable roads than any other administration in the history of Nigeria.

    Adeyeye, who spoke as a guest on Channels Television’s Sunrise Daily programme on Monday, insisted that the Jonathan administration has made considerable progress in the road sector, more than any of the governments that have administered the country.
    According to him, the administration in 2011 had about 4,500 kilometers of fairly motorable roads, just as he explained that today the administration has about 25,000 kilometres of very good roads.

    Babatunde Raji Fashola , Nigeria’s Minister for Power, Works and Housing on Tuesday while unveiling his plans praised the achievements of former President Goodluck Jonathan.

    Fashola during his first news conference tagged “Setting the Agenda for Delivering Change” said that Goodluck Jonathan has constructed more roads than any president ever in Nigeria.

    He also acknowledged that the Transformation in the power sector is above 50% and that he would try to build on it.

    Minister of State for Works, Adebayo Adeyeye, also said that Jonathan’s administration has recorded more success in the provision of motorable roads than any other administration in the history of Nigeria.

    Adeyeye, who spoke as a guest on Channels Television’s Sunrise Daily programme on Monday, insisted that the Jonathan administration has made considerable progress in the road sector, more than any of the governments that have administered the country.
    According to him, the administration in 2011 had about 4,500 kilometers of fairly motorable roads, just as he explained that today the administration has about 25,000 kilometres of very good roads.

    OKONJO-IWEALA DESCRIBES AS BASELESS ALLEGATIONS OF “ILLEGAL DIVERSION”

    OF ABACHA FUNDS

    SAYS THIS LEVEL OF PERSECUTION AND HARRASSMENT UNPRECEDENTED, SIGNALS DANGER OF FIGHTING CORRUPTION IN OFFICE

    As part of the campaign of falsehood against former Minister of Finance, Dr Ngozi Okonjo-Iweala by Edo Governor, Adams Oshiomhole and other powerful and corrupt interests, another baseless story has been published by some online media. To achieve their evil propaganda objective of tarnishing her name, these evil elements have distorted the contents of a memo dated January 20, 2015 in which the former Minister of Finance, Dr Ngozi Okonjo-Iweala responded to a request by the former National Security Adviser, Col Ibrahim Dasuki (retired) for funds to prosecute the terror war against Boko Haram.

    Here are the facts:

    · The central responsibility of the Minister of Finance IS to find sources of funding for the financing of approved national priorities such as security, job creation and infrastructure.

    · It will be recalled that throughout 2014, there were public complaints by the military hierarchy to President Goodluck Jonathan about the inadequacy of funds to fight the anti-terror war in the North East, resulting in Boko Haram making gains and even taking territories. A lot of the criticism was directed at the Federal Ministry of Finance under Dr Okonjo-Iweala which was accused of not doing enough to find funds for the operations.

    · In fact, the Ministry, on several occasions, had to call press conferences to provide details of budgetary spending on the military, to show, against the background of limited resources and other urgent national priorities, that it was doing its best on funding security.

    · It was about this time that some new Abacha funds of about $322m were returned with another $700m still expected to be returned. (This is not to be confused with the Abacha funds returned in 2005-2006 under the Obasanjo government whose use for developmental purposes was monitored by the World Bank as earlier explained by Dr Okonjo-Iweala).

    · Former President Jonathan set up a Committee comprising of the former Minister of Justice, former NSA and the former Minister of Finance to determine how best to use both the returned and expected funds for development.

    · The NSA made a case for using the returned funds for urgent security operations since, he noted, there cannot be any development without peace and security. Based on this, a decision was taken to deploy about $322m for the military operations, while the expected $700m would be applied for development programmes as originally conceived.

    · Following the discussions and based on the urgency of the NSA’s memo, Dr Okonjo-Iweala requested the President to approve the transfer of the requested amount to the NSA’s Office for the specified purposes.

    · But, as captured in the memo, she insisted on three conditions: a. only a part, not the entire Abacha funds would be spent on the arms; the rest would be invested in developmental projects as originally conceived b. the money was to be treated as borrowed funds which would be paid back as soon as possible c. the NSA’s office was to account for the spending to the President who was the Commander in Chief, given the fact that the Minister of Finance is not part of the security architecture and does not participate in the Security Council.

    · The attempt to link the former Minister’s name to any misuse of these funds for any purpose other than security as far as she understood it is totally false and cannot stand.

She could not have been a finance minister under Jonathan without being aware, and be complicit in the astounding financial recklessness and fraudulent misappropriation of public funds that were part and parcel of the Jonathan administration. Okonja Iweala should hire a lawyer immediately because she seriously has a case to answer. As a finance minister, she is responsible for managing and disbursing money that accrued to the federation during the GEJ administration. Besides, Okonja served under OBJ, and then GEJ so she could not lay claim to not being aware of what was going on within Nigerian government circles during the times she served as a minister. If at all she insists she did not take part in any corrupt deals while in government, then she as the chief finance officer must have been aware that such activities were taking place. Since she did not resign, and given the constitutional convention of ministerial responsibility, she ought to at least take some of the blame of the failures under her watch. What this means is that she is culpable too for either not raising alarm, and for continuing to serve in that government rather than resign. Since she took no proactive action to absolve her office as the finance minister of all the fraudulent activities and financial malfeasance of the GEJ administration, Iweala, like all the principal officers in that government, has a case to answer. This is common sense logic.

    I am so surprised the way some Nigerians especially the igbos are reacting to this story. This issue is not an ethnic stuff but Nigeria’s problem. All officials serving under any president are advisers who advise him/her about policy, legal, constitution and what the law says is right to do or not to do. okonjo-iweala held two posts as minister and coordinator of the economy. At the ministry of finance there is a legal department that can advice her on many issues and for a woman who has worked for WB, she should know better that she can’t seek approval from jonathan without checking what the law says, policy and procedures. She might not have taken or stolen a kobo but she was wrong in misadvicing the dumb president on this issue which makes her highly guilty. As for my igbo friends, they should be objective and stop being ultra conservative on all issues. If okonjo -iweala stole some of this money, kobo will not come to the pockets of these igbos defending her and it is them and their children and generation yet unborn that will suffer.

    OKONJO-IWEALA DESCRIBES AS BASELESS ALLEGATIONS OF “ILLEGAL DIVERSION”

    OF ABACHA FUNDS

    SAYS THIS LEVEL OF PERSECUTION AND HARRASSMENT UNPRECEDENTED, SIGNALS DANGER OF FIGHTING CORRUPTION IN OFFICE

    As part of the campaign of falsehood against former Minister of Finance, Dr Ngozi Okonjo-Iweala by Edo Governor, Adams Oshiomhole and other powerful and corrupt interests, another baseless story has been published by some online media. To achieve their evil propaganda objective of tarnishing her name, these evil elements have distorted the contents of a memo dated January 20, 2015 in which the former Minister of Finance, Dr Ngozi Okonjo-Iweala responded to a request by the former National Security Adviser, Col Ibrahim Dasuki (retired) for funds to prosecute the terror war against Boko Haram.

    Here are the facts:

    · The central responsibility of the Minister of Finance IS to find sources of funding for the financing of approved national priorities such as security, job creation and infrastructure.

    · It will be recalled that throughout 2014, there were public complaints by the military hierarchy to President Goodluck Jonathan about the inadequacy of funds to fight the anti-terror war in the North East, resulting in Boko Haram making gains and even taking territories. A lot of the criticism was directed at the Federal Ministry of Finance under Dr Okonjo-Iweala which was accused of not doing enough to find funds for the operations.

    · In fact, the Ministry, on several occasions, had to call press conferences to provide details of budgetary spending on the military, to show, against the background of limited resources and other urgent national priorities, that it was doing its best on funding security.

    · It was about this time that some new Abacha funds of about $322m were returned with another $700m still expected to be returned. (This is not to be confused with the Abacha funds returned in 2005-2006 under the Obasanjo government whose use for developmental purposes was monitored by the World Bank as earlier explained by Dr Okonjo-Iweala).

    · Former President Jonathan set up a Committee comprising of the former Minister of Justice, former NSA and the former Minister of Finance to determine how best to use both the returned and expected funds for development.

    · The NSA made a case for using the returned funds for urgent security operations since, he noted, there cannot be any development without peace and security. Based on this, a decision was taken to deploy about $322m for the military operations, while the expected $700m would be applied for development programmes as originally conceived.

    · Following the discussions and based on the urgency of the NSA’s memo, Dr Okonjo-Iweala requested the President to approve the transfer of the requested amount to the NSA’s Office for the specified purposes.

    · But, as captured in the memo, she insisted on three conditions: a. only a part, not the entire Abacha funds would be spent on the arms; the rest would be invested in developmental projects as originally conceived b. the money was to be treated as borrowed funds which would be paid back as soon as possible c. the NSA’s office was to account for the spending to the President who was the Commander in Chief, given the fact that the Minister of Finance is not part of the security architecture and does not participate in the Security Council.

    · The attempt to link the former Minister’s name to any misuse of these funds for any purpose other than security as far as she understood it is totally false and cannot stand.

    If somebody who wants to steal did not apply for bail before starting to steal,
    that person does not need bail after he has stolen. That is the best law
    a good Judge should apply. But here, no. It is bail for all thieves of Nigeria
    because Judge too is taking bribe.

    Unlike Nigerian peacekeepers in the 1990s, who were effective in curbing ethnic bloodshed in Sierra Leone and Liberia, those in Mali last year lacked the equipment and training needed to be of much use in the fight against al Qaeda-linked forces, sources involved in that mission say.

    Hall said the Nigerian peacekeepers had to buy pick-up trucks and their armor kept breaking down. They spent a lot of time on base or manning checkpoints.

    Military education is still taken very seriously, he said, but equipment and training to use it have been neglected, with radio equipment in particularly short supply.

    President Buhari represented by the Chief of Defence Staff (CDS) General Gabriel Olonisakin, dropped the bombshell at the annual chief of army staff (COAS) conference yesterday in Dutse, Jigawa state.
    He said new operational exigencies may require a modification of the December deadline of ending insurgency.

    Olonisakin said “Let me emphasize that the time frame given is only a guide line and if exigencies of multiple operations across the country advices a modification the federal government will not hesitate to do so in order to address the flash points that are rearing their heads in this country.”

    He said the army must therefore develop new strategies to address current security challenges facing the country and ensure total elimination of insurgents.
    “Despite the achievements of the military in combating terrorism in the Northeast, the challenges of terrorism in other parts of the country remains issue of serious national concern with the potential to impede our change drive,” he said.

    Boko Haram has intensified its attacks after the president declared the December ultimatum to end the insurgency, executing bomb attacks on civilian targets as well as the military’s.
    The military suffered serious attacks by Boko Haram recently with dozens personnel reportedly killed in their effort to rout the insurgents in Sambisa forest.

Are other Nigerians not brilliant enough to handle our fiscal / finance matters only people of Igbo extraction? Haba? Remember absolute power and absolute control corrupt absolutely. See how Nigeria was forced by this Worldbank/ IMF agent Okonjo Iweala to have swallowed a whooping $18 billion external loan and $42 billon domestic loan in just 4 years ! With this regrettable misadventure Okonjo Iweala has eternally mortgaged the Nigerian peoples lives with all the immediate and future expensive and painful consequences. More worrisome is looking at the portfolio of these loans mostly on service matters much less is credited to the real productive sector of the economy. I just pity PMB who will have to bear the burden of steering this already sinking ship and again it is during his tenure the symptoms of these macroenomic self imposed ailments will begin to manifest. On last note this Okonjo woman considering the way she is being widely and ignorantly touted as a quintessential economist, is not even one. She only read FINE ART as her first degree and later blended it with some questionable and debatable phd in some concussion called ” regional economics”. Any wonder why we are in this mess?. To digress a little, it was said that as economics guru she used her expertise to source the $18 billion debt ” forgiveness ” for which we parted with a whooping $12 billion! Which country would have ever agreed to pay this ( lump sum) in CASH “one go” ? Not even the USA! Do you know of this $12 billion Okonjo’s private firm took 1% consultancy charges? Do you know how much is 1% of $12 billion is? And again our debt burden now suddenly rose from $18billion to unprecedented $60 billion under the watchful eyes of Okonjo !!!!! Indeed, a total disaster she is. Besides, she granted unprecedented waivers worth billions of Naira to her people. She is just one of the “Economy Hit Men “of the World Bank .So what are your PDP’s achievements in those 16 years? May God Almighty bail PMB out, amen. Any wonder she unilaterily authorized the spending of $2 billion dollars from the ECA ? Finally, dollar now exchanges at $1 to N250 from N114 to $1 under Yaraduwa’s regime getting to well over 100% rise!!!
