Kaduna bans Nigeria’s foremost Shiite group, IMN


The Kaduna State Government has issued an order declaring the Shiite Islamic Movement in Nigeria, IMN, an unlawful society.

The government said the action was taken to preserve peace and security in the state, and to ensure that all persons and organisations are guided by lawful conduct and with due allegiance to the Nigerian state and its constitution.

“The Kaduna state executive council approved the making of this order following deliberations at its meeting of Thursday, 06 October 2016,” Samuel Aruwan, a spokesperson to Governor Nasir El-Rufai, said in a statement on Friday.

Friday’s announcement occurs several months after over 300 members of the Shiite group were killed by soldiers who accused them of blocking a road and plotting to kill the army chief. The IMN denied the charges and said it was mainly targeted in an extra-judicial killing.

To arrive at its decision, the Kaduna government said it relied on the findings of a panel it established to investigate the army’s attack on the Shiite group.

The group had refused to appear before the panel saying it would not do so unless its leader, Ibrahim El-Zakzaky, and other members detained by the government are released.

Mr. El-Zakzaky has been held by the government since the December clash and without any court order.

Kaduna declares Islamic Movement in Nigeria unlawful society

The Kaduna State Government has issued an Order declaring the Islamic Movement in Nigeria (IMN) an unlawful society. This action is taken in the exercise of the government’s duty to preserve peace and security in the state, and to ensure that all persons and organisations are guided by lawful conduct and with due allegiance to the Nigerian state and its Constitution. The Kaduna state executive council approved the making of this order following deliberations at its meeting of Thursday, 06 October 2016.

The Order, which has been signed by the Governor, draws on powers vested by the Constitution and the laws of Kaduna State. Section 45 (1) of the Constitution categorically vests in the Governor the powers to take such measures and actions as are necessary for the promotion and protection of:

  1. public safety, public order, public morality or public health; or
  2. the rights and freedom of all persons in Kaduna State.

Section 97A of the Penal Code (Cap 110, Laws of Kaduna State, 1991) empowers the Governor to declare as an unlawful society any organisation whose activities are dangerous to the security and good governance of the state.

The Judicial Commission of Inquiry into the Zaria Clashes of 12-14 December 2015 found that the IMN is not a registered organisation, that it has a paramilitary wing and that its members do not recognise or respect the laws of the country and the duly constituted authorities that have the responsibility to secure and administer the country.

The Declaration Order noted that since the regrettable events in Zaria which resulted in the loss of 347 lives, the IMN “has overtly continued with unlawful processions, obstruction of public highways, unauthorized occupation of public facilities including schools without regard to the rights of other citizens and the public peace and order of the State”.

The Order noted that “these acts, if allowed to go unchecked will constitute danger to the peace, tranquillity, harmonious coexistence and good governance of Kaduna State”.

The Declaration Order, which comes into effect on Friday, 7 October 2016, provides for the prosecution of persons that may be in breach of its provisions under the laws of Kaduna State:

“Whoever manages, or is a member of the said Society under any appellation or mutation with the propensity of causing the breakdown of law and order, or operates in a manner dangerous to the good governance of the State shall, from commencement of this order, be prosecuted in accordance with the Laws of Kaduna State.”

Sections 97A and 97B of the Penal Code prescribe a penalty of imprisonment for seven years or a fine or both for any person convicted for belonging to an unlawful society.

The Kaduna State Government reaffirms its vigorous commitment to upholding the right of citizens to practice the religion of their choice. These are rights fully protected by Sections 38 and 40 of the Constitution.

Such rights to freedom of thought and worship must however be exercised in ways that do not infringe on the rights of others, and should not subject other people to distress and inconvenience.

    There is no recorded act of violence by the group, even after their leader was kidnapped by the Nigerian govt. this ban is ABSOLUTELY illegal and I hope the group will resist this action be el rufai peacefully. Herdsmen kill and no major action taken by the northern governors, but peaceful groups like this they go after.

    We urge Buhari or Professor Paden his Biographer who he wrote about Jonathan’s campaign funds and alleged all manner of corruption concerning their source and application, in his next book on President Buhari I would suggest that he sheds more light on how his subjects own 2015 presidential campaign funds were sourced. For a start he should tell us who provided the 10 million USD that was paid as consultancy fees to the company of Mr. David Axelrod, President Barack Obama’s erstwhile campaign manager. He should also tell us the source of funds and how Buhari and his team managed the 19 billion naira that was given to him in cash by the then sitting Governor of the leading and largest state in the south west and the 24.6 billion naira that was given to him in cash and in one day (which was recorded on video before being handed over to Buhari) by another leading south western politician. In addition to that he should tell us precisely how much the then Governors of Rivers led by Amaechi and Kano states and the present Governors of Ogun and Kwara states amongst many others contributed to Buhari’s campaign and where they got the money from. Since everyone is claiming to be holy and righteous in this matter let us all get there and publicly exchange notes for the world to see who is the most corrupt president in Nigeria. After all the Nigerian public, and indeed the entire world, has a right to know. If Paden fails to ask those questions and declines to provide the answers then he, his accursed books and his questionable and dubious “white-washing” mission of President Muhammadu Buhari shall undoubtedly remain damned forever. Whether he does so or not other governments that will come to power in the future in this country will not only get the necessary answers but they will also do the appropriate thing and bring them to justice. It is only a matter of time. Buhari will soon face justice in the hands of the laws of the land!!!!!!

    The Nigerians constitution unequivocally guarantees freedom of religious worship to all citizens. El Rufai probably invoked the Sharia constitution of Sunni Nigerianstan to ban Shiites from worshipping in Kaduna state. Nigeria is sleep-walking into the abyss of a Sunni Islam draconian dictatorship., if this illegality and abuse of the rights of citizens is allowed to stand then there is no need for laws in this country.

    As it stands, the governor of any southern state can wake up one morning and ban Muslims from their state and when that happens no one should make noise because we reserve the rights to ban the herdsmen and their religion as well, they have killed a lot while the Shiites killed no one.

        The point is that El Rufai has opened a pandora’s box and history will have it that this issue started in the north. You cannot be flouting the constitution on a serial basis whilst expecting to reap from the benefits of the same constitution financially.

That was how the bloodshed was averted to the glory of Allah. I knew something was really wrong with my brothers. Kano gave Buhari the highest vote. It was massively rigged in his favour. That was why the INEC officer in charge of Kano was burnt alive with his family after the election to cover up the rigging. I wept for my people. Now what are we seeing? Baba has abandoned us. My brothers in the North are dying every day of hunger. Prices of things are so high, we can’t even eat three square meal a day. My Northern Elders are not worried.

  • There can be no smoke without fire. The Governor have done the right thing as far as am concern. In fact all these religious bigots group should be banned in Nigeria by FG. Any group That can face the government in gun battle in no more a religious group but a cult. The Muslims in the southwest that I know are peaceful and loving people. Even the northerners living here in Lagos that I have known since I was born here in Lagos and now 43 years of age, I have always known the Muslims to be peaceful and loving here in Lagos. Only in the north you hear all manner of demonic groups called Muslims. The federal government should follow the step of Kaduna state and put a stop to any radical cult group operating under the disguise of Islam. As a Christian, any christian group that will take the guns to face the state army is not a Christian group. Nigeria is a loving state and the people are beautiful and loving.
