Supreme Court upholds Nyesom Wike’s election as Rivers Governor

The Supreme Court has upheld the election of Nyesom Wike of the Peoples Democratic Party as governor of the oil-rich Rivers State.

The court gave the ruling validating the April 11 governorship election on Wednesday but did not provide reasons for its judgment.

It said detailed reasons for the verdict would be provided on February 12.

The Court of Appeal had on December 16  affirmed the judgment of the Rivers Governorship Election Tribunal.

The appeal court had  ruled that Mr. Wike was not validly elected.

The Rivers Tribunal had earlier on October 24 nullified Mr. Wike’s election.

The tribunal, which delivered its ruling in Abuja, also ordered that a fresh governorship election be conducted in the state.

After the tribunal’s ruling, the governor headed to the Court of Appeal, saying the judgment was untenable.

The petition challenging the election of Mr. Wike as Rivers State Governor was filed by Dakuku Peterside, the candidate of the All Progressives Congress in the election.

The Rivers governorship election, which was criticised by local and international observers, witnessed the largest amount of violence both in its build-up and after the election.

      Why do we always assume that judgment was bought when it is upturned on appeal? For God’s sakes, we must begin to wean ourselves of this scandalous line of thinking. The Judges at the court below saw the facts and arguments of counsel differently and applied the law as they know it. The Supreme Court has done its bit also by applying the law as they know it to the facts and arguments presented before them. That is why we have the appellate system. Inherent in the appellate system of courts is an admission or confirmation that lower courts could err thus can be corrected on appeal. That does not mean the Supreme Court does not err. Maybe the judge that sentenced Oscar Pitorius to a few years in jail that was upturned on appeal was also compromised by Oscar???

      But the judges are being accused of taking bribe instead! If I may guess a reason, it could be due to the disparity in the use of Card Readers. For instance, in Lagos State, where the card readers did not function effectively or were not generally used, the Election Petitions Tribunal and Appeal Court held that the non functional or effective use of the card readers were not enough to invalidate Ambode’s election since card readers are not known to the electoral laws of the land. On the other hand, the Election Petition and Appeal Court ruled in the case of Rivers State that the non use or non effective use of the card readers were enough to invalidate the election. So this has been the basis of the argument that similar situations were given different judgement on different states and I believe that was major reason the Supreme Court upheld Wike’s election because the card reader precedent has been set in one state already.

      The Supreme Court has the power under the constitution to give a bench decision and adjourn its reasons to another day. It is the only court in Nigeria that can do that and this is not the first time it has happened. Before the Justices sit on a matter, they usually read the briefs of the parties and a conference is held amongst them after adoption of the briefs by lawyers to determine the merits of the case. one of them is subsequently appointed by the presiding justice to write the lead judgment. However, in matters where time is of the essence particularly in election petitions where judgment must be delivered within a limited window, a bench decision may be read while reasons are given later. The Supreme Court was perfectly in order.

      No, they said they would give it later. It is not an uncommon practice both here and the US that we like to copy. I think the logic is – they hear arguments, deliberate and come up with a decision and then they need to write up the decision (i.e. explan it); if they want to explain their decision in depth but they think an answer is needed immediately, they announce their decision and then take the time to write up a full explanation of their reasons. That is my guess.

    I am utterly ashamed of the Nigerian Judiciary and her judges. I don’t have a problem with wike and frankly i think he is much more popular than dakuku and he would have won anyway had a re-run been ordered. I just need to see some consistency from our judges. Wike lost completely at the tribunal and again at the appeal court. when we take into account that these courts are presided by at least 3 judges each, that makes a total of 9 judges or so have reviewed this case and have had completely different interpretations of the electoral law. I think a compulsory course on the constitution and electoral law be recommended for all our judges.

If 8 years ago Amaechi lost at tribunal and appeal court and later won at the Supreme Court what is now wrong that Wike won at Supreme Court after losing at the tribunal and appeal court? Has the law been changed? Or do you want the goalpost shifted in the midst of the game? Or is it because you don’t like Wike’s face? The reason given by the tribunal and Appeal Court was it not on same card reader? Was it not the same card reader issue that Agbage went to the tribunal in Lagos? What was the ruling of that tribunal? Was it in consonance with ruling of the Rivers election tribunal?

    The kind of celebration going on now in Rivers is not because people like Wike that much. All this is because of the arrogance and foolishness of Amaechi.     More than 90 people were killed in that election. Bombs were used in it. INEC officials were captured on video rigging the elections. All of that did not matter to our SUPREME COURT. Another great pat on the back of mindless and violent riggers. It’s such a shame!

      True Nigerian, I don’t usually join such debate as this because most people in the forum have formed and concretised their views and opinions based on hatred, tribe, religion and political affiliations. It is either you agree with their opinions or you are tagged enemy, traitor, wailer and all the sort. But truth remains that even if 1million people died during the election, what matters most in the eyes of the law are facts laced with evidence and two, the prayer sought by the litigant. In this case, violence during the election was not the bone of contention. What was the issue is the card reader. The petitions tribunal ruled that the card reader was not used during the election or that it was not effectively used due to to malfunctioning. As a result of that the tribunal annulled Wike’s victory. Unfortunately for APC and Dakuku Peterside, the Lagos election petition tribunal on same card reader issue had ruled in the petition filled Jimmy Agbaje that the non functional or non effective use of the card reader during the election was not strong enough to invalidate Ambode’s victory. This is a precedent already set and the Supreme Court maintained that card reader was not a pre condition for the voting exercise since the card reader is not entirely known to the electoral law of the land. It is in its test level and as such cannot take over riding position in the electoral process in the country. The Supreme Court may also have relied its judgement on the precedent already set in the Lagos case since you cannot interprete same law differently on same issue.         The Supreme Court doesn’t follow the precedent set by tribunals. It’s the other way round. It would however be better to wait for their reasoning before commenting.

          I agree. But I suspect that what Sab was trying to say there is that the decision of the Lagos tribunal may have influenced the Supreme Court’s approach on this case. I don’t think that Sab was saying that the Supreme Court has followed the Lagos decision on the basis that the decision is a binding precedent on the Supreme Court.

          But I still feel that the Supreme Court needs to have a long hard look at itself. It has developed a mentality of approvals for mindless rigging. The SC’s decision on 2007 Presidential was and remains a stain on the reputation of the court. We later discovered from the US intelligence that some of them took bribes to uphold the worst election in Nigeria’s history.

          The Supreme court should be promoting a jurisprudence of social engineering. If they do so, it would be nearly impossible for the court to look away from electoral violence and malpractices in a country where those two vices have made the politics a drag on the country’s progress and also visited calamitous leadership on the country.

          As an example, Jonathan would never have had the opportunity to wreak the havoc he has wreaked on this country if the Supreme Court did not return Yaradua as the duly elected, despite the mindless rigging that brought him and Jonathan to power.

          The Supreme Court does not follow lower courts ruling or precedence. Like you observed, it is the other way round. But it has overriding decision when it feels satisfactorily and evidentially that the law has been turned on its head. The laws of the land cannot be interpreted differently on related cases. It will be a miscarriage of justice if this happens. Remember, two weeks ago, the Chief Justice of Nigeria, CJN, told appeal court judges and other lower court judges in their faces that they are erring in most of their pronouncements in cases. He told them that was reason many people no longer have faith in the judiciary. On the issues of the alleged 90 people killed during the elections in Rivers, no court gives you judgement on issues you did not pray for. Secondly, the onus to prove is on the petitioner and not the respondent. And even if you ask the judge to cancel the election on the basis of the alleged violence, you are bound by law to prove how the violence affected or hindered what you assume would have been the outcome of the election. Let me reiterate, some times we lose cases in court not because we don’t have good case but in the technicalities of the law, its filing, application and all that. I’m not a judge or lawyer but my experience in such related matters shows that when a case is wrongly filed, argued, that case is bound to suffer.

With Tompolo refusing to yield to EFCC and the Niger Delta/MEND gunners threatening to return to the battlefield, this is hardly the time to alienate a strategic State like Rivers and its helmsman Wike who has declared a stance against the so-called Biafra Republic. Amaechi has been groveling, threatening to bring down Rivers state, talking tough, laying unsubstantiated allegation against the government in power in Rivers, since the SC is the final court of arbiter in Nigeria, and amaechi being a ‘notice me’ kind of person, where is he burying his head now.
